Wednesday, April 30, 2025
The Common Council was convened at 5:35 PM in the Council Chambers on the Second Floor of City Hall, 24
Eagle Street, and was called to order by President Pro Tempore Kimbrough. It was livestreamed on YouTube
and Facebook.
Members Present: Kimbrough, Farrell, Balarin, Conti, Flynn, Hoey, Keegan, Love, & Robinson
Also Present: Mayor Kathy Sheehan

Discussion:
Mayor Kathy Sheehan discussed the current status and future plans for the Rapp Road Landfill, inviting
questions from Council Members.
o Council Member Sonia Frederick asked about the difference in cost between the external
proposals and the City’s expected costs for constructing a transfer station. Mayor Sheehan
explained that she believed the City could construct the transfer station for less money, detailing
the uncertainties that made the external responses unattractive, such as the estimated cost per ton
for disposal.
o Majority Leader Farrell sought clarification on what she meant by recycling, to which the Mayor
described the extent of the capacity of the transfer station for recycling.
o Majority Leader Farrell discussed the possibility of additional revenue for the City through
recycling. She proceeded to ask about other municipalities that currently use the City’s landfill
and who may use the transfer station. Mayor Sheehan stated that she would share a list of
potential municipalities.
o Majority Leader Farrell asked about the transfer station’s capacity for commercial composting.
Mayor Sheehan noted that she had investigated the Town of Bethlehem’s composting facility
and is exploring if the City’s current composting facility could be expanded to facilitate food
waste composting.
o Council Member Jahmel Robinson asked if there was a plan for the long-term use of the landfill
site, particularly to create revenue. Mayor Sheehan said there are existing requirements
precluding possibilities such as solar panel use.
o Council Member Meghan Keegan asked if the projected costs for hauling have taken weight
reducing strategies into consideration. Mayor Sheehan discussed the efforts being made to
reduce waste, noting that the projections being made are based on current trends.
o Council Member Thomas Hoey discussed Albany County’s investigation of biodigester use,
asking if the Mayor would be amenable to partnering with them. Mayor Sheehan shared that she
was unfamiliar, but even with additional technology they will likely still need a transfer station.
She proceeded to discuss the financial feasibility of the transfer station and the current
status of the project, noting that she is not seeking the Common Council to take action on
the issue at this time.
o Council Member Hoey asked about the location of the transfer station, to which Mayor Sheehan
discussed it being located at the landfill. She discussed different options, touching on cost and
environmental justice concerns.
o Council Member Richard Conti asked if there is any action the Council may need to anticipate
undertaking this year, to which Mayor Sheehan explained that they will likely not need a
bonding ordinance until after the Fiscal Year 2026 budget.
Council Member Conti reiterated his question, to which Mayor Sheehan confirmed. She
noted that next year, the budget may show contractual costs.
o Council Member Conti asked about the waste disposal fee, to which Mayor Sheehan discussed
the different factors that may impact its increase.
o Council Member Conti asked if the tipping fee is being impacted by state landfill approvals, to
which Mayor Sheehan explained that there is increasingly limited capacity for waste disposal in
upstate New York.
o Majority Leader Farrell noted the closing landfills of in the region, to which Mayor Sheehan
discussed different waste management options, concluding that they are seeking the most cost-
effective option.
President Pro Tempore Kimbrough reviewed the May 5, 2025 agenda, noting that all members will be
co-prime sponsors on Resolution 30.51.25R (Adams), Resolution 32.51.25R (Keegan), Resolution
34.51.25R (Zamer), 35.51.25R (Flynn), 36.51.25R (Adams), and 37.51.25R (Keegan).
o Council Member Jack Flynn discussed discharging Ordinance 17.53.24 (Flynn) from the
Planning, Economic Development and Land Use Committee for a Council vote on May 5th.
Council Member Conti asked about the amendment noted on the agenda, to which
Legislative Director Bryan Jimenez explained that the title will be changed.
Council Member Conti asked about the legislation’s effective date, to which Council
Member Flynn explained.
Council Member Conti discussed the logistics of Ordinance 17.53.24 (Flynn) being
discharged, sharing his concern about the precedent it could set.
President Pro Tempore Kimbrough clarified the sponsors’ purpose for discharging
Ordinance 17.53.24 (Flynn) from committee.
Majority Leader Farrell expressed the importance of including Members who represent
the most impacted wards in legislative discussions. She proceeded to share her support
for reforming the Cabaret licensing process, noting that she would vote “no” on the
discharge of Ordinance 17.53.24 (Flynn).
Council Member Sergio Adams discussed the progress on the legislation thus far,
explaining the purpose of discharging the legislation from committee.
President Pro Tempore Kimbrough asked Council Members Adams if they had met to
discuss Council Member Conti’s proposed changes. Council Member Adams explained
that they have reviewed his proposed changes, noting the fundamental differences in their
opinions on this issue.
Council Member Balarin described the work the Planning, Economic Development and
Land Use committee had undertaken to date to support the Cabaret License reform. He
emphasized his preference for the legislation to go through his committee.
Council Member Conti further discussed his concerns regarding discharging the
legislation from committee.
Council Member Flynn shared that if there could be a committee meeting scheduled
within the next two weeks, the sponsors would be amenable to not discharging Ordinance
17.53.24 (Flynn).
Council Member Balarin noted that the meeting may not be within the next two weeks
due to scheduling conflicts, but he assured Council Members Adams and Flynn that
Ordinance 17.53.24 (Flynn) would be the sole agenda item.
Council Member Conti asked when his legislation would be considered, to which
Council Member Balarin noted that his ordinance would be considered next.
Council Member Conti asked how his legislation could be considered next if the
Committee chose to pass Council Member Flynn’s ordinance. Council Member
Balarin noted that should the committee pass Ordinance 17.53.24 (Flynn), then it
would be a decision of the entire Council. He continued to discuss his attempts at
achieving a compromise.
Council Member Conti expressed the need to consider both ordinances
simultaneously, to which Council Member Balarin defended his process of
evaluating them separately.
Council Member Flynn noted that the sponsors would not object to both
ordinances being discussed at the same meeting.
Council Member Balarin justified his process for evaluating the ordinances,
emphasizing his desire to coordinate a compromise.
Council Member Sonia Frederick clarified the number of meetings to discuss both
ordinances, to which Council Member Balarin explained.
o Council Member Conti asked about the changes made to the honorary street dedication process
through Ordinance 26.61.24 (Kimbrough), to which President Pro Tempore Kimbrough and
Legislative Director Jimenez described the changes made.
o President Pro Tempore Kimbrough noted that despite Council Member Conti’s concerns about
Resolution 31.51.25R (Hoey), he is comfortable moving forward, to which Council Member
Hoey agreed.
o President Pro Tempore Kimbrough discussed Resolution 33.51.25R, to which Council Member
Richard Conti asked for clarification regarding the position the resolution referenced. President
Pro Tempore Kimbrough clarified that the Resolution was to hire the Program Director of the
Community Police Review Board.
Council Member Conti asked for clarification on the Program Director’s position within
the City’s structure. Legislative Director Jimenez clarified.
o Council Member Robinson discussed introducing a resolution by Majority Consent, justifying
the legislation’s urgency.
There being no further business, President Pro Tempore Kimbrough adjourned the meeting at 6:38 PM.
