MINUTES OF A REGULAR MEETING
MONDAY, SEPTEMBER 20, 2021
The Common Council was convened at 7:00p.m. and was called to order by President Ellis.
The roll being called, the following answered to their names: Anane, Balarin, Conti, Fahey,
Farrell, Flynn, Frederick, Hoey, Igoe, Johnson, Kimbrough, and O’Brien.
Also present was the following staff: John-Raphael Pichardo, Cashawna Burt, Brett Williams
and Mashaal Bhatti.
Council President Ellis led the Pledge of Allegiance.
PUBLIC COMMENT PERIOD
1. Theresa Zubretsky, 9 Jesse Court, Troy, NY, on behalf of Capital District Tobacco Free
Community (Spoke on Tobacco Free spaces and in support of expansion of no smoking
policies)
There being no additional speakers for public comment, President Ellis declared the Public
Comment Period closed.
APPROVAL OF MINUTES
President Pro Tem Kimbrough made a motion to approve the minutes of September 9, 2021
meetings of the Council, which was duly seconded, and APPROVED by majority voice vote.
CONSIDERATION OF LOCAL LAWS
President Pro Tem Kimbrough held all the Local Laws on the pending agenda.
REPORTS OF STANDING COMMITEES
Planning, Land Use and Economic Development Committee: Chair Fahey discussed the
upcoming committee meetings on September 27th and September 28th, 2021 where they will
discuss amendments to the USDO. She also spoke on the presentation to the council scheduled for
September 29th and noted the upcoming public hearings for the amendments scheduled for October
4th and 18th.
Finance Assessment and Taxation: Chair Farrell discussed that the committee will be meeting
on Wednesday September 22, 2021 to receive update on the City’s financial position and Federal
COVID Relief funds, as well as have brief preliminary budget discussion for 2022 fiscal year, and

discuss one Ordinance.
Law, Building and Codes: Chair Igoe reported the upcoming meeting on Thursday, September
23rd at 5:30 to discuss Local Law Q concerning noise abatement and treatment of such noises.
Public Safety: Chair Kimbrough reported the Public Safety Committee meeting will be Thursday,
September 30th to discuss Local Laws M & L
CONSIDERATION OF ORDINANCES
President Pro Tem Kimbrough moved to add Ordinance 28.92.21 (MC) to agenda by majority
consent, seconded by Council Member Anane, and passed unanimously.

AN ORDINANCE FURTHER TEMPORARILLY SUSPENDING CERTAIN
PROVISIONS OF CHAPTER 375 OF THE CODE OF THE CITY OF ALBANY IN
RELATION TO THE REGULATION OF SIDEWALK OR OUTDOOR CAFES IN
ORDER TO ALLOW CONTINUATION OF THE EXTENDED PATIO AND OUTDOOR
SEATING PROGRAM
The City of Albany, in Common Council convened, does hereby ordain and enact:
Section 1. Section 3 of Ordinance 20.71.21 (UC) is amended to read:
Section 3: This ordinance shall take effect immediately and shall be deemed to have been
in effect on and after July 7, 2021 and shall expire and be of no further force or effect on and after
October 4, 2021 January 15, 2022.
Section 2. This ordinance shall take effect immediately
President Pro Temp Kimbrough made a motion requesting Unanimous Consent to take up
Ordinance 28.92.21 (MC) (UC) for consideration on its same meeting as introduction. The
motion was second by Council Member Hoey and passed by unanimous voice vote.

CONSIDERATION OF RESOLUTIONS
Council Member Frederick noticed for introduction resolution number 75.92.21R and asked for
its passage on a roll call vote thereon:

A RESOLUTION OF THE COMMON COUNCIL RECOGNIZING HISPANIC
HERITAGE MONTH AND CELEBRATING THE HERITAGE AND CULTURE OF
LATINOS IN THE UNITED STATES AND THE IMMENSE CONTRIBUTIONS OF
LATINOS TO THE UNITED STATES
WHEREAS, from September 15, 2021 through October 15, 2021, the United States
celebrates Hispanic Heritage Month; and

WHEREAS, National Hispanic Heritage Month begins on September 15 because it
coincides with the national independence days for many Latin American countries, including
Guatemala, El Salvador, Honduras, Nicaragua, and Costa Rica. Mexico's national independence
day follows on the 16th, while Chile's occurs on the 18th, and Belize's is on the 21st; and
WHEREAS, the 2021 Theme is “Esperanza: A Celebration of Hispanic Heritage and
Hope”; and
WHEREAS, as of the 2020 Census, the Bureau of the Census stated that the Hispanic or
Latino population living in the United States is 62.1 million people, comprising of 18.7 percent of
the total population of the United States, up from 50.5 million in the 2010 census; and
WHEREAS, the number of states with a population of 1 million or more Hispanic
residents in 2019 are Arizona, California, Florida, Georgia, Illinois, New Jersey, New Mexico,
New York, North Carolina, Pennsylvania, and Texas; and
WHEREAS, the Latino population in the United States is projected to grow to
107,000,000 people by 2065, at which point the Latino population will comprise more than 24
percent of the total population of the United States; and
WHEREAS, the Latino population in the United States is currently the third largest
population of Latinos worldwide, exceeding the size of the population in every Latin American
and Caribbean country except Mexico and Brazil; and
WHEREAS, each year approximately 800,000 Latino citizens reach 18 years of age and
become eligible to vote, a number that could grow to 1,000,000 per year, potentially adding
18,000,000 new Latino voters by 2032; and
WHEREAS, in 2018, the annual purchasing power of Hispanic Americans was an
estimated $1,700,000,000,000, which is an amount greater than the economy of all except 17
countries in the world; and
WHEREAS, there are more than 4,370,000 Hispanic-owned firms in the United States,
supporting millions of employees nationwide and contributing more than $1,700,000,000 in
revenue to the economy of the United States; and
WHEREAS, Hispanic-owned businesses represent the fastest growing segment of small
businesses in the United States, with Latino-owned businesses growing at more than 15 times the
national rate; and
WHEREAS, Hispanic Americans harbor a deep commitment to family and community,
an enduring work ethic, and a perseverance to succeed and contribute to society;
NOW THEREFORE, BE IT RESOLVED, that the Common Council of the City of
Albany hereby recognizes the celebration of Hispanic Heritage Month from September 15, 2021,
through October 15, 2021 and esteems the integral role of Latinos and the manifold heritages of
Latinos in the economy, culture, and identity of the United States; and

BE IT FURTHER RESOLVED, that the Common Council urges the people of the City
of Albany to observe Hispanic Heritage Month with appropriate programs and activities that
celebrate the contributions of Latinos to the United States.
