MINUTES OF CAUCUS
Wednesday, August 14th, 2024
The Common Council was convened at 5:34 PM in the Council Chambers on the Second Floor
of City Hall, 24 Eagle Street, and was called to order by President Pro Temp Kimbrough. It
livestreamed on YouTube and Facebook.
Members Present: Clarke, Farrell, Flynn, Hoey, Kimbrough, Love, Zamer

Services), Sam Wells (Neighborhood Stabilization Coordinator), Brett Williams (Senior
Assistant Corporation Counsel), Jake Eisland (Research Counsel), Bryan Jimenez (Senior
Legislative Aide), Ramesha Hill (Violence Prevention Coordinator)
Discussion/Questions:
President Pro Tempore Kimbrough discussed the August 14, 2024 regular meeting
agenda.
Sam Wells presented on progress made on the vacancy study.
Council Member Zamer asked if there is a timeline for how long a state of emergency
might last to which Wells responded that it is not clear how long. Council Member Zamer
also confirmed with Wells that new construction would not affect the study's vacancy
rate.
Council Member Adams asked if there is any indication as to the current vacancy rate, to
which Wells responded that the department is not prepared to review a rate at this point
without validating all of the received information first.
Council Member Hoey asked if the Hudson Valley Property Owners Association will file
a lawsuit against the City of Albany if it declares a housing emergency. Wells and
Andrews responded that they are unable to predict if the City of Albany will be sued, but
noted that there is litigation against other municipalities that have conducted vacancy
studies. Wells noted that the department has also received two FOIL requests for the
study information.
Council Member Keegan asked how a vacancy rate could be established if data must be
accepted until the moment when the Common Council would consider declaring an
emergency to which Wells responded that he is unaware of the specifics.
Council Member Flynn asked if the $20 fee applied to other municipalities, to which
Andrews responded that State law prescribes the fee.
Majority Leader Farrell thanked Andrews and the department for taking on the vacancy
study. Majority Leader Farrell continued:
o Asked if the longer review and validation timeline would impact the results to
which Wells responded that the City is currently on a similar timeline compared
to other municipalities and that a thorough review could potentially help the City
as the results would be less disputable.
Wells noted that they may need to also review county records among other
resources before making a determination as to whether there were
substantial renovations or not.
Wells also noted that there needed to be additional follow-up regarding
subsidies being received by property owners.
Andrews offered that the City of Albany has a larger number of potential
buildings to collect and review information than other municipalities.
o Noted that the idea of finalizing the vacancy study prior to the end of the
university school season was to ensure that vacancy information would include
the occupancy of students to which Andrews and Wells responded that the
questions asked were based on active leases and not physical presence.
o Asked if a covered property not having active leases in particular units would
impact the study to which Wells responded.
o Asked a question regarding information verification to which Wells responded
that while site visits have not been conducted yet, they anticipate conducting
some. Wells also noted that other municipalities have not had issues with property
owners intentionally falsifying information but that the City is able to levy fines
for intentional falsification.
o Asked about the additional data being collected to which Wells responded.
Candidates for the Violence Prevention Task Force were invited up to speak.
There being no further business, President Pro Temp Kimbrough adjourned the meeting at 6:36
PM.
