Aberdeen City Planning Commission August 17, 2021 MINUTES ABERDEEN CITY PLANNING COMMISSION August 17, 2021 The City Planning Commission was called to order by Chairman Dean Marske. Members present at roll call were Marske, Schumacher, Mitchell, Lien, Woodward and Cogley. Also present were Brett Bill, Planning & Zoning Director, Ken Hubbart, City Planner, and Amanda Kamphuis, Aberdeen City Planning Commission Secretary. Schumacher moved, and Lien seconded, to approve the Aberdeen City Planning Commission Minutes of July 20, 2021, all members voting aye, the motion carried. OPEN FORUM – No one was present. There being no old business, Chairman Marske began with new business as follows: 1) A Preliminary and Final Plat described as “Hub City Roofing Addition to the City of Aberdeen, in the SW¼ of Section 13-T123N-R64W of the 5th P.M., Brown County, South Dakota” (a.k.a. 118 & 120 First Ave NE and 118 & 122 Railroad Ave NE) was submitted Hub City Roofing, Inc. Brett Bill stated the petitioner is requesting this Preliminary and Final Plat in order to combine multiple underlying lots along with previously vacated R.O.W. to allow for commercial development. A Petition to Rezone this property to the Central Business District was submitted in conjunction with this plat. Following discussion, Cogley moved, and Woodward seconded, to approve with the stipulation that sidewalks are installed, where missing along all platted rights of way, as required by Aberdeen City Code Sec. 46-127. Upon roll call, all members voting aye, the motion carried. 2) A Petition to Rezone from (C-3) Central Business District & (I-2) Unrestricted Industrial District to (C-3) Central Business District described as “Proposed Lot 1, Hub City Roofing Addition to the City of Aberdeen, in the SW¼ of Section 13-T123N-R64W of the 5th P.M., Brown County, South Dakota” (a.k.a. 118 & 120 First Ave NE and 118 & 120 Railroad Ave NE) was submitted by Hub City Roofing, Inc. Brett Bill stated the petitioner is requesting this Petition to Rezone in order to eliminate split zoning that was created by a replat of this property. Following discussion, Lien moved, and Cogley seconded, to approve this petition. Upon roll call, all members voting aye, the motion carried. 3) A Preliminary and Final Plat described as “Wylie Meadows Second Addition to Aberdeen, in the NW¼ of Section 11-T123N-R64W of the 5th P.M., Brown County, South Dakota” (a.k.a. South of Wylie Lake between Nineteenth Street N and Hwy 281) was submitted by Wylie Meadows, LLC. Brett Bill stated the petitioner is requesting this Preliminary and Final Plat in order to reconfigure lots within a previously platted residential subdivision. This reconfiguration will increase the number of residential lots from 45 to 53. Increasing the number of lots will not adversely affect TIF 31. Following discussion, Schumacher moved, and Cogley seconded to approve with the stipulation that easements are established/maintained for all existing public utilities. Upon roll call, all members voting aye, the motion carried. 4) A Preliminary and Final Plat described as “Dakota Estates Third Subdivision to Aberdeen, in the SW¼ of Section 6-T123N-R63W of the 5th P.M., Brown County, South Dakota” (a.k.a. South of 917 and 1019 Twenty-Seventh Ave NE) was submitted by Purple Cow Properties, LLC. Brett Bill stated the petitioner is requesting this Preliminary and Final Plat in order to combine multiple underlying lots with yet to be vacated Villa Drive to prepare for the future construction of two {00078429.DOC / 1} 1 Aberdeen City Planning Commission August 17, 2021 apartment building and two multi-unit garages. The petitioner has submitted an application to the Aberdeen Board of Zoning Adjustment requesting approval for a Group Project, a setback variance for the 72 unit building and maximum density variance to allow for 172 living units rather than the allowed 84. A Petition to Vacate Villa Drive was submitted in conjunction with this plat. Following discussion, Woodward moved, and Cogley seconded, to approve with the following stipulations: 1) The remainder of 27th Avenue NE and Harrison Street N must be built to City standards, including sidewalks and any other required utilities, and 2) That sidewalks are installed, where missing along all platted rights of way, as required by Aberdeen City Code Sec. 46-127. Upon roll call, all members voting aye, the motion carried. 5) Petition to Vacate Public Right-Of-Way described as “The 60’ wide Villa Drive public right-of- way beginning at the south side of 27th Ave NE, extending west approximately 369.2’ adjacent to Lots 8-15 and 22-33, Block 2, Dakota Estates Second Subdivision in the SW¼ of Section 6- T123N-R63W of the 5th P.M., Brown County, South Dakota” (a.k.a. Undeveloped Villa Drive south of the 1000 block of Twenty-Seventh Ave NE) was submitted by Purple Cow Properties, LLC. Brett Bill stated the petitioner is submitting this Petition to Vacate a portion of public right- of-way with the intention of combining the R.O.W. with the adjacent property to allow for future residential development. This section of Villa Drive is unimproved and does not contain any public utilities. Following discussion, Cogley moved, and Woodward seconded, to approve this petition. Upon roll call, all members voting aye, the motion carried. 6) A Preliminary and Final Plat described as “Citizens Building Addition to the City of Aberdeen, in the SW¼ of Section 13-T123N-R64W of the 5th P.M., Brown County, South Dakota” (a.k.a. 202 Main Street S) was submitted by Friends & Citizens, LLC. Jason Erickson was present to present this property. Brett Bill stated the petitioner is requesting this Preliminary and Final Plat in order to combine multiple underlying lots into one parcel to allow for the future renovation of the building. The petitioners intend to apply for Tax Increment Financing to help finance this project. Following discussion, Lien moved, and Cogley seconded, to approve this plat. Upon roll call, all members voting aye, the motion carried. 7) A Preliminary and Final Plat described as “Avera St. Luke’s Addition to the City of Aberdeen in the SE¼ of Section 12-T123N-R64W of the 5th P.M., Brown County, South Dakota” (a.k.a. 1002 Jay Street N) was submitted by Avera St. Luke’s Hospital. Brett Bill stated the petitioner is requesting this Preliminary and Final Plat to facilitate the construction of an addition to an existing facility. This plat also notes the new utility and access easements created for the completion of this project. Following discussion, Schumacher moved, and Mitchell seconded, to approve this plat. Upon roll call, all members voting aye, the motion carried, There being no further business before the Commission, Cogley moved, and Schumacher seconded, to adjourn the meeting, all members voting aye, the motion carried. Adjournment FORMAT GUIDELINES: 1) Open forum provides an opportunity for the public to address the Aberdeen City Planning Commission with questions, concerns or comments on items, which are not on the agenda. Citizens are asked to sign up to speak prior to the open forum portion of the meeting. Open forum will be limited to 10 minutes (if no one is in attendance for the open forum, the regular meeting may begin) unless a majority of the Aberdeen City Planning Commission agrees to extend the time period. The open forum may not be used to make personal attacks, to air personality grievances, to make political endorsements, or for political campaign purposes. Open forum will not be used as a time for problem solving or reacting to the comments made, but, rather for hearing the citizen for informational purposes. The Aberdeen City Planning Commission may respond with request for city management to follow up and report back on any issue raised during the public address time. A presentation may not exceed two minutes in duration. 2) ADA Compliance: The City of Aberdeen fully subscribes to the provisions of the American’s With Disabilities Act. If you desire to attend this public meeting and are need of special accommodations, please notify the City Planning & Zoning Office at least 8 hours prior to the meeting so appropriate auxiliary aids and services can be made available. The Aberdeen City Planning Commission meets monthly on the third Tuesday of each month. 3) A copy of the subject matter on the Aberdeen City Planning Commission meeting agenda is available for public distribution at the City Planning & Zoning Office and available on the City’s website @ www.aberdeen.sd.us.
