Unified Government of Athens-Clarke County, Georgia Mayor and Commission Tuesday, March 4, 2025 6:00 p.m. City Hall The Unified Government of Athens-Clarke County, Georgia met this date in a regular monthly session. Present: Mayor Girtz; Commissioners Davenport, Link, Taylor, Wright, Fisher, Johnson, Myers, Thornton, and Hamby. Commissioner Culpepper was absent. A motion was made by Commissioner Thornton, seconded by Commissioner Taylor, to approve the Minutes of meetings Tuesday, February 4; Tuesday, February 18; and non-voting meetings of Tuesday, February 11; and Tuesday, February 18, 2025. The motion passed by unanimous vote. Written Communications There were none. Old business – Consent Items under this section were discussed at prior public meetings and were presented for consideration as a single item. Only one vote was taken. Public Input There was none. A motion was made by Commissioner Wright, seconded by Commissioner Hamby, to consent to action on the following 12 items. The motion passed by unanimous vote. 1. a. Approve a four (4) month extension to the Denali Water Solutions, LLC (Denali) hauling contract as per agenda report dated January 17, 2025; b. Adopt the following ordinance (#25-03-17) which was presented by title only; and c. Authorize the Mayor and appropriate staff to sign all documents related to the contract. AN ORDINANCE TO AMEND THE FY2025 ANNUAL OPERATING AND CAPITAL BUDGET FOR ATHENS-CLARKE COUNTY, GEORGIA SO AS TO PROVIDE FUNDING FOR BIOSOLIDS HAULING AND DISPOSAL CONTRACTING; AND FOR OTHER PURPOSES. The Commission of Athens-Clarke County, Georgia hereby ordains as follows: SECTION 1. The Commission of Athens-Clarke County, Georgia desires to amend the FY2025 Water and Sewer Fund Budget for the purpose of amending the contract for biosolids hauling and disposal contracting. Said Operating and Capital budget is hereby amended as follows: Water & Sewer Enterprise Fund: Expenditures: Increase: Public Utilities – NOWRF $520,000 Services-Landfill Revenue: Decrease: Public Utilities - W&S Fund $520,000 Unrestricted Net Position SECTION 2. All ordinances or parts of ordinances in conflict herewith are hereby repealed. 2. a. Approve the Clerk of Superior Court’s Criminal Justice Coordinating Council Continuation Grant (CJCC) application for, and if awarded, acceptance of S.T.O.P. Violence Against Women (VAWA) grant funds in the amount of $55,000 to fund for calendar year (CY) 2025 as per agenda report dated January 14, 2025:  i. one authorized full‐time Clerk position in the Clerk of Courts Office; b. Adopt the following ordinance (#25-03-18) which was presented by title only; and c. Authorize the Mayor and appropriate staff to execute all related documents. AN ORDINANCE TO AMEND THE FY2025 ANNUAL OPERATING AND CAPITAL BUDGET FOR ATHENS-CLARKE COUNTY, GEORGIA SO AS TO PROVIDE GRANT FUNDING FROM THE GEORGIA CRIMINAL JUSTICE COORDINATING COUNCIL (CJCC) TO CONTINUE ONE FULLTIME POSITION IN THE OFFICE OF THE CLERK OF SUPERIOR COURT AND ASSOCIATED EXPENSES TO SUPPORT CASE PROCESSING OF DOMESTIC VIOLENCE CASES; AND FOR OTHER PURPOSES. The Commission of Athens-Clarke County, Georgia hereby ordains as follows: SECTION 1. The Commission of Athens-Clarke County, Georgia desires to amend the Grants Special Revenue Fund to provide grant funding from the Georgia CJCC to continue one fulltime position in the Office of the Clerk of Superior Court and associated expenses to support case processing of domestic violence cases. Said Operating and Capital budget is hereby amended as follows: Grants Special Revenue Fund: REVENUES: Increase: Stop Violence Against Women Grant (CJCC) $55,000 EXPENDITURES: Increase: Clerk of Courts General Operating Expenses $55,000 SECTION 2. Approve the application of and accept Georgia Environmental Protection Division grant funding, if awarded, for procurement of processing equipment to operate the new ACCGov Recovered Materials Processing Facility (RMPF) as per agenda report dated January 21, 2025; b. Approve the application of and accept United States Environmental Protection Agency grant funding, if awarded, for procurement of processing equipment to operate the new ACCGov Recovered Materials Processing Facility (RMPF); c. Adopt the following ordinances (#25-03-19 and #25-03-20) which were presented by title only; and d. Authorize the Mayor and appropriate staff to execute all related documents. AN ORDINANCE TO AMEND THE FY2025 ANNUAL OPERATING AND CAPITAL BUDGET FOR ATHENS-CLARKE COUNTY, GEORGIA SO AS TO PROVIDE GRANT FUNDING FROM THE ENVIRONMENTAL PROTECTION DIVISION OF THE GEORGIA DEPARTMENT OF NATURAL RESOURCES FY25 RECYCLING AND WASTE DIVERSION GRANT FOR PROCUREMENT OF PROCESSING EQUIPMENT TO OPERATE THE RECOVERED MATERIALS PROCESSING FACILITY; AND FOR OTHER PURPOSES. The Commission of Athens-Clarke County, Georgia hereby ordains as follows: SECTION 1. The Commission of Athens-Clarke County, Georgia desires to amend the Grants Special Revenue Fund to provide grant funding from the Environmental Protection Division of the Georgia Department of Natural Resources FY25 Recycling and Waste Diversion Grant for procurement of processing equipment to operate the Recovered Materials Processing Facility. AN ORDINANCE TO AMEND THE FY2025 ANNUAL OPERATING AND CAPITAL BUDGET FOR ATHENS-CLARKE COUNTY, GEORGIA SO AS TO PROVIDE GRANT FUNDING, IF AWARDED, FROM THE U. S. ENVIRONMENTAL PROTECTION AGENCY SOLID WASTE INFRASTRUCTURE FOR RECYCLING GRANT FOR PROCUREMENT OF PROCESSING EQUIPMENT TO OPERATE THE RECOVERED MATERIALS PROCESSING FACILITY; AND FOR OTHER PURPOSES. The Commission of Athens-Clarke County, Georgia hereby ordains as follows: SECTION 1. The Commission of Athens-Clarke County, Georgia desires to amend the Grants Special Revenue Fund to provide grant funding, if awarded, from the U. S. Environmental Protection Agency Solid Waste Infrastructure for Recycling Grant for procurement of processing equipment to operate the Recovered Materials Processing Facility. Said Operating and Capital budget is hereby amended as follows: Grants Special Revenue Fund: REVENUES: Increase: Federal Grant - Operating $5,000,000 EXPENDITURES: Increase: Solid Waste Department Capital Expenses $5,000,000 SECTION 2. Approve the Solicitor General’s submission of a Criminal Justice Coordinating Council (CJCC) renewal grant application for and, if awarded, acceptance of S.T.O.P. Violence Against Women (VAWA) grant funds in the amount of $66,097 to be used to fund one Domestic Violence Prosecutor position for the prosecution of domestic violence cases in calendar year (CY) 2025 and for appropriate training and travel funds as per agenda report dated February 5. 2025; b. Approve the continuation of one full‐time authorized position for the Solicitor General's Office specialized domestic violence prosecution in CY25; c. Adopt the following ordinance (#25-03-21) which was presented by title only; and d. Authorize the Mayor and appropriate staff to execute all related documents. AN ORDINANCE TO AMEND THE FY2025 OPERATING AND CAPITAL BUDGET FOR ATHENS-CLARKE COUNTY, GEORGIA SO AS TO PROVIDE GRANT FUNDING, IF AWARDED, FROM THE GEORGIA CRIMINAL JUSTICE COORDINATING COUNCIL’S (CJCC) STOP VIOLENCE AGAINST WOMEN ACT (VAWA)COMPETITIVE GRANT PROGRAM FOR CONTINUATION OF ONE DOMESTIC VIOLENCE PROSECUTOR POSITION AND APPROPRIATE TRAINING TO RESPOND TO AND PREVENT CRIMES OF VIOLENCE AGAINST WOMEN; AND FOR OTHER PURPOSES. The Commission of Athens-Clarke County, Georgia hereby ordains as follows: SECTION 1. The Commission of Athens-Clarke County, Georgia desires to amend the Grants Special Revenue Fund to provide grant funding, if awarded, from the Georgia Criminal Justice Coordinating Council’s (CJCC) Stop Violence Against Women Act (VAWA) Competitive Grant Program for continuation of one Domestic Violence Prosecutor position and appropriate training to respond to and prevent crimes of violence against women. Said Operating budget is hereby amended as follows: Grants Special Revenue Fund: REVENUES: Increase: CJCC STOP VAWA Competitive Grant $66,097 EXPENDITURES: Increase: Solicitor’s Office Personal Services $66,097 SECTION 2. All ordinances or parts of ordinances in conflict herewith are hereby repealed. 5. a. Authorize an expenditure in the amount of $306,000 from the Water & Sewer Enterprise Fund to relocate existing water and sewer mains for the Georgia Department of Transportation (GDOT) SR10 at CR99/West Hancock Ave Intersection Improvements Project. The requested expenditures include construction cost and a 10% contingency as per agenda report dated January 17, 2025; b. Approve the Standard Utility/Contract Item Agreement, for GDOT PI#0016920, relating to the relocation and replacement of water mains; c. Adopt the following resolution (Attachment #2); and d. Authorize the Mayor and appropriate staff to execute all related documents. RESOLUTION STATE OF GEORGIA UNIFIED GOVERNMENT OF ATHENS-CLARKE COUNTY BE IT RESOLVED by the MAYOR and BOARD OF COMMISSIONERS of the UNIFIED GOVERNMENT OF ATHENS-CLARKE COUNTY, and it is hereby resolved, that the foregoing attached Agreement, relative to project N/A, CLARKE COUNTY, P.I. No. 0016920 to construct a multi- lane roundabout on State Route 10 at County Road 993/West Hancock Avenue in Clarke County and that the Honorable Mr. Kelly Girtz as Mayor and Shemekia Armstrong, as Deputy Clerk of Commission, be and they are, thereby authorized and directed to execute the same for and in behalf of said by the Mayor and BOARD OF COMMISSIONERS of the Unified Government of Athens- Clarke County. 6. a. Approve a Task Order to Stantec Consulting Services Inc. (Stantec), in the amount of $306,341 to design Section 1 of the Athena Industrial Park Recycle Water Transmission Line project as per agenda report dated January 17, 2025; and b. Authorize the Mayor and appropriate staff to sign all documents related to the Task Order. 7. a. Award and authorize the procurement of 11 diesel engines from Cummins Inc. in the amount of $367,592.94, for the midlife rehabilitation of the ACCGov Transit diesel‐electric hybrid bus fleet as per agenda report dated January 21, 2025; and, b. Authorize the Mayor and appropriate staff to execute all related documents. 8. a. Approve and authorize the submission of the ACCGov Transit Department’s Public Transit Agency Safety Plan 2025 Updates (Attachment # 1) to the Georgia Department of Transportation (GDOT) and Federal Transit Administration (FTA) for final approval as per agenda report dated January 29, 2025; and, b. Authorize the Mayor and appropriate staff to execute the resulting Public Transit Agency Safety plan document. 9. a. Approve a connection to the Unified Government of Athens‐Clarke County sanitary sewer system by means of a private pump station and force main to provide sewage service to property located at 610 Athena Drive as per agenda report dated January 21, 2025. 10. a. Approve the recommendation from the Athens Downtown Development Authority to increase the hourly parking rate to $2.00/hour in the decks as per agenda report dated December 19, 2024; b. Adopt the following ordinance (#25-03-22) which was presented by title only; c. Approve the recommendation from the Athens Downtown Development Authority to not charge for the first hour of deck parking; and, d. Authorize the Mayor and appropriate staff to execute all related documents, including changes to the FY25 Unified Fee Schedule. AN ORDINANCE TO AMEND THE CODE OF ATHENS-CLARKE COUNTY, GEORGIA WITH RESPECT TO SCHEDULE OF FEES TO BE ADOPTED ANNUALLY; AND FOR OTHER PURPOSES. The Commission of Athens-Clarke County, Georgia hereby ordains as follows: SECTION 1. Section 2-6-2 of the Code of Athens-Clarke County, Georgia, entitled “Schedule of fees to be adopted annually,” is hereby amended by increasing the hourly rate for parking decks from $1.00 to $2.00 so that the schedule of fees now reads as follows: CENTRAL SERVICES Subject Fee/Unit Parking Decks & Surface Lots 31 All Decks – Hourly Parking (subject to time limits) $2.00/hour SECTION 2. All ordinances or parts of ordinances in conflict herein are hereby repealed. 11. a. Accept the Periodic Audit of the Housing and Community Development Department as recommended by the Audit Committee (Attachment A) as per agenda report dated January 21, 2025; and, b. Authorize the Mayor and appropriate staff to execute all necessary documents. 12. a. Endorse the Coalition of Local Government’s clean energy goals as indicated in Facts and Issues #12 as per agenda report dated January 27, 2025, and b. Authorize the Manager to have staff represent Athens-Clarke County needs and values by participating in all proceedings before the Public Service Commission in support of local clean energy goals, and sign onto the final “stipulation” as appropriate. Public hearing and deliberation on recommendations from the Athens-Clarke County Planning Commission A public hearing was held on request of Will Avant/Foresite Group LLC, owner: GAINESCEDAR LLC, for Planned Development Amendment from C-O (GSRC) (PD) to C-O (GSRC) on 0.64 acres known as 995 Gaines School Road. AN ORDINANCE TO AMEND THE CODE OF ATHENS-CLARKE COUNTY, GEORGIA WITH RESPECT TO REZONING ONE PARCEL OF LAND COMPRISING APPROXIMATELY 0.64 ACRES OF LAND LOCATED AT 995 GAINES SCHOOL ROAD FROM C-O (GSRC) (PD) [COMMERCIAL-OFFICE (GAINES SCHOOL ROAD CORRIDOR OVERLAY) (PLANNED DEVELOPMENT)] TO C-O (GSRC) [COMMERCIAL-OFFICE (GAINES SCHOOL ROAD CORRIDOR OVERLAY)]; AND FOR OTHER PURPOSES. The Commission of Athens-Clarke County, Georgia hereby ordains as follows: SECTION 1. The map constituting the component part of the Zoning Ordinance of Athens-Clarke County, Georgia, by virtue of and in compliance with Sections 9-3-3 and 9-3-6 thereof, is hereby amended by changing the zoning of one parcel of land comprising approximately 0.64 acres and located at 995 Gaines School Road from C-O (GSRC) (Planned Development) [Commercial-Office (Gaines School Road Corridor Overlay) (Planned Development)] to C-O (GSRC) [Commercial-Office (Gaines School Road Corridor Overlay)] as shown on Attachment A hereto. The affected parcel of land is more particularly described in that certain document entitled “Site Plan With Existing Conditions And Overlay,” designated in the lower right-hand corner as “C-3.1,” prepared by David M. Stoniecki, registered professional engineer, dated January 3, 2025, and being on file and available for public inspection in the office of the Athens-Clarke County Planning Department, 120 West Dougherty Street, Athens, Georgia. The affected parcel is also known as Tax Parcel No. 241 005V on the Athens-Clarke County tax maps being on file and available for public inspection in the office of the Athens-Clarke County Planning Department, 120 West Dougherty Street, Athens, Georgia. The date of this amendment on the Official Zoning Map of Athens-Clarke County as shown by Attachment A hereto shall be noted on said Official Zoning Map in the office of the Clerk of Commission, 301 College Avenue, Athens, Georgia, and duly noted in the minutes of the Commission meeting. SECTION 2. The following condition of zoning shall be associated with this ordinance: 1. The stormwater detention facility shall be included as eligible planting areas for street trees that are compatible with the function of the facility, as determined by the ACC Arborist in cooperation with the ACC Transportation and Public Works Department. AN ORDINANCE TO AMEND THE CODE OF ATHENS-CLARKE COUNTY, GEORGIA WITH RESPECT TO AMENDING THE OFFICIAL FUTURE DEVELOPMENT MAP OF ATHENS- CLARKE COUNTY BY CHANGING THE DESIGNATION OF A PARCEL OF LAND COMPRISING APPROXIMATELY 0.36 ACRES LOCATED AT 445 BARNETT SHOALS ROAD FROM MIXED DENSITY RESIDENTIAL TO TRADITIONAL NEIGHBORHOOD; AND FOR OTHER PURPOSES. The Commission of Athens-Clarke County, Georgia, hereby ordains as follows: SECTION 1. The Future Development Map referred to in the Code of Athens-Clarke County, Georgia, as specifically identified in Section 9-3-3(A)(2) thereof, is hereby amended by changing the future development map designation of a parcel of land comprising approximately 0.36 acres and located at 445 Barnett Shoals Road, also known as Tax Parcel No. 174B 002 on the Official Tax Map of Athens-Clarke County, Georgia, from Mixed Density Residential to Traditional Neighborhood as shown on Exhibit A, which is attached hereto and incorporated herein by reference. The date of this amendment to the Official Future Development Map of Athens-Clarke County as shown by Exhibit A shall be duly noted in the minutes of the Commission meeting. AN ORDINANCE TO AMEND THE CODE OF ATHENS-CLARKE COUNTY, GEORGIA WITH RESPECT TO AMENDING A PLANNED DEVELOPMENT IN THE C-N (PD) (COMMERCIAL-NEIGHBORHOOD, PLANNED DEVELOPMENT) DISTRICT AND EXTENDING SUCH PLANNED DEVELOPMENT BY REZONING PARCELS OF LAND IN THE RM-1 (MIXED DENSITY RESIDENTIAL) AND RS-8 (SINGLE-FAMILY RESIDENTIAL) DISTRICTS TO C-N (PD) (COMMERCIAL-NEIGHBORHOOD, PLANNED DEVELOPMENT), SAID AMENDMENT AND EXPANSION AFFECTING EIGHT PARCELS OF LAND AT 445, 605, 705, AND 1015 BARNETT SHOALS ROAD, 190, 200, AND 210 LAKEWOOD DRIVE, AND 162 PARK RIDGE COURT, THE IMPACTED PORTIONS OF WHICH COMPRISE APPROXIMATELY 90.22 ACRES IN TOTAL; AND FOR OTHER PURPOSES. Said map is further amended by rezoning two parcels of land from RM-1 (Mixed Density Residential) and RS-8 (Single- Family Residential), respectively, to C-N (PD) (Commercial-Neighborhood, Planned Development). The date of this amendment to the Official Zoning Map of Athens-Clarke County as shown by Attachment A shall be noted on said Official Zoning Map in the office of the Clerk of Commission at 301 College Avenue, Athens, Georgia, and duly noted in the minutes of the Commission meeting. SECTION 2. The binding master site plan associated with this ordinance and incorporated herein by reference consists of six sheets in total. Each sheet is titled, numbered, and dated in the lower right-hand corner as shown in the table below. SECTION 3. The conditions of zoning associated with this ordinance are as follows: 1. As modified in Condition No. 3 below, pages 22-23 of that certain document entitled “Development Standards,” as identified in Section 2 above, shall be binding conditions of zoning. 1 For purposes of clarity, the design standards set forth in the Architectural Design Book are incorporated herein by reference, and the proposed development must be con- structed in accordance with the standards set forth therein. If the Architectural Design Book does not explicitly address a particular standard, then the owners/developer(s) shall adhere to any applicable standards in Title 9 of the Code of Athens-Clarke County, Georgia. 2. As modified in Condition No. 3 below, Item Nos. 1-14, which are listed as “Proffered Conditions” on pages 30-31 of that certain document entitled “Development Standards,” as identified in Section 2 above, shall be binding conditions of zoning. 3. The following portions of that certain document entitled “Development Standards,” as identified in Section 2 above, shall be amended to add drive-through uses to the list of prohibited uses: Under the heading “Prohibited Uses” on page 23. Item No. 13 on page 31. 4. The owners/developer(s) must satisfy all technical requirements described in Part IV, entitled “Technical Assessment,” of the staff report presented to the Planning Commission on February 6, 2025, said staff report incorporated herein by reference and being on file and available for public inspection in the office of the Athens-Clarke County Planning Department, 120 West Dougherty Street, Athens, Georgia. 5. Retaining walls that are adjacent to and rise above a public right-of-way shall be set back from a public right-of-way a minimum of one foot for every foot of wall height as measured parallel to the right-of-way and accounting for any linear changes in height. No portion of any retaining wall adjacent to and rising above a public right-of-way shall exceed twelve feet in height. A terrace is required between a lower retaining wall and an up- per wall and the terrace area shall have a minimum five-foot depth as measured from the upper grade of the lower retaining wall to the base of the upper retaining wall. Retaining walls over five feet in height shall be screened by a landscape buffer no shorter than 3 feet at time of planting and reaching a minimum mature height of 6 feet; however, wall art, including murals, sculptural or other decorative treatment of exterior walls may extend for a maximum of 50 percent of the wall length. Acceptable exterior finish materials include, but are not limited to, stucco, split face blocks, brick, stone, curved interlock blocks, wood, tubular steel, wrought iron bars or other grill work, textural or scored poured concrete, engineered “green” or vegetative wall as approved by the planning director, or a combination of these materials. Exposed flat-face CMU blocks and EIFS stucco are prohibited. 6. Because certain portions of the proposed development are presently land- locked and to ensure adequate future traffic access to the proposed development, access easements must be granted and recorded with the Clerk of the Superior Court of Athens- Clarke County prior to approval of site plans. 7. The owners/developer(s) shall implement a minimum of three (3) electric vehicle charging stations and three (3) public 120v outlets for charging electric bikes within the commercial parking area of the proposed Arts and Entertainment District.  8. The owners/developer(s) shall ensure that at least one (1) shared-use Level 3 electric vehicle charging station will be provided within each of the three (3) proposed neighborhoods outside of the proposed Arts and Entertainment District. Additionally, the owners/developer(s) shall ensure that 120v (Level 1) charging facilities will be provided to all housing units within the proposed development to support charging of electrically- powered forms of transportation. SECTION 4. All ordinances or parts of ordinances in conflict herewith are hereby repealed. Old and new business – Discussion Public input 1. Dylan Woolsey supported the Extension of Non-Profit Leases for FY26. A motion was made by Commissioner Myers, seconded by Commissioner Thornton, to DENY the recapture and accept the plans presented by Athens Land Trust and East Athens Development Corporation for using the required 50% of ARPA funds by June 30, 2025 as per agenda report dated January 21, 2025. The motion passed by unanimous vote. A motion was made by Commissioner Johnson, seconded by Commissioner Fisher, to a. Approve an hourly rate, not‐to‐exceed, Professional Services contract in the amount of $400,000 to Pond & Company for design and construction administration services for the TSPLOST 2023 Project 17, Stonehenge Neighborhood Area Pedestrian Improvements (Sub‐Project #1) as per agenda report dated January 20, 2025; b. Approve the Athens Cultural Affairs Commission (ACAC) recommendation that TSPLOST 2023 Project 17, Stonehenge Neighborhood Area Pedestrian Improvements be designated as appropriate for public art (Attachment #1) with a budget amount of $29,000, for all Sub‐Projects, (1% of the proposed construction budget); and c. Approve the designation of ER Snell Contractor Inc. as the apparent low responsive and responsible bidder for the CY 2025 Pavement Maintenance Project as per revised agenda report dated February 28, 2025; b. Award a Total Unit Price Construction Services Contract in the amount of $3,985,101 to ER Snell Contractor Inc. as the lowest responsive and responsible bidder for the CY 2025 Pavement Maintenance Project & associated maintenance activities as shown on Attachment #1 (including an Extra Work Contingency Allowance in the amount of $300,000); and c.
