Approval of Minutes There were no meeting minutes available for approval. Consideration of Local Laws Council Member Doesschate on the behalf of Finance, Assessment and Taxation noticed the introduction of Local Law E-2019 as follows, which was held for further consideration: LOCAL LAW E-2019 A LOCAL LAW AMENDING ARTICLE I (REMOVAL OF GARBAGE) OF CHAPTER 313 (SOLID WASTE) OF THE CODE OF THE CITY OF ALBANY REGARDING THE CURBSIDE WASTE COLLECTION AND SECTION SECTION 5 OF LOCAL LAW I-2016 TO REPEAL THE EXPIRATION THEREOF BE IT ENACTED by the Common Council of the City of Albany as follows: Section 1. Subsections B and D of Section 313-3 of Article I of Chapter 313 of the Code of the City of Albany, as added by Local Law 1-2016, is hereby amended to read as follows: B. There is hereby established a curbside waste collection fee for residential dwellings eligible for such service under subsection A of this section. Such fee shall offset the cost of curbside collection, and for calendar year 2016 shall be in the amount of $180 per unit per year, except that for the calendar year periods prior to calendar year 2019 such fee shall not apply to the first unit of a dwelling. For calendar year periods after 2016 and prior to 2019, such fee shall be annually reviewed and adjusted in accordance with Subsection I of this section. For  calendar year 2019, 2020 and thereafter such fee shall be in the amount of $90 per unit. 1. The number of dwelling units to be charged fees with regard to any property shall be determined by the number of dwelling units indicated on the certificate of occupancy or based on the records maintained by the Department of Assessment and Taxation for said property. 1. For calendar year periods prior to 2019, with respect to a parcel of property containing a duplex or condominium of fewer than five units, for purposes of this Article and upon submission of sufficient proof to the Department of Buildings and Regulatory Compliance that each dwelling unit is owned and occupied by separate persons, each unit will be entitled to one weekly curbside collection. C. Bills for curbside collection program fees. Bills for curbside collection program fees shall be prepared and sent to each owner annually, starting February 1 of each calendar year; provided, however, that for calendar year 2017 and thereafter, bills may be prepared and sent to each owner in the same manner as water and sewer charges are now billed, distributed and collected. D. Penalties for nonpayment. After three months of nonpayment, a property owner who fails to pay charges that have been established and imposed for the curbside collection program, a penalty of $50 will be added to the base curbside collection fee. After six months of nonpayment, $100 will be imposed on top of the previous late fee and the curbside collection fee. Section 2. Section 5 of Local Law 1-2016, amending Chapter 313 (Solid Waste) of the Code of the City of Albany in relation to establishing a curbside waste collection fee, is amended to read as follows: Section 5. This local law shall take effect upon final passage, public hearing and filing with the Secretary of State; provided, however, that it shall be deemed to have been in full force and effect on and after January 1, 2016 and that the amendments made to Chapter 313 of the Code of the City of Albany by Section 2 of this local law shall be deemed repealed and of no further force and effect for the period after December 31, 2019. Section 3. Except as herein amended the provisions of Chapter 313 are hereby ratified, continued and approved. Section 4. This local law shall take effect upon final passage, public hearing and filing with the Secretary of State. President Pro Tem Conti referred Local Law E-2019 to the Finance, Assessment and Taxation Committee for further consideration. President Pro Tem Conti held remaining local laws on the pending agenda. Reports of Standing and Ad Hoc Committees Finance, Assessment and Taxation: Council Member Doesschate reported that the committee has scheduled budget meetings through November. The Thursday, October 10, 2019 meeting included a Debt Report Presentation by Treasurer Darius Shahinfar and review of the Department of Fire and Emergency Services budget. Law, Building and Code Enforcement: Council Member Igoe reported that the committee will meet on October 21, 2019 to review Ordinance 35.101.19 (MC) (enact an Equity Agenda within the City of Albany) and Resolution 69.101.19 (MC) (recognize Albany Housing Authority’s commitment to providing $6,000 dollars annually to higher education scholarships for residents of the City of Albany). Council Operation and Ethics: President Pro Tem Conti reported that the committee will meet soon to review Ordinance 32.101.19 (waive the fee for obtaining a marriage license for those members of the public who are serving active duty in the United States Armed Forces and to reduce the fee for a certificate of marriage from $15 to $10) and Ordinance 34.101.19 in relation to Vital Statistics fees. Consideration of Ordinances Council Member Doesschate on the behalf of Finance, Assessment and Taxation noticed the introduction of Ordinance 16.101.19 as follows, which was held for further consideration: Ordinance Number 16.101.19 AN ORDINANCE AUTHORIZING CERTAIN PURCHASES BY THE CITY OF ALBANY, NEW YORK AT A MAXIMUM ESTIMATED COST OF $1,350,000.00 AND AUTHORIZING THE LEASE FINANCING OR THE ISSUANCE OF $1,350,000.00 SERIAL BONDS OF SAID CITY TO PAY THE COST THEREOF The City of Albany, in Common Council convened, does hereby ordain and enact: Section 1. The objects or purposes to be authorized and financed pursuant to this ordinance are set forth below, together with estimates of the maximum estimated costs thereof; determinations of the periods of probable usefulness thereof and the subparagraphs of Section 11.00(a) of the New York Local Finance Law pursuant to which it is determined; the maximum amount of the bonds to be issued with respect to such object or purpose and the maximum term of the obligations to be issued with respect to each project or purpose. Object or Purpose: Fire Apparatus Local Finance Law Section 11.00(a) Subparagraph 27 Period of Probable Usefulness: 20 years Maximum Term of Obligations: 20 years Maximum Estimated Cost: $1,350,000.00 Maximum Amount of Bonds: $1,350,000.00 Comptroller's Bond Authorization Numbers: A-20 Comptroller's Project Numbers: GH.3410.9001 Section 2. The plan of financing such objects or purposes is the lease financing of or the issuance of $1,350,000.00 serial bonds hereby authorized to be issued. Section 3. It is hereby ordered and directed that the projects specified above be undertaken and the amounts set forth as the maximum estimated costs are hereby appropriated therefor. The Board of Contract and Supply is hereby authorized to take such necessary and further steps to carry out the provisions of this section. Section 4. Pending the sale of the bonds herein authorized, the temporary use of funds from the City's general fund, pursuant to the provisions of section 165.10 of the New York Local Finance Law, is hereby authorized. The City reasonably expects to reimburse such temporary expenditures with the proceeds of the bonds or bond anticipation notes authorized by section 1 of this ordinance. This ordinance shall constitute the City's "official intent" to reimburse such temporary expenditures in accordance with United States Treasury Regulation section 1.150-2. Section 5. The faith and credit of the City of Albany, New York are hereby irrevocably pledged for the payment of the principal of and interest on such leases or bonds as the same respectively become due and payable. An annual appropriation shall be made in each year sufficient to pay the principal of and interest on such leases or bonds becoming due and payable in such year and such debt service payments may be made in substantially level or declining amounts as may be authorized by law. There shall annually be levied on all taxable real property of said City, a tax sufficient to pay the principal of and interest on such leases or bonds as the same become due and payable. Section 6. Subject to the provisions of the New York Local Finance Law, the power to authorize the issuance of and to sell bond anticipation notes in anticipation of the issuance and sale of the serial bonds herein authorized, including renewals of such notes, is hereby delegated in the City comptroller, as chief fiscal officer of the City of Albany. Such notes shall be of such terms, form and contents, and shall be sold in such manner, as may be prescribed by said City Comptroller, consistent with the provisions of Local Finance Law. Section 7. The City Comptroller is further authorized to take such actions and execute such documents as may be necessary to ensure the continued status of the interest on the leases or bonds authorized by this resolution and any notes issued in anticipation thereof, as excludable from federal income taxation pursuant to Section 103 of the Internal Revenue Code of 1986, as amended (the "Code") and to designate the bonds authorized by this resolution, and any notes issued in anticipation thereof as "qualified tax-exempt bonds" in accordance with Section 265(b)(3)(B)(i) of the Code. Section 8. The City Comptroller is further authorized to enter into a continuing disclosure agreement with the initial issuer of the leases or the purchaser of the bonds or notes authorized by this resolution, containing provisions which are satisfactory to such purchaser in compliance with the provisions of Rule 15c12-12, promulgated by the Securities and Exchange Commission pursuant to the Securities and Exchange Act of 1934. Section 9. The validity of such leases or bonds and bond anticipation notes may be contested only if: (a) Such obligations are authorized for an object or purpose for which said City is not authorized to expend money, or (b) The provisions of law which should be complied with at the date of publication of this ordinance pursuant to Section 8 hereof are not substantially complied with, and an action, suit or proceeding contesting such validity is commenced within twenty days after the date of such publications, or (c) Such obligations are authorized in violation of the provisions of the Constitution. Section 10. Upon this ordinance taking effect, the Clerk of the Common Council is hereby authorized and directed to publish the same together with a notice in substantially the form set forth in section 81.00 of the New York Local Finance Law.  Section 11. It is hereby determined that except as hereinafter specified, the authority and funding of the projects aforesaid constitute either unlisted of Type II actions under the New York State Environmental Quality Review Act and the regulations promulgated thereunder having no adverse effect upon the environment. Section 12. This ordinance shall be dated February 5 and shall take effect immediately upon passage. The Code of the City of Albany is amended by adding a new Chapter 183 entitled: “Equity Agenda” to read as follows: Chapter 183 – Equity Agenda 183-1. Legislative Intent Equity is a cornerstone of a thriving democracy and must be embedded in the internal and external actions of local government that contribute to the health and well-being of everyone in our City. Racial and social disparities persist across key indicators of success in Albany, including education, economic development, health, housing, jobs, criminal justice, the built environment, service equity and arts and culture. The Mayor’s office established an Equity Agenda Advisory Committee in 2014 to advise the Administration on executing an equity agenda. The goal of this equity agenda is to focus on achieving equity across all communities and ending the injustices caused by institutional and systemic racism and discrimination. The Common Council of the City of Albany seeks to more actively oversee and assist City Departments, as they utilize available tools and resources to end inequities across key indicators of success. Equitable budgeting is a “funding shift” to focus on those neighborhoods with the greatest needs. 183-2. Equitable Budgeting 1. Built Environment Enhancements A. The City rates streets on a scale of one to ten. A rating of three or lower indicates a need for repair or replacement. The City shall seek to achieve parity among all Wards in the proportion of street ratings of 3 or higher. The City of Albany Department of General Services and Division of Engineering will provide the Common Council with a Ward map identifying the rating of each street at the time that it submits to the Common Council its annual proposed list of street and sidewalk reconstructions/enhancements. This map will break down street conditions by percentage within each Ward. Wards with a disproportionate percentage of streets rated three or lower will be prioritized. The Department of General Services and Division of Engineering will also be required to keep an electronic record of requests made for the enhancement of existing streets and sidewalks and the installment of new sidewalks and walking paths. An update on these requests will be included in the report. B. Investment in parks must be based on equity which is measured based on data retrieved from a city-wide parks assets map. The Departments of Recreation, General Services and Water will develop a city-wide asset map that includes, at a minimum: the location and name of each City-owned Park; the size of each park; the recreation equipment (including splash pads) in each park including the age of the equipment, the designed age range for children using the equipment, and the ADA access to such equipment; the number and condition of any court services; the existence and condition of any restroom facilities and water fountains; the existence and condition of benches, picnic tables, chess tables and other such surfaces; the overall condition of the grounds (including hardscape) of the park. The Department of Parks and Recreation, in conjunction with the Department of General Services and Water Department will provide the Common Council with a detailed asset map by September 1st of each year. C. The City of Albany Planning Department will conduct an annual assessment of lighting to ensure streets, alleyways and parks are adequately illuminated. D. The City of Albany Department of General Services will assess if trash receptacles are evenly distributed throughout wards in commercial zones and placed in areas of high activity. E. Any proposed qualified capital improvements (other than capital projects required at the City of Albany Landfill) will be accompanied with the name of previous capital projects completed by ward in a four year period. The selection of wards for capital projects must take into account the need for built environment enhancements, and the time period of the last capital project proposed or completed in the ward. Wards that have received zero or a limited number of capital project funds must be prioritized. The list will be submitted to the Albany Common Council annually. Exceptions will be made for State and Federal mandated orders. 1. Violence Prevention A. The Albany Common Council’s Public Safety committee will establish a Violence Prevention Task Force. The Violence Prevention Task Force will be responsible for convening stakeholders every fall to develop action items in preparation for the upcoming summer in anticipation of an uptick in violence. This Task Force will be composed of members of the Albany Common Council’s Public Safety Committee, community members from wards disproportionately impacted by violence, at least one youth representative, representatives from the Albany Police Department, the Mayor’s office, the Albany City School District, clergy and members from violence prevention-related organizations. B. Funding will be allocated annually to violence prevention programming and initiatives in Wards with the highest incidence and prevalence of violence. The funds will be allocated based on prioritization through a community participatory budgeting process with involvement from the Violence Prevention Task Force. A separate budget line within the City of Albany’s annual budget will be created and titled violence prevention task force funding. 1. Community Programming While the office of Housing and Urban Development requires that all Community Block Grant Funding be allocated to high needs communities, the Albany Community Development Agency will take special care to ensure that CDBG funds be prioritized for organizations that serve communities historically disadvantaged due to racism and discrimination including African Americans, Latinos and Native Americans. 183-3. Measuring and Monitoring the Campaign for Equity. The Department of Administrative Services and the Office of the Mayor will be responsible for monitoring, advising and evaluating the City’s Equity Agenda in the following manner: A. The Human Rights Commission will be responsible for reviewing, enhancing and providing recommendations on the City of Albany’s Equity Agenda. Recommendations will be submitted to the Office of the Mayor. The Equity Agenda should include policy recommendations for city-wide initiatives and policies to ensure equitable growth among key indicators of success: education, economic development, health, housing, jobs, criminal justice, the built environment, service equity, and arts and culture. B. The Office of the Mayor and the Department of Administrative Service will develop and implement a communications strategy to promote summer jobs, job fairs, workforce development training centers and information about Civil Service testing to residents. The communications strategy will be submitted to the Human Rights Commission for enhancements and recommendations. The communications strategy will be implemented city-wide with an emphasis on communities with the following characteristics, minority majority wards, low- income and disproportionate crime rates and vacant buildings. C. The Human Rights Commission will implement an annual dialogue on race, equity and inclusion for the City of Albany Community. The forum will be funded as part of the Mayor’s Rotunda Evening Series. Funds for this initiative will be made available through an administrative contractual expenditure line in the City’s annual budget. D. The City of Albany Commission on Human Rights, in partnership with the City of Albany’s Department of Administrative Service, will track outcomes over time and publish a report on an annual basis on the City’s progress towards achieving equity. The City will measure the collective actions and policies in the following equity areas: built environment enhancements; violence prevention, workforce training employment; and education. A report will be delivered to the Council on an annual basis no later than September 21st. § 183-4 Employee Racial Equity Training. The Department of Administrative Services will ensure that all City employees receive annual training on racial equity, diversity and inclusion. Section 2. Resolution Number 68.101.19R (MC) RESOLUTION OF THE COMMON COUNCIL HONORING DEBORAH SCHRAMEK FOR HER WORK IN THE HELDERBERG NEIGHBORHOOD WHEREAS, the City of Albany is a mix of vibrant neighborhoods and people, including individuals who make extraordinary efforts to build community in their neighborhood; and WHEREAS, Deborah Schramek, was one such individual who cared deeply about her neighborhood and worked tirelessly to improve the quality of life of her neighbors; and WHEREAS, Deborah was a volunteer in the Helderberg Neighborhood Association over many years; and WHEREAS, Deborah spent hours every month producing the neighborhood newsletter, writing and coordinating articles, working with monthly deadlines, then putting it all together to be printed and then delivered; and WHEREAS, Deborah organized the system for delivery by neighbors and the result of her efforts was for neighbors to receive a newsy, neighborly newsletter at their doors, once a month for many years on end; and WHEREAS, the Helderberg Neighborhood Association has always had great leaders who have given of their time and talent though sometimes there were gaps in leadership and Deborah would fill in and lead; and WHEREAS, Deborah also produced a newsletter for the Honest Weight Food Cooperative for many years; and WHEREAS, Deborah was just as generous on her Grove Avenue block with her time and kindnesses, such as, when an increasingly frail, older neighbor needed a hand, she and husband Daniel were there to help for months on end; and WHEREAS, Deborah formed her block's Backyard Wednesdays tradition in an effort to bring neighbors together in the summertime to socialize; and WHEREAS, Deborah's numerous accomplishments included her long career as Assistant Director at the Albany County Crime Victims & Sexual Violence Center; and WHEREAS, Deborah was devoted to her husband, Daniel Gonsiewski, daughters Sara and Katherine, precious grandchildren and her entire family; and WHEREAS, Deborah's accomplishments will not be forgotten and her generous spirit continues on in the good works of others;  NOW, THEREFORE, BE IT RESOLVED, the City of Albany's Common Council wishes to commend and honor the memory of Deborah Schramek for her lifelong contributions to the Albany community. Council Member Applyrs noticed the introduction of Resolution 69.101.19 (MC) as follows, which was held for further consideration: RESOLUTION NUMBER 69.101.19R (MC) A RESOLUTION OF THE CITY OF ALBANY’S COMMON COUNCIL RECOGNIZING ALBANY HOUSING AUTHORITY’S COMMITMENT TO SUPPORTING EQUITY ACROSS THE CITY BY PROVIDING AN ANNUAL EDUCATIONAL SCHOLARSHIP FOR USE TOWARDS HIGHER EDUCATION WHEREAS, racial and social disparities persist across key indicators of success in Albany, including education, economic development, health, housing, jobs, criminal justice, the built environment, service equity, and arts and culture; and WHEREAS, local government leadership in conjunction with community partnerships, can bolster the efforts being made to end inequality and bring greater equity to every corner of the community; and WHEREAS, the Albany Housing Authority has agreed to establish an annual educational scholarship in the amount of $6,000 dollars to assist students of Albany in reaching their pursuits of higher education; and WHEREAS, applicants must be a tenant/resident of a property owned, affiliated with or subsidized by the Albany Housing Authority; and WHEREAS, a recipient of the scholarship must be a senior in high school, an active full-time college student or a re-entry student pursuing technical, vocational or academic training; and WHEREAS, the scholarship will be administered by the Albany Housing Authority and will be awarded in one $3,000 dollar scholarship, one $2,000 dollar scholarship and one $1,000 scholarship; and THEREFOR, BE IT RESOLVED that the Albany Common Council wishes to thank and recognize the Albany Housing Authority for their generosity and willingness to join as a vital community partner in the Council’s quest to bring equity to all residents and neighborhoods throughout the City of Albany.
