RECORD OF PROCEEDINGS ASHVILLE COUNCIL REGULAR SESSION Held: December 15, 2025 Page 1 of 3 The Council of Ashville convened in Regular Session from 6:31 PM to 8:33 PM in the Charles K. Wise Council Chambers at 200 East Station Street, Ashville, Ohio 43103. Mayor Clark called the meeting to order with the Pledge of Allegiance and requested a moment of silence. The following members and visitors were present: Mr. CHAD NOGGLE Present Mr. DARRYL GLICK Present Mr. JESSE BURKE Present Mr. DAVE RAINEY Present MINUTES OF PREVIOUS MEETING: Dave Rainey moved, seconded by Jesse Burke, to approve the minutes for the December 1, 2025 Regular Session as presented. All votes were yay. RESIGNATION: Dave Rainey moved, seconded by Chad Noggle, to approve the resignation of Steve Welsh as mayor. All votes were yay. COUNCIL APPOINTMENT: Jesse Burke moved, seconded by Chad Noggle, to appoint Jeff Martin to Council. All votes were yay with the exception of Darry Glick who voted no. The Oath of Office was administered following the vote. EXECUTIVE SESSION: At 6:38 PM Jesse Burke moved, seconded by Dave Rainey, to go into Executive Session pursuant to R.C. 121.22(G)(3) to confer with the Solicitor concerning a dispute involving the Village that is the subject of imminent court action. All votes were yay. Regular Session resumed at 7:53: PM with no action taken. LEGISLATION: ORDINANCES FOR FIRST READING 2025-10 AN ORDINANCE CREATING SEVEN INCENTIVE DISTRICTS AND DECLARING IMPROVEMENTS TO CERTAIN REAL PROPERTY WITHIN THE INCENTIVE DISTRICTS TO BE A PUBLIC PURPOSE, AND EXEMPT FROM REAL PROPERTY TAXATION; IDENTIFYING CERTAIN PUBLIC INFRASTRUCTURE IMPROVEMENTS THAT, ONCE MADE, WILL BENEFIT OR SERVE THE PARCELS IN THE INCENTIVE DISTRICTS; REQUIRING THE OWNERS OF THOSE PARCELS TO MAKE SERVICE PAYMENTS IN LIEU OF TAXES: ESTABLISHING AN INCENTIVE DISTRICT PUBLIC IMPROVEMENT TAX INCREMENT EQUIVALENT FUND FOR THE DEPOSIT OF SUCH SERVICE PAYMENTS; AUTHORIZING PAYMENTS TO THE TEAYS VALLEY LOCAL SCHOOL DISTRICT AND EASTLAND-FAIRFIELD CAREER AND TECHNICAL SCHOOLS; AND APPROVING RELATED MATTERS; AND DECLARING AN EMERGENCY. Darryl Glick moved, seconded by Chad Noggle, to have the First Reading. All votes were yay. After the reading, Dave Rainey moved, seconded by Chad Noggle, to suspend the Rules of Council, waive the Second and Third Readings, and adopt as an emergency measure. RESOLUTION FOR FIRST READING 12-2025 A RESOLUTION AUTHORIZING SUPPLEMENTAL APPROPRIATIONSBETWEEN ACCOUNTS AND AMENDING ORDINANCE 2025-01 THEPERMANENT APPROPRIATIONS ORDINANCE FOR THE VILLAGE OFASHVILLE, OHIO, AND DECLARING AN EMERGENCY. Dave Rainey moved, seconded by Chad Noggle, to have the First Reading. All votes were yay. After the reading, Dave Rainey moved, seconded by Chad Noggle, to suspend the Rules of Council, waive the Second and Third Readings, and adopt as an emergency measure. All votes were yay. VILLAGE ADMINISTRATOR: • Bert Cline submitted a request to allocate $67,000 in Parks and Recreation Impact Fees for the purchase of playground equipment at Westside Park. Dave Rainey moved, seconded by Jesse Burke, to approve the request. All votes were yay. • Cline stated that he would like the Council to consider allowing him to negotiate Impact Fees with developers if they agree to place Tax Increment Financing {TIF) designations on their properties. He explained that TIFs would generate greater revenue over a 30-year period and could be used at the Village's discretion, whereas Impact Fees are restricted to specific purposes within designated areas and must be returned to the developer if not utilized within a limited timeframe. Dave Rainey requested that Cline provide supporting financial data before a decision is made. PUBLIC COMMENTS Various members of the public spoke out against the proposed data center. COUNCIL COMMENTS: Jeff Martin expressed his appreciation to Chad Noggle and Steve Welsh for their service to the community. He emphasized that there is no place for threats and noted that unfounded accusations only serve to exacerbate the situation.
