By City Clerk at 8:59 am, Jul 03, 2023 APPROVED: 6/29/23 ZONING BOARD OF APPEALS MEETING MINUTES THURSDAY – April 27, 2023 (Posted in accordance with the provisions of MGL Ch. 39, Sec. 23A, as amended) City Hall – 7:00 p.m. / 62 Friend St., Amesbury, MA 01913 Attendance: Sharon McDermot (Chair), Donna Collins, David Haraske, Michael McCarthy, and Charles Basler Also in attendance: Vinny Tirone, Dir. of Inspectional Services _______________________________________________________ AGENDA 1. Meeting Minutes Approval: March 23, 2023 2. Robin Cohn - CONTINUED – 27 River St. – Special Permit/Finding request to convert a single-family dwelling to a two-family dwelling under Section XI.K1 of the Amesbury Zoning Ordinance. Previous ZBA approval has expired. 3. VC Detailed Properties – CONTINUED - 13 High St. – Special Permit/Finding and Variance application request to modify a non-conforming single-family structure to a two-family dwelling Under Section XI.K.1 and Section IX.B of the Amesbury Zoning Ordinance. Chair McDermot called the meeting to order at 7:10 pm and read the agenda items and asked if there were any changes to the meeting minutes. No changes. Chair McDermot motioned to approve the meeting minutes from March 23, 2023, seconded by Donna Collins. All in favor. PUBLIC HEARINGS: 1. Robin Cohn - CONTINUED – 27 River St. – Special Permit/Finding request to convert a single-family dwelling to a two-family dwelling under Section XI.K1 of the Amesbury Zoning Ordinance. Previous ZBA approval has expired. Ms. Cohn received approval to convert a single-family dwelling to a two-family dwelling on 1/28/21, but the application expired. Ms. Cohn has come before the Board to allow her to proceed. The home was originally a 2-family that was converted to a 1-family. QUESTIONS: None 1. Chair McDermot made a motion to discuss. The Board had no further questions. 2. Chair McDermot read the Summary of Findings. 3. Finding no issues, Chair McDermot made a motion to vote to approve the VARIANCE. 4. Donna Collins motioned to approve the Special Permit. Michael McCarthy seconded the motion. The Board unanimously voted to allow the Special Permit to revert the home back to a 2-family dwelling. APPROVED: 6/29/23 2. VC Detailed Properties – CONTINUED - 13 High St. – Special Permit/Finding and Variance application request to modify a non-conforming single-family structure to a two-family dwelling Under Section XI.K.1 and Section IX.B of the Amesbury Zoning Ordinance. Paul Gagliardi, on behalf of VC Detailed Properties, LLC is requesting a Special Permit and Variance to convert a single-family dwelling to a 2-family dwelling. For the SPECIAL PERMIT: modify a pre-existing, non-conforming single-family structure. For the VARIANCE: variance from dimensional requirements contained in Section XI.K.1, subsections 1,2, and 4, to enable the Applicant to proceed. QUESTIONS: Chair McDermot asks if there is sufficient parking in regard to the Special Permit application. Atty. Gagliardi stated there is with parking access through Union & High St. Donna Collins mentions the hardship in regard to the Variance application stating that the size of the lot makes it impossible to meet dimensional requirements. Michael McCarthy stated that the only non-conforming part in regard to the Variance Application is the height of the existing home. 1. Chair McDermot made a motion to discuss. The Board had no further questions. 2. Chair McDermot read the Summary of Findings. 3. Finding no issues, Chair McDermot made a motion to vote to approve the SPECIAL PERMIT/FINDING. Donna Collins motioned to approve the SPECIAL PERMIT/FINDING. Dave Haraske seconded the motion. The Board unanimously voted to grant the SPECIAL PERMIT/FINDING to convert the single-family dwelling to a two-family dwelling. 1. Chair McDermot made a motion to discuss. The Board had no further questions. 2. Chair McDermot read the Summary of Findings. 3. Finding no issues, Chair McDermot made a motion to approve the Variance. Dave Haraske seconded the motion. The Board unanimously voted to approve the Variance to convert a single-family dwelling to a two-family dwelling. Motion to adjourn the meeting at 8:00pm. Motion passed unanimously.
