June 29, 2023 Page 1 of 2 SPECIAL MEETING OF THE ANOKA CITY COUNCIL ANOKA CITY HALL CITY COUNCIL CHAMBERS JUNE 29, 2023 1. CALL TO ORDER Mayor Rice called the special meeting of the City Council to order at 6:00 p.m., followed by the Pledge of Allegiance. 2. ROLL CALL Present at roll call: Mayor Rice, Councilmembers Scott, Skogquist, Wesp, and Weaver. Staff present: City Manager Greg Lee, Community Development Director Doug Borglund, Senior City Planner Clark Palmer, City Attorney Scott Baumgartner. Absent at roll call: None. 3. COUNCIL BUSINESS AND/OR DISCUSSION ITEMS 3.1 RES/ Consideration of Purchase Agreement; 2939 6th Avenue, Miller Manufacturing Building. Community Development Director Doug Borglund shared a background report stating on June 26, 2023 the City Council was presented with a purchase agreement for the property at 2939 6th Avenue/06-31-24-22-0010 and 06-31-24- 0090. The City Council requested the City Attorney work with the seller’s attorney to revise the purchase agreement and address concerns brought forward by the City Council and since that time the purchase agreement has been revised for the City Council’s review and consideration. City Attorney Scott Baumgartner outlined the proposed changes in detail that included clarification that the $500,000 shall be applied towards the purchase agreement, inclusion of title commitment and inspection of the property, reference towards scheduling of soil borings, timeline for financing elements, inclusion to terminate at any time for any reason during the due diligence period, that the property will be sold as is, and other elements. Councilmember Weaver thanked staff for their work and confirmed the seller will share the Phase I EAS upon signature of the purchase agreement. Mr. Baumgartner said the seller’s broker was present but had assured the environmental study would be released once the purchase agreement was signed. June 29, 2023 Page 2 of 2 Councilmember Wesp asked if a title search had been conducted the last time this property was sold. Tim Prinson, owner’s agent, stated Lakeland Tool had purchased and had included the real estate as part of the assets. (inaudible) Mr. Baumgartner confirmed the City has an April 24, 2023, title commitment and was confident a title search had been conducted. City Manager Greg Lee noted the City received title commitment on April 2, 2019. Motion by Councilmember Skogquist, seconded by Councilmember Scott, to adopt a resolution approving purchase of real property; 2939 6th Avenue/PID 06- 31-24-21-0090 and PID 06-31-24-22-0010. Upon a roll call vote: Mayor Rice, Councilmembers Scott, Skogquist, Weaver, and Wesp voted in favor. Motion carried. UPDATES AND REPORTS Councilmember Skogquist requested a special meeting be held at 5:00 p.m. prior to the July 17, 2023, regular meeting to discuss organized hauling. Councilmember Scott supported the request. Mr. Baumgartner said staff will review the topics to be discussed during the special meeting and would confirm the meeting start time. Councilmember Weaver invited the community to attend the annual fireworks display on July 3. ADJOURNMENT Councilmember Skogquist made a motion to adjourn the Special Council meeting.
