Staff Present: Gerald Campbell, Marisa Franchini, Michele Andre, Jared Pellerin The roll being called, the meeting was called to order by President Ellis at 7:34 pm; Council Members recited the Pledge of Allegiance followed by a moment of silence. Approval of Minutes There were no meeting minutes available for approval. Consideration of Local Laws Council Member Hoey moved to amend of Local Law A as follows, and as amended requested it be held: LOCAL LAW A 2019 (As Amended) A LOCAL LAW AMENDING SECTION 34-1 (MEETINGS OF BOARDS, COMMISSIONS AND COMMITTEES TO BE RECORDED) OF CHAPTER 34 (MEETINGS) OF THE CODE OF THE CITY OF ALBANY IN RELATION TO THE KEEPING OF MEETING MINUTES BY PUBLIC BODIES AND ENSURING THE POSTING THEREOF. BE IT ENACTED by the Common Council of the City of Albany as follows: Section 1. Section 34-1 of the Code of the City of Albany is amended to read as follows: §34-1 Meetings of Boards, Commissions and Committees to be recorded; content and posting of minutes A. Meetings of all public bodies subject to the New York State Public Officers Law, Article 7 (commonly referred to as the "Open Meetings Law"), shall be recorded, except those portions of meeting where the body validly enters into executive session. The audio  recording shall be made available to the public and shall be digitally preserved for a minimum of five years. B. Meetings of all public bodies of the City of Albany, in accordance with Article 7, Section 106 of the New York State Public Officers Law, shall establish procedures and protocol pertaining to the taking of meeting minutes and the publishing thereof. Minutes must contain a record or summary of all motions, proposals, resolutions and any other matter formally voted upon and the vote by individual members of the public body thereon. Meeting minutes for a meeting at which a public hearing or public comment period is held shall include the name and jurisdiction within which they reside of those individuals who have freely chosen to state their name for the record and the nature of their testimony. Meeting minutes of all public bodies of the City of Albany shall be posted to the City of Albany’s website within two weeks of any public meeting, except in the case of an executive session in which instance the minutes shall be made available to the public within one week from the date of the executive session. Section 2. This local law shall take effect upon final passage, public hearing and filing with the Secretary of State. President Pro Tem Conti held the pending local law on the agenda for further consideration. Reports of Standing and Ad Hoc Committees Finance, Assessment and Taxation: Council Member Doesschate reported that the committee met on January 23, 2019 to review Bond Ordinances 44.122.18 through 58.122.18 which were moved out of the committee for Council consideration. Joint Meeting with Housing and Community Development and Human Resources and Human Rights: Council Member Kimbrough reported the committee met on January 10, 2019 to receive a report from the Albany Housing Authority and consider Ordinance 1.11.19 (MBWE Reports) which was reported out of committee with a positive recommendation. Council Operations and Ethics: President Pro Tem Conti reported the Committee met on January 23, 2019 to review Local Law A - 2019 which was reported out of committee with amendment and a a positive recommendation. Consideration of Ordinances Council Members Conti and Anane noticed the introduction of Ordinance 2.12.19 as follows, which was held for further consideration: Ordinance Number 2.12.18 AN ORDINANCE AMENDING ARTICLE II (TRAFFIC REGULATIONS) OF CHAPTER 359 (VEHICLE AND TRAFFIC) OF THE CODE OF THE CITY OF ALBANY IN RELATION TO MARKINGS FOR FIRE HYDRANTS The City of Albany, in Common Council convened, does hereby ordain and enact: Section 1. Subsection D of Section 359-22 of Article II of the Code of the City of Albany is amended to read as follows: D. Stop, stand or park a vehicle within 15 feet of a fire hydrant except when such vehicle is attended by a licensed operator or chauffeur who is seated in the front seat and who can immediately move such vehicle in case of emergency, unless a different distance is indicated by official signs, markings or where parking meters are installed. The Chief of Police shall clearly mark and identify the no parking area adjacent to fire hydrants. Section 2. This ordinance shall take effect 180 days after its enactment into law. President Pro Tem Conti referred Ordinance 2.12.18 to the Law, Buildings and Code Enforcement Committee for further consideration. Council Member Fahey noticed the introduction of Ordinance 3.12.19 as follows, which was held for further consideration: Ordinance Number 3.12.19 AN ORDINANCE AMENDING CHAPTER 375 (CITY OF ALBANY UNIFIED SUSTAINABLE DEVELOPMENT ORDINANCE) OF THE CODE OF THE CITY OF ALBANY IN RELATION TO SPECIAL FLOOD HAZARD AREAS The City of Albany, in Common Council convened, does hereby ordain and enact: Section 1. Clause (ii) of Subparagraph (C) (General Provisions) of paragraph (3) (FP-O Flooplain Overlay) of subsection (F) (Overlay Districts) of section 375-2 (Zoning Districts) of Chapter 375 of the Code of the City of Albany is amended by adding a new item (iii) to read as follows: (iii) Letter of Map Revision (LOMR) Case No. 17-02-1160P revising FIRM panels: 36001C0192D, 36001C0211D, & 36001C0213D effective March 7, 2019. Section 2. This ordinance shall take effect immediately. President Pro Tem Conti referred Ordinance 3.12.18 to the Planning, Economic Development and Land Use Committee for further consideration. Council Member Johnson noticed the introduction of Ordinance 4.12.19 as follows, which was held for further consideration: Ordinance Number 4.12.19 AN ORDINANCE AMENDING CHAPTER 375 OF THE CODE OF THE CITY OF ALBANY (UNIFIED SUSTAINABLE DEVELOPMENT ORDINANCE) CHANGING THE ZONING CLASSIFICATIONS OF 151 & 153 GRAND STREET FROM MU-FS MIXED-USE FORM-BASED SOUTH END (MU-FS) TO LAND CONSERVATION (LC) AND AMENDING THE ZONING MAP ACCORDINGLY The City of Albany, in Common Council convened, does hereby ordain and enact:  Section 1. Chapter 375 of the Code of the City of Albany (Unified Sustainable Development Ordinance) and the Official Zoning Map are hereby amended to change the zoning classifications 151 & 153 Grand Street from Mixed-Use Form-Based South End (MU-FS) to Land Conservation (LC), said properties being more particularly described as follows: All that parcel of land situated in the City of Albany, County of Albany and State of New York, identified on the tax map as follows: Parcel 1 Section: 76.57 Block: 1 Lot: 55 Sub Lot: 1 Said premises more commonly known as 151 Grand Street measuring approximately 85.65’ by 243.92’. This ordinance shall take effect immediately. President Pro Tem Conti referred Ordinance 4.12.18 to the Planning, Economic Development and Land Use Committee for further consideration. President Pro Tem Conti made a motion, which was duly seconded, requesting Majority Consent to add Ordinance 5.12.19 to the agenda. There being no discussion, the motion was adopted by voice vote. Council Member Doesschate noticed the introduction of Ordinance 5.12.19 (MC) as follows, which was held for further consideration: Ordinance Number 5.12.19 (MC) AN ORDINANCE AUTHORIZING CERTAIN PURCHASES BY THE CITY OF ALBANY, NEW YORK AT A MAXIMUM ESTIMATED COST OF $1,000,000.00 AND AUTHORIZING THE LEASE FINANCING OR THE ISSUANCE OF $1,000,000.00 SERIAL BONDS OF SAID CITY TO PAY THE COST THEREOF (DEPT. OF ENGINEERING – RENOVATIONS TO CITY BUILDINGS) The City of Albany, in Common Council convened, does hereby ordain and enact: Section 1. The objects or purposes to be authorized and financed pursuant to this ordinance are set forth below, together with estimates of the maximum estimated costs thereof; determinations of the periods of probable usefulness thereof and the subparagraphs of Section 11.00(a) of the New York Local Finance Law pursuant to which it is determined; the maximum amount of the bonds to be issued with respect to such object or purpose and the maximum term of the obligations to be issued with respect to each project or purpose. Object or Purpose: Engine 9 Roof Replacement Local Finance Law Section 11.00(12)(a)(2) Period of Probable Usefulness: 15 years Maximum Term of Obligations: 15 years Maximum Estimated Cost: $1,000,000.00 Maximum Amount of Bonds: $1,000,000.00 Treasurer's Bond Authorization Numbers: K-19 Treasurer's Project Numbers: GH.1440.8911 Section 2. The plan of financing such objects or purposes is the lease financing of or the issuance of $1,000,000.00 serial bonds hereby authorized to be issued. Section 3. It is hereby ordered and directed that the projects specified above be undertaken and the amounts set forth as the maximum estimated costs are hereby appropriated therefor. The Board of Contract and Supply is hereby authorized to take such necessary and further steps to carry out the provisions of this section. Section 4. Pending the sale of the bonds herein authorized, the temporary use of funds from the City's general fund, pursuant to the provisions of section 165.10 of the New York Local Finance Law, is hereby authorized. The City reasonably expects to reimburse such temporary expenditures with the proceeds of the bonds or bond anticipation notes authorized by section 1 of this ordinance. This ordinance shall constitute the City's "official intent" to reimburse such temporary expenditures in accordance with United States Treasury Regulation section 1.150-2. Section 5. The faith and credit of the City of Albany, New York are hereby irrevocably pledged for the payment of the principal of and interest on such leases or bonds as the same respectively become due and payable. An annual appropriation shall be made in each year sufficient to pay the principal of and interest on such leases or bonds becoming due and payable in such year and such debt service payments may be made in substantially level or declining amounts as may be authorized by law. There shall annually be levied on all taxable real property of said City, a tax sufficient to pay the principal of and interest on such leases or bonds as the same become due and payable. Section 6. Subject to the provisions of the New York Local Finance Law, the power to authorize the issuance of and to sell bond anticipation notes in anticipation of the issuance and sale of the serial bonds herein authorized, including renewals of such notes, is hereby delegated in the City Treasurer, as chief fiscal officer of the City of Albany. Such notes shall be of such terms, form and contents, and shall be sold in such manner, as may be prescribed by said City Treasurer, consistent with the provisions of Local Finance Law. Section 7. The City Treasurer is further authorized to take such actions and execute such documents as may be necessary to ensure the continued status of the interest on the leases or bonds authorized by this resolution and any notes issued in anticipation thereof, as excludable from federal income taxation pursuant to Section 103 of the Internal Revenue Code of 1986, as amended (the "Code") and to designate the bonds authorized by this resolution, and any notes issued in anticipation thereof as "qualified tax-exempt bonds" in accordance with Section 265(b)(3)(B)(i) of the Code. Section 8. The City Treasurer is further authorized to enter into a continuing disclosure agreement with the initial issuer of the leases or the purchaser of the bonds or notes authorized by this resolution, containing provisions which are satisfactory to such purchaser in compliance with the provisions of Rule 15c12-12, promulgated by the Securities and Exchange Commission pursuant to the Securities and Exchange Act of 1934. Section 9. The validity of such leases or bonds and bond anticipation notes may be contested only if:  (a) Such obligations are authorized for an object or purpose for which said City is not authorized to expend money, or (b) The provisions of law which should be complied with at the date of publication of this ordinance pursuant to Section 8 hereof are not substantially complied with, and an action, suit or proceeding contesting such validity is commenced within twenty days after the date of such publications, or (c) Such obligations are authorized in violation of the provisions of the Constitution. Section 10. Upon this ordinance taking effect, the Clerk of the Common Council is hereby authorized and directed to publish the same together with a notice in substantially the form set forth in section 81.00 of the New York Local Finance Law. Section 11. It is hereby determined that except as hereinafter specified, the authority and funding of the projects aforesaid constitute either unlisted of Type II actions under the New York State Environmental Quality Review Act and the regulations promulgated thereunder having no adverse effect upon the environment. Section 12. This ordinance shall be dated January 7, 2019 and shall take effect upon its approval by the Board of Estimate and Apportionment of the City of Albany.
