RECORD OF PROCEEDINGS 00767 ASHVILLE COUNCIL REGULAR SESSION Held: September 23, 2019 Page 1 of 2 The Council of Ashville convened in Regular Session from 6:33 PM to 7:00 PM in the Council Meeting Room at 200 East Station Street, Ashville, Ohio 43103. Mayor Wise called the meeting to order with the Pledge of Allegiance and a moment of silence. All votes were yea. MAYOR'S REPORT: Mayor Wise asked council to review the 2017-2018 Audit that had been issued to them for discussion at the October 7 meeting. The Mayor also noted that we received a liquor license transfer request from the Department of Liquor Control giving us the option to request a hearing or to waive a hearing and not oppose the transfer. Brad Lutz moved, seconded by Roger Clark, to waive a hearing. All votes were yea. Wise closed his report by asking the clerk to put parking issues at Cherry Street Diner on the agenda for the next Committee of the Whole meeting. TAX ADMINISTRATOR'S REPORT: Brad Lutz moved, seconded by Randy Loveless, to approve the Tax Administrator's monthly report. All votes were yea. --- POLICE DEPARTMENT REPORT: Chief George announced that Officer Michael Hedrick resigned and that he posted an ad to fill the position. George also announced that Officer Andrew Bynorth will be deployed to Guantanamo Bay for approximately 10 months at the end of the year, so the department will be short one officer during that period. VILLAGE ADMINISTRATOR'S REPORT: Franklin Christman delivered his written report which included the progress of the various street improvements going on throughout the village. Christman also said he, Chris Tebbe, and Adam Kehoe are still working with the EPA on the I & I Findings and Orders. RESOLUTION (S) FOR FIRST READING 13-2019 A RESOLUTION TO STRONGLY URGING THE OHIO GOVERNOR AND MEMBERS OF THE OHIO GENERAL ASSEMBLY TO RESTORE THE LOCAL GOVERNMENT FUND TO PRE-RECESSION LEVELS. Brad Lutz moved, seconded by Randy Loveless, to have the First Reading. All votes were yea. After the reading, Brad Lutz moved, seconded by Roger Clark, to accept the First Reading. All votes were yea. 14-2019 A RESOLUTION AUTHORIZING THE MAYOR OR VILLAGE ADMINISTRATOR TO EXECUTE CONTRACTS FOR DELINQUENT DEBT COLLECTION WITH THE OHIO ATTORNEY GENERAL OFFICE AND DECLARING AN EMERGENCY. Nelson Embrey moved, seconded by Randy Loveless, to have the First Reading. After the reading, Nelson Embrey moved, seconded by Brad Lutz, to accept the First Reading, suspend the Rules of Council, waive the Second and Third Readings and adopt as an emergency measure. All votes were yea. 15-2019 A RESOLUTION AUTHORIZING SUPPLEMENTAL APPROPRIATIONS BETWEEN ACCOUNTS AND AMENDING ORDINANCE 2019-02, THE PERMANENT APPROPRIATIONS ORDINANCE FOR THE VILLAGE OF ASHVILLE, OHIO, AND DECLARING AN EMERGENCY. Brad Lutz moved, seconded by David Rainey, to have the First Reading. After the reading, Nelson Embrey moved, seconded by Randy Loveless, to accept the First Reading, suspend the Rules of Council, waive the Second and Third Readings and adopt as an emergency measure. All votes were yea. ORDINANCE(S) FOR THIRD READING 2019-11 AN ORDINANCE FOR A CHANGE TO PART ELEVEN PLANNING & ZONING CHAPTER 1145 RESIDENTIAL OFFICE DISTRICT (RO). Tracie Sorvillo stated that she was only voting no because of the zoning classification of the property, not because she doesn't want Ms. Wilburn to have a successful restaurant. After the rea1 ling, David Rainey moved, seconded by Randy Loveless, to accept the Third Reading. Roger Clark, Randy Loveless and David Rainey voted yea with Tracie Sorvillo, Nelson Embrey and Brad Lutz voting no. Mayor Wise said that because of the obvious support of the restaurant from the neighbors his vote was yea and the n 10tion passed. 2019-13 AN ORDINANCE TO ACCEPT BILLY R. AND SUSAN A. NEAL'S APPLICATION FOR ANNEXATION BY THE UTILITY DEPARTMENT, ET AL FOR ANNEXATION OF CERTAIN TERRITORY CONTAININli 1.001 +/-ACRES IN HARRISON TOWNSHIP, COUNTY OF PICKAWAY, STATE OF OHIO, TO THE VILLAGE OF ASHVILLE. Brad Lutz moved, seconded by Randy Loveless, to have the Third Reading. All votes were y,�a. After the reading, Nelson Embrey moved, seconded by Tracie Sorvillo, to accept the Third Reading.
