RECORD OF PROCEEDINGS ASHVILLE COUNCIL REGULAR SESSION Held: SEPTEMBER 16, 2024 Page 1 of 3 The Council of Ashville convened in Regular Session from 6:30 PM to 6:57 PM in the Council Meeting Room at 200 East Station Street, Ashville, Ohio 43103. Mayor Welsh called the meeting to order with the Pledge of Allegiance and a moment of silence. The following members and visitors were present: Mr. CHAD NOGGLE Present Mr. COLTON HENSON Present Mr. ROGER CLARK Present Mr. DAVE RAINEY Present Mr. RANDY LOVELESS Present Mr. MATT SCHOLL Excused Colton Henson opened the meeting with a public appology for his actions during a traffic stop that he was involved in over Labor Day weekend. The appology is attached as part of the minutes. MINUTES OF PREVIOUS MEETING: Dave Rainey moved, seconded by Randy Loveless, to approve the September 3, 2024 minutes for the Regular Session as presented. All votes were yay. DEPARTMENTAL REPORTS POLICE: Chief Mettler reported that a new officer had been hired but the department is still down two officers. Roger Clark asked if speed was an issue on Long Street and Officer Jester said that the majority of speeding tickets are issued north of SR 752 and at The Distillery. STREET/SERVICE: Greg Sturgill reported that the storage garage was up and the he's waiting for a bid for the concrete flooring. Mayor Welsh asked Sturgill to put a speed limit sign on the north end of Lockbourne-Eastern Road. WATER: Jim Welsh reported that the pole is up for the third gateway for meter reading and that he is now working on well abandonment. CONSTRUCTION/DEVELOPMENT: Darryl Ward reported that sidewalks had been poured on Rail Street by The Distillery. PLANNING & ZONING: Samantha Pemberton reported that the P & Z Board will meet in October to review the third draft of the updated code. FINANCE: Roger Clark moved, seconded by Randy Loveless, to approve Then & Nows to Bricker Graydon for economic development consulting services in the amount of $3152.50 and American Legal Publishing for codified ordinance replacement pages in the amount of $8623.45. All votes were yay. RESOLUTIONS FOR FIRST READING 12-2024 A RESOLUTION DELINEATING AN OVERLAY IN RELATION TO THE PROPOSED WALNUT MILL INCENTIVE DISTRICTS #1 THROUGH #6, WITHIN THE VILLAGE OF ASHVILLE, OHIO; ADOPTING A WRITTEN ECONOMIC DEVELOPMENT PLAN AS TO SAME; SETTING THE TIME AND PLACE OF A PUBLIC  RECORD OF PROCEEDINGS ASHVILLE COUNCIL REGULAR SESSION Held: SEPTEMBER 16, 2024 Page 2 of 3 HEARING; AUTHORIZING AND RATIFYING THE GIVING OF NOTICE TO THE TEAYS VALLEY SCHOOL DISTRICT, THE EASTLAND-FAIRFIELD CAREER & TECHNICAL SCHOOL AND THE BOARD OF COUNTY COMMISSIONERS OF PICKAWAY COUNTY, OHIO, ALL PURSUANT TO OHIO REVISED CODE SECTION 5709.40(() AND ITS RELATED RULES AND LAWS, AND DISPENSING WITH THE REQUIREMENT THAT THIS RESOLUTION MUST BE READ ON THREE DIFFERENT DAYS PURSUANT TO OHIO REVISED CODE SECTION 731.17(A) AND DECLARING AN EMERGENCY. Dave Rainey moved, seconded by Randy Loveless, to have the First Reading. All votes were yay. Roger Clark asked if the village forgoes real estate taxes in lieu of the TIF. Bert Cline said the village will get TIF revenue in addition to real estate tax revenue. After discussion, Dave Rainey moved, seconded by Chad Noggle, to accept the First Reading, suspend the Rules of Council, waive the Second and Third Readings, and adopt as an emergency measure. All votes were yay. 13-2024 A RESOLUTION AUTHORIZING THE VILLAGE ADMINISTRATOR TO ENTER INTO A WATER SERVICE AGREEMENT WITH THE VILLAGE OF SOUTH BLOOMFIELD. Dave Rainey moved, seconded by Chad Noggle, to have the First Reading. All votes were yay. Roger Clark said he was confused because the resolution indicated South Bloomfield would provide water for free but the agreement stated that the village would be billed monthly. Clark asked for clarity on the fees. Bert Cline said he would discuss with South Bloomfield. Dave Rainey moved, seconded by Randy Loveless, moved to approve the First Reading. All votes were yay. 14-2024 A RESOLUTION ACCEPTING THE AMOUNTS AND RATES AS DETERMINED BY THE BUDGET COMMISSION AND AUTHORIZING THE NECESSARY TAX LEVIES AND CERTIFYING THEM TO THE COUNTY AUDITOR. Dave Rainey moved, seconded by Randy Loveless, to have the First Reading. All votes were yay. After the reading, Dave Rainey moved, seconded by Chad Noggle, to accept the First Reading, suspend the Rules of Council, waive the Second and Third Readings and adopt. All votes were yay. COMMITTEE REPORTS PARKS: Roger Clark reported that the committee met prior to the Committee of the Whole meeting and discussed installing lights with timers at the pickleball courts, building a small shelter house at the park on Lexington Avenue, and decided to keep the fence in the outfield of the main diamond in the park. Clark also said that the men's club asked if they could decorate the covered bridge in the park for Christmas. Roger Clark moved, seconded by Randy Loveless, to approve the club to decorate the bridge. All votes were yay. GUEST COMMENTS: A resident from The Distillery asked council if they could enforce a quiet zone during certain hours of the evening because she and her family were being awakened every night by passing trains blowing their horns. Council advised her that they have had this conversation with the railroad but were told that blowing the horns is a safety measure. If the village would enforce a quiet zone the village would assume legal liability if someone was injured or killed by the train coming through town without blowing the horn and that's not an option the village will consider. All votes were yay and the meeting adjourned.
