DANGEROUS BUILDINGS COMMISSION James Downey, Hearing Officer Charles Bayly Bill Hass Ed Carter Mark Thompson Joe Doan CITY OF ALGONAC 805 St. Clair River Drive Algonac, MI 48001 FOR SPECIAL MEETING Wednesday, November 18, 2020 at 9 a.m. Minutes This was an electronic meeting held under authority of SB 1108 due to the Coronavirus pandemic. Call to Order Hearing Officer Downey called the meeting to order at 9 a.m. Roll Call Present: Bayly, Carter, Doan, Thompson Absent: Thompson Others: Hearing Officer and City Attorney Jim Downey, City Clerk Sam Boelke, City Code Enforcement Officer Lori Warner, City Building Official Tracy Kallek, Kathy Nastase, David Doss, Judy Kay McCracken, Stephanie Smith, Virginia Baumgartner. Amend Agenda Motion by Bayly; supported by Carter to amend the agenda by striking item #4 ) Presentation on 910 Columbia Street and reschedule at a later date. Motion carried. Roll Call Ayes: Carter, Doan, Bayly Nays: None Presentation – 703 Michigan Hearing officer swore in Blight Officer Lori Warner and Building Official Tracy Kallek. There were no representatives for the property owner. All parties presented their perspectives. Motion by Bayly; supported by Carter to declare 703 Michigan, a dangerous structure and a public nuisance, granting the property owner 60 days (January 18, 2021) to 1) secure all necessary permits to repair and list for sale with a licensed broker or demolish the home and 2) address all outstanding blight issues. Also, within 14 days submit a plan of action to the building department. If actions are not completed by January 18, 2021, the blight enforcement officer will take action to abate the violations and demolish the building immediately. The Board authorizes and approves the imposition of a lien against the property in the amount of the cost of the abatement incurred by the city, as permitted by applicable city ordinance. Motion carried. 11.18.20 Dangerous Buildings Minutes 1 Roll Call Ayes: Doan, Bayly, Carter Nays: None Presentation – 135 Loch Haven Street Hearing officer swore in Blight Officer Lori Warner and Building Official Tracy Kallek. There were no representatives for the property owner. Neighbor Kathy Nastase thanked Blight Officer Lori Warner for all her effort in getting this resolved. All parties presented their perspectives. Motion by Carter; supported by Doan to declare 135 Loch Haven, a dangerous structure and a public nuisance, granting the property owner 14 days to file a plan of action with the building official and 60 days (January 18, 2021) to 1) secure all necessary permits to demolish the home and 2) address all outstanding blight issues. If actions are not completed by January 18, 2021, the blight enforcement officer will take action to abate the violations and demolish the building immediately. Motion by Bayly; supported by Doan to declare 1813 St. Clair River Drive, a dangerous structure and a public nuisance, granting the property owner 14 days to submit a plan of action with the building official and 45 days (January 4, 2021) to 1) secure all necessary permits to repair and list for sale with a licensed broker or to demolish the home and 2) address all outstanding blight issues. If actions are not completed by January 4 2021, the blight enforcement officer will take action to abate the violations and demolish the building immediately. The Board authorizes and approves the imposition of a lien against the property in the amount of the cost of the abatement incurred by the city, as permitted by applicable city ordinance. Motion carried.
