Mount, Councilmember Jeremy Craig, Councilmember Presley Boswell, Councilmember Terry Powell, Councilmember Mark Christensen, City Attorney ABSENT: Joe Nix, Councilmember The City Council of the City of Andalusia, Alabama, met in room 340 at City Hall for a work session at 5:30 p.m. for the purpose of planning and finalizing the agenda. REGULAR COUNCIL MEETING PRESENT: Earl V. Johnson, Mayor Kennith C. Mount, Councilmember Jeremy Craig, Councilmember Presley Boswell, Councilmember PAGE 2 Terry Powell, Councilmember Mark Christensen, City Attorney ABSENT: Joe Nix, Councilmember APPROVAL OF MINUTES: Mayor Johnson presented the minutes from the regular meeting on July 7, 2026. Councilmember Mount moved to approve the minutes. Councilmember Craig seconded the motion, which passed unanimously. MAYOR JOHNSON PRESENTED ORDINANCE NO. 2026-03, SURPLUS INDUSTRIAL PARK PROPERTY FOR CONECUH SAUSAGE OVERFLOW/OVERNIGHT TRUCK PARKING ADDITION: Mayor Johnson presented Ordinance No. 2026-03, surplus Industrial Park property for Conecuh Sausage overflow/overnight truck parking addition. Mayor Johnson called for a vote, which produced the following results: YES NO ABSTAINED Mayor Johnson Councilmember Craig Councilmember Mount Councilmember Boswell Councilmember Powell THE CITY OF ANDALUSIA ANDALUSIA, ALABAMA ORDINANCE NO. 2026 - 03 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ANDALUSIA, ALABAMA: WHEREAS, the City Council of the City of Andalusia, Alabama, desires to improve the quality of life for all of its citizens and the residents of surrounding areas; and PAGE 3 WHEREAS, the City Council of the City of Andalusia, Alabama, desires to encourage economic development in the City of Andalusia and to encourage responsible development that will lead to benefits that will serve valid and sufficient public purposes including, but not limited to, expansion and enhancement of the City’s economic and tax base, thereby providing additional revenues for schools, municipal services, and other public needs, and increased employment opportunities within the City; promotion of the City as a center for retail, industrial, and other commercial activity; and provision of additional goods and services to the residents of Andalusia and the surrounding areas; and WHEREAS, the Industrial Development Board of the City of Andalusia is in the process of completing an agreement with Conecuh Sausage, Inc. for further development at the Andalusia Industrial Park on land currently titled in the name of the City of Andalusia; and WHEREAS, the City Council of the City of Andalusia, Alabama, finds that said agreement will promote the purposes set forth above and also finding that said land is not currently being used by the City of Andalusia and that there are no other specific plans for it to be used by the City of Andalusia, the City Council of the City of Andalusia finds that said property is no longer needed for public or municipal purposed and that it should be conveyed to the Industrial Development Board of the City of Andalusia, Alabama; NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Andalusia, Alabama, as follows: 1. It is hereby established and declared that the following described real property of the City of Andalusia, Alabama, is no longer needed for public or municipal purposes, to wit: All that portion of the SE¼ of SW¼ of Section 4, Township 4 North, Range 16 East, Covington County, lying East of Sutton Road and South of East Progress Drive, LESS AND EXCEPT that portion of the property described in that certain deed recorded in Book 2016, Page 8762 in the Office of the Judge of Probate of Covington County, Alabama, lying in the said SE¼ of SW¼, and more particularly described as: Commencing at a found 3" concrete marker, said point being the Northwest corner of the Southwest Quarter of Southeast Quarter of Section 4, Township 4 North, Range 16 East; thence South 82̊21'26" East a distance of 129.72' to a found ½" rebar w/cap ALS 26950 on the East right of way of Progress Drive (80' R.O.W.); thence along said Progress Drive South 07̊19'03" West a distance of 50.18' to a ½" rebar w/cap ALS 26950; thence continue along Progress Drive South 07̊19'03" West a distance of 471.14' to a concrete marker; thence run along a right of way flare South 39̊12'04" East for a distance of 41.29' to a concrete marker on the North side of an 80' right of way; thence run along said right of way South 85̊43'11" East for a distance of 356.29; thence leaving PAGE 4 said right of way run South 02̊59'40" West for a distance of 80.02' to a ½" rebar w/ cap PLS 21469 set on the South side of said 80' right of way; thence run North 85̊43'11" West along the South side of Progress Drive (80' R.O.W.) for a distance of 602.57 feet to a ½" rebar w/cap PLS 21469 set on the South side of Progress Drive and the Point of Beginning of the parcel herein excepted; thence run South 06̊32'43" West for a distance of 400.69 feet to a ½" rebar w/cap PLS 21469; thence run North 49̊32'22" East to the East line of the Southeast Quarter of Southwest Quarter of Section 4, Township 4 North, Range 16 East, thence run North along said forty line to the South right of way of East Progress Drive; thence West along said South right of way to the Point of Beginning of the parcel herein excepted. The parcel herein conveyed contains 15.5 acres, more or less. 2. This ordinance shall become effective immediately upon its adoption and publication as required by law. 3. Upon this ordinance becoming effective, the Mayor and Clerk are authorized to execute such documents as necessary to convey said land to the Industrial Development Board of the City of Andalusia, Alabama. THOMPSON, CITY CLERK AND TREASURER COUNCIL APPROVES EQUIPMENT FOR ANDALUSIA POLICE DEPARTMENT: Mayor Johnson presented a request from the Andalusia Police Department to purchase two Stalker LIDAR RLR Units. Councilmember Boswell moved to appropriate $4,629.50 from capital to purchase two Stalker LIDAR RLR Units for the Andalusia Police Department. Councilmember Mount seconded the motion, which passed unanimously. COUNCIL APPROVES RESOLUTION NO. 2026-21, HERITAGE PARK FORMAL ENTRANCE: PAGE 5 Mayor Johnson presented Resolution No. 2026-21, Heritage Park Formal Entrance. THE CITY OF ANDALUSIA ANDALUSIA, ALABAMA RESOLUTION 2026-21 A RESOLUTION ALLOCATING FUNDING FOR HERITAGE PARK WHEREAS, the City of Andalusia City Council desires to make improvements to Downtown Andalusia and is constructing Heritage Park; and WHEREAS, the next phase of development will be a formal entrance to the park; and NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ANDALUSIA, that $77,500.00 be appropriated from the 2022 Series A Bond Account for the Heritage Park Improvements. COUNCIL APPROVES RESOLUTION NO. 2026-20, ABATEMENT OF NUISANCE PROPERTIES: PAGE 6 Mayor Johnson presented Resolution No. 2026-20, abatement of nuisance properties. CITY OF ANDALUSIA ANDALUSIA, ALABAMA RESOLUTION NO. 2026-20 BE IT RESOLVED by the City Council of the City of Andalusia, Alabama that we, after having examined the report of the City Building Inspector, do hereby find that the property in question specifically described below and denominated as parcel numbers by the Revenue Commission of Covington County is hazardous to the health, safety, welfare, and morals of the citizens of Andalusia and thereby constitute a public nuisance pursuant to the Alabama Act No. 94-540 as adopted by the City Council of the City of Andalusia: 1) 105 Perry Street parcel # 1304183007015000 2) 403 Woodruff Street parcel # 1304181004030000 BE IT FURTHER RESOLVED that the City Council hereby authorizes the Building Inspector to proceed with the abatement of these nuisances as authorized under the State of Alabama Act.
