Unified Government of Athens-Clarke County, Georgia Mayor and Commission Tuesday, February 4, 2025 6:02 p.m. City Hall The Unified Government of Athens-Clarke County, Georgia met this date in a regular monthly session. Present: Mayor Girtz; Commissioners Davenport, Link, Taylor, Wright, Fisher, Johnson, Culpepper, Myers, Thornton, and Hamby. No one was absent. A motion was made by Commissioner Thornton, seconded by Commissioner Taylor, to approve the Minutes of meetings Tuesday, January 7 and non-voting meetings of Tuesday, January 14; Thursday, January 23; and Friday, January 24, 2025. The motion passed by unanimous vote. Written Communications There were none. Old business – Consent Items under this section were discussed at prior public meetings and were presented for consideration as a single item. Only one vote was taken. Public Input There was none. A motion was made by Commissioner Taylor, seconded by Commissioner Myers, to consent to action on the following five items. The motion passed by unanimous vote. 1. a. Approve the proposed transfer of funds in the amount of $238,921 from the Airport's Unrestricted Net Position to the Airport's Operating Fund to finance the previously approved Project Design and Bidding Services for Taxiway Alpha refurbishment as per agenda report dated December 3, 2024; b. Adopt the following ordinance (#25-02-06) which was presented by title only; and, c. Authorize the Mayor and appropriate staff to execute all related documents. AN ORDINANCE TO AMEND THE FY2025 ANNUAL OPERATING AND CAPITAL BUDGET FOR ATHENS-CLARKE COUNTY, SO AS TO PROVIDE FUNDING FROM AIRPORT ENTERPRISE FUND UNRESTRICTED NET POSITION FOR AIRPORT TAXIWAY A RECONSTRUCTION AND TAXIWAY A3 REALIGNMENT PROJECT DESIGN AND BIDDING SERVICES; AND FOR OTHER PURPOSES. The Commission of Athens-Clarke County, Georgia hereby ordains as follows: SECTION 1. The Commission of Athens-Clarke County, Georgia desires to amend the Airport Enterprise Fund to provide funding from Unrestricted Net Position for Airport Taxiway A Reconstruction & Taxiway A3 Realignment project design and bidding services; and for other purposes Said Operating & Capital budget is hereby amended as follows: Airport Enterprise Fund: NET POSITION: Decrease: Unrestricted Net Position $238,921 EXPENDITURES: Increase: Airport - Operating Expenses Taxiway Project Design & Bidding Services $238,921 SECTION 2. All ordinances or parts of ordinances in conflict herewith are hereby repealed. 2. a. Approve acceptance of up to $500,000 from the Athens‐Clarke Police Foundation in support of the development and sustainment of the Real‐Time Crime Center as per agenda report dated December 9, 2024; b. Adopt the following ordinance (#25-02-07) which was presented by title only; and, c. Authorize the Mayor and appropriate staff to execute all related documents necessary for fund acceptance and use. AN ORDINANCE TO AMEND THE FY2025 ANNUAL OPERATING AND CAPITAL BUDGET FOR ATHENS-CLARKE COUNTY, GEORGIA SO AS TO ACCEPT DONATED FUNDS FOR USE BY THE POLICE DEPARTMENT FROM THE ATHENS POLICE FOUNDATION, ORIGINATING FROM QUIKTRIP CORPORATION, FOR EXPENSES TO SUPPORT THE REAL-TIME CRIME CENTER (RTCC); AND FOR OTHER PURPOSES. The Commission of Athens-Clarke County, Georgia hereby ordains as follows: SECTION 1. The Commission of Athens-Clarke County, Georgia desires to amend the Special Revenue Fund to provide funding, to the Police Department from the Athens Police Foundation, originating from QuikTrip Corporation, for expenses to support the Real-Time Crime Center (RTCC); and for other purposes. Said Operating and Capital budget is hereby amended as follows: Special Revenue Fund: REVENUES: Increase: Donations $500,000 EXPENDITURES: Increase: Police Department Capital Expenses $500,000 SECTION 2. All ordinances or parts of ordinances in conflict herewith are hereby repealed. 3. a. Approve the list of roadways and associated maintenance activities recommended for the 2025 Calendar Year Pavement Maintenance Program (CY25 PMP) project as per revised agenda report dated January 28, 2025, as shown in Attachment #1; b. Adopt the following Resolution, as shown in Attachment #2; c. Authorize staff to advertise and solicit sealed bids on the CY25 PMP Project List; d. Authorize staff to include Extra Work Contingency Allowance in the amount of $300,000; and, e. Authorize Mayor and appropriate staff to execute all related documents. AUTHORIZING RESOLUTION CY2025 PAVEMENT MAINTENANCE PROGRAM PROJECT WHEREAS, The Mayor and Commission of the Unified Government of Athens-Clarke County, Georgia, have specifically determined and found that it is in the public interest to perform rehabilitation/resurfacing on approximately 17.28 (seventeen and twenty-eight one-hundredths) lane- miles and preventive maintenance on approximately 71.74 (seventy-one and seventy-four one hundredths) lane miles of locally maintained roads (hereinafter referred to as “the PMP Project”); and WHEREAS, The Mayor and Commission of the Unified Government of Athens-Clarke County have further found that the PMP Project is necessary and appropriate for the protection of public safety and serves the general welfare of Athens-Clarke County. NOW, THEREFORE, the Commission of Athens-Clarke County, Georgia, hereby resolves as follows:  SECTION 1. This PMP Project is authorized and approved as an official project of the Unified Government of Athens-Clarke County, Georgia. SECTION 2. The Mayor, Clerk of Commission, and Manager, or their respective lawful designees, are hereby expressly authorized to initiate, certify, and sign all documents and to perform all lawful acts necessary to secure funds from the State of Georgia, or the United States of America, or from any department, agency, or subdivision thereof or from any private individual or entity, to defray, in whole or in part, the cost of the said PMP Project; and SECTION 3. The Manager or his lawful designees are hereby expressly authorized to acquire appropriate interest or title to all real estate necessary for the reasonable execution of said PMP Project, by any means allowed by law including, without limitation, the exercise on behalf of the Unified Government of Athens-Clarke County, of the power of eminent domain; SECTION 4. The Manager or his lawful designees are hereby authorized to employ or contract for the professional services of attorneys, accountants, engineers, architects, appraisers, sureties, indemnitors, actuaries, and other professional consultants necessary for the plan, design, construction, execution, and general management of the said PMP Project; and, SECTION 5. The Manager or his lawful designees are hereby authorized to seek bids or competitive proposals in the newspaper, on radio stations and television stations, or by other means as they deem appropriate or as may be required by law; and SECTION 6. The Mayor, Clerk of Commission, and Manager, or their respective lawful designees, are hereby authorized to execute and file all documents and certifications necessary for the proper completion of the said PMP Project. SECTION 7. This Resolution shall be construed to confer upon the Mayor, Clerk of Commission, and Manager, or their respective lawful designees, all incidental authority necessary to carry out the purposes of this Resolution as expressed in the preamble and the foregoing sections. 4. a. Award a purchase contract to C&C Manufacturing, LLC (certified Al-Jon manufacturer) in the amount of $513,990 to rebuild the 2012 Al-Jon Compactor for use by the Solid Waste Department’s Landfill Division as per agenda report dated December 17, 2024, and b. Authorize the Mayor and staff to execute all related contracts and documents. 5. a. Approve a revision of property previously utilized by Athens ‐Ben Epps Airport for navigational purposes to revert in ownership to John A. McLung and Timothy J. McLung in accordance with the terms of the deed (Attachment #1) as per agenda report dated December 10, 2024; and, b. Authorize the Mayor and appropriate staff to execute all related documents. Public hearing and deliberation on recommendations from the Athens-Clarke County Planning Commission A public hearing was held on request of Brett Nave/Studio.BNA Architects, Owner WE Oconee LLC, for rezoning from C-G & RM-1 to C-G & RM-2 (PD) on 2,.03 acres known as 1280 Oconee Street and 300 Ann Street Proposed use is mixed-use multi-family and commercial. This will require an amendment to the Future Land Use from Main Street Business Density Residential (boundary line shift) Type I District 8 Planning Commission recommendation: Future Land Use: Approve (unanimous) Rezoning: Approve (unanimous) Public input 1. AN ORDINANCE TO AMEND THE CODE OF ATHENS-CLARKE COUNTY, GEORGIA WITH RESPECT TO AMENDING THE FUTURE LAND USE MAP OF ATHENS-CLARKE COUNTY BY CHANGING THE DESIGNATION OF ONE ACRE OF LAND LOCATED AT 1280 OCONEE STREET FROM “MAIN STREET BUSINESS” TO “MAIN STREET BUSINESS” AND “MIXED DENSITY RESIDENTIAL;” AND FOR OTHER PURPOSES. The Commission of Athens-Clarke County, Georgia hereby ordains as follows: SECTION 1. The Official Land Use Map referred to in the Zoning Ordinance of Athens- Clarke County, Georgia, as specifically identified in Section 9-3-3(A)(2) thereof, is hereby amended by changing the future land use designation on approximately 1.00 acres of land located at 1280 Oconee Street, Athens-Clarke County tax parcel number 172C3 B004, from “Main Street Business” to “Main Street Business” and “Mixed Density Residential,” as more fully shown on Exhibit A, attached hereto and incorporated herein by reference. The date of this amendment to the Official Land Use Map of Athens-Clarke County as shown by Exhibit A shall be duly noted in the minutes of the Commission meeting. The Official Land Use Map and Exhibit A hereto are available for public inspection in said Clerk’s Office, 301 College Avenue, Athens, Georgia. SECTION 2. AN ORDINANCE TO AMEND THE CODE OF ATHENS-CLARKE COUNTY, GEORGIA WITH RESPECT TO REZONING TWO PARCELS OF LAND COMPRISING APPROXIMATELY 2.03 ACRES LOCATED AT 1280 OCONEE STREET AND 300 ANN STREET FROM C-G (COMMERCIAL-GENERAL) AND RM-1 (MIXED DENSITY RESIDENTIAL) TO C-G (COMMERCIAL GENERAL, PLANNED DEVELOPMENT) AND RM-2 (MIXED DENSITY RESIDENTIAL, PLANNED DEVELOPMENT); AND FOR OTHER PUROSES. A waiver from the table found at Section 8-7-15 of the Code of Athens-Clarke County, Georgia so as to reduce the total required covered tree canopy coverage from 20.3 percent to 6.66 percent. b. A waiver from the requirement found at Section 9-25-8(C)(1)(a) of the Code of Athens-Clarke County, Georgia so as to remove the requirement that a minimum of 50 percent of the buildings shall have a front entrance facing a public or private street. c. The applicant/architect shall include two (2) level one residential electric vehicle (“EV”) chargers in the development. 3. The applicant/architect shall include a 110 standard outlet and a method of securing a bike or scooter on each residential unit. 4. The applicant/architect shall include a narrow ramp for bicycles and scooters on the edge on the back stairway to Ann Street to facilitate ease of movement. SECTION 4. Bob Dulinawka - supported A motion was made by Commissioner Link, seconded by Commission Thornton, to adopt the following ordinance (#25-02-10) which was presented by title only; and in addition to approving the rezoning with conditions from C-N to RM-3 on 4.5 acres known as 218 North Avenue, the Mayor and Commission of Athens-Clarke County hereby directs the Interim Manager to direct the Planning Department, in consultation with the Attorney’s Office, to develop a text amendment to Title 9 of the Code of Athens-Clarke County, Georgia for review and/or consideration by the Mayor and Commission that would allow single inhabited recreational vehicles (“RVs”) as a permitted use in the single-family residential zoning district. The motion passed 9 – 1. Commissioner Taylor voted NO.  AN ORDINANCE TO AMEND THE CODE OF ATHENS-CLARKE COUNTY, GEORGIA WITH RESPECT TO REZONING ONE PARCEL OF LAND COMPRISING APPROXIMATELY 4.5 ACRES LOCATED AT 218 NORTH AVENUE FROM C-N (COMMERCIAL-NEIGHBORHOOD) TO RM-3 (MIXED DENSITY RESIDENTIAL); AND FOR OTHER PURPOSES. The Commission of Athens-Clarke County, Georgia hereby ordains as follows: SECTION 1. The map constituting the component part of the Zoning Ordinance of Athens-Clarke County, Georgia, by virtue of and in compliance with Sections 9-3-3 and Sections 9-3-6 thereof, is hereby amended by changing the zoning of one parcel of land comprising approximately 4.5 acres and located at 218 North Avenue from C-N (Commercial-Neighborhood) to RM- 3 (Mixed Density Residential) as shown on Attachment A hereto. The architectural design intent as conceptually depicted in the applicant/architect’s submission shall be conceptually binding with regards to the design of the renderings provided, particularly pertaining to building shapes and the diversity of massing and scale with smaller structures located toward the southeast portion of the property nearest Fourth Street. The final development construction permit submittal shall be in keeping with the design intent as noted, and shall be allowed leeway for adjustment by the applicant/architect to accommodate site utility requirements, grading conditions, and similar development process discoveries while, in good faith, maintaining the design intent. 2. The applicant/architect shall accommodate electric vehicle charging capability as follows: a. The applicant/architect shall provide one (1) level-one residential electric vehicle charger for every twenty (20) parking spaces. All level-one residential electric vehicle chargers shall be distributed throughout the property to enable convenient access for all residents. b. All private porches in the development shall include a 110 standard dedicated exterior outlet and a means of securing a bike or scooter for each residential unit. 3. The applicant/architect shall communicate with senior staff of the Athens-Clarke County Planning Department and the Athens-Clarke County District 2 Commissioner prior to the submittal of the final site plan and architectural renderings for permit. AN ORDINANCE TO AMEND THE CODE OF ATHENS-CLARKE COUNTY, GEORGIA WITH RESPECT TO ZONING AND DEVELOPMENT STANDARDS FOR HALFWAY HOUSES; AND FOR OTHER PURPOSES. The Commission of Athens-Clarke County, Georgia hereby ordains as follows: SECTION 1. Section 9-15-21 of the Code of Athens-Clarke County, Georgia, entitled “Halfway houses,” is hereby amended by deleting from subsection (A), paragraph (2) thereof the phrase “and the hearing provisions set forth in O.C.G.A. § 36-66-4” so that said sub-section (A), paragraph (2) now reads as follows: A. Halfway houses are subject to, but not limited to, the following conditions: 1. The facility must show evidence of all required state or federal permits. 2. (7 YES; 3 NO) A RESOLUTION OF THE COMMISSION OF ATHENS-CLARKE COUNTY, GEORGIA, TO REQUEST THAT THE GENERAL ASSEMBLY AMEND THE LOCAL ACT CREATING THE CLASSIC CENTER AUTHORITY OF CLARKE COUNTY DURING THE 2025 SESSION OF THE GEORGIA GENERAL ASSEMBLY IN ORDER TO ADD TWO MEMBERS OF THE COMMISSION OF ATHENS- CLARKE COUNTY, GEORGIA, TO SERVE ON THE CLASSIC CENTER AUTHORITY; AND FOR OTHER PURPOSES. WHEREAS, the Classic Center Authority for Clarke County (the “Authority”) was created by an Act of the Georgia Legislature [1988 Ga. Laws, Page 3799], as subsequently amended, which governs the composition and manner of appointment of the members of the Authority; and WHEREAS, the Act currently provides that the Authority shall be composed of five members who shall serve four year terms and who shall be appointed by “the governing authority of Clarke County, Georgia,” which is an outdated reference to the governing authority that existed prior to unification in 1990, and thus, now the governing authority is the Unified Government of Athens-Clarke County, Georgia (“Unified Government”); and WHEREAS, the Act currently prohibits elected officials of any government or government agency from serving on the Authority; and WHEREAS, in contrast, the majority of other local authorities include at least one representative of the Unified Government, as shown below: a) The Downtown Athens Development Authority includes the Mayor and one Commissioner of the Unified Government; and b) The Development Authority of the Unified Government includes one Commissioner of the Unified Government; and  c) The Georgia's Innovation Corridor Joint Development Authority includes the Mayor of the Unified Government; and d) The Athens-Clarke County Industrial Development Authority includes the Mayor of the Unified Government; and e) The Athens-Clarke County Public Facilities Authority includes the Mayor of the Unified Government; and f) The Joint Development Authority of the Unified Government & the City of Winterville includes the Mayor of the Unified Government; and WHEREAS, on November 5, 2019, the Unified Government’s SPLOST 2020 Program was voted on and approved in a referendum by the voters of Athens-Clarke County and included a budgeted amount of $34,000,000 to support the construction of the Athens Classic Center Arena Project (the “Project”); and WHEREAS, to provide additional funds for the cost of acquiring, constructing, installing and equipping the Project, the Authority subsequently issued, with the approval and backing of the Unified Government, a total of $114,465,000 in revenue bonds as shown below: a) Series 2021, in the aggregate principal amount of $48,880,000, issued on November 2, 2021; b) Series 2022, in the aggregate principal amount of $37,500,000, issued on August 23, 2022; and c) Series 2023A, in the aggregate principal amount of $15,305,000, and Series 2023B in the aggregate principal amount of $12,780,000, both issued on September 28, 2023; and WHEREAS, the Unified Government believes that it is important for the Unified Government to have representation on the Authority to ensure that both entities can work together in a cooperative manner to provide for the repayment of the bonds and for other purposes; WHEREAS, adding representatives of the Unified Government to the Authority will enable both entities to work together more effectively and to properly steward government funds; NOW, THEREFORE, BE IT RESOLVED by the Commission of Athens-Clarke County, Georgia, and it is hereby so resolved by the authority of the same that the Commission of Athens-Clarke County, Georgia, hereby requests that the General Assembly amend the local act creating the Classic Center Authority of Clarke County during the 2025 Session of the Georgia General Assembly to add two new members to serve on the Classic Center Authority of Clarke County, one of whom shall be a member of the Commission of Athens-Clarke County, Georgia, and the other shall be a resident of Athens-Clarke County, both of whom shall be selected by the Commission of Athens-Clarke County, Georgia, and to make further amendments as would be necessitated by the addition of two new members to adjust the quorum of the Authority and for other purposes in substantially the same form as Exhibit A of this Resolution.  BE IT FURTHER RESOLVED THAT, the Commission hereby declares that the foregoing preamble and whereas provisions set forth hereinabove constitute, and shall be considered to be, substantive provisions of this Resolution and are hereby incorporated by reference into this Resolution; and BE IT FURTHER RESOLVED THAT, in the event scrivener’s errors shall be discovered in this Resolution after the adoption hereof, the Commission hereby authorizes and directs that the County Attorney and the Clerk of Commission shall correct each such scrivener’s error in all counterparts of this Resolution; and BE IT FURTHER RESOLVED THAT this Resolution shall become effective immediately upon its approval by the Mayor or upon its adoption into law without such approval.
