Aberdeen City Planning Commission June 20, 2017 MINUTES ABERDEEN CITY PLANNING COMMISSION June 20 , 2017 The City Planning Commission was called to order by Chairman Mike Jung. Members present at roll call were Jung, Marske, Woodward, Cogley, and Lien. Rivett was absent. Also present were Brett Bill, Planning & Zoning Director, Eric Miller, City Planner, and Paula Nelson, Planning Commission Secretary. Woodward moved and Lien seconded to approve the minutes of May 16, 2017, all members voting aye, the motion carried. There being no old business Chairman Jung began with new business as follows: 1) A petition to rezone from (C-1) Neighborhood Commercial District to (C-1/R-4) Neighborhood Commercial/Special Density Residential District for property described as “Lot 6, Block 15, Sullivan & Easton Addition,” (a.k.a. 801 First St N) was submitted by Samantha Snyder and S & J Enterprises, LLC. Brett Bill stated that an appeal was granted by the Aberdeen Board of Zoning Adjustment at the regularly scheduled meeting on May 11, 2017 to permit the applicant to operate a dog wash business at this location. The applicant is requesting to rezone the property to include a residential overlay in order to live in the existing apartment in the same building. Following discussion Cogley moved and Marske seconded to approve, all members voting aye, the motion carried. 2) A petition to rezone from (R-2) Medium Density Residential District to (C-2) Highway Commercial District for property described as “Lot 1, Lamont Eleventh Addition in the S ½ NE ¼ of Section 20, T123N-R63W of the 5th P.M., Brown County, South Dakota,” (a.k.a. 1104 Melgaard Rd S) was submitted by Lamont Companies, Inc. Brett Bill stated that the petitioner is requesting this petition to rezone in order to permit the construction of a mini-warehouse facility. The applicant received a special exception and several building variances at the regularly scheduled meeting of the Aberdeen Board of Zoning Adjustment meeting on June 8, 2017. The property was platted and annexed by the City of Aberdeen last month. Following discussion Cogley moved and Lien seconded to approve, all members voting aye, the motion carried. 3) A preliminary and final plat described as “HAPI Fifth Central Subdivision to Aberdeen, in the W ½ of the NE ¼ of Section 30, T123N-R63W of the 5th P.M., Brown County, South Dakota,” (a.k.a. Directly south of HAPI Central Subdivision) was submitted by Homes Are Possible, Inc. Jeff Mitchell was present to represent the property. Brett Bill stated that the petitioners are requesting this preliminary and final plat in order to create 39 lots for the construction of single family residences. The proposed lots comply with current subdivision regulations. The following item on the agenda is a proposal for a TIF that will allow for the development of this final phase of HAPI Central Subdivision. Following discussion Marske moved and Woodward seconded to approve, all members voting aye, the motion carried. {00028458.DOC / 1} 1 Aberdeen City Planning Commission June 20, 2017 4) A Tax Increment Finance District No. 27 Proposal described as “HAPI Fifth Central Subdivision to Aberdeen, in the W ½ NE ¼ of Section 30, T123N-R63W of the 5th P.M., Brown County, South Dakota,” (a.k.a. The southernmost end of HAPI Central Subdivision, including lots adjacent to Lawson St S, Merton St S and 24th Ave SE) was submitted by Homes Are Possible, Inc. Jeff Mitchell was present to represent the property. Brett Bill stated that the petitioners are requesting this Tax Increment Finance District (TIF) with the intention of expanding an existing subdivision which has been developed for single family home construction. The purpose of the TIF request is to fund the necessary installation of water, sewer, curb and gutter, asphalt streets, and sidewalks. These improvements will serve a residential development consisting of 39 lots for proposed construction of new single family homes. Each lot will have the required curb, gutter, street sidewalk, landscaping, as well as water, sewer and all other city utilities. This TIF project plan has been previously reviewed by the City Finance Officer and has been given his tentative approval. The TIF #27 Project Plan proposal appears to meet the requirements set forth by South Dakota Codified Law. Following discussion Lien moved and Marske seconded to approve, all members voting aye, the motion carried. 5) A preliminary and final plat described as “Brett Hanson Addition to the City of Aberdeen, South Dakota,” (a.k.a. 625 and 701 Eighth Ave SE) was submitted by Brett Hanson. Brett Bill stated that the petitioner is requesting this preliminary and final plat in order to combine multiple underlying lots into one legal parcel for the construction of an accessory structure in addition to an existing residence. Following discussion Cogley moved and Woodward seconded to approve, all members voting aye, the motion carried. 6) A preliminary and final plat described as “Roosevelt Estates Fifth Subdivision to Aberdeen, in the SE ¼ of Section 19, T123N-R63W of the 5th P.M. Brown County, South Dakota,” (a.k.a. 2309 17th Ave SE) was submitted by Forsyth Enterprises, LLC. Brett Bill stated that the petitioner is requesting this preliminary and final plat in order to subdivide one lot into two legal parcels for the construction of two town homes. The Aberdeen Board of Zoning Adjustment granted approval of two 0’ setback variances to accommodate this construction at their regularly scheduled meeting on May 11, 1017. Following discussion Cogley moved and Marske seconded to approve, all members voting aye, the motion carried. 7) A preliminary and final plat described as “Homes Are Possible 2017-3 Subdivision in Aberdeen, South Dakota,” (a.k.a. 1009 Lloyd St S) was submitted by Homes Are Possible, Inc. Jeff Mitchell was present to represent the property. Brett Bill stated that the petitioner is requesting this preliminary and final in order to create a lot for the construction of an in-fill house. Following discussion Cogley moved and Lien seconded to approve, all members voting aye, the motion carried. 8) A petition to Vacate Public ROW described as “The entire 60’ wide Lee Street Public ROW commencing at the North side of 27th Ave NE Public ROW and continuing North 155.66’ to point of termination,” (a.k.a. Lee Street ROW between {00028458.DOC / 1} 2 Aberdeen City Planning Commission June 20, 2017 1019 27th Ave NE and 2717 Harrison St N) was submitted by Stencil Group and the City of Aberdeen. Brett Bill stated that the petitioners are requesting this petition in order to vacate the entire Lee Street Public ROW in order to combine the ROW with adjacent parcels to accommodate the construction of an apartment complex. If this ROW is vacated, the applicant will have to successfully negotiate a land swap with the City of Aberdeen to provide sufficient access to a city owned holding pond. Following discussion Marske moved and Lien seconded to approve with the stipulation that an arrangement to provide the city with permanent access to the adjacent holding pond is confirmed before the vacation is recorded with the Register of Deeds Office. Upon roll call, all members voting aye, the motion carried. There being no further business before the Commission, Marske moved and Woodward seconded to adjourn the meeting, all members voting aye, the motion carried.
