Submitted by: Denice A. Gerstenberg, City Manager Summary The city attorney has requested that the City Council declare this property a nuisance per City Code Section 34-18 so that enforcement can be initiated in the St. Clair County Circuit Court. Nuisance abatements are only sent to City Council when the owner fails to comply and/or contact the city to discuss remedies. If the owner abates the nuisances prior to the City Council meeting, city staff will advise Council of such and request that the item be removed from the agenda. Upon approval of the attached Resolution, the owner has 21 days to abate the nuisances before circuit court action is filed. Extensions can be granted by the city attorney and code officer if the owner is making progress. Circuit court action is only filed when the owner fails to make progress and/or fails to communicate with the city. There have been multiple code violation investigations at this property since June 2022. Issues include dead trees, unkept yard, unregistered boats, outdoor storage of and lack of all-over property maintenance. The owner contacted the city once in June 2022, stating that this is their primary home but they are currently living in Lexington while they fix it up. The city manager can provide an update at the meeting. Attached is a Resolution for City Council approval. Suggested Action: MOVED BY: SUPPORTED BY: RESOLVED, to approve Resolution #2023-06 and declare 351 Center Street a nuisance within the bounds of Code Section 34-18 and permit the City Attorney to pursue abatement remedies in the St. Clair County Circuit Court.
