CALL TO ORDER Mayor Rice called the meeting to order at 7:00 p.m., followed by the Pledge of Allegiance. 2. ROLL CALL Present at roll call: Mayor Rice, Councilmembers Barnett, Freeburg, Skogquist and Wesp. Staff present: City Manager Greg Lee; Community Development Director Doug Borglund; Police Captain Andy Youngquist; City Planner Clark Palmer; City Attorney Scott Baumgartner. Absent at roll call: None. 3. COUNCIL MINUTES 3.1 Minutes of the June 15, 2020, Worksession. Minutes of the June 22, 2020, Regular Meeting. Councilmember Skogquist requested spelling corrections for Lieutenant Weidenbach and Jon Holmes in Item 3.1, Page 7, Paragraph 2 corrected to painting the Fischer House, and Page 9, Paragraph 8 adding “…as he did not want to bond for a new public works facility…” Motion by Councilmember Freeburg, seconded by Councilmember Barnett, to waive the reading and approve the June 15, 2020, Worksession and the June 22, 2020, Regular Meeting as corrected. Upon a roll call vote: Mayor Rice, Councilmembers Barnett, Freeburg, Skogquist and Wesp voted in favor. Motion carried. 4. OPEN FORUM 4.1 Proclamation; Dave Hoagland Day, July 9, 2020. Police Captain Andy Youngquist stated a proclamation proclaiming July 9, 2020 as Dave Hoagland Day in the City of Anoka would be presented to retired Anoka Police Chief Dave Hoagland who turns 100 years old on July 9. Captain Youngquist shared Chief Hoagland’s background that included serving in WWII July 6, 2020 (Regular) Page 2 of 7 as the United States Army Air Corps from 1942 to 1946 then hired in 1948 as a Sheriff’s Deputy as one of the first uniformed deputies in Anoka County. He left the Sheriff’s office to join the Anoka Police Department and in 1963 Mayor J. David Johnson appointed him as Police Chief. During his service Police Chief Hoagland served on the committee that established Central Communications to dispatch officers by radio to calls and also assisted with the development of a County-wide investigation unit now known as the Criminal Investigation Division. Among his many accomplishments, Chief Hoagland approved the first K-9 in Anoka and K-9 King and his handler retired Chief Andy Revering were the first of a long-standing tradition to have a K-9 on staff. Chief Hoagland is a 52- year member of the Anoka America Legion and retired in 1979. Dale McKusick, family representative, thanked the Council for presenting the proclamation and recognizing Chief Hoagland’s accomplishments and service to the City. Mayor Rice read the Proclamation into the record proclaiming July 9, 2020, as Dave Hoagland Day in Anoka and thanked him for his service to the City. Councilmember Wesp since 1963 the City has only had six police chiefs and noted all have come from within the department and thanked everyone for their good work. 4.2 Police Activity Update. Captain Youngquist shared a police sergeant will be retiring in August and thanked him for his service then shared applications for the position had been received and were notably less than in the past and a dynamic change possibly based on the recent civil unrest and events surrounding police officers in general. He said the interviews resulted in five very good candidates with an offer to one who was currently being backgrounded and hoped to be hired soon. Captain Youngquist shared information about the recent arrest of an intoxicated individual who with guns in their possession, and said the department had no significant incidents occur as part of the 4th of July holiday outside of increased fireworks complaints. Councilmember Freeburg inquired about Anoka Halloween and asked if events would be held this year. City Manager Greg Lee said members of Anoka Halloween would be addressing City Council at their next meeting regarding plans for October. Councilmember Wesp asked about National Night Out being moved to October due to COVID-19. Captain Youngquist shared the department was working through CDC guidelines for this event to hopefully be held in October and would be working with Anoka Halloween on their plans as well. July 6, 2020 (Regular) Page 3 of 7 OTHER INFORMATION UNDER OPEN FORUM None. 5. CONSENT AGENDA Motion by Councilmember Skogquist, seconded by Councilmember Freeburg, to approve Consent Agenda 6.1 through 6.2. 6.1 Approve Verified Bills. 6.2 Revising and Setting Council Calendars. Upon a roll call vote: Mayor Rice, Councilmembers Barnett, Freeburg, Skogquist and Wesp voted in favor. Motion carried. 7. REPORTS OF OFFICERS, BOARDS AND COMMISSIONS None. 8. PETITIONS, REQUESTS AND COMMUNICATION None. 9. ORDINANCES AND RESOLUTIONS 9.1 RES/Establishment of Municipal Primary; Mayoral Position. RESOLUTION Mr. Lee shared a background report stating the City Charter requires if three or more individuals file an affidavit of candidacy for the Mayor’s position the City must declare and hold a municipal Primary Election for that office for the purpose of selecting two candidates for the November General Election. He said we received affidavits for the office of Mayor from Barbara Deeds-Baldwin, Shane Perry, and Phil Rice and requested the Council adopt the resolution establishing a Municipal Primary Election on August 11 for the Mayoral Position. Motion by Councilmember Wesp, seconded by Councilmember Barnett, to adopt a resolution establishing a Municipal Primary Election for the selection of candidates for the Office of Mayor. July 6, 2020 (Regular) Page 4 of 7 Upon a roll call vote: Mayor Rice, Councilmembers Barnett, Freeburg, Skogquist and Wesp voted in favor. Motion carried. 9.2 RES/Appointment of Election Judges for 2020 August 11 and November 3, 2020 Elections. RESOLUTION Mr. Lee shared a background report stating Minnesota Statute 204B.21 requires the City Council to approve the appointment of election judges. Wages for the election judges is paid out of the 2020 Election Budget and salaries for the judges were shared including staff who conduct the nursing home and residential treatment facility voting and equipment testing. Generally, each precinct will have eight election judges working but due to COVID-19 several judges have opted not to work as an election judge. He said staff has been advertising on the City’s website and through social media and encouraged the public to serve as an election judge. Motion by Councilmember Freeburg, seconded by Councilmember Skogquist, to adopt a resolution of adoption of election judges for the 2020 elections. Councilmember Barnett shared about her service as an election judge and encouraged residents to consider serving as well. Councilmember Skogquist asked about concerns raised regarding COVID-19 during elections. Mr. Lee shared the State has put guidelines in place during elections that includes encouraging the wearing of masks and having them available for voters, physical barriers, social distancing, and other protocols. Upon a roll call vote: Mayor Rice, Councilmembers Barnett, Freeburg, Skogquist and Wesp voted in favor. Motion carried. 9.3 RES/First Amendment to Purchase Agreement; Ryan Companies, US, Inc. RESOLUTION Community Development Director Doug Borglund shared a background report stating on February 18, 2020 the City approved a purchase agreement with Ryan Companies for the sale of a 14-acre parcel at the northwest corner of 7th Avenue and Bunker Lake Boulevard. He said that due to COVID-19, the state of retail and the City’s desire to an obtain a grocery retailer on the site has resulted in additional time being requested by the buyer. The amendment to Section 5 of the existing purchase agreement changes the term from 120 days and replaced with 480 days and extend the period to May of 2021. Section 5 addresses contingencies expected to be completed by the buyer and/or seller based on the purchase July 6, 2020 (Regular) Page 5 of 7 agreement and the amendment to Section 11 of the existing purchase agreement changes the first sentence of Section 11 and is hereby deleted in its entirety and replaced as follows: “Buyer’s performance of this Agreement is expressly conditioned upon Buyer’s inspection and approval of the Premises, which inspection shall be made within five hundred forty (540) days after the Effective Date” This would extend the time period out to July of 2021. Section 11 addresses access and inspection of the site which may include architectural, design, soil, environmental studies and assessments. Mayor Rice said this amendment was reasonable during this time and the generous timeframe was wise. Councilmember Wesp spoke about a recent homeowner’s association meeting near the site and shared that residents were excited about this development including the liquor store. Patrick Daly, Ryan Companies, thanked staff for their work and said they felt strong about developing this site and bringing retail to Anoka. He said they have been working to be more reactive and manage existing operations and stores instead of focusing on growth at this time but their goal was to bring a grocer to the site and this extension would allow them to continue their work and give the time needed to carry out this vision. He thanked the neighborhood and Council for their support during this unusual time. Motion by Councilmember Wesp, seconded by Councilmember Barnett, to adopt a resolution first amendment to the purchase agreement; Ryan Companies US, Inc. Upon a roll call vote: Mayor Rice, Councilmembers Barnett, Freeburg, Skogquist and Wesp voted in favor. Motion carried. 9.4 RES/David Weekley Homes Riverside Final Plat. RESOLUTION Mr. Borglund shared a background report stating David Weekly Homes, LLC is requesting approval of a final plat for Riverside, which will allow the related site work and construction of 56 detached ownership townhome units to move forward. He outlined the legal descriptions that would be created through the final plat due to the site containing both abstract and Torrens properties recorded over time then shared Outlot A would contain the historic wall and 300-foot buffer from the Rum River and natural area retained by the City. The proposed plat was consistent with the approved original Preliminary Plat/PRD. Councilmember Freeburg suggested a quiet title process could have been used instead. Mr. Borglund said discussions were held with the title company and July 6, 2020 (Regular) Page 6 of 7 Anoka County who felt this process would also accomplish recording of the final plat. Motion by Councilmember Skogquist, seconded by Councilmember Freeburg, to adopt a resolution approving a final plat for Riverside. Upon a roll call vote: Mayor Rice, Councilmembers Barnett, Freeburg, Skogquist and Wesp voted in favor. Motion carried. 10. UNFINISHED BUSINESS None. 11. NEW BUSINESS None. 12. UPDATES AND REPORTS 12.1 Tentative Agenda(s). The Council reviewed the tentative agendas of the upcoming Council meetings. 12.2 Staff and Council Input. Mr. Lee shared that the Fire Board would be meeting this week to discuss the interim Fire Chief position and 2021 budget, which was being proposed at less than a 2% increase. He noted Interim Chief Holmes wished to no longer serve as Chief and an RFP for either an interim chief or consultant had been created. He said the Fire Board operating committee would be meeting with firefighters to update them as well on the process. Councilmember Wesp asked about progress to schedule a meeting with Champlin City Council and staff regarding the fire department. Mr. Lee shared he had spoken with the city administrator to discuss meeting objectives and said there was not a lot of support from Champlin to hold a joint meeting at this time. Councilmember Skogquist inquired why the agenda did not include a COVID-19 update and impact item and if the item was being removed from future agendas. Mr. Lee said the item would continue to be included in future agendas but that he had nothing specific to add for this agenda. Councilmember Skogquist noted Councilmember Freeburg had chosen not to run again for office and thanked him for his 24 years of service to the City. July 6, 2020 (Regular) Page 7 of 7 13. ADJOURNMENT Councilmember Freeburg made a motion to adjourn the Regular Council meeting. Councilmember Wesp seconded the motion.
