DANGEROUS BUILDINGS COMMISSION James Downey, Hearing Officer Charles Bayly Karl Richardson Ed Carter Mark Thompson Joe Doan CITY OF ALGONAC 805 St. Clair River Drive Algonac, MI 48001 Minutes for Special Meeting Wednesday, October 7, 2020 at 9 a.m. This is was held electronically under authority of EO 2020-154 due to the Coronavirus pandemic. Call to Order Hearing Officer Downey called the meeting to order at 9 a.m. Roll Call Present: Bayly, Carter, Doan, Thompson Absent: Richardson Others: Hearing Officer and City Attorney Jim Downey, City Clerk Sam Boelke, City Code Enforcement Officer Lori Warner, City Building Official Tracy Kallek, Julie Peters, Rich Glaz Presentation - 1309 St. Clair River Drive Hearing officer swore in Blight Officer Lori Warner and Building Official Tracy Kallek. Julie Peters represented Dr. Peleman. All parties presented their perspectives. Motion by Doan; supported by Carter to declare 1309 St. Clair River Drive, a dangerous structure and a public nuisance, granting the property owner 30 days (November 6, 2020) to address all outstanding blight issues and list the property for sale, lease, or rent with a real estate broker licensed under article 25 of the occupational code, Public Act No. 299 of 1980 (MCL339.2401et.seq). If actions are not completed by November 6, 2020, the blight enforcement officer will take action to abate the violations and demolish the building immediately. The Board authorizes and approves the imposition of a lien against the property in the amount of the cost of the abatement incurred by the city, as permitted by applicable city ordinance. Motion failed. Roll Call Ayes: Doan, Carter, Thompson Bayly Nays: None Presentation - 2204 St. Clair River Drive Hearing officer swore in Blight Officer Lori Warner, Building Official Tracy Kallek and property owner Wayne Richard Glaz. All parties presented their perspectives. Motion by Thompson; supported by Bayly to give the property owner at 2204 St. Clair River Drive 60 days (December 6, 2020) to come into compliance with all outstanding blight issues. Motion Failed. Roll Call Ayes: Thompson, Bayly Nays: Carter, Doan Motion by Doan, supported by Carter to declare 2204 a dangerous building and public nuisance and give the property owner 60 days to come into compliance with all outstanding blight issues. Motion Failed. Roll Call Ayes: Carter, Doan Nays: Thompson, Bayly Motion by Carter, supported by Doan to declare 2204 St. Clair River Drive a dangerous structure and public nuisance granting the property owner 30 days to address all outstanding blight issues or file with the building official, a binding plan of action for remedying and returning to proper condition. If not, the blight enforcement official has the authority to abate the violations and demolish the structure. Motion carried. Roll Call Ayes: Bayly, Carter, Doan Nays: Thompson Presentation – 430 Pointe Tremble Hearing officer swore in Blight Officer Lori Warner and Building Official Tracy Kallek. There were no representatives from Speedway LLC. All parties presented their perspectives. Motion by Bayly; supported by Thompson to declare 430 Pointe Tremble, a dangerous structure and a public nuisance, granting the property owner 60 days (December 6, 2020) to address all outstanding blight issues and list the property for sale, lease, or rent with a real estate broker licensed under article 25 of the occupational code, Public Act No. 299 of 1980 (MCL339.2401et.seq) or obtain the proper permits to demolish the building 10.7.2020 Dangerous Buildings Meeting Minutes 2 themselves. If actions are not completed in the 60 days, the blight enforcement officer will take action to abate the violations and demolish the building immediately. The Board authorizes and approves the imposition of a lien against the property in the amount of the cost of the abatement incurred by the city, as permitted by applicable city ordinance.
