Aberdeen City Planning Commission November 20, 2018 MINUTES ABERDEEN CITY PLANNING COMMISSION November 20 , 2018 The City Planning Commission was called to order by Chairman Dean Marske. Members present at roll call were Cogley, Schumacher, Mitchell, Woodward, Mettler, and Marske. Lien was absent. Also present were Brett Bill, Planning & Zoning Director, Eric Miller, City Planner, and Ken Hubbart, City Planner. Cogley moved and Mettler seconded to approve the minutes of October 16, 2018, all members voting aye, the motion carried. OPEN FORUM – No one was present. There being no old business Chairman Marske began with new business as follows: 1) A petition to vacate public right-of-way for property described as “The entire 99’ wide Lancelot Dr N Public R.O.W. commencing at the north side of Jones Ave NE Public R.O.W. and continuing north 346.5’ to the point of termination, adjacent to the east of Lot 3, Hedgers Outlots and to the West of Sacred Heart Roman Catholic Church Cemetery,” (a.k.a. 114 and 125 Lancelot Dr N) was submitted by Roman Catholic Church. Jeff Swank was present to represent the property. Eric Miller stated that the petitioner has submitted this petition to vacate a portion of Lancelot Drive North as the current right-of- way provides access only to their property and dead-ends there within. The petitioners have stated that vacating the right-of-way would aid in their future planning and expansion of the Sacred Heart Cemetery. Following discussion Woodward moved and Cogley seconded to approve with the following stipulations: 1) The petitioners must replat their adjacent properties to include the newly vacated right-of-way, 2) A utility easement shall be maintained for any utilities currently within the right-of-way, 3) An access easement must be established to allow city employees access to the levee, which runs along the eastern boundary of the petitioner’s property. Upon roll call, all members voting aye, the motion carried. 2) A preliminary and final plat described as “HHS Properties Fourth Subdivision to the City of Aberdeen in the W ½ of the NE ¼ of Section 30, T123N-R63W of the 5th P.M., Brown County, South Dakota,” (a.k.a. 1908, 1914, and 1920 Miller Ln) was submitted by Ellsbee Properties, LLC. Eric Miller stated that the petitioner is requesting this preliminary and final plat in order to adjust property lines to match the shared walls on the three town homes that are under construction. Proposed Lot 2 is less than the required 50’ in width for a lot located within the High Density Residential District; therefore, an application for a lot width variance for proposed Lot 2 has been submitted by the petitioner, and will be acted on by the Aberdeen Board of Zoning Adjustment at their December 13, 2018 meeting. At their August 11, 2016 meeting, the Aberdeen Board of Zoning Adjustment granted zero foot setback variances along the shared lot lines between proposed Lots 1 & 2 and proposed Lots 2 and 3. Following discussion Cogley moved and Schumacher seconded to approve with the stipulation that the Aberdeen Board of Zoning Adjustment {00041500.DOC / 1} 1 Aberdeen City Planning Commission November 20, 2018 grants a lot width variance for proposed Lot 2 and that each individual premise has its own water and sewer service. Upon roll call, all members voting aye, the motion carried. 3) A preliminary and final plat described as “Wagner Holdings Subdivision of Lot 1, Pheasant Run Second Subdivision in the SW ¼ of Section 11, T123N-R64W of the 5th P.M., Brown County, South Dakota,” (a.k.a. 1702 8th Ave NW) was submitted by Wagner Holdings, LLC. Ron Wagner was present to represent the property. Eric Miller stated that the petitioner is requesting this preliminary and final plat in order to create two separate parcels from one underlying lot to allow for conveyance of one of the parcels. Following discussion Mitchell moved and Mettler seconded to approve with the stipulation that the petitioner has sidewalks installed where missing along all adjacent rights-of-way within five years of the plat filing date. Upon roll call, all members voting aye, the motion carried. 4) A preliminary and final plat described as “Beadle First Consolidation Subdivision in Block 37, Second Addition, Aberdeen, South Dakota in the NW ¼ of Section 24, T123N-R64W of the 5th P.M., Brown County, South Dakota,” (a.k.a. 111 and 119 6th Ave SW) was submitted by Beadle Properties, LLC. Eric Miller stated that the petitioner is requesting this preliminary and final plat in order to consolidate multiple underlying lots into one legal parcel. At their September 7, 2017 meeting, the Aberdeen Board of Zoning Adjustment granted a Special Exception to the petitioners for the open storage, parking, or sale of vehicles with a stipulation that the property would need to be replatted into one lot. Following discussion Cogley moved and Woodward seconded to approve with the stipulation that the property would need to be replatted into one lot. Upon roll call, all members voting aye, the motion carried. 5) A preliminary and final plat described as “John J. Young Consolidation Subdivision in Block 37, Second Addition, Aberdeen, South Dakota in the NW ¼ of Section 24, T123N- R64W of the 5th P.M., Brown County, South Dakota,” (a.k.a. 107 and 109 6th Ave SW) was submitted by John J. Young. Don Young was present to represent the property. Eric Miller stated that the petitioner is requesting this preliminary and final plat in order to consolidate multiple underlying lots into one legal parcel to allow for possible future conveyance. Following discussion Cogley moved and Mitchell seconded to approve, all members voting aye, the motion carried. There being no further business before the Commission, Mitchell moved and Schumacher seconded to adjourn the meeting, all members voting aye, the motion carried. Adjournment FORMAT GUIDELINES: 1) Open forum provides an opportunity for the public to address the Aberdeen City Planning Commission with questions, concerns or comments on items, which are not on the agenda. Citizens are asked to sign up to speak prior to the open forum portion of the meeting. Open forum will be limited to 10 minutes (if no one is in attendance for the open forum, the regular meeting may begin) unless a majority of the Aberdeen City Planning Commission agrees to extend the time period. The open forum may not be used to make personal attacks, to air personality grievances, to make political endorsements, or for political campaign purposes. Open forum will not be used as a time for problem solving or reacting to the comments made, but, rather for hearing the citizen for informational purposes. The Aberdeen City Planning Commission may respond with request for city management to follow up and report back on any issue raised during the public address time. A presentation may not exceed two minutes in duration. 2) ADA Compliance: The City of Aberdeen fully subscribes to the provisions of the American ’s With Disabilities Act. If you desire to attend this public meeting and are need of special accommodations, please notify the City Planning & Zoning Office at least 8 hours prior to the meeting so appropriate auxiliary aids and services can be made available.
