June 6, 2016 STATE OF ALABAMA, LIMESTONE COUNTY, CITY OF ATHENS. The City Council of the City of Athens, Alabama met in regular session at the Athens Municipal Building, 200 Hobbs Street West in the said City on June 6, 2016, at 5:30 p.m. The meeting was called to order by Councilman Wayne Harper, President of the Council. Upon roll call the following were found to be present: Councilmember Chris Seibert, Harold Wales, Joseph Cannon and Wayne Harper. Mayor Marks led the Pledge of Allegiance. Annette Barnes, City Clerk, was present and recorded the minutes of the meeting. Wayne Harper offered the invocation. The Chairperson stated that a quorum was present and that the meeting was open for transaction of business. The Chairperson stated that the Minutes of the May 23, 2016 City Council Meeting had been submitted for approval. Councilman Cannon moved that the reading of the Minutes be suspended and that the Minutes be approved as recorded. The motion was seconded by Councilman Seibert and was unanimously carried. The Chairperson stated that the Minutes of the May 23, 2016 City Council Work Session Meeting had been submitted for approval. Councilman Cannon moved that the reading of the Minutes be suspended and that the Minutes be approved as recorded. The motion was seconded by Councilman Seibert and was unanimously carried. The Chairperson stated that the Special Minutes of the May 27, 2016 City Council Meeting had been submitted for approval. Councilman Cannon moved that the reading of the Minutes be suspended and that the Minutes be approved as recorded. The motion was seconded by Councilman Seibert and was unanimously carried. Mayor Marks introduced Frank Eskridge who was appointed as the City’s Manager of Water Services at the Council’s May 27th Special Session. He welcomed him to Athens and stated that Mr. Eskridge is scheduled to join the City staff on July 1st. Mayor Marks then read a proclamation declaring June 6, 2016 as Lineman Appreciation Day in recognition of the profession of linemen and in honor of the Electric Department personnel for their exemplary services to the City of Athens. LINEMEN APPRECIATION MONTH WHEREAS, the City of Athens, Alabama, would like to recognize and celebrate the profession of linemen and wishes to honor its Electrical Department personnel for their exemplary services to the City; and WHEREAS, their profession requires passion, dedication and ongoing training and is steeped in personal, family, and professional tradition; and WHEREAS, linemen are often first responders during storms and other catastrophic events working to repair damaged electrical lines and make the scene safe for other public heroes; and WHEREAS, linemen work with thousands of volts of electricity high atop power lines 24 hours a day, 365 days a year, to keep electricity flowing; and WHEREAS, linemen put their lives on the line everyday with little recognition from the community regarding the danger of their work; and WHEREAS, the U.S. House of Representatives recognizes the efforts of linemen in keeping the power on and protecting public safety and supports the designation of National Linemen Appreciation Day; and 1 NOW, THEREFORE, I, William R. Marks, Mayor of the City of Athens, Alabama do hereby proclaim June 6, 2016 as: “LINEMEN APPRECIATION DAY” in Athens and urge all citizens to recognize the selfless and dangerous work the City’s linemen do every day to keep our power on and public safe. IN WITNESS WHEREOF, I have hereunto set my hand and caused the official seal of the City of Athens, Alabama to be affixed this 6th day of June, 2016. Councilman Cannon introduced the following resolution: RESOLUTION BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ATHENS, ALABAMA, that the travel expenses in the following amount be approved for Electric Department personnel. Gary Scroggins TVPPA – Annual meeting $175.45 Destin, FL May 15 – 18, 2016 The motion was seconded by Councilman Wales and was unanimously carried. Councilman Wales introduced the following resolution: RESOLUTION BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ATHENS, ALABAMA, to purchase two (2) concept, model 3142, chairs for a cost of $2,746.00 from Endura. Funding for this purchase will be from the Police Department’s existing capital expenditure account. The motion was seconded by Councilman Seibert and was unanimously carried. Councilman Cannon introduced the following resolution: RESOLUTION A RESOLUTION TO DEANNEX APPROXIMATELY 2.3 ACRES LOCATED AT 24470 NICK DAVIS ROAD IN AN R-1(1) (LOW DENSITY SINGLE FAMILY RESIDENTIAL) DISTRICT. WHEREAS, on March 29, 2016, the City of Athens received a request from Eric and Jean Suarez to de- annex 2.3 acres of property located at 24470 Nick Davis Road in a R-1-1 District from the City Limits of Athens, and WHEREAS, City administration has reviewed the request and find that there would be no adverse impact to our provision of services in the area, no interruption in the continuity of our corporate limits to properties further north and east along Nick Davis Road, and would not place the City at a disadvantage from strategically annexing property that has apparent value as a substantial revenue source, and WHEREAS, the Code of Alabama 1975, as amended, provides that “whenever in the opinion of the council or governing body of any city or town the public health or public good requires that the corporate limits of such town or city be reduced and the boundaries thereof reestablished, said council shall pass a resolution defining the proposed corporate limits.” 2  NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ATHENS, ALABAMA, AS FOLLOWS: SECTION 1. The City Council of the City of Athens, Alabama, finds and declares as the legislative body of the City that it is in the best interest of the citizens of the City, and the citizens of the affected area, to remove the territory in Section 2 of this resolution from the City Limits of the City of Athens, Alabama. SECTION 2. The boundary lines of the City of Athens, Alabama, are hereby altered or rearranged so as to exclude therefrom the territory described in Attachment “A”, and illustrated on the attached map (Attachment “B”). SECTION 3. This resolution shall be published as provided by law, and a certified copy of same shall be filed with the Probate Judge of Limestone County, Alabama. SECTION 4. The territory described in this resolution shall no longer be included as a part of the corporate limits of Athens, Alabama, upon publication of this ordinance as set forth in Section 3, above. The motion died due to the lack of a second. Councilman Seibert introduced the following resolution: RESOLUTION BE IT RESOVLED BY THE CITY COUNCIL OF THE CITY OF ATHENS, ALABAMA, to appoint Harold Wales to the Solid Waste Authority Board to fulfill the term of Councilman Jimmy W. Gill ending February 28, 2019.
