ALBANY COMMON COUNCIL MINUTES OF A REGULAR MEETING Thursday, February 21, 2019 The Common Council was convened at 7:10 p.m. and was called to order by President Pro Tem Conti. The roll being called, the following answered to their names: Council Members Anane, Balarin, Conti, Fahey, Farrell, Hoey, Igoe, Johnson, Kimbrough, Love, and O’Brien Also present was the following staff: Cashawna Burt, Marisa Franchini, Jared Pellerin and Michele Andre. President Pro Tem Conti led the Pledge of Allegiance followed by a moment of silence. PUBLE HEARINGS The Clerk read the title of the ordinance for the first public hearing: Ordinance 3.12.19:AN ORDINANCE AMENDING CHAPTER 375 (CITY OF ALBANY UNIFIED SUSTAINABLE DEVELOPMENT ORDINANCE) OF THE CODE OF THE CITY OF ALBANY IN RELATION TO SPECIAL FLOOD HAZARD AREAS There being no members of the public wishing to speak, President Pro Tem Conti declared the public hearing on Ordinance 3.12.19 closed. Alana Klein, 29 Glenwood Street, Albany, NY 12208 (Transparency) There being no further speakers, the President Pro Tem declared the Public Comment Period closed. Approval of Minutes Majority Leader Kimbrough made a motion, which was duly seconded, to approve the minutes of February 4, 2019 regular meeting of the Council, which was APPROVED by unanimous voice vote. CONSIDERATION OF LOCAL LAWS: Council Member Hoey noticed the introduction of Local Law B as follows: LOCAL LAW B 2019 A LOCAL LAW ADDING A NEW SECTION 34-2 (PUBLIC NOTICE OF MEETINGS OF BOARDS, COMMISSIONS AND COMMITTEES) OF CHAPTER 34 (MEETINGS) OF THE CODE OF THE CITY OF ALBANY IN RELATION TO THE NOTICING OF A MEETING OF A PUBLIC BODY BE IT ENACTED by the Common Council of the City of Albany as follows: Section 1. Section 2 of chapter 34 of the Code of the City of Albany is renumbered as section 3 and a new section 2 is added to read as follows: §34-2 Public Notice of Meetings of Boards, Commissions and Committees 1. Public notice of the time, place and the meeting agenda of a meeting scheduled at least one week prior thereto shall be given or electronically transmitted to the news media and shall be conspicuously posted in one or more designated public locations at least seven days before before such meeting. 2. Public notice of the time, place and the meeting agenda of every other meeting shall be given or electronically transmitted, to the extent practicable, to the news media and shall be conspicuously posted in one or more designated public locations at a reasonable time thereto. 3. When a public body has the ability to do so, notice of the time, place and the meeting agenda of a meeting given in accordance with subdivision one or two of this section, shall also be conspicuously posted on the public body’s internet website. Section 2. This local law shall take effect upon final passage, public hearing and filing with the Secretary of State. Majority Leader Kimbrough referred Local Law B to the Council Operations and Ethics Committee for further consideration. CONSIDERATION OF ORDINANCES Majority Leader Kimbrough held the pending ordinances on the agenda for further consideration. 2 CONSIDERATION OF RESOLUTIONS Council Members Hoey, Johnson, Robinson, Fahey, Farrell, Balarin, Flynn, Love, Anane, Igoe, Conti, Doesschate, O’Brien, Kimbrough and Applyrs, with the support of Council President Ellis offered Resolution 5.22.19R as follows, asked for its passage and a vote thereon: RESOLUTION NUMBER 5.22.19R A RESOLUTION OF THE CITY OF ALBANY’S COMMON COUNCIL CALLING ON THE UNITED STATES IMMIGRATION AND CUSTOMS ENFORCEMENT AGENCY TO STAY THE DEPORTATION OF ALBANY RESIDENT AND COMMUNITY MEMBER, KINIMO NGORAN WHEREAS, Mr. Ngoran has established himself as a resident and engaged community member of the City of Albany and has been working to legitimize his immigration status; and WHEREAS, Mr. Ngoran is actively engaged in the lawful process seeking permanent immigration status; and WHEREAS, Mr. Ngoran had previously been ordered removed from the U.S. by a federal immigration judge in 2004, but was ultimately issued a temporary stay of deportation, until he was detained without warning on January 23rd, 2019, at a routine check-in meeting with United States Immigration and Customs Enforcement (ICE); and WHEREAS, Mr. Ngoran continues to be held from his family, friends and community at the Batavia Federal Detention Center, while he awaits the final ruling on his case; and WHEREAS, Mr. Ngoran is well liked and respected throughout the community and his work as a chef at the Capital City Rescue Mission helps to feed approximately 800 meals a day to the City’s poor and homeless population; and WHEREAS, Mr. Ngoran has been described as a “genuine,” “hardworking,” and “loving” person, who simply wants to “help people,” and WHEREAS, the Common Council takes seriously their duty to represent the interests of their constituents, including those of Mr. Kinimo Ngoran; and NOW THEREFORE, BE IT RESOLVED, that the Common Council of the City of Albany hereby calls upon the Federal Government and U.S. Immigration and Customs Enforcement Agency to recognize the contributions Mr. Ngoran has made to his community and the City of Albany; and BE IT FURTHER RESOLVED, that the Common Council stands in unity behind Mr. Ngoran, his family and supporters in their hopes for a swift resolution of his case, a permanent stay of his deportation from the United States and his ultimate return to his family, friends and the community he so deeply cares for. Council Members Hoey, Anane, Balarin, Johnson and Igoe spoke on the Resolution prior to passage. There being no further discussion, President Pro Tem Conti called for a voice vote thereon and the Resolution was ADOPTED unanimously. Council Member Farrell offered Resolution 6.22.19R as follows, asked for its passage and a vote thereon: RESOLUTION NUMBER 6.22.19R 3  RESOLUTION OF THE COMMON COUNCIL CONSENTING TO AN ADJUSTMENT IN SALARY FOR CERTAIN POSITIONS FOR THE 2019 BUDGET (TREASURER’S OFFICE) WHEREAS, Section 604(D)(b) of the Charter of the City of Albany dictates that any transfer of budgeted funds that affects a salary total that occurs outside of those described in the duly adopted budget must be consented to by the Common Council; and WHEREAS, the Treasurer has requested amendments to the 2019 budget to reduce the salary of the position of Senior Accountant from $46,500 to $30,000 and increasing the salary for the position of Account Clerk from $10,000 to $26,500 by transferring $16,500 from the line for the Senior Accountant position to the line for the Account Clerk position. NOW, THEREFORE, BE IT RESOLVED, that the Common Council of the City of Albany consents to the transfer of funds as set forth above, affecting the salary totals for two positions in the Department of Treasurer. There being no discussion, President Pro Tem Conti called for a roll call vote thereon and the Resolution was ADOPTED: The Resolution passed by the following vote of all Council Members elected voting in favor thereof: Affirmative – Anane, Balarin, Conti, Fahey, Farrell, Hoey, Igoe, Johnson, Kimbrough, Love, and O’Brien Affirmative 11 Negative 0 Abstain 0 Council Members Igoe and Johnson offered Resolution 7.22.19R as follows, asked for its passage and a vote thereon: RESOLUTION NUMBER 7.22.19R A RESOLUTION AUTHORIZING THE IMPLEMENTATION, AND FUNDING IN THE FIRST INSTANCE 100% OF THE FEDERAL-AID AND STATE “MARCHISELLI” PROGRAM-AID COSTS, OF A TRANSPORTATION FEDERAL-AID PROJECT, AND APPROPRIATING FUNDS THEREOF (PAVING) WHEREAS, a Project New Scotland Ave Mill & Fill from Manning Blvd to Onderdonk Ave, Pearl St Mill & Fill from Clinton Ave to Madison Ave, City of Albany P.I.N. 1760.27 (the Project") is eligible for funding under Title 23 U.S. Code, as amended, that calls for the apportionment of the costs such program to be borne at the ratios of 80% Federal funds and 20% non-federal funds; and WHEREAS, the City of Albany desires to advance the Project by making a commitment of 100% of the non-federal share of the costs of Design and Construction/Construction Inspection, NOW, THEREFORE, the Common Council duly convened does hereby RESOLVE, that the Common Council hereby approves the above-subject project; and it is hereby further RESOLVED, that the Common Council hereby authorizes the City of Albany to pay in the first instance 100% of the federal and non-federal share of the cost of Design and Construction/Construction 4 Inspection, work for the Project or portions thereof; and it is further RESOLVED, that the sum of $199,282.00 has been appropriated from GH 1492.5010.8710 (ordinance 11.21.17) and made available to cover the cost of participation in the above phases of the Project; and it is further RESOLVED, that the additional sum of $2,081,890.00 has been appropriated from, GH 1492.5010.8507 (Ordinance 16.32.15); GH 1492.5010.8710 (Ordinance 11.21.17); Ordinance 6.21.18, GH 1492.5010.8806 and made available to cover the cost of participation in the above phases of the Project; and it is further RESOLVED, that in the event the full federal and non-federal share costs of the project exceeds the amount appropriated above, the Common Council of the City of Albany shall convene as soon as possible to appropriate said excess amount immediately upon the notification by the New York State Department of Transportation thereof, and it is further RESOLVED, that the Mayor of the City of Albany be and is hereby authorized to execute all necessary Agreements, certifications or reimbursement requests for Federal Aid and/or Marchiselli Aid on behalf of the City of Albany with the New York State Department of Transportation in connection with the advancement or approval of the Project and providing for the administration of the Project and the municipality's first instance funding of project costs and permanent funding of the local share of federal- aid and state-aid eligible Project costs and all Project costs within appropriations therefore that are not so eligible, and it is further RESOLVED, that a certified copy of this resolution be filed with the New York State Commissioner of Transportation by attaching it to any necessary Agreement in connection with the Project and it is further RESOLVED, this Resolution shall take effect immediately There being no discussion, President Pro Tem Conti called for a roll call vote thereon and the Resolution was ADOPTED: The Resolution passed by the following vote of all Council Members elected voting in favor thereof: Affirmative – Anane, Balarin, Conti, Fahey, Farrell, Hoey, Igoe, Johnson, Kimbrough, Love, and O’Brien Affirmative 11 Negative 0 Abstain 0 Council Member Kimbrough on the behalf of Council Member Applyrs offered Resolution 8.22.19R as follows, which was held for further consideration: RESOLUTION NUMBER 8.22.19R RESOLUTION OF THE COMMON COUNCIL REAPPOINTING MATT INGRAM AS A MEMBER OF THE COMMUNITY POLICE REVIEW BOARD WHEREAS, the Common Council of the City of Albany, pursuant to the Section 42-334 of Chapter 42 of the Code of the City of Albany, appoints members to the City of Albany Community Police Review Board. 5  NOW, THEREFORE, BE IT RESOLVED, that Matt Ingram is hereby reappointed as a member of the City of Albany Community Police Review Board for a term ending on October 26, 2021. BE IT FURTHER RESOLVED, that this resolution shall take effect immediately. Majority Leader Kimbrough referred Resolution 8.22.18R to the Public Safety Committee for further consideration. Council Member Kimbrough on the behalf of Council Member Applyrs offered Resolution 9.22.19R as follows, which was held for further consideration: RESOLUTION NUMBER 9.22.19R RESOLUTION OF THE COMMON COUNCIL REAPPOINTING VENEILYA HARDEN AS A MEMBER OF THE COMMUNITY POLICE REVIEW BOARD WHEREAS, the Common Council of the City of Albany, pursuant to the Section 42-334 of Chapter 42 of the Code of the City of Albany, appoints members to the City of Albany Community Police Review Board. NOW, THEREFORE, BE IT RESOLVED, that Veneilya Harden is hereby reappointed as a member of the City of Albany Community Police Review Board for a term ending on October 26, 2021. BE IT FURTHER RESOLVED, that this resolution shall take effect immediately. Majority Leader Kimbrough referred Resolution 9.22.18R to the Public Safety Committee for further consideration. Council Member Love offered Resolution 10.22.19R as follows, asked for its passage and a vote thereon: RESOLUTION NUMBER 10.22.19R RESOLUTION URGING THE COUNTY LEGISLATURE TO AUTHORIZE THE INSTALLMENT PAYMENT OF TAXES FOR ALL RESIDENTS IN THE CITY OF ALBANY WHEREAS, The payment of property taxes in one annual payment may create a significant financial hardship for taxpayers on a fixed income, and WHEREAS, Section 928-a(1) of the Real Property Tax Law enables the Albany County Legislature to authorize the installment payment of real property taxes on property in general and where used as a principal residence of and owned by one or more persons who have received an exemption pursuant to Section 467 of the Real Property Tax Law in two equal installments, and WHEREAS, Such installment payments would serve to assist eligible persons in meeting the financial hardship of paying property taxes, now, therefore be it RESOLVED, the Common Council of the City of Albany supports the Albany County Legislature’s adoption of a resolution permitting the City of Albany, pursuant to Section 928-a(1) of the Real Property Tax Law, to enable its residents to pay their property taxes in two equal installments. 6 There being no discussion, President Pro Tem Conti called for a roll call vote thereon and the Resolution was ADOPTED: The Resolution passed by the following vote of all Council Members elected voting in favor thereof: Affirmative – Anane, Balarin, Conti, Fahey, Farrell, Hoey, Igoe, Johnson, Kimbrough, Love, and O’Brien Affirmative 11 Negative 0 Abstain 0 Council Member Kimbrough offered Resolution 11.22.19R as follows, asked for its passage and a vote thereon: RESOLUTION NUMBER 11.22.19R RESOLUTION OF THE COMMON COUNCIL CONSENTING TO AN ADJUSTMENT IN SALARY FOR CERTAIN POSITIONS FOR THE 2019 BUDGET (APD/NON-SWORN PERSONNEL CONTRACT AGREEMENT) WHEREAS, Section 604(D)(b) of the Charter of the City of Albany dictates that any transfer of budgeted funds that affects a salary total that occurs outside of those described in the duly adopted budget must be consented to by the Common Council; and WHEREAS, the Treasurer has requested amendments to the 2019 budget in order to effectuate a contract with Police Officers Union Local 2841, Law Enforcement Officers Union Counsel 82, AFSME, AFL-CIO (Non-Sworn Personnel) by transferring $47,459 from A3120.7802 to A3120.7000 ($44,574) and A3120.3510.7000 ($2,885). Council Member Anane offered Resolution 12.22.19R (MC) as follows, asked for its passage and a vote thereon: RESOLUTION NUMBER 12.22.19R (MC) 7  A RESOLUTION OF THE CITY OF ALBANY’S COMMON COUNCIL CALLING ON THE NEW YORK STATE LEGISLATURE AND NEW YORK STATE GOVERNOR ANDREW M. CUOMO TO PROVIDE THE CITY OF ALBANY WITH ITS FAIR SHARE OF UNRESTRICTED STATE AID AND MAKE PERMANENT $12.5 MILLION IN CAPITAL CITY FUNDING. WHEREAS, as the capital city of the State of New York, 64% of the property in the City of Albany is tax-exempt and nearly 60% of that property is owned by the State; and WHEREAS, thousands of State employees commute into the City of Albany from nearby suburbs daily, the City hosts tens of thousands of visitors coming to engage in business with State entities and the City is called upon to assist in facilitating a number of rallies, marches and protests by outside interest groups visiting the New York State Capitol each year; and WHEREAS, the City of Albany receives less state aid as a percentage of its municipal general fund than every other large upstate city, with the exception of Schenectady; and WHEREAS, the City of Albany receives less Aid and Incentives for Municipalities (AIM) per capita than any other city with at least 48,000 residents, and that disparity only grows when you take into account the City of Albany’s daytime population; and WHEREAS, the lack of adequate state aid results in significant strain on vital services that both residents and visitors of the City of Albany rely on every day; and WHEREAS, the cost of maintaining roads and sidewalks, providing police, fire and emergency services to State entities falls upon the tax paying residents of our Capital City; and WHEREAS, the City of Albany is constantly striving to make financially prudent choices which can been seen in the fact that the City’s budget has only increased by a total of 0.48% over the last 5 years; and WHEREAS, Albany certainly has its fair share of challenges, evidenced by the fact that the City is home to more than 1,000 vacant buildings, a median household income of less than $44,000 and a poverty rate of almost 25%; and WHEREAS, these challenges along with the inequity in state funding puts the City in a precarious position most of which is no result of the City’s own actions but rather the fact that the Capital City is forced to return to the Legislature and Governor year after year to ask for what is rightfully owed to those who call Albany home; and NOW THEREFORE, BE IT RESOLVED, that the Common Council of the City of Albany hereby calls upon the New York State Legislature and Governor Andrew M. Cuomo to pay the State’s fair share by including in the 2020 State Budget, $12.5 million in Capital City Funding for the City of Albany; and BE IT FURTHER RESOLVED, the Common Council of the City of Albany wishes to see this Capital City Funding be made permanent, so Albany residents are relieved of their unfair and inequitable tax burdens while also allowing Albany the chance to continue to flourish and thrive as the Capital of the State of New York.
