Aberdeen City Planning Commission December 20, 2022 MINUTES ABERDEEN CITY PLANNING COMMISSION December 20, 2022 The City Planning Commission was called to order by Acting Chairman Schumacher. Members present at roll call were Schumacher, Mitchell, Woodward, Rux, and Cogley. Also present were Brett Bill, Planning & Zoning Director, Eric Miller, City Planner, Ken Hubbart, City Planner, and Amanda Kamphuis, Aberdeen City Planning Commission Secretary. Woodward moved, and Rux seconded, to approve the Aberdeen City Planning Commission Minutes of November 15, 2022, all members voting aye, the motion carried. OPEN FORUM – No one was present. There being no old business, Acting Chairman Schumacher began with new business as follows: 1) Preliminary and Final Plat described as “Conraads Consolidation Subdivision to the City of Aberdeen, in the SE¼ of Sec.12-T123N-R64W of the 5th P.M., Brown County, South Dakota” (a.k.a. 1412 Lloyd St N – East of North Highland United Methodist Church). Eric Miller stated the Petitioners are requesting this Preliminary and Final Plat in order to combine multiple underlying lots into one legal parcel to allow for future residential development. Following discussion, Rux moved, and Cogley seconded, to approve this request. Upon roll call, all members voting aye, the motion carried. 2) Preliminary and Final Plat described as “TDAF First Addition to the City of Aberdeen, in the SW¼ of Sec.13-T123N-R64W of the 5th P.M., Brown County, South Dakota” (a.k.a. 1 Main St N – BNSF Depot Building). Heath Johnson was present to represent the property. Eric Miller stated the Petitioners are requesting this Preliminary and Final Plat in order to subdivide the property into two parcels to allow for conveyance. Following discussion, Cogley moved, and Mitchell seconded, to approve this request. Upon roll call, all members voting aye, the motion carried. 3) Preliminary and Final Plat described as “HAPI 2nd North Subdivision to the City of Aberdeen, in the NW¼ of Sec. 6-T123N-R63W of the 5th P.M., Brown County, South Dakota” (a.k.a. 3314 Congress St N – ½ mile north of Holgate Middle School). Darin Beckius was present to represent the property. Eric Miller stated the Petitioner is requesting this Preliminary and Final Plat in order to subdivide undeveloped land to continue the development of a residential subdivision. This subdivision contains 66 lots for future development of single-family residences. All of the proposed lots conform to current subdivision regulations. Following discussion, Rux moved, and Woodward seconded, to approve this request. Upon roll call, all members voting aye, the motion carried. 4) New Land Use in a C-1 Zoning District described as “Lots 1-5, Block 31, Bennett & Thomas Addition to Aberdeen, in the NW¼ of Sec. 13-T123N-R64W of the 5th P.M., Brown County, South Dakota” (a.k.a. 719 Main St N – Former Scotty’s Restaurant). Eric Miller stated the petitioner is requesting permission to alter an existing structure to allow for the opening of a new 1 Aberdeen City Planning Commission December 20, 2022 restaurant in a Neighborhood Commercial District. New land uses and alterations of existing structures within the Neighborhood Commercial District require approval by the Aberdeen City Planning Commission. This structure will have some interior remodeling done including the installation of a drive-thru window. Additionally, the petitioners intend to add on a 10’x12’ walk-in freezer and plan to reface the existing free-standing sign. At their December 8, 2022 meeting, the Aberdeen Board of Zoning Adjustment approved multiple requests pertaining to this project. Setback variances were approved for the existing structure and sign as well as for the new addition and parking stalls along the west property line. A Special Exception for the operation of a drive-thru restaurant was also approved. The Neighborhood Commercial District allows for a limited number of commercial uses conducive, and not detrimental, to a typical quiet residential district; the proposed use does not seem contrary to this. Following discussion, Cogley moved, and Woodward seconded, to approve with the stipulations that permits are obtained for any improvements to the building and sign and that the property is replatted into one lot. There being no further business before the Commission, Rux moved, and Mitchell seconded, to adjourn the meeting, all members voting aye, the motion carried. Adjournment FORMAT GUIDELINES: 1) Open forum provides an opportunity for the public to address the Aberdeen City Planning Commission with questions, concerns or comments on items, which are not on the agenda. Citizens are asked to sign up to speak prior to the open forum portion of the meeting. Open forum will be limited to 10 minutes (if no one is in attendance for the open forum, the regular meeting may begin) unless a majority of the Aberdeen City Planning Commission agrees to extend the time period. The open forum may not be used to make personal attacks, to air personality grievances, to make political endorsements, or for political campaign purposes. Open forum will not be used as a time for problem solving or reacting to the comments made, but, rather for hearing the citizen for informational purposes. The Aberdeen City Planning Commission may respond with request for city management to follow up and report back on any issue raised during the public address time. A presentation may not exceed two minutes in duration. 2) ADA Compliance: The City of Aberdeen fully subscribes to the provisions of the American’s With Disabilities Act. If you desire to attend this public meeting and are need of special accommodations, please notify the City Planning & Zoning Office at least 8 hours prior to the meeting so appropriate auxiliary aids and services can be made available. The Aberdeen City Planning Commission meets monthly on the third Tuesday of each month. 3) A copy of the subject matter on the Aberdeen City Planning Commission meeting agenda is available for public distribution at the City Planning & Zoning Office and available on the City’s website @ www.aberdeen.sd.us.
