Board of Zoning Adjustment (BOZA) Meeting Minutes
The members of the Board of Zoning Adjustment (BOZA) of the City of Athens, Alabama met on Thursday, April
21, 2022 at 5:30PM (Regular Meeting) in the Council Chambers at City Hall, 200 Hobbs ST W, Athens, AL.
The applicant and the public were allowed to participate In-Person.
Also present: Matt Davidson (City Planner), Lakeisha Johnson (Planner) & Jackson Miller (GIS Administrator)
were also present.
Call Meeting to Order
The Board of Zoning Adjustment meeting was called to order at 5:30PM by Chairman, Greg Greene, after the
BOZA work session.
Roll Call of Elected Board Members
The following Board Members were present:

Public Hearing
Case #1
Request of Milton A. George II, located at 15250 Line RD., Athens AL, 35613, regarding a “Variance Request
specifically related to a “Building Setba ck”; Applicant is requesting to utilize an existing
concrete pad on the property for a greenhouse that is related to the agricultural use (tree farm)
on the adjacent property. Zoned: EST (Estate Residential & Agricultural Zoning District).
-Mr. Greene, opened a public hearing for Case #1.
● -Mr. Davidson explained the applicants are requesting a rear yard setback variance to allow for a greenhouse
building related to an existing agricultural use (tree farm) to encroach 30’ into the required 50’ rear yard
setback. The property to the south and west of the subject site are owned by the applicant’s son. The
applicant’s home and tree farm are located directly east, across Line Rd. A Conditional Use was approved

Board of Zoning Adjustment for the City of Athens, Alabama, will hold a work session at 5:00
p.m., followed by the regular meeting at 5:30 p.m., this meeting will be held at the City Council
Chambers at 200 Hobbs Street West, Athens, Alabama, on Thursday, April 21, 2022 for the
purpose of hearing the following application and/or appeal. At this time, the applicant and all
interested parties are requested to make their presence known and will be given the
opportunity to be heard.

Approval of Regular Meeting Minutes – March 17, 2022
Case #1
Request of Milton A. George II, located at 15250 Line RD., Athens AL, 35613, regarding a

Case #2
Request of Chick-fil-A at 1291 US HWY 72 E, Athens, AL 35611, regarding a “Variance Request”
of “Required Parking Spaces”, “Reduction of Dumpster Enclosure setback” and
“Reduction of Landscaping and Buffer area”, Applicant is requesting to reduce
the onsite parking spaces by 15 parking spaces for a total of 27 onsite parking
spaces. Applicant has added 20 additional offsite parking spaces; Applicant is
also requesting a reduction of W building setback to 5’ for the dumpster
enclosure; and reduction of the N buffer to 3’ at the narrowest point to allow for
sidewalk connection to off-site parking, required West buffer is 8’, North buffer
is 8’, building setback West is 10’. Zoned B2 – General Business District. The
proposed project is part of the owner's existing property reinvestment program
to improve customer service and restaurant operations. The property
improvements will include building addition with interior & exterior renovations,
duel lane drive thru with canopy. existing parking lot will be adjusted to support
elements proposed.
