August 31, 2020 STATE OF ALABAMA, LIMESTONE COUNTY, CITY OF ATHENS. The City Council of the City of Athens, Alabama met in a special session at the Athens Municipal Building, 200 Hobbs Street West in Athens on August 31, 2020, at 11:00 a.m. Council President, Frank Travis, called the meeting to order. Upon roll call, the following were found to be present: Councilmembers Harold Wales, Frank Travis, Wayne Harper, and Chris Seibert. Mayor Marks led the Pledge of Allegiance. Annette Barnes, City Clerk, was present and recorded the minutes of the meeting. Councilman Harper offered the invocation. The Chairperson stated that a quorum was present and that the meeting was open for transaction of business. Annette Barnes, City Clerk, read the reports from the Limestone County Board of Registrars, regarding the provisional ballots that could and could not be counted for the election that was held on August 25, 2020. The provisional ballot boxes were then opened by district, the envelopes opened and ballots tallied accordingly. Councilman Harper introduced the following resolution: RESOLUTION NUMBER 2020 - 1708 CANVASSING RESOLUTION WHEREAS, the general election for the City of Athens was duly and legally held on Tuesday, August 25, 2020, as provided by law, and WHEREAS, the municipal governing body of the City of Athens met on this 31st day of August, 2020, all members thereof being present, at 11:00 o'clock a.m., and has canvassed the returns, and has ascertained and determined the number of votes received by each candidate, and WHEREAS, the said municipal governing body has ascertained and determined the result of said election as follows: VOTE TOTAL CANDIDATE District District District District District TOTAL #1 #4 #5 Absentee Provisional VOTES #2 #3 Mayor Russell R. That William R. “Ronnie” Marks received a majority of the votes cast for the office of Mayor, and is hereby declared duly elected to that office for the term beginning on the first Monday in November, 2020. 2. That Dana Sims Henry received a majority of the votes cast for the office of Council District No. 4 and is hereby declared duly elected to that office for the term beginning on the first Monday in November, 2020. Councilman Seibert introduced the following resolution: RESOLUTION NUMBER 2020 - 1709 A RESOLUTION APPOINTING DANA SIMS HENRY TO THE ATHENS CITY COUNCIL _______________________________________________ WHEREAS, the Code of Alabama provides that the Athens City Council may fill a vacancy on the city council by appointing a person to fill that vacancy for the remainder of the unexpired term; WHEREAS, the office of City Council, District Four is vacant after the resignation of Councilman Joseph Cannon; WHEREAS, the City Council recognizes that the official canvass of the votes cast in the general municipal election held in the City of Athens on August 25, 2020, indicates that Dana Sims Henry was duly elected to the office of City Council, District Four, for the term commencing on the first Monday of November, 2020; and WHEREAS, the City Council wishes to appoint Dana Sims Henry to fill the current vacancy in City Council, District Four, so that she may serve in such office commencing immediately. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ATHENS, ALABAMA, that Dana Sims Henry is hereby appointed to fill the current vacancy in the position of City Council, District Four, for the remainder of the unexpired term of office.
