DANGEROUS BUILDINGS COMMISSION James Downey, Hearing Officer Charles Bayly Bill Hass Ed Carter Mark Thompson Joe Doan CITY OF ALGONAC 805 St. Clair River Drive Algonac, MI 48001 Minutes for Special Meeting Wednesday, January 27, 2021 at 9 a.m. This was an electronic meeting held under authority of SB 1246 due to the Coronavirus pandemic. Call to Order Hearing Officer Downey called the meeting to order at 9 a.m. Roll Call Present: Bayly, Carter, Doan, Hass, Thompson Absent: None Others: City Clerk Sam Boelke, City Blight Officer Lori Warner, City Building Official Tracy Kallek, Justin Taipalus, Theresa Dougherty Presentation – 354 Center Street Hearing officer swore in Blight Officer Lori Warner. Ms. Warner indicated that yesterday she received a copy of a purchase agreement for purchase of this property. Hearing Officer suggested we adjourn to give time for the purchase to take place with the understanding that we will bring the case back to the board if the new owner does not take timely action. Motion by Thompson; supported by Bayly to adjourn 354 Center Street from the Dangerous Buildings agenda based on the purchase agreement. Motion carried. Roll Call Ayes: Carter, Doan, Hass, Thompson, Bayly Nays: None Presentation – 478 Maple Street Hearing Officer Downey swore in Blight Officer Lori Warner and Building Official Tracy Kallek. All parties presented their perspectives. Motion by Bayly; supported by Doan to declare the property at 478 Maple Street, a dangerous structure and a public nuisance, granting the property owner 60 days (March 28, 2021) to address all outstanding blight issues. If actions are not completed by March 28, 2021, the code officer will take action to abate the violations immediately. The Board 1.27.21 DB Minutes 1 authorizes and approves the imposition of a lien against the property in the amount of the cost of the abatement incurred by the city, as permitted by applicable city ordinance. Motion carried. Roll Call Ayes: Doan, Hass, Thompson, Bayly, Carter Nays: None Presentation – 1007 St. Clair Blvd. Hearing Officer Downey swore in Blight Officer Lori Warner, Building Official Tracy Kallek and property owner Justin Taipalus. All parties presented their perspectives. Motion by Bayly; supported by Thompson to declare the property at 1007 St. Clair Blvd, a dangerous structure and a public nuisance, granting the property owner 60 days (March 28, 2021) to 1) secure all necessary permits and repair the structure or 2) secure all necessary permits and demolish the structure and 3) address all outstanding blight issues. If actions are not completed by March 28, 2021, the code officer will take action to abate the violations and demolish the structure immediately. The Board authorizes and approves the imposition of a lien against the property in the amount of the cost of the abatement incurred by the city, as permitted by applicable city ordinance.
