MINUTES OF CAUCUS Monday, December 11, 2024 The Common Council was convened at 6:58 PM in the Council Chambers on the Second Floor of City Hall, 24 Eagle Street, and was called to order by President Pro Tempore Kimbrough. It livestreamed on YouTube and Facebook. Members Present: Adams, Anane, Balarin, Farrell, Hoey, Johnson, Romero, and Zamer Also Present: Council President Ellis Staff Present: Brendan Cox (Interim Police Chief), Darius Shahinfar (Treasurer), Brett Williams (Senior Assistant Corporation Counsel), Demetria L Brown (Deputy City Clerk), Jake Eisland (Research Counsel), Bryan Jimenez (Legislative Director), Martin Daley (Director of Infrastructure Management), Alyssa Kamara (Junior Policy Analyst) Discussion/Questions:  Majority Leader Ginnie Farrell acknowledged present Council Members and asked Interim Police Chief Brendan Cox to introduce himself and his work to the Common Council.  Interim Police Chief Cox proceeded to discuss his work history, perspectives on public safety, his goals for his time as interim chief, and his aspirations for the department’s future.  Majority Leader Farrell thanked the Interim Chief and noted the entrance of additional Common Council members, achieving quorum.  Council Member Hoey expressed concern about departmental staffing, offered his and the Council’s partnership, and asked about Interim Chief Cox’s goals to fill staffing vacancies.  In response, Interim Chief Cox discussed vacancies in the telecommunications department and the residency requirement’s barrier to new employment.  Council President Ellis asked if police officers are covered under the residency requirement to which Interim Chief Cox clarified he was referring to dispatchers.  Council President Ellis asked about previously passed legislation and inquired about Interim Chief Cox’s plans to actualize its contents. Council President Ellis proceeded to offer solutions to officer vacancies.  Interim Chief Cox empathized with Council President Ellis’ suggestions, noting the importance of social work. He expressed aspirations to integrate social workers in policing, discussed the possibility of having “quality of life” officers, and discussed alternative avenues for reporting.  Majority Leader Farrell noted that under New York State law, the police department would not be able to directly hire social workers.  Council President Ellis responded by asking why the budget includes lines for hiring social workers in the police department if New York State law prohibits them from being hired.  Majority Leader Farrell explained that the addition may have been a misstep, but noted that social workers could be contracted through the department.  Council Member Anane shared support for previous initiatives within his ward and asked Interim Chief Cox if the challenges of maintaining public safety has changed since he last served the city.  Interim Chief Cox shared that challenges have changed, discussing challenges presented by staffing vacancies and its impact on his staff.  Council Member Anane expressed the immigrant community’s apprehension due to the president-elect and asked how the interim chief will be able to maintain Albany’s sanctuary city status and ensure their feeling of security.  Interim Chief Cox responded that the Albany Police Department has a good relationship with the immigrant community that he hopes to maintain.  Council Member Anane asked about morale within the police department.  Interim Chief Cox expressed his support for the work conducted by the previous chief, then proceeded to emphasize the importance of allowing officers time to rest.  Council Member Anane asked how long Interim Chief Cox planned to serve in the position to which Interim Chief Cox expressed that he agreed to remain to staff the transition.  Council Member Balarin expressed his gratitude and excitement for Chief Cox’s service. He then asked about best practices Cox may have noted while working with LEAD and if they could be integrated into the City of Albany.  Interim Chief Cox discussed best practices with integrating social workers, service providers, and housing support into policing.  Council Member Johnson welcomed the Interim Chief back, expressing the importance of local leadership.  Majority Leader Farrell thanked Chief Cox for his service to the community and attendance at the meeting.  Majority Leader Farrell acknowledged present city staff members.  Majority Leader Farrell discussed the Monday, December 16th regular meeting agenda. o Majority Leader Farrell noted Local Law F of 2024 was passed out of committee with recommendations for amendments. o Majority Leader Farrell noted plans to override the Mayor’s budgetary vetoes, noting the mayor’s inaccurate veto memo regarding a second vacancy study. Majority Leader Farrell then asked the body their reactions. o Council Member Johnson expressed his confusion about the police department being unable to hire social workers despite what had been previously mentioned within the body; he expressed that he felt similarly frustrated with the budget line in the veto override possibly not being used for a 2025 vacancy study, as he supported a study redo. o Council Member Adams recounted his perspectives on why the funding should not be used to redo the Vacancy Study in 2025 and advocated for the funding to be more directly applied to impact housing issues in the city, noting different initiatives the funding could support. o Council Member Hoey asked about the typical procedure surrounding veto overrides to which Research Counsel Eisland explained that the override must happen before December 20th, emphasizing that the vote requires 2/3rds of the body to vote affirmatively to pass. o Majority Leader Farrell reminded council members that the $125,000’s allocation would need to be voted on in the future. o Council Member Balarin expressed his support for a second vacancy study, discussed the importance of reviewing all housing concerns, and shared his openness to consider alternative approaches to lessening the housing crisis. He urged the Council to not vote against the veto override due to their support of a 20205 Vacancy Study as it will prevent access to resources that could assist the community. o Council Member Anane reemphasized Council Member Balarin’s points. He revoked his support for a 2025 Vacancy Study and demonstrated his belief that the council had the ability to address the housing crisis through other means. o Council Member Zamer expressed her support for both the compromise and the original Vacancy Study produced by the Department of Neighborhood Services. She reemphasized that existing line is not for a new vacancy study, noted the importance of transparency, and discussed that the funding could be strengthened through collaboration with the Albany County Legislature. o Council Member Romero expressed her support for the veto override. o Majority Leader Farrell noted that the veto override vote will occur at the December 16th meeting.  Majority Leader Farrell continued reviewing the agenda for the December 16th regular meeting. o Majority Leader Farrell reviewed Resolution 137.122.24R (Johnson).  Senior Assistant Corporation Counsel Brett Williams began discussing Local Law F of 2024 to which Majority Leader Farrell noted that the Council was reviewing Resolution 137.122.24R.  Senior Assistant Corporation Counsel Williams discussed the financial structure related to Resolution 137.122.24R.  Majority Leader Farrell asked Senior Assistant Corporation Counsel Williams about the passage timeline for the resolution to which Senior Assistant Corporation Counsel Williams expressed that it could be moved on the December 16th meeting.  Council Member Johnson noted that Senior Assistant Corporation Counsel Williams had previously told him that the resolution was on an expedited timeline as it had to be referred to the Albany County Planning Board.  Legislative Director Jimenez noted that the expedited timeline may have been referring to legislation related to Trinity Place to which Senior Assistant Corporation Counsel Williams and Research Counsel Eisland concurred.  Council Member Johnson expressed the importance of Resolution 137.122.24R, sharing that he had met with constituents that had hoped it would move quickly.  Senior Assistant Corporation Counsel Williams noted that he had communicated that the resolution would be going through committee to which Majority Leader Farrell concurred and noted that it could be drawn from committee if it is urgent.  Research Counsel Eisland shared procedural recommendations.  Majority Leader Farrell affirmed that Resolution 137.122.24R would be referred to the Finance, Assessment and Taxation committee. o Majority Leader Farrell reviewed Council Member Romero’s request to pass Bond Ordinance 62.102.24 (Frederick) by Majority Consent.  Council Member Romero discussed Bond Ordinance 62.102.24, sharing that the Washington Park playground is tied to state funding that requires the bond’s passage before the end of the year. For that reason, she shared the need to pull the bond ordinance from the Finance Committee to pass at the December 16th Regular Meeting.  Majority Leader Farrell expressed concerns about discharging the bond ordinance from committee as it was tied to other projects that the committee had further questions. She inquired if the Washington Park portion of the bond be passed at the upcoming regular meeting.  Research Counsel Eisland clarified if Majority Leader Farrell was asking to create a new ordinance by unanimous consent to be passed.  Majority Leader Farrell explained that the bonds were being passed at their regular pace, that there were further questions regarding other projects included in the bond ordinance, and for that reason she is not comfortable passing Bond Ordinance 62.102.24 in its entirety.  Senior Assistant Corporation Counsel Williams noted that Director of Infrastructure Management Martin Daley could correct him if he was incorrect but the bond does not necessarily need to be passed by the end of the year.  Majority Leader Farrell noted her confusion as regardless of passage, the bond would ultimately go out in January with the rest of the bonds.  Council Member Romero reiterated that it was her understanding that the bond had to be passed by the end of the year.  Majority Leader Farrell explained that the city “goes out” with their bonds at the same time so sending this one out before the end of the year is not possible.  Senior Assistant Corporation Counsel Williams explained that procedurally, the council could pass a broken out bond at the upcoming meeting.  Director Daley provided an overview of the project’s grants, explaining that the grant provided by Assembly Member Fahy’s office that is administered through the Dormitory Authority of the State of New York (DASNY). He shared that DASNY must see evidence that the project has secured it’s financing. Despite not wanting to delay the project, he did share that there is nothing that statutorily states that the bond must be passed by January. He expressed that regardless, this project needed to be moved forward as soon as possible.  Council Member Romero shared that she does not want to reintroduce the funding when she enters the assembly as Assembly Member Fahy has already introduced the funding.  Majority Leader Farrell reiterated that DASNY is not looking for a bond ordinance passed by the Common Council, they are seeking the bond that will not be done until January.  Council President Ellis asked if passing the bond ordinance would be enough as it would indicate to DASNY that the funding is secured despite the bonds not going out until January.  Majority Leader Farrell noted that she believes DASNY is seeking the actual bond that will be going out in January to which Director Daley agreed.  Council Member Anane reminded the Common Council of his role as Chair of the Parks and Recreation Committee, sharing his collaboration with Mayor Sheehan to improve parks across the city. He emphasized that he sees no harm in trying to pass the bond, especially as the Washington Park project could be separated, as there were too many unknowns surrounding the funding.  Majority Leader Farrell shared that she has no problem passing the legislation to ease others’ worries, expressed her desire to separate the Washington Park Playground project funding from the rest of the bond for procedural reasons, and noted that despite passing the legislation the bond will not be actually done. Majority Leader Farrell then complimented the work done for the playground project by Director Daley and Sarah Reed.  Council Member Balarin asked a procedural question to which Majority Leader Farrell, Research Counsel Eisland, and Senior Assistant Corporation Counsel Williams shared their recommendations.  Council Member Romero shared that the information that she was provided indicated that passing the bond ordinance was time sensitive, but she would re-review. She also noted worries about attaining unanimous consent and noted that the Council may have to seek different options for passage.  Council Member Balarin shared that he supports passing the bond ordinance as he would like to avoid the risk of losing funding and would like to allow Assembly Member Fahy to close out her involvement in the project. o Legislative Direction Jimenez noted that Resolution 137.122.24R went through the County Planning Board and had a scheduled public hearing on December 16th. Therefore, the resolution could be moved to the active calendar to be voted on at the December 16th Regular Meeting.  Majority Leader Farrell asked Council Member Johnson if he would like the resolution to be voted on to which he agreed.  Majority Leader Farrell continued reviewing the Agenda for the December 16th regular meeting.
