Aberdeen City Planning Commission November 15, 2022 MINUTES ABERDEEN CITY PLANNING COMMISSION November 15, 2022 The City Planning Commission was called to order by Acting Chairman Schumacher. Members present at roll call were Schumacher, Woodward, Lien, and Rux via telephone. Also present were Brett Bill, Planning & Zoning Director, Eric Miller, City Planner, Ken Hubbart, City Planner, and Amanda Kamphuis, Aberdeen City Planning Commission Secretary. Woodward moved, and Lien seconded, to approve the Aberdeen City Planning Commission Minutes of October 18, 2022, all members voting aye, the motion carried. OPEN FORUM – No one was present. There being no old business, Acting Chairman Schumacher began with new business as follows: 1) Petition to Vacate Public R.O.W. described as “The 66’ wide Second Avenue SW Public R.O.W. commencing 122’ west of Fourth Street South Public R.O.W. and continuing 100.45’ west to point of termination, adjacent to Railroad R.O.W., located between Lot 3A, Mardian Sixth Subdivision to the City of Aberdeen, and Lot 1, Ladner’s First Addition, in the SW¼ of Sec. 13- T123N-R64W of the 5th P.M., Brown County, South Dakota” (a.k.a. 116 Fourth St S and 418 Third Ave SW – Undeveloped R.O.W. north of Ladner Electric). Jared and Kelly Ladner and Randy Meister were present to represent the property. Ken Buechler and Chuck Blumhardt were there in opposition to this request. Eric Miller stated the petitioners submitted this Petition to Vacate undeveloped public right-of-way with the intention to combine it with their adjacent property in order to more easily allow for future development. An application to allow mini- storage units on the property located at 418 Third Ave SW was approved by the Aberdeen Board of Zoning Adjustment at their November 10, 2022 meeting. Following discussion, Lien moved, and Woodward seconded, to approve with the stipulations that the petitioners have a plat prepared to combine the vacated R.O.W. with their adjacent lots and easements must be established for any existing utilities within the R.O.W. Upon roll call, all members voting aye, the motion carried. 2) Preliminary and Final Plat described as “William Daschle First Addition to the City of Aberdeen, in the SW¼ of Sec. 12-T123N-R64W of the 5th P.M., Brown County, South Dakota” (a.k.a. 1201 Fourth St N – East of Lee Park Golf Course). Eric Miller stated the petitioners are requesting this Preliminary and Final Plat in order to combine multiple underlying lots to allow for future residential development. Following discussion, Woodward moved, and Lien seconded, to approve this request. Upon roll call, all members voting aye, the motion carried. 3) Preliminary and Final Plat described as “Eric Brenner First Addition to the City of Aberdeen, in the SW¼ of Sec. 12-T123N-R64W of the 5th P.M., Brown County, South Dakota” (a.k.a. 1209 Fourth St N – East of Lee Park Golf Course). Eric Miller stated the petitioners are requesting this Preliminary and Final Plat in order to combine multiple underlying lots to allow for future residential development. Following discussion, Lien moved, and Woodward seconded, to approve this request. Upon roll call, all members voting aye, the motion carried. 1 Aberdeen City Planning Commission November 15, 2022 4) Preliminary and Final Plat described as “T&K Schneider Addition to the City of Aberdeen, in the NE¼ of Sec. 13-T123N-R64W of the 5th P.M., Brown County, South Dakota” (a.k.a. 110 Lloyd St N – One half bock NW of Schwan’s Recreation). Eric Miller stated the petitioners are requesting this Preliminary and Final Plat in order to combine multiple underlying lots to allow for future residential development. This lot does not meet the 50’ minimum width; therefore, an application for lot size variance was submitted in conjunction with this plat and will be heard by the Aberdeen Board of Zoning Adjustment at their December 8, 2022 meeting. Following discussion, Woodward moved, and Lien seconded, to approve this request. Upon roll call, all members voting aye, the motion carried. 5) New land use in a (C-1) Neighborhood Commercial Zoning District described as “Lots 10-12, Block 31, Bennett & Thomas Addition to Aberdeen, in the NW¼ of Sec. 25-T123N-R64W of the 5th P.M., Brown County, South Dakota” (a.k.a. 701 Main St N). Nicole Johnson was present to represent the property. Eric Miller stated the petitioner is requesting permission to relocate their existing private esthetics school from 10 Railroad Ave SW to this location. They are also requesting to reface the existing free-standing sign on the property. New land uses within the Neighborhood Commercial District require approval by the Aberdeen City Planning Commission. The Neighborhood Commercial District allows for a limited number of commercial uses conducive, and not detrimental, to a typical quiet residential district; the proposed use does not seem contrary to this. Following discussion, Woodward moved, and Lien seconded, to approve with the stipulation that permits are obtained for the sign change and any improvements to the building. Upon roll call, all members voting aye, the motion carried. There being no further business before the Commission, Lien moved, and Woodward seconded, to adjourn the meeting, all members voting aye, the motion carried. Adjournment FORMAT GUIDELINES: 1) Open forum provides an opportunity for the public to address the Aberdeen City Planning Commission with questions, concerns or comments on items, which are not on the agenda. Citizens are asked to sign up to speak prior to the open forum portion of the meeting. Open forum will be limited to 10 minutes (if no one is in attendance for the open forum, the regular meeting may begin) unless a majority of the Aberdeen City Planning Commission agrees to extend the time period. The open forum may not be used to make personal attacks, to air personality grievances, to make political endorsements, or for political campaign purposes. Open forum will not be used as a time for problem solving or reacting to the comments made, but, rather for hearing the citizen for informational purposes. The Aberdeen City Planning Commission may respond with request for city management to follow up and report back on any issue raised during the public address time. A presentation may not exceed two minutes in duration. 2) ADA Compliance: The City of Aberdeen fully subscribes to the provisions of the American’s With Disabilities Act. If you desire to attend this public meeting and are need of special accommodations, please notify the City Planning & Zoning Office at least 8 hours prior to the meeting so appropriate auxiliary aids and services can be made available. The Aberdeen City Planning Commission meets monthly on the third Tuesday of each month. 3) A copy of the subject matter on the Aberdeen City Planning Commission meeting agenda is available for public distribution at the City Planning & Zoning Office and available on the City’s website @ www.aberdeen.sd.us.
