CHAPTER 30A §§18-25 Version 7.1.10 City Council Ordinance & Administration Subcommittee Meeting Agenda March 20, 2023, at 7:30 PM City Hall- 62 Friend Street Call to order Roll Call Approval of Minutes- February 16, 2023 Public Comment Topics for Discussion- 2023-005 An Ordinance to amend the Amesbury Zoning Ordinance and the Amesbury Overlay Zoning Map in order to establish a new Smart Growth Overlay District pursuant to M.G.L. Chapter 40R and 760 CMR 59.00 that shall be known as the East End Smart Growth Overlay District. -Mayor Sponsor Summary: The City of Amesbury has received a Letter of Eligibility from the Massachusetts Department of Housing and Community Development for establishing a Smart Growth District pursuant to the provisions of M.G.L. Chapter 40R and 760 CMR 59.00. The proposed Smart Growth District will be known as the East End Smart Growth Overlay District (EE-SGOD). (See ordinance for full summary). 2023-013 An Order of the Amesbury City Council exempting certain categories of public employees from the education and training requirements of the Conflict-of-Interest Law, based on the State Ethics Commission’s Conflict of Interest Law Education and Training Guidelines. -Mayor Sponsor Summary: Chapter 28 of the Acts of 2009, the ethics reform law amending the Conflict-of-Interest Law, imposes education and training requirements on public employers and public employees. The law authorizes the Commonwealth Ethics Commission to establish procedures to implement and ensure compliance with these requirements, and these Implementation Procedures are issued pursuant to that authority. Ideally, all public employees in the Commonwealth would be trained in the Conflict-of-Interest Law. However, cost, and other practical circumstances require that a principled way be found to exempt certain categories of public employees from the education and training requirements without compromising the objectives of those requirements. Therefore, the Commission established guidelines to enable public employers to determine which of their employees are exempt from the education and training requirements. Additional information relative to these guidelines and examples can be found on mass.gov. This order requests exemptions for the following positions in the City of Amesbury: • Senior and Veteran Tax Work-off Program participants; and • Poll Workers. 2023-020 An Order of the Amesbury City Council to approve and accept a Preservation Restriction Agreement on property located at 20 Maple Street, Amesbury, and to authorize the Mayor to execute said Preservation Restriction Agreement on behalf of the City of Amesbury. -Mayor Sponsor Summary: The Amesbury Planning Board approved an Application for Site Plan Review, Special Permit and Definitive Subdivision for the property located at 20 Maple Street, Amesbury on March 28, 2022 (said approval is recorded with the Essex South Registry of Deeds in Book 40933, Page 358.) The Planning Board required that a historic preservation restriction be prepared and recorded for the building and site, identified as Assessors Map 51, Parcel 145 and described in a deed recorded with said Registry in Book 40334, Page 538, and further shown as existing building on Lot 2 on Sheet 3 of 4 of the definitive plan prepared by Atlantic Survey and Engineering, Inc., dated 01/03/2022, last revised on 4/22/2022 and recorded at the Registry of Deeds as Plan 40933 Book 352. According to the Pictorial Guide to Historic Amesbury, the house was constructed in 1874. It is a fine example of a highly ornamented Italianate villa style residence. The Historic Preservation Restriction for the said structure has been recorded at the Registry of Deeds in Book 40933, Page 403. The intent of this Order is to obtain the authorization of the City Council to acquire the historic preservation restriction and authorize the Mayor to accept the historic preservation restriction.
