Yes: 6- Mayor Wilson, Vice Mayor Rizzi, Councilmember Evans, Councilmember Heck, Councilmember Nesser and Councilmember Schroeder No: 0 Excused: 1- Councilmember Johnson City of Apache Junction, Arizona Page 1 City Council Meeting Meeting Minutes July 19, 2022 1. 22-426 Consideration of acceptance of agenda. 2. 22-360 Consideration of approval of the minutes of the special meeting of June 20, 2022. 3. 22-427 Consideration of approval of minutes of the regular meeting of July 5, 2022. 4. 22-401 Consideration of approval of proposed Resolution No. 22-22 authorizing the city to enter into Intergovernmental Agreement (IGA) Amendment No. 2 with Arizona Department of Transportation (ADOT) for additional funds that will be used for bicycle and pedestrian improvements along Idaho Road from Superstition Boulevard to McKellips Road in the amount of $243,247.00. 5. 22-455 Consideration of approval of proposed Resolution No. 22-23 authorizing the city to enter into an Intergovernmental Agreement (IGA) Amendment No. 2 with Arizona Department of Transportation for additional federal funds in the amount of $1,943,679 for sidewalk improvements on Old West Highway from Idaho Road to Goldfield Road and on Winchester Road from 6th Avenue to Old West Highway. 6. 22-422 Consideration of approval of vacation of dedicated right-of-way, a portion of Ness Boulevard north of North Apache Trail for the purpose of combining lots for future housing development for Bela Flor. 7. 22-424 Consideration of approval for a Federal Patent Easement (FPE) extinguishment of Scenic Street (alignment) from Plaza Drive to Ness Boulevard (alignment), for the purpose of combining lots for a future housing development for Bela Flor. 8. 22-432 Consideration of approval to enter into an agreement with Roadway Electric, LLC for traffic signal repair services through the City of Mesa Cooperative Contract # 2022146 for one (1) year in an amount not to exceed $400,000.00 with an option to renew annually and not to exceed five (5) years. 9. 22-440 Consideration of approval of the Final Plat for Blossom Rock Phase 1 in order to facilitate a 554-lot residential subdivision consisting of approximately 212 acres zoned Master Planned Community (MPC). 10. 22-441 Consideration of approval of the Final Plat for Blossom Rock Phase 2 in order to facilitate a 691-lot residential subdivision consisting of approximately 168 acres zoned Master Planned Community (MPC). AWARDS, PRESENTATIONS AND PROCLAMATIONS F. REGIONAL INTERGOVERNMENTAL UPDATES 14. 22-433 Brief summary of intergovernmental updates from mayor and councilmembers. G. CITY MANAGER'S REPORT 15. 22-429 City Manager's Report. Assistant City Manager Matt Busby, addressed the recent Pinal County election ballot issue. He stated there were seven (7) municipalities affected by the error in ballot distribution. Pinal County has been sharing several resources through social media, press releases, and news broadcasts, which the city is reposting to its social media sites, for the voters to understand what happened and how the County will rectify the situation. Mr. Busby reviewed the new card insert that will accompany the second mailing of ballots. This will explain what happened, who was impacted, where to go to find out if you were impacted, and a website where everyone in Pinal County can go to find the information quickly. Mr. Busby highlighted the city's homepage with the link to the city's elections web pages with several resources and overall election information. The second ballot that people receive must be voted if they want their vote for Mayor and the City Council members counted. Mr. Busby introduced Supervisor Jeff Serdy, who had several updates regarding the county's activities and a bit on the election matter. 16. 22-417 Presentation and discussion with Pinal County District 5 Supervisor Jeff Serdy. Pinal County District 5 Supervisor Jeff Serdy provided an update on the following items: 1. The August 2, 2022 ballot issues 2. Recent redistricting based on the 2020 Census 3. Formation of the Land Managers discussion group City of Apache Junction, Arizona Page 3 City Council Meeting Meeting Minutes July 19, 2022 4. Peralta Road- Pinal County will have their first park opening around January 2023 5. Announced a new winery in the Peralta area - estimated 20 acres 6. Creation of another discussion group related to the Fish Creek Hill fire and road that was washed out. 7. He is organizing a meeting with the Pinal County Fire Chiefs to discuss the 911 system 8. The 1/2 cent sales tax that is due to Sunset in 2024 9. State Land Department needs their own law enforcement agency 17. 22-428 Announcement of current events. Public Information Officer Al Bravo highlighted the following events: 1. Announced Mayor Wilson and City Manager Powell attended the funeral services for Queen Creek Mayor Gail Barney 2. Apache Junction School is back in session: watch for kids and the additional traffic 3. AJUSD is hiring H. PUBLIC HEARINGS 18. 22-420 Consideration of application for an interim permit and new Series 10 Beer and Wine Store liquor license for Apache Marketplace located at 420 N. Apache Trail. The next step in the process is for the council to hold a public hearing on the application and make a recommendation of approval or denial to the Arizona Department of Liquor License and Control. Councilmember Evans moved, seconded by Vice Mayor Rizzi, that the interim application and new application for a series 10 Beer and Wine liquor license for Apache Marketplace located at located at 420 N. Apache Trail, be recommended for approval to the Arizona Department of Liquor Licenses and Control. Yes: 6- Mayor Wilson, Vice Mayor Rizzi, Councilmember Evans, Councilmember Heck, Councilmember Nesser and Councilmember Schroeder No: 0 Excused: 1- Councilmember Johnson City Clerk Jennifer Pena stated the city received an interim application and a series 10, Beer and Wine Liquor License submitted by Vishal Goel for Apache Marketplace located at 420 N. Apache Trail. Ms. Pena stated a series 10 is a non-transferable, off-sale retail privileges liquor license which allows a retail store to sell beer and wine (no other spirituous liquors). The property was posted on June 20,2022, giving notice of the public hearing. No comments have been received in support or opposition of the application. Mayor asked the applicant if they wished to address council, Ms. Pena stated the applicant was unable to attend the meeting. Mayor opened the public hearing, receiving no comments from the public, he closed the public hearing. City of Apache Junction, Arizona Page 4 City Council Meeting Meeting Minutes July 19, 2022 I. OLD BUSINESS J. NEW BUSINESS 19. 22-425 Presentation, discussion and consideration of Resolution No. 22-26, an intergovernmental agreement with the City of Apache Junction and the Apache Junction Unified School District #43 for a grant-funded school resource officer at the Apache Junction High School. Councilmember Schroeder moved, seconded by Councilmember Nesser, that Resolution No. 22-26, authorizing the city to enter into an intergovernmental agreement with Apache Junction Unified School District #43 for a grant-funded School Resource Officer at The Apache Junction High School be approved. Yes: 6- Mayor Wilson, Vice Mayor Rizzi, Councilmember Evans, Councilmember Heck, Councilmember Nesser and Councilmember Schroeder No: 0 Excused: 1- Councilmember Johnson Police Chief Michael Pooley stated the Apache Junction Police Department (AJPD) has been asked to partner with the Apache Junction Unified School District #43 (AJUSD #43) in providing them with a school resource officer (SRO) for the Apache Junction High School with the position being filled by an AJPD sworn police officer. The position will be 100% funded (salary and benefits) by a grant secured by AJUSD for two (2) years. AJUSD #43 has committed to pay for any training the officer will need in order to fulfill the requirements of the grant. Resolution No. 22-26 which includes an intergovernmental agreement between the City of Apache Junction and AJUSD #43, AJPD requests council approval of this partnership. The assigned officer would perform the following: • Provide law enforcement and police services to the students, administration, campus and the areas in the immediate proximity to the school, will take reports, investigate criminal incidents and enforce state and city ordinances. • Regularly patrol the campus to deter criminal or delinquent activities; monitor uniform crime reporting statistics (NIBRS) and act as a liaison between AJPD and AJHS and CCJHS. • Develop and foster a partnership with AJUSD administrators in order to create a secure and safe learning environment for students; assist school administrators to enforce their own policies and procedures; protect school administrators while weapons and/or illegal drug searches are conducted. • Be present in situations where a student’s emotional state may present a risk to other students and staff members; and work in tandem with school administrators in emergency crisis planning and facility security. • Be a highly visible participant within the school community by planning, regularly attending and participating in school-related events and functions; and build working relationships with the school’s staff and parent/teacher organizations. City of Apache Junction, Arizona Page 5 City Council Meeting Meeting Minutes July 19, 2022 • Develop and teach classes with an emphasis on the positive role of police officers in society and other law-related education topics. • Work with academic advisors and behavioral coaches in providing outside agency student services. • Interact with students in the classroom and in the common areas with the intention of promoting law enforcement as a profession and to serve as a positive role model to students. 20. 22-447 Presentation, discussion and consideration of Resolution No. 22-27, an intergovernmental agreement with the City of Apache Junction and the Apache Junction Unified School District #43 for a grant-funded school resource officer at the Cactus Canyon Junior High School. Vice Mayor Rizzi moved, seconded by Councilmember Schroeder that Resolution No. 22-26, authorizing the city to enter into an intergovernmental agreement with Apache Junction Unified School District #43 for a grant-funded School Resource Officer at The Cactus Canyon Junior High School be approved. Superstition Boulevard, Apache Junction, Arizona, respectively; and other meetings if necessary. CALL TO PUBLIC George Schroeder, 2444 W Virginia St., Apache Junction commended council and the Police Chief on the grants for the additional School Resource Officers. He spoke on the health of our planet, and the need for improvements in his neighborhood. Lastly he inquired about the fence his neighbor has erected and whether it is legal or not. N.
