ARMADA TOWNSHIP BOARD Regular Meeting Minutes 23121 East Main Held Electronically & In Person Armada, MI 48005 June 14, 2023 7:00 p.m. REGULAR MEETING CALL TO ORDER: Supervisor Paterek called the meeting to order at 7 p.m. Motion CARRIED MEMBERS PRESENT: Murray, Goetzinger, Job, Paterek, Swiacki Also present: Township Attorney Christine Anderson MEMBERS ABSENT: None SET/AMEND AGENDA: Motion by Swiacki seconded by Murray to approve the agenda as presented. Motion CARRIED PUBLIC COMMENTS: Bill Calvin, Sue Vandenberge. CONSENT AGENDA ITEMS: (a) Approval of Minutes: Regular Minutes May 10, 2023 (b) Current Bills totaling $ 281,560.12 (c) Revenue and Expenditure Report (d) Department Reports Motion by Swiacki seconded by Murray to approve consent agenda items as presented. Ayes: Swiacki, Murray, Goetzinger, Paterek Nays: Job Motion CARRIED CORRESPONDENCE/INFORMATION: Received a thank you letter from the Veteran’s Auxiliary of Striber/McVicar VFW Post 2052 of Romeo for proclaiming Armada Township as a Purple Heart Community. UNFINISHED BUSINESS: Website Revamp: No action. The clerk will contact other website designers who specialize in municipal websites. Broadband Grant: No action. NEW BUSINESS: FOIA Appeal: Michael Butz: Motion by Paterek seconded by Murray to uphold the denial of Mr. Michael Butz’s FOIA request for election poll book records in a csv or xls file from the election held in Armada Township on November 8, 2022 this is due to the fact that those records were destroyed per instructions in an email received from the Director of the Michigan Bureau of Elections dated January 17, 2023. The township can provide a redacted paper print out of the electronic poll book generated on election night and can scan the redacted paper documents to a flash drive in PDF form. Motion by Paterek seconded by Murray to retract motion to make another motion. Supervisor Paterek stated that in lew of the fact that we have 10 business days to fulfill Mr. Butz’s FOIA, motion by Paterek seconded by Murray to turn any and all hardware we have over to Axis Discovery and Branden Fannon to try to recover the electronic poll book data that was deleted by directive of the State of Michigan Elections Commission. All ayes Motion CARRIED Motion by Paterek seconded by Murray to set a special meeting to consider Mr. Butz’s FOIA appeal for June 28, 2023 at 7:00 p.m. All ayes Motion CARRIED Macomb County’s Urban County 2024-2026 Program Year Renewal: Cooperative Agreement and Resolution No. 2023-02: Motion by Swiacki seconded by Paterek to approve Cooperative Agreement “Urban County” CDBG Program for FY24 to FY26 and adopt Resolution No. 2023-02 as presented for renewal. The supervisor will contact McKenna’s office to discuss the issue. Motion by Job seconded by Murray to go out for an RFP for a new attorney. Ayes: Job, Murray Nays: Paterek, Goetzinger, Swiacki Motion FAILED Planning Commission: Notice of Adoption No. 114-43 – Armada Zoning Map Amendments: No action. Planner will be contacted to make proper map modifications. Maintenance personnel: Motion by Swiacki seconded by Murray to hire John Peitz at an hourly rate of $16. Ayes: Swiacki, Murray Nays: Goetzinger, Job, Paterek Motion FAILED Motion by Paterek seconded by Job to hire John Peitz at an hourly rate of $15. Ayes: Paterek, Job, Goetzinger, Murray Nays: Swiacki Motion CARRIED Annual Michigan Township Association Dues – July 1, 2023 to June 30, 2024: Motion by Swiacki seconded by Murray to approve annual dues of $7,318.00 and $ 219.54 for legal defense fund for a total of $7,537.54. All Ayes Motion CARRIED Fire Chief – (Committee to discuss upcoming expiration of contract): Chief Krotche’ s contract expires on July 31, 2023. Motion by Swiacki seconded by Paterek to have Supervisor Paterek and Clerk Swiacki on the committee. All Ayes Motion CARRIED Comcast Phone Services: No action. Park – Playground Mulch: Motion by Swiacki seconded by Paterek to accept quote from Cross Building & Excavating as presented for 20 yards of playground mulch only for $600. All Ayes Motion CARRIED PUBLIC COMMENT: BOARD MEMBERS: Trustee Job, Trustee Goetzinger, Treasurer Murray, Clerk Swiacki and Supervisor Paterek.
