City Council Ordinance Committee Meeting Minutes
January 19, 2021

This meeting was conducted under the ‘Executive Order Suspending Certain Provisions of the Open
Meeting Law G.L. c.30A, §20’, signed on March 12, 2020.
The public can view this meeting on ACTV Channel 12, the ACTV website, or ACTV’s Facebook page.
Public comment was made available by email ahead of time.
Councilor Mandeville called the meeting to order at 7:05 PM
Roll Call was taken and present were: Councilor Lennon, Atty. Raffa, Councilor Rinaldi, and Councilor
Mandeville (Atty. Johnson was not present)
Minutes for approval:
Atty. Raffa noticed a grammatical error in the minutes and would like it changed.
Councilor Rinaldi motioned to accept the minutes, Councilor Lennon seconded the motion. Roll
call was taken, 3 members yes; Councilor Rinaldi abstaining. Motion passed.
Administrative Items:
Approval of the 2021 Ordinance Committee Schedule.
Councilor Lennon motioned to approve the schedule. Councilor Rinaldi seconded the motion. Roll
call was taken, 4 members yes. Motion passed.
Order 2021-003 An Order to expend the duration of the Amesbury Housing Trust – Mayor Sponsor
Atty. Raffa would like the Trust document reviewed by K.P. Law to ensure that it is current and
up-to-date. She stated she does not want anyone to sign an outdated 2012 version of the Trust.
She did not see where/if it was signed and recorded and strongly reiterated it should be looked
over.
She recommended changed the language in the order itself; on the first line where it says, “…
expend the duration of the [trust]…” instead have it read, “… expend the termination of the
[trust]…”
She recommended to change “… (10) year sunset clause terminating the trust…” to “… (10)
year sunset clause shall automatically terminate the trust…” *unless extended*
Order 2021-008 An Order to Authorize the Mayor to Release a Sewer Easement Located at 14 Merrimac
St. – Mayor Sponsor
Rob Desmarais stated that the Department of Public Works, the Sewer Department and the
Developer did a thorough review of the abandonment that took place in the 1970’s.
Atty. Raffa would like K.P. Law to review the easement.
Atty. Raffa motioned to send 2021-003 back to Council with a positive recommendation pending
terms that had been discussed in this meeting. Councilor Lennon seconded the motion. Roll call
was taken, 4 members yes. Motion passed.
Councilor Lennon motioned to send 2021-008 back to Council with a positive recommendation
pending suggestion that K.P. Law reviews the easement. Motion was seconded by Atty. Raffa. Roll
call was taken, 4 members yes. Motion passed.
Councilor Lennon motioned to adjourn the meeting at 7:24pm. Motion was seconded by Atty.
Raffa. Roll call was taken, 4 members yes. Motion passed.

2021-003 An Order to expend the duration of the Amesbury Housing Trust – Mayor Sponsor
Summary: In 2012 the City of Amesbury accepted MGL Chapter 44, Section 55C in order to establish a
municipal affordable housing trust as the Amesbury Housing Trust. This order (2012-046) included a ten
(10) year sunset clause terminating the trust on December 31, 2022. However, the Housing Trust was
never appointed. Mayor Gove is appointing Trust members, subject to Council approval, in January 2021.
She is seeking extension of this order for an additional ten (10) years.
2021-008 An Order to Authorize the Mayor to Release a Sewer Easement Located at 14 Merrimac St. –
Mayor Sponsor
Summary: The property located at 14 Merrimac Street is subject to a sewer easement described in an
instrument recorded with the Essex South Registry of Deeds in Book 2167, page 212. The Department of
Public Works has made a determination that the sewer easement is no longer needed. If the City Council
adopts this Order, the Mayor would then execute the document necessary to release the sewer
easement, so that it no longer burdens the property at 14 Merrimac St.
