January 5, 2017 STATE OF ALABAMA, LIMESTONE COUNTY, CITY OF ATHENS. The City Council of the City of Athens, Alabama met in regular session at the Athens Municipal Building, 200 Hobbs Street West in the said City on January 5, 2017, at 5:30 p.m. The meeting was called to order by Councilman Joseph Cannon, President of the Council. Upon roll call the following were found to be present: Councilmember Chris Seibert, Harold Wales, Frank Travis, Joseph Cannon and Wayne Harper. Mayor Marks led the Pledge of Allegiance. Annette Barnes, City Clerk, was present and recorded the minutes of the meeting. Frank Travis offered the invocation. The Chairperson stated that a quorum was present and that the meeting was open for transaction of business. The Chairperson stated that the Minutes of the December 19, 2016 City Council Meeting had been submitted for approval. Councilman Seibert moved that the reading of the Minutes be suspended and that the Minutes be approved as recorded. The motion was seconded by Councilman Wales and was unanimously carried. The Chairperson stated that the Minutes of the December 19, 2016 City Council Work Session Meeting had been submitted for approval. Councilman Seibert moved that the reading of the Minutes be suspended and that the Minutes be approved as recorded. The motion was seconded by Councilman Wales and was unanimously carried. Mayor Marks presented a plaque to Judge Chad Wise expressing the City’s appreciation of the years Judge Wise has served as City Prosecutor. Mayor Marks thanked him for his service to the City and wished him well in his new role. Kelly Range, 303 Brookwood Drive, Athens, addressed the Council and requested that the Council give the residents of the City of Athens the right to choose whether to have a glass of wine or a glass of tea with their meals on Sunday. Councilman Travis introduced the following resolution: RESOLUTION BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ATHENS, ALABAMA, to approve the following applicant for a, “Special Events Retail License for On-Premises Consumption”, alcohol license: The National Wild Turkey Federation, Inc. Special Event Date: February 3, 2017 Special Event Location: 114 West Pryor Street, Athens, AL 35611 The motion was seconded by Councilman Harper and was unanimously carried. Councilman Travis introduced the following resolution: RESOLUTION BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ATHENS, ALABAMA, to approve the following applicant for a, “On & Off Premises Beer”: Jiang’s Golden Phoenix 516 Highway 72, West Athens, AL 35611 The motion was seconded by Councilman Seibert and was unanimously carried. Councilman Harper introduced the following resolution: 1 RESOLUTION BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ATHENS, ALABAMA, to approve the purchase of residential garbage cans and residential recycling carts for the Public Works Department. This purchase shall not exceed $45,000 and will be funded through a General Fund budget amendment to line item 100.527.90112, Transfers Out, Capital Expenditure Fund. Councilmember Seibert moved that unanimous consent be given for immediate consideration of and action on said resolution, which motion was seconded by Councilmember Wales, and upon the said motion being put to vote the following vote was recorded: YEAS: Councilmembers Seibert, Wales, Travis, Cannon and Harper; NAYS: None. The President thereupon declared that the motion for unanimous consent for immediate consideration of and action on the said resolution had been unanimously carried. Councilmember Harper thereupon moved that the resolution be finally adopted, which motion was seconded by Councilmember Seibert and upon the said motion being put to vote the following vote was recorded: YEAS: Councilmembers Seibert, Wales, Travis, Cannon and Harper; NAYS: None. The President thereupon announced that the motion for the adoption of the said resolution had been unanimously carried. Councilman Seibert introduced the following resolution: RESOLUTION NUMBER 2017-1505 A RESOLUTION CONCERNING RELAY FOR LIFE WHEREAS, Relay for Life is a project of the American Cancer Society, devoted to bringing communities together to remember loved ones lost to cancer, honoring survivors of all cancers, and raising money to help the American Cancer Society make a global impact on cancer; WHEREAS, the City of Athens, Alabama, like all municipalities in Alabama, is empowered by statute to aid in taking care of the sick, preventing disease, and improving the public health and safety of residents of the City; WHEREAS, many citizens of the city have been deeply impacted by cancer, and the Athens City Council finds that Relay for Life serves the above statutory objects; WHEREAS, the Athens City Council finds that Relay for Life also serves a valuable public purpose; WHEREAS, the Athens City Council wishes to support Relay for Life and its activities in the city of Athens; WHEREAS, the City’s employees have often voluntarily participated in Relay for Life activities; and WHEREAS, the Athens City Council wishes to formally recognize support for Relay for Life. THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ATHENS, ALABAMA, on January 5, 2017 at 5:30 p.m., that Relay for Life serves a valuable public purpose in the City of Athens and that from time to time and under the direction/control of the Mayor, city resources and property may be utilized to support Relay for Life, such that, for example, municipal employees may solicit and accept voluntary donations for Relay for Life, and may engage in activities that benefit Relay for Life, so long as none of the activities pose any violation of the Alabama Ethics Law. Councilman Wales introduced the following resolution: RESOLUTION NUMBER 2017-1506 A RESOLUTION REQUESTING THE PASSAGE OF A LOCAL LEGISLATIVE ACT CONCERNING THE SALE OF ALCOHOLIC BEVERAGES ON CERTAIN HOURS ON SUNDAYS WHEREAS, the City of Athens, Alabama is a wet municipality pursuant to § 28-2A-1, et al., of the Code of Alabama; and WHEREAS, the Athens City Council desires the adoption of a local law that would authorize the City Council of the City of Athens, Alabama to regulate and permit the sale of alcoholic beverages during certain hours on Sunday in the city, pursuant to §§ 28-3A-25(19) and (20) of the Code of Alabama, and subject to the ordinances and regulations adopted by the City of Athens. THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ATHENS, ALABAMA while in regular session at January 5, 2017 at 5:30 p.m., as follows: 1. The Athens City Council requests that the Limestone County Legislative Delegation cause the Alabama Legislature to adopt a local law that would authorize the City Council of the City of Athens, Alabama to regulate and permit the sale of alcoholic beverages on certain hours on Sundays by properly licensed retail licensees 3 serving the general public in the city, subject to ordinances and regulations adopted by the City Council of the City of Athens, Alabama. 2. The Mayor and City Clerk are hereby directed to provide a copy of this Resolution to the members of the Limestone County Legislative Delegation.
