Village of Arcanum Council Meeting July 28, 2020 7:00 p.m. Call to Order Mayor Bonnie Millard opened the meeting with the Pledge of Allegiance along with all present members of council. Roll Call Council Members present include Tim Philpot, Jacob Banks, Jerry Boolman, Rick Genovesi and Taylor Somers. Council President Jerry Boolman moved to excuse Council Member Tammy Bruner. Council Member Banks seconded. All present council members voted yea. Motion passed. Also present were Fiscal Officer Toni Stanley, Village Administrator Bill Kessler, Police Chief Marcus Ballinger, Administrative Specialist Mary Stephens, Nate Kubik (Daily Advocate), Tammy Short, Brian Short and Missie Shilt. Meeting Minutes – Corrections and Approvals Mayor Millard asked for the approval of the meeting minutes from July 14, 2020. Council President Boolman moved to approve meeting minutes from July 14, 2020. Council Member Philpot seconded. All present council members voted yea. Motion passed. Amendments to Agenda Mayor Millard asked for an executive session after Announcements to discuss matters that require confidentiality according to state statutes. Comments from the Public Brian and Tammy Short presented Chief Ballinger with a handcrafted wood police piece of artwork and custom tumblers in appreciation of the Arcanum Police Department. Administrative Reports Mayor:  The Village’s exit conference call with the auditor was held on 7/27/2020 and findings shall remain confidential until the report is released by the auditor’s office.  The swearing-in ceremony of new firefighters has been postponed until September 13, 2020 at 2:00pm.  A letter regarding issues with the block party event was received. The event was not Village- sponsored, so those concerns were asked to be redirected to the host of the event. Mayor Millard added that comments from the public regarding the event have been favorable.  A community garage sale was held and Mayor Millard commented that residents preferred the July weekend as opposed to May.  Mayor Millard and VA Kessler met with Mr. Shellabarger from Arcon. Arcon is ready to begin phase I of the project behind the former Sutton’s Grocery store. Phase I will consist of approximately 17 lots. Arcon plans to start initial infrastructure in Jan-March 2021 and begin building homes in May 2021.  The Board of Zoning Appeals met to discuss Kniesly property at 105/107 N High Street regarding an apartment on the first floor of their downtown property. A motion was made and unanimously approved to temporarily reclassify the property to B3 pending the Planning Board’s re-evaluation of the downtown area classifications. Council Member Philpot moved to accept the variance at 105/107 N High Street. Council Member Somers seconded. All present council members voted yea. Motion passed.  A map from Access Engineering was dispersed showing the boundary of the area to be submitted in August to the Clean Ohio Act for the additional park development. The Village will know if the funding is approved in September. Vi l l a ge o f A r c a n u m R e gu l a r C o u n c i l M e e t i n g July 28, 2020 7:00 p.m. Page |2 Solicitor: Village Administrator:  The park expansion will allow for upgrades to the Village as well as electrical upgrades.  Concerns of clean-up were received regarding the block party. The street department was not brought in after the event, not knowing how large it would be. SRL-Troutwine did well with the event and clean up. SRL-Troutwine hosted the event as a fundraiser, worked closely with the Health Department and they have hopes of it being an annual event.  The State is getting ready to start the grinding process to lay the new pavement. Crosswalks are being redone to meet ADA standards. Fiscal Officer:  Acceptance of properly appropriated and funded expenditures. Council Member Philpot moved to accept the properly appropriated and funded expenditures. Council President seconded. All present council members voted yea. Motion passed.  Income tax revenue is slightly down compared to this time last year by approximately 1%. Committee Reports Safety: The committee had nothing to report at this time. New vests will be ordered for officers soon. Police Chief Ballinger advised that the cruiser cameras were installed and working properly. A new police officer will begin with the Village on August 17, 2020. Utility Committee: Chairperson Philpot advised that a half cent increase will be recommended later in August 2020 and another half cent in February 2021 to go toward the Electric Capital Improvement Fund. The purpose of the increase is to purchase a bucket truck at the cost of approximately $300,000 and to upgrade the Village’s electric grid to 7200. VA Kessler reported that disconnects were once again implemented. Less than five were in jeopardy and were paid by the end of the day. Effort was made to help residents with payment plans. Finance & Audit: The next meeting is scheduled August 3, 2020 at 4:30pm. Service and Leisure: The committee met on July 16, 2020. The west side of the village’s sidewalks needing repair were discussed. The next meeting is July 30, 2020 at 4:30pm. Personnel: Planning: Meetings were held on July 15 and July 27 to work on the proposed nuisance documents which will be brought before council as a first reading during tonight’s meeting. Old Business New Business Ordinance 2020-19 - An Ordinance Providing For An Amendment To The 2020 Appropriations For Current Expenses And Other Expenditures Of The Village Of Arcanum, Darke County, Ohio And Declaring An Emergency (Electric Fund). Council President Jerry Boolman moved to waive the three-reading rule of Ordinance 2020-19. Council Member Philpot seconded. All present council members voted yea. Motion passed. Council President Boolman moved to adopt Ordinance 2020-19. Council Member Philpot seconded. All present council members voted yea. Motion passed. Council President Boolman moved to declare Ordinance 2020-19 an emergency. Council Member Philpot seconded. All present council members voted yea. Motion passed. Council President Boolman moved to waive the three-reading rule of Ordinance 2020-20. Council Member Genovesi seconded. All present council members voted yea. Motion passed. Council President Boolman moved to adopt Ordinance 2020-20. Council Member Genovesi seconded. All present council members voted yea. Motion passed. Ordinance 2020-21 - An Ordinance Providing For Adoption Of New Job Description For The Village Part-Time Administrative Specialist (Exhibit A). 1st Reading. Council Member Philpot moved to waive the three-reading rule of Ordinance 2020-21. Council Member Somers seconded. All present council members voted yea. Motion passed. Ordinance 2020-22 - An Ordinance Regulating Trees And Shrubbery In The Village Of Arcanum. 1st Reading. Ordinance 2020-23 - An Ordinance Repealing Ordinance 2008-15. 1st Reading Ordinance 2020-24 - An Ordinance Repealing Ordinances 2013-22 And 2019-26. 1st Reading Ordinance 2020-25 - An Ordinance Regulating Weeds And Grass In The Village Of Arcanum. 1st Reading Ordinance 2020-26 - An Ordinance Enacting An Exterior Property Maintenance Code For The Village Of Arcanum, Ohio. 1st Reading Resolution 2020-17 - A Resolution Authorizing The Village Of Arcanum To Enter Into A Loan With Greenville National Bank And Declaring An Emergency. Council President Boolman moved to waive the three-reading rule of Resolution 2020-17. Council Member Banks seconded. All present council members voted yea. Motion passed. Council President Boolman moved to adopt Resolution 2020-17. Council Member Banks seconded. All present council members voted yea. Motion passed. Resolution 2020-18 - A Resolution Of Authorization Allowing The Village Administrator To Apply For Funding And Declaring It An Emergency. Council Member Banks moved to waive the three-reading rule of Resolution 2020-18. Council Member Genovesi seconded. All present council members voted yea. Motion passed. Council Member Banks moved to adopt Resolution 2020-18. Council Member Genovesi seconded. All present council members voted yea. Motion passed. Council Member Banks moved to declare Resolution 2020-18 an emergency. Council Member Genovesi seconded. All present council members voted yea. Motion passed. Announcements Executive Session – Council President Boolman moved to go into Executive Session for the purpose of matters that require confidentiality according to state statutes. Council Member Genovesi seconded. All present council members voted yea. Motion passed. Executive Session commenced at 7:31pm. At 7:48pm, Council President Boolman moved to return from Executive Session. Council Member Banks seconded. All present council members voted yea. Motion passed.
