Mayor Siry welcomed everyone to the June 22nd meeting of the Board of Trustees, which was conducted online and telephone via Zoom Meeting. He reminded everyone of the 3-minute limit for public comments. The Mayor reminded everyone that the Beach would be opening this Saturday, June 27th and we are limiting number of passes being given out due to COVID safety practices. There will be no public rental of the pavilions for gatherings. We are planning two additional drive-in movies, and once again, thanked Joanne Mills of Exit Realty for her event sponsorship. He reminded residents that the first half of property taxes payment deadline is coming up July 1. He also thanked Police Chief Burton and the APD for their professionalism in keeping us informed about upcoming equality and justice walks. Overall, they have run smoothly. Mayor Siry advised the Village is working on having a scaled down Fourth of July parade. Mayor Siry called for Committee Reports from the Trustees: • Amityville Fire Dept. (Trustee Whalen): 112 calls recorded; of which 90 rescue/ 22 fire • Department of Public Works (Trustee O’Neill): Repairing the sprinkler systems at village owned properties and parks; street sweeping and sweeper maintenance is ongoing daily; garbage/trash removal and litter removal including discarded face masks and gloves throughout the village; grass maintenance and cutting, including tree wells and weeding; repaired 2 sidewalks on Oldfield Ave. (complaint wheelchair hazard) and complaint Gaylord Dr.; continue to issue mark out requests and road opening permits; making signage to promote social distancing, i.e. at Village Hall. In addition, gathering and preparing material and supplies for the emergency repair of the walkway to the west pier at the beach; working with the contractor to rectify the problem at the end of Norman Ave - adding a rock barrier; and preparing supplies and material for the seaweed fence installation. • Amityville Police Dept. (Deputy Mayor Smith) 8 arrests, 399 blotters, 43 cases, 4 citations, 1 impound, 84 medically aided, and 24 Motor Vehicle Accidents. Deputy Mayor Smith and Mayor Siry also gave credit to Chief Burton for their handling of the recent gatherings and peaceful marches. 1  Board of Trustees Minutes June 22, 2020 • Beach Committee (Trustee Bernius): The beach will open on the last Saturday in June - fully staffed. There will be no sailing or swim instructions taking place this year due to COVID. She also noted that many other places are not opening pools and beaches. Trustee Bernius gave credit to the Parks Commission unsung heroes- these volunteers weeded and edged 9/11 park and filled 10 sidewalk planters. She gave a shout out to Parks Commissioner Corinne Budde. Mayor Siry also expressed his thanks, and invited anyone interested in joining the beautification committee to email us at mayor@amityville.com. Mrs. Budde has requested that businesses help them out. If they see the planters on their sidewalks could use water or weeding perhaps they can take care of that. • Building Department (Deputy Mayor Smith): May revenue was $11,925. There were 12 permits issued and 16 inspections performed. The Building Dept is open Mon-Tues-Wed. and permits can also be obtained online. Planning Board and Zoning Board of Appeals meetings are taking place via Zoom meeting. Mayor Siry announced that June 24th would be the IDA public hearing for Avalon Bay and the Village Planning Board would be reviewing their plans at the July Planning Board Meeting. Snow is the owner of real property adjacent to such bulkhead on the easterly side of LeBrun Avenue, known as 130 LeBrun Avenue, Amityville, NY and WHEREAS there is a bulkhead (bulkhead No 2) on a portion of the extended line of LeBrun Avenue, which portion is contiguous to the land of said Douglas R. Snow, and WHEREAS said bulkheads intersect at right angles at the end of the paved surface of LeBrun Avenue, and WHEREAS the structural integrity of such bulkheads is necessary to protect LeBrun Avenue and the residents thereof from flooding and storm damage, and WHEREAS bulkhead No 2 is failing and needs to be replaced, and 11  Board of Trustees Minutes June 22, 2020 WHEREAS Douglas R. Snow has agreed to replace bulkhead No 2 at his expense in consideration for receiving whatever claim of title the Village may have to the extension of LeBrun Avenue into the Great South Bay, and WHEREAS such extended portion of LeBrun Avenue has never been used or maintained by the Village, and cannot be utilized as a public street. NOW THEREFORE BE IT RESOLVED AS FOLLOWS: 1) The Mayor of the Village of Amityville be and is hereby authorized to execute a quitclaim deed to Douglas R. Snow for the property described in Schedule A attached hereto on the following conditions: (a) The existing bulkhead (bulkhead No 2) on the subject premises shall be replaced at his expense and tied into the village bulkhead (bulkhead No 1) in a manner approved by the Superintendent of Public Works (b) Douglas R. Snow shall not replace said bulkhead No 2 until he has received all required governmental permits (c) Douglas R. Snow acknowledges that the Village of Amityville is not warranting title to the subject premises and is conveying whatever interest it may have therein, if any (d) All expenses in connection with said conveyance shall be paid by Douglas R. Snow. 2) This Resolution shall be effective immediately Village Attorney Bruce Kennedy explained that since the title for this bulkhead property is up in the air, awarding the property owner with a quick claim deed would require him to care for the bulkhead at his expense. Without it, the Village might incur expenses in the range of $50,000- $60,000 to tie this bulkhead into the Village bulkhead. Mayor Siry explained that this proposed legislation (which follows) would help preserve greenspace in front yards for aesthetic reasons and to allow stormwater drainage. He reported there are now large boats that are used overnight, people are smoking marijuana, there has been loud music, lights, foul language, and public urination. He says the marina has disrupted his quality of life and devalued his home. Lisa Strollo, 84 New Point Pl., said she is upset that she no longer has a million dollar view from her home and her property value has gone down. Al Strollo, 34 Meadow La., also cited cars shooting down the street on route to and from the marina and described the atmosphere like a trailer park. Joan Donnison, 150 S. Ketcham Ave., and Diane Melish, 22 S. Ketcham Ave., inquired about DEC procedures and jurisdiction. The residents raised questions about DEC permitting for the additional slips, and Mayor Siry confirmed that the waterfront is controlled by the DEC and not the Village. He stated that the Village will meet with the property manager right away to convey their concerns and that they should report any incidents to the APD immediately. Building Inspector Donato noted that the owners have requested a fence permit for the property and as a pre-existing nonconforming property, they will go before the planning board to address boat storage and parking. However, he noted the Planning Board cannot remove the docks. The residents said the property use and stipulations were under discussion back in 2001 under former Mayor Imbert when the former owner was denied a permit to park boats on the property. Village Attorney Bruce Kennedy clarified for residents that views are not protected under the law. Trustee O’Neill suggested that APD increase their patrols of the area to curtail any illegal activity.
