The property is located at 1101 Cornwall Ave, Amery, WI 54001 PID 201-00776-2000. The current business operating on the property is operating as a nonconforming use. The owner would like to build two new structures on the property to expand operations and cannot do so on a nonconforming property. The use and lot conform with the I-1 Light Industrial district. This property has other Light Industrial properties located near it, so it is not spot zoning. A public hearing will be held at the August 5th Council meeting per City code. Fiscal Impact: There would be no cost to the City for this Rezoning. The current business operating on the property would like to build a 32’x18’ lean-to building directly behind the existing building and a 64’x40’ shed in the rear parking lot of the property. If the property is rezoned to I-1 at the August 5th Council meeting, these buildings will be allowable in the district since accessory buildings in the I-1 District can be used for uses that are normally auxiliary to the principal use. These buildings will be an extension of the existing business. This district does not have any setbacks or size restrictions. Fiscal Impact: There would be no cost to the City for this Zoning Permit. Also, City of Amery Website: www.amerywi.gov. 1 Memo To: The City of Amery Planning Commission From: Claire Stickler, MSA Professional Services Subject: Accessory Structure Discussion for Zoning Code Update Date: July 16th , 2026 The City has expressed specifically discussing the accessory structure provisions of the Zoning Ordinance to provide additional flexibility for residential property owners while maintaining reasonable development standards. The current ordinance allows a residential lot to contain a garage and one additional accessory building. In addition, residential district regulations currently limit private garages to a maximum of three stalls. Following our discussions at the June Planning Commission meeting, we have the following draft recommendation. Proposed Amendments 1. Remove Garage Stall Limitation The current residential district regulations permit one private garage with not more than three stalls per residential parcel. The City has indicated a desire to remove this limitation. The proposed amendment would eliminate the three-stall restriction and instead regulate garages through existing dimensional standards, setbacks, lot coverage limitations, and building permit review processes. 1. Establish Carports as a Permitted Accessory Structure The current ordinance does not specifically address carports. The amendment would recognize attached and detached carports as permitted accessory structures in residential districts. A definition should be added to clarify what constitutes a carport. Suggested Definition: 1 "Carport: A roofed structure permanently affixed to the ground and open on not less than two sides, intended for the parking or storage of motor vehicles." Recommended Amendment to § 450-100(B)(1) Replace the existing accessory building number limits with the following: "In any residential district, in addition to the principal building, any number of accessory structures may be permitted on a lot provided that:" a. All accessory structures comply with the setback requirements of the zoning districts. b. All accessory structures comply with the maximum permitted height. c. The combined footprint of all principal and accessory structures does not exceed the maximum lot coverage permitted within the zoning district. d. As part of the zoning code rewrite, staff has prepared a draft use table to replace the City's current district use lists. The proposed table consolidates and modernizes the existing ordinance by organizing uses into clear categories while maintaining a level of specificity that provides certainty for applicants, property owners, and staff. Rather than relying on outdated Standard Industrial Classification (SIC) code references and lengthy lists of individual business types, the draft organizes similar uses into logical land use categories and identifies whether each use is permitted or conditional within each zoning district. The intent is to create a use table that is easier to administer, more adaptable to changing business trends, and more user-friendly, while still preserving the character and purpose of each zoning district. Staff is seeking Planning Commission feedback on the overall organization of the table, the proposed use categories, and the recommended permitted and conditional use assignments before incorporating the use table into the draft zoning ordinance.
