DPR #0104 – Approved with Vote: 5-0-0 Conditions CONDITION #1: Prior to the issuance of building permits, fire alarm drawings and any changes to the site plan must be submitted to the Department of Fire and Fire Safety for approval of the locations of the fire command room, fire alarm panels, fire department connections, Knox Boxes, and fire apparatus access. CONDITION #2: Prior to the demolition of the existing retaining wall along the property boundary of 70 and 76 Second Avenue, drawings stamped by a licensed New York State Engineer and calculations for the proposed retaining wall along the property boundary of 70 and 76 Second Avenue must be submitted to and approved by the Division of Engineering. CONDITION #3: With the submission of the grading permit to the Division of Engineering, a letter from the property owner of 70 Second Avenue must also be submitted acknowledging that construction is to occur on their 200 HENRY JOHNSON BOULEVARD | ALBANY, NEW YORK 12210 | (518) 465-6066 Planning Board Agenda December 2020 property and that the proposed finishes are acceptable to the property owner of 70 Second Avenue. CONDITION #4: Prior to the issuance of building permits, the Applicant must receive approval from the Department of Planning and Development and Albany County Real Property Tax Service Agency for the proposed lot consolidation. CONDITION #5: Prior to the issuance of building permits, a site plan set must be submitted to the Department of Planning and Development that does not include future project phases and that has been stamped by an engineer licensed in New York State. CONDITION #6: Prior to issuance of building permits to construct “Building B”, Site Plan Sheet AA-202 must be updated to confirm that the proposed loading dock located in “Building B” will be fully enclosed. CONDITION #7: Prior to the approval of building permits, the Applicant must receive approval from the Division of Traffic Engineering. CONDITION #8: Prior to the issuance of building permits, the Applicant must receive approval from the Albany County Department of Health, City of Albany Department of Water and Water Supply, and the New York State Department of Environmental Conservation for the design and use of the proposed on-site wastewater treatment system. CONDITION #9: Prior to the issuance of any street opening permits, the decommissioning and sale of Scott Street must be approved by the Common Council and the conveyance must be finalized in a form as approved by Corporation Counsel and the deed recorded with the Albany County Clerk as required under the New York State Real Property Law. CONDITION #10: Prior to the issuance of any building or street opening permits, a performance bond for the amount of $1,158,042.00 for work proposed in the “Scott Street Decommissioning Report” submitted by The Chazen Companies dated December 1, 2020 must be executed and delivered to the City of Albany Department of Water and Water Supply and the Department of General Services, naming the same as obligees for the full amount of such bond. DR #0102, DR #0103, DR Vote: 5-0-0 #0104, DR #0105, DR #0106, DR #0107 – Approved with CONDITION #1: Prior to the issuance of building permits for demolition Conditions activities, a Fire Prevention and Fire Protection “Prefire” Plan must be submitted to the Department of Fire and Fire Safety, as required by Section 3308.3 of the International Fire Code. CONDITION #2: Prior to the issuance of building permits for demolition activities, the Applicant must receive approval from the Division of Traffic Engineering. Page 2 of 3 Planning Board Agenda December 2020 CONDITION #3: Prior to the issuance of building permits for demolition activities, the Applicant must receive approval from the Department of Water and Water Supply. CONDITION #4: During demolition activities, the Department of Fire and Fire Safety requires all fire hydrants to be accessible at all times. The Fire Code mandates a 3-foot clear radius around each hydrant and clear access from the street. CONDITION #5: Prior to the issuance of building permit applications for demolition, the Applicant must execute and deliver to the Director of Buildings a reasonable performance bond as required by §133-20 of the Albany City Code. The amount of such bond shall be fixed by the Director of Buildings and shall encompass potential liabilities that may result from the demolition site activities, including but not necessarily limited to demolition of principal and accessory structures, management of debris, cleanup, and site restoration. CONDITION #6: Prior to the issuance of building permits to demolish principal and accessory structures, the Applicant must construct screening that is 10 feet in height at time of installation along the property boundaries with 84 and 86 Second Avenue and uses a combination of fencing and vegetative screening that is permitted under Section §375-4(F)(8) of the USDO. CONDITION #7: Prior to the issuance of building permits to demolish principal and accessory structures, the Applicant must enter into an agreement with the owners of 70, 84 and 86 Second Avenue incorporating the pre-construction and post-construction assessment surveys, interim construction monitoring, and vibration monitoring program set forth in the “Protection of Adjacent Properties Plan for South End Development” submitted by The Chazen Companies dated November 3, 2020. This agreement and the results of such pre-construction assessment surveys shall be submitted to the respective property owners and the Department of Buildings & Regulatory Compliance prior to the issuance of building permits for demolition. In the event that the Applicant is unable to negotiate an agreement as required by this condition, the Applicant may request a modification of this condition from the Planning Board upon a showing of good cause. CONDITION #8: Prior to the issuance of building permits, the Applicant must submit a site plan set that has been stamped by an engineer licensed in New York State.
