CALL TO ORDER Mayor Rice called the Executive Session to order at 6:00 p.m. 2. ROLL CALL Present at roll call: Mayor Rice, Councilmembers Barnett, Skogquist, and Wesp, Councilmember Freeburg. Staff present: City Attorney Scott Baumgartner, Darin Berger, HRA Manager, and Engineering Tech Ben Nelson. Guests: Attorney’s Peter Mikhail and Amanda Johnson of LeVander, Gillen & Miller, P.A. 3. Mayor Rice closed the meeting pursuant to Minnesota Statute § 13D.05, Subd 3(b), for Attorney-Client discussions regarding: (a) negotiations and litigation risks in using eminent domain to acquire property for U.S. Highway 10/169 Improvement Project; and (b) negotiation and relocation options to avoid risk in the schedule for Green Haven Parkway Phase II. 4. CALL TO ORDER Mayor Rice called the meeting to order at 7:00 p.m., followed by the Pledge of Allegiance. 2. ROLL CALL Present at roll call: Mayor Rice, Councilmembers Barnett, Freeburg, Skogquist and Wesp. Staff present: Police Chief Eric Peterson, Public Services Director Mark Anderson; Darin Berger, HRA Manager, Engineering Technician Ben Nelson; and City Attorney Scott Baumgartner. Absent at roll call: None. 3. COUNCIL MINUTES 3.1 Minutes of the September 28, 2020, Worksession. Minutes of the October 5, 2020, Regular Meeting. Councilmember Skogquist asked for a correction on the September 28, 2020, Worksession on Page 4, Paragraph 2: “Councilmember Skogquist said the proposal this proposal would allow for a uniform timeframe but still allow some flexibility.” Motion by Councilmember Skogquist, seconded by Councilmember Wesp, to waive the reading and approve the September 28, 2020, Worksession and the October 5, 2020, Regular Meeting as corrected. Upon a roll call vote: Mayor Rice, Councilmembers Barnett, Freeburg, Skogquist, and Wesp voted in favor. Motion carried. 4. OPEN FORUM 4.1 Police Activity Update. Police Chief Eric Peterson shared the department’s staffing plan for October 31 to provide safety and security for those wishing to enjoy the drive-by Grand Day Parade event and any bar activity then shared about the recent increase in individuals fleeing officers in vehicles. He shared statistics on increased car October 19, 2020 (Regular) Page 2 of 7 thefts and car jacking’s and their work to address these crimes and encouraged the public to report suspicious activity and that drivers need to be aware of their surroundings and secure their vehicles. He spoke about the recent increases in drug overdoses that totaled 24 since January, 14 of which involved heroin or fentanyl and resulted in three deaths. He said the department was working hard with Anoka County’s Drug Task Force to arrest those who supply controlled substances and will aggressively enforce drug possession. Chief Peterson updated the Council on the COVD-19 pandemic and shared about the recent barrier-free testing that occurred at the Anoka Armory then shared statistics on testing and deaths in both the City and County. Councilmember Freeburg inquired about the limit for gatherings for indoor events. Chief Peterson said the Minnesota Department of Health was limiting gatherings to 50% capacity of the venue with a maximum of 250 people. Councilmember Barnett asked if officers carry Narcan and if the increases in overdoses was occurring locally or was regionally as well. Chief Peterson said not all officers carry Narcan but shared users were actually carrying this as well then said he did not have actual statistics but that use was up nationwide and spoke about possible reasons why. Councilmember Skogquist asked if car jacking’s were similarly trending in other cities too and if concerns surrounding recent racial events were one of the reasons. Chief Peterson said he did not believe reasons included interaction with police officers due to race but was based more of a willingness of not abiding by the law and taking more risks. Councilmember Barnett thanked the community for participating in raising awareness on Domestic Violence Month by displaying purple lights throughout the City. CONSENT AGENDA Motion by Councilmember Freeburg, seconded by Councilmember Barnett, to approve Consent Agenda 6.1 through 6.3. 6.1 Approve Verified Bills. October 19, 2020 (Regular) Page 3 of 7 6.2 Revising and Setting Council Calendars. 6.3 2019 Combined Street Improvement Project; Final Payment and Project Close-out for the Street Renewal Project Area. Councilmember Skogquist noted the election canvass meeting should be added to the Council calendar for November 12 at 1:00 p.m. Upon a roll call vote: Mayor Rice, Councilmembers Barnett, Freeburg, Skogquist, and Wesp voted in favor. Motion carried. 7. REPORTS OF OFFICERS, BOARDS AND COMMISSIONS 7.1 Planning Items: None. 8. PETITIONS, REQUESTS AND COMMUNICATION None. 9. ORDINANCES AND RESOLUTIONS 9.1 RES/Adopting Assessment for Services Against Property with Delinquent Accounts (1010 Grant Street). Director of Public Services Mark Anderson shared a background report stating Anoka City ordinances and Minnesota Statutes allow for the certification of unpaid service billings. The proposed assessment was for an emergency water service repair at 1010 Grant Street on March 22, 2020, and that after review of the circumstances it was determined the property owner would be assessed over five years for the cost of the repair. Motion by Councilmember Freeburg seconded by Councilmember Barnett, to adopt a resolution Certifying the 2020 Assessment for Services Against Property with Delinquent Accounts (1010 Grant Street). Upon a roll call vote: Mayor Rice, Councilmembers Barnett, Freeburg, Skogquist, and Wesp voted in favor. Motion carried. 9.2 RES/2020 Combined Street Improvement Project; Adopt Revised Assessment Roll (Bob Ehlen Area SRP Project). Engineering Technician Ben Nelson shared a background report stating on December 2, 2019, City Council held the assessment hearing at 7:00 pm at City Hall and approved the assessment roll for the 2020 Combined Street Improvement October 19, 2020 (Regular) Page 4 of 7 Project (Bob Ehlen Area SRP Project). The subject properties with PID 06-31- 24-41-0004 (900 Bob Ehlen Drive) and PID 06-31-24-42-0058 (unassigned address) are located within the construction limits of the project and were included in the adopted assessment roll. At the time the assessment roll was adopted the property owner was in the process of a lot combination. On July 28, 2020, the City received notice that the subject parcels where combined and the new PID is 06-31-24-44-0007 (1055 East Main Street). The property with PID 06-31-24-44-0007 will have one of the street unit assessments ($7,160.00) removed, given the lot combination was completed and recorded at Anoka County. In addition to the above assessment adjustment, the ownership of some parcels located within the construction limits have changed. Motion by Councilmember Barnett seconded by Councilmember Wesp, to adopt a resolution for the 2020 Combined Street Improvement Project; adopt a revised Assessment Roll (Bob Ehlen Area SRP Project). Mayor Rice referred to the credit and asked if the assessment changed based on street footage and if two water stubs were charged. Mr. Nelson explained the amounts were added together into the same PID so only street unit will be removed and clarified the City only installed one sewer and water service to the property. Upon a roll call vote: Mayor Rice, Councilmembers Barnett, Freeburg, Skogquist, and Wesp voted in favor. Motion carried. 9.3 RES/2020 Combined Street Improvement Project; Adopt Revised Assessment Roll (Monroe Area SRP Project). Mr. Nelson shared a background report stating on December 16, 2019, City Council held the assessment hearing at 7:00 pm at City Hall and approved the assessment roll for the 2020 Combined Street Improvement Project (Monroe Area SRP Project). The subject properties with PID 07-31-24-22-0125 (1923 3rd Avenue) is located within the construction limits of the project and was included in the adopted assessment roll in anticipation the parcel had two sanitary sewer services based on the televising video of the main. As the project progressed it was discovered that said property was served by only one sanitary sewer service which, the contractor installed as part of the project. The property with PID 07- 31-24-22-0125 will have one sanitary sewer service unit assessment ($1,180.00) removed, given the second service was not installed. The subject properties with PID 12-31-25-11-0099 (12 Bridge Square) is located within the construction limits of the project and was included in the adopted assessment roll in anticipation the parcel had a sanitary sewer service. As the project progressed this property did not have an existing sanitary sewer service and therefor the contractor did not install a sanitary sewer service as part of the project. The property with PID 12-31-25-11-0099 will have the sanitary sewer service unit assessment ($1,180.00) removed, given the service was not installed. The subject October 19, 2020 (Regular) Page 5 of 7 properties with PID 07-31-24-22-0042 (420 East Main Street) is located within the construction limits of the project and was included in the adopted assessment roll in anticipation the parcel had a water service. As the project progressed this property did not have an existing water service and therefor the contractor did not install a water service as part of the project. The property with PID 07-31-24-22- 0042 will have the water service unit assessment ($2,580.00) removed, given the service was not installed. In addition to the above assessment adjustment, the ownership of some parcels located within the construction limits have changed. Councilmember Skogquist disclosed that because adoption of this assessment would affect property he owns as well as his church home that he would be abstaining. Motion by Councilmember Freeburg seconded by Councilmember Barnett, to adopt a Resolution 2020 Combined Street Improvement Project; adopt a revised Assessment Roll (Monroe Area SRP Project). Upon a roll call vote: Mayor Rice, Councilmembers Barnett, Freeburg, and Wesp voted in favor. Councilmember Skogquist abstained. Motion carried. 9.4 RES/Anoka County CSAH-116 (Bunker Lake Boulevard) at TH-47 (St. Francis Boulevard) Intersection Improvements; Approve Joint Powers Agreement with Anoka County Highway Department. Mr. Nelson shared a background report stating on July 3, 2018 the City of Anoka supported Anoka County’s CSAH-116 (Bunker Lake Blvd) at TH-47 (St. Francis Blvd) Intersection Improvements by providing a letter of support for the project. The City supported the County’s efforts addressing the geometric issues, congestion, safety concerns and sidewalk/trail network. He outlined the Anoka County Highway Department’s project kickoff meeting for the intersection improvements at CSAH-116 (Bunker Lake Boulevard) and TH-47 (St. Francis Boulevard) in 2021 and open house that had approximately 100 people attend. One comment heard multiple times was that the project should include upgrades to Trunk Highway 47. It appeared that Ramsey residents felt a four-lane section should be considered with the project. The County mentioned the only improvements on TH-47 as part of their project includes incorporating improvements from the State’s Highway 47/169 Resurfacing Project scheduled for 2021. The proposed improvements including the addition of left-turn lanes - to the CSAH-116 and TH-47 intersection will increase capacity by better accommodating all traffic and left-turns in particular. The project will also widen a bridge on CSAH-116 that crosses an oxbow of the Rum River, to the east of TH-47. The widened bridge will to accommodate a turning lane on westbound CSAH-116 for vehicles turning north onto TH-47. Mr. Nelson outlined project benefits as well as the Joint Powers Agreement (JPA) required. The total project cost including construction engineering is $3,976,368 with the City portion being $57,015. Anoka County de-federalized a portion of the funding for the project October 19, 2020 (Regular) Page 6 of 7 which would have been an eligible City cost covered; therefore, the County is covering these costs by using local funds as part of the commitment to deliver the project. Anoka County will contribute $29,476 of federal funds to Anoka’s cost share portion so the City’s final cost share for this project is $27,539. Motion by Councilmember Wesp seconded by Councilmember Skogquist, to adopt a resolution Anoka County Csah-116 (Bunker Lake Blvd) at Th-47 (St. Francis Blvd) Intersection Improvements; Approve Joint Powers Agreement with Anoka County Highway Department. Upon a roll call vote: Mayor Rice, Councilmembers Barnett, Freeburg, Skogquist, and Wesp voted in favor. Motion carried. 10. UNFINISHED BUSINESS None. 11. NEW BUSINESS None. 12. UPDATES AND REPORTS 12.1 Tentative Agenda(s). The Council reviewed the tentative agendas of the upcoming Council meetings. 12.2 COVID-19: City Operations, Changes, and Impacts – Questions, Comments, and Discussion. 12.3 Update/Reminder, Anoka Highway 10 Virtual Open House, October 21- November 6, 2020. Mr. Nelson shared the upcoming Highway 10 Virtual Open House from October 21-November 6, 2020 and outlined online comment opportunities with in person meetings by reservation only. 12.4 CARES Act Small Business Fund Update. Housing and Redevelopment Authority Manager Darin Berger shared the CARES Act Small Business Fund program application period closed and that staff and the consultant were reviewing applications. He shared 37 applications were received totaling $656,684 and included five nonprofit organizations, of which 15 were approved totaling $186,854.19. He outlined expenses applied for included virtual environments, payroll, PPE, and lease/mortgage payments and noted the Anoka Champlin Fire Department and QCTV expenses totaled $75,000. Mr. Berger October 19, 2020 (Regular) Page 7 of 7 noted recipients includes those from the Round Up program and that some funds would be used for auditing expenses in January for a total allocation of $272,471.19 for Council approval at the next meeting. Councilmember Skogquist asked if Rum River Arts Center was included in the list and asked about those nonprofits who submitted were based on inquiries with no final applications. Mr. Berger confirmed some nonprofits had submitted inquires but did not proceed with full applications. Councilmember Barnett asked about next steps and when funds would be distributed. Mr. Berger responded applicants would begin to receive funds next week. 12.5 Staff and Council Input. None. 13. ADJOURNMENT Councilmember Freeburg made a motion to adjourn the Regular Council meeting. Councilmember Wesp seconded the motion.
