Unified Government of Athens-Clarke County, Georgia Mayor and Commission Tuesday, May 6, 2025 6:01 p.m. City Hall The Unified Government of Athens-Clarke County, Georgia met this date in regular monthly session. Present: Mayor Girtz; Commissioners Davenport, Link, Taylor, Wright, Fisher, Johnson, Culpepper, Myers, Thornton, and Hamby. Commissioner Davenport arrived at 6:06 p.m. and Commissioner Johnson arrived at 6:08 p.m. A motion was made by Commissioner Thornton, seconded by Commissioner Link, to approve the Minutes of meetings Tuesday, April 1 (2); Tuesday, April 8; Tuesday, April 15; Thursday, May 1, and non-voting meetings of Tuesday, April 8; and Tuesday, April 15, 2025. The motion passed with 8 YES votes. Commissioners Davenport and Johnson were absent. Written Communications There were none. Adopt the following ordinance (#25-05-37), which was presented by title only increasing the TSPLOST 2018 Project #5 Oconee Rivers Greenway Project, Sub‐Project #7 Oak/Oconee Street Underpass, budget in the amount of $153,410.25 as per agenda report dated March 28, 2025; and, b. Authorize the Mayor and appropriate staff to execute all related documents. AN ORDINANCE TO AMEND THE TRANSPORATION SPECIAL PURPOSE LOCAL OPTION SALES TAX 2018 PROGRAM BUDGET SO AS TO PROVIDE ADDITIONAL FUNDING FROM GEORGIA POWER FOR PROJECT #05 OCONEE RIVERS GREENWAY PROJECT, SUB- PROJECT #7 OAK/OCONEE STREET UNDERPASS; AND FOR OTHER PURPOSES. The Commission of Athens-Clarke County, Georgia hereby ordains as follows: SECTION 1. The Commission of Athens-Clarke County, Georgia desires to amend the TSPLOST 2018 Capital Projects Fund to provide additional funding from Georgia Power for the TSPLOST 2018 Project #05 Oconee Rivers Greenway Project, Sub-Project #7 Oak/Oconee Street Underpass. AN ORDINANCE TO AMEND THE FY2025 OPERATING AND CAPITAL BUDGET FOR ATHENS-CLARKE COUNTY, GEORGIA SO AS TO PROVIDE GRANT FUNDING, IF AWARDED, FROM THE FEDERAL HIGHWAY ADMINISTRATION (FHWA) FOR A TRANSPORTATION ALTERNTIVES PROGRAM GRANT FOR THE NORTH OCONEE RIVER GREENWAY TRAIL FROM NORTH AVE TO 1ST STREET; AND FOR OTHER PURPOSES. The Commission of Athens-Clarke County, Georgia desires to amend the Grants Special Revenue Fund to provide grant funding, if awarded, from the Federal Highway Administration for a Transportation Alternatives Program Grant for the North Oconee River Greenway Trail from North Ave to 1st Street. Approve submission of an application by the Athens‐Clarke County Police Department (ACCPD) for, and accept, if awarded, the Edward Byrne Memorial Justice Assistance Grant (JAG) Program 2024 Existing Local Project Grant as per agenda report dated March 10, 2025; b. Authorize the continuation of four Athens‐Clarke County Police Department (ACCPD) sworn officer positions in the Northeast Georgia Regional Drug Task Force, consistent with the grant award; c. Adopt the following ordinance (#25-05-39); which was presented by title only; and d. Authorize the Mayor and appropriate staff to execute all documents associated with the grant. AN ORDINANCE TO AMEND THE FY2025 OPERATING AND CAPITAL BUDGET FOR ATHENS-CLARKE COUNTY, GEORGIA SO AS TO PROVIDE GRANT FUNDING, IF AWARDED, FROM THE GEORGIA CRIMINAL JUSTICE COORDINATING COUNCIL’S (CJCC) BYRNE JUSTICE ASSISTANCE EXISTING LOCAL PROJECT GRANT PROGRAM FOR CONTINUATION OF FOUR POLICE DEPARTMENT INVESTIGATOR POSITIONS DIRECTLY SUPPORTING EFFORTS OF THE NORTHEAST GEORGIA REGIONAL DRUG TASK FORCE; AND FOR OTHER PURPOSES. The Commission of Athens-Clarke County, Georgia hereby ordains as follows: SECTION 1. The Commission of Athens-Clarke County, Georgia desires to amend the Grants Special Revenue Fund to provide grant funding, if awarded, from the Georgia Criminal Justice Coordinating Council’s (CJCC) Byrne Justice Assistance Existing Local Project Grant Program for continuation of four Investigator positions directly supporting efforts of the Northeast Georgia Regional Drug Task Force; and for other purposes.  Said Operating budget is hereby amended as follows: Grants Special Revenue Fund: REVENUES: Increase: CJCC Byrne Justice Assistance Grant $139,460 EXPENDITURES: Increase: Police Department: Personal Services $139,460 SECTION 2. Authorize staff to advance the Proposed Project Concept for TSPLOST 2023 Project 10, E. Athens Transit Improvements into the land acquisition and construction bidding phases; c. Approve the Athens Cultural Affairs Commission’s (ACAC) recommendation that the TSPLOST 2023 Project 10, E. Athens Transit Improvements Project is appropriate for Public Art with a proposed budget of $1,000; and, d. Authorize the Mayor and appropriate staff to execute all related documents. 5. a. Approve GDOT Grant Agreement – Taxiway B Pavement Rehabilitation and Lighting Project, (Attachment#1) as per agenda report dated April 7, 2025; b. Approve RS&H, Inv., Work Order #8 for $267,891.50 to provide construction phase professional services and testing during the construction of the Taxiway B project (Attachment #2); c. The Commission of Athens-Clarke County, Georgia hereby ordains as follows: SECTION 1. The Commission of Athens-Clarke County, Georgia desires to amend the Grants Special Revenue Fund to provide grant funding, if awarded, from GDOT Grant for Airport Taxiway B pavement rehabilitation and lighting project. Approve the Proposed Project Concept for the SPLOST 2020 Project 07 ‐ E911 System Replacement Project, as generally described in Facts & Issues #4 & #5 as per agenda report dated March 10, 2025; b. Approve the Athens Cultural Affairs Commission’s (ACAC) recommendation (Attachment #1) that SPLOST Project 07, E911 System Replacement Project is not appropriate for Public Art; c. Authorize staff to advance the Proposed Project Concept into the Implementation Phase; d. Adopt the following ordinance (#25-05-41), which was presented by title only to f u n d t h e anticipated costs of SPLOST 2020 Project 07, E911 System Replacement Project. Such funds are to be used, as appropriate, for the acquisition of equipment, professional services, and licenses, as described in Facts & Issues #5; e. Authorize the transfer of revenue from The University of Georgia’s project contribution, as specified in the Intergovernmental Services Agreement between the ACCPD and UGAPD dated March 3, 2015, to an appropriate expense account in support of the E911 Phone System’s replacement; f. Approve the selection of Motorola Solutions as the designated vendor for SPLOST 2020 Project 07, E911 System Replacement in the provision of the VESTA 9‐1‐1 Call Handling Hardware refresh (Attachment #3) via a cooperative purchase agreement; and g. AN ORDINANCE TO AMEND THE SPECIAL PURPOSE LOCAL OPTION SALES TAX 2020 PROGRAM BUDGET SO AS TO PROVIDE ADDITIONAL FUNDING FOR PROJECT #07 E911 PHONE SYSTEM REPLACEMENT; AND FOR OTHER PURPOSES. The Commission of Athens-Clarke County, Georgia hereby ordains as follows: SECTION 1. The Commission of Athens-Clarke County, Georgia desires to amend the SPLOST 2020 Capital Projects Fund to provide additional funding for the SPLOST 2020 Project #07 E911 Phone System Replacement Project. Said Operating and Capital budget is hereby amended as follows: SPLOST 2020 Capital Projects Fund: REVENUES: INCREASE: Board of Regents of the University System of Georgia Payment $235,981 EXPENDITURES: INCREASE: Project #07 – E911 Phone System Replacement $235,981 SECTION 2. Accept the FY2025‐2029 “Transit Development Plan” (TDP) Update as the basic guidance and direction for use in evaluating future service options and development of the Transit system as per agenda report dated March 25, 2025. 8. a. Authorize the Mayor and relevant staff to execute the Letter of Agreement with the University of Georgia (UGA) for the annual traffic signal maintenance of the six UGA traffic signals and 12 rectangular rapid flashing beacons (RRFB) on the UGA campus, as shown in Attachment #1 as per agenda report dated March 11, 2025. 9. a. Approve the proposed FY26 CDBG Annual Action Plan I and FY26‐30 Consolidated Plan for submission to the U.S. Department of Housing and Urban Development, as shown in Attachment #1 as per agenda report dated January 29, 2025; b. Authorize staff to include eligible carryforward funds in FY26 subrecipient contracts if the agency’s remaining project fund balance is 15% or less of the original allocation; c. Authorize acceptance of the associated grant awards; and, d. Authorize the Mayor and appropriate ACCGov staff to execute all related contracts and documents. 10. a. Approve the proposed HOME Annual Action Plan I for the FY26‐30 Consolidated Plan for submission to the U.S. Department of Housing and Urban Development, as shown in Attachment #1 as per agenda report dated January 30, 2025; b. Authorize acceptance of the HUD FY2025 (HCD FY26) Grant Award; and c. Authorize the Mayor and appropriate ACCGov staff to execute all related contracts and documents. 11. a. Authorize the submission of a grant application for up to $721,000 in HUD EDI funding via Congressionally Directed Spending through Office of US Senator Ossoff as per agenda report dated March 17, 2025; b. Accept the grant funds, if awarded; c. Adopt the following ordinance (#25-05-42), which was presented by title only; and d. The map constituting the component part of the Zoning Ordinance of Athens- Clarke County, Georgia, by virtue of and in compliance with Sections 9-3-3 and 9-3-6 thereof, is hereby amended by changing the zoning of a parcel of land comprising approximately 6.29 acres and located at 1030 Barnett Shoals Road, Athens, Georgia, from RM-2 (Mixed Density Residential) to G (Government) as shown on Attachment A hereto. The affected parcel is further described in that certain survey for the Unified Government of Athens-Clarke County, Georgia, prepared by Aaron P. Blomberg, professional land surveyor, dated October 31, 2024, and being on file and available for public inspection in the office of the Athens- Clarke County Planning Department, 120 West Dougherty Street, Athens, Georgia. The affected parcel is also known as Tax Parcel No. 174D 005 on the Athens-Clarke County tax maps being on file and available for public inspection in the office of the Athens-Clarke County Planning Department, 120 West Dougherty Street, Athens, Georgia. The date of this amendment to the Official Zoning Map of Athens-Clarke County as shown by Attachment A shall be noted on said Official Zoning Map in the office of the Clerk of Commission, 301 College Avenue, Athens, Georgia, and duly noted in the minutes of the Commission meeting. WHEREAS, under Chapter 9-4 of the Code of Athens-Clarke County, Georgia, as presently written, the Athens-Clarke County Planning Commission hears appeals of variance decisions from the Athens-Clarke County Hearings Board; and WHEREAS, the Commission of Athens-Clarke County, Georgia, has established the position of the Administrative Hearing Officer of Athens-Clarke County in Chapter 1-5 of the Code of Athens-Clarke County, Georgia; and WHEREAS, the Commission of Athens-Clarke County, Georgia, finds that the Administrative Hearing Officer is an appropriate officer to hear appeals of variance decisions and desires to convey the jurisdiction of such appeals from the Planning Commission to the Administrative Hearing Officer; NOW, THEREFORE, the Commission of Athens-Clarke County, Georgia, hereby ordains that: SECTION 1. Section 1-5-1 of the Code of Athens-Clarke County, Georgia, entitled “Administrative hearing officer,” is hereby amended by adding a new sub-paragraph (4)(a)(4) to read as follows: 4. An appeal of any action subject to the Type IV planning procedure, as provided for in section 1-5-3(a). SECTION 2. Chapter 1-5 of the Code of Athens-Clarke County, Georgia, entitled “Administrative Hearing Officer,” is hereby amended by adding a new section to be numbered Section 1-5-3, entitled “Review of variances and other actions subject to the Type IV planning procedure,” to read as follows:  Sec. 1-5-3. – Review of variances and other actions subject to the Type IV planning procedure. (a) The administrative hearing officer shall hereby have jurisdiction over appeals of any final decision by the Athens-Clarke County Hearings Board or any other body subject to the Type IV planning procedure. For purposes of clarity, staff permitting and interpretive decisions shall be governed by section 1-5-2 of this Code. (b) A person appealing a final decision described in this code section must file his or her appeal in the time and manner described in section 9-4-8. Upon the filing of an appeal, the Athens-Clarke County Planning Department shall timely submit a copy of the appeal and the full administrative record to the administrative hearing officer. (c) If the Unified Government of Athens-Clarke County, Georgia, is not the appellee or the appellant, it may intervene in the matter, acting by and through the Athens-Clarke County Planning Department. (d) After docketing of the appeal, the administrative hearing officer shall set a date for the appeal hearing and shall timely inform the appellant (or the appellant’s authorized attorney), the appellee (or the appellee’s authorized attorney), and the Athens-Clarke County Planning Department (or its authorized attorney) of the same. The Athens-Clarke County Planning Department will be responsible for issuing, posting, and advertising all official notices of the hearing as required under the Zoning Procedures Law, O.C.G.A. §§ 36-66-1, et seq., and will supplement the record with proof of the same. The appeal hearing must be set for a date that ensures compliance with the Zoning Procedures Law. (e) The administrative hearing officer’s review of the final decision shall be confined to the administrative record, and no new evidence shall be submitted. Unless otherwise in conflict with state law standards for appellate review of the types of decisions described herein, the administrative hearing officer shall review the record to determine whether any evidence supports the final decision, and the administrative hearing officer may review any applicable final legal conclusions on a de novo basis. The administrative hearing officer shall only consider the errors or issues explicitly raised in the written appeal. (f) The parties may provide oral argument during the hearing. Each party shall be afforded ten minutes. The administrative hearing officer shall first hear argument from the appellant, then from the appellee. The appellant may reserve up to three minutes for rebuttal. If the Athens-Clarke County Planning Department is an intervenor in the matter, the administrative hearing officer shall also afford it ten minutes, and the administrative hearing officer shall decide the appropriate time and manner during the proceedings for the Athens-Clarke County Planning Department to be heard. Upon prior written request and for good cause shown, the administrative hearing officer may provide additional time for oral argument, provided that all parties are afforded the same total amount of time. The administrative hearing officer, in his or her reasonable discretion, may request that the parties submit memoranda or briefs in support of their respective positions with page limits and other criteria as may be set by the administrative hearing officer. (g) After the hearing, the administrative hearing officer shall issue a written decision on the appeal. If the administrative hearing officer finds it to be appropriate, he or she may remand the matter to the Athens-Clarke County Hearings Board, or other appropriate body, to further develop the administrative record. The written decision of the administrative hearing officer shall constitute the final decision of the Unified Government of Athens-Clarke County, Georgia, pertaining to its subject matter, and any party may petition for review of this decision in accordance with state law. (h) The administrative hearing officer shall be authorized to rule on any motions or objections properly raised by either party that are related to the appeal. The administrative hearing officer shall have control of the process and procedure of the appeal and may issue procedural orders and directives pertaining to the appeal, provided that such orders and directives do not otherwise conflict with this code section, any applicable procedures set forth in Title 9 of the Code of Athens-Clarke County, Georgia, or state law. SECTION 3. Section 9-4-8 of the Code of Athens-Clarke County, Georgia, entitled “Appeals,” is hereby amended by replacing paragraph (A)(2) thereof to read as follows: 2. Type IV planning actions. The decision of the Administrative Hearing Officer shall be the final decision of Athens-Clarke County pertaining to all  actions subject to the Type IV planning procedure, including all variances not subject to the staff review process. Said Section 9-4-8 of the Code of Athens-Clarke County, Georgia, is further amended by deleting paragraph (B)(2) thereof in its entirety—including sub-paragraphs (a)-(e) of paragraph (B)(2)—and replacing said paragraph (B)(2) to read as follows: 2. Appeals of Type IV decisions, including all variances not subject to the staff review process, shall be heard and decided by the Administrative Hearing Officer of Athens-Clarke County in accordance with the procedures set forth in Chapter 1-5 of the Code of Athens-Clarke County, Georgia. a. The appeal shall be filed within five business days after the final decision is rendered, as defined in section 9-4-14. b. The appeal shall be in writing and filed with the Athens-Clarke County Planning Department. Such appeal shall include the appellant’s name, address, and specifically state the alleged grounds or errors for which the hearings board’s decision should be overturned. c. The standards for any such appeal shall be governed by the provisions of Chapter 1-5 of the Code of Athens-Clarke County, Georgia. SECTION 4. Section 9-4-10 of the Code of Athens-Clarke County, Georgia, entitled “Administrative hearings,” is hereby amended by adding a new subsection (G) thereto to read as follows: G. The procedures described in this code section shall not apply to administrative hearings or appeals held before the Administrative Hearing Officer of Athens- Clarke County. Those types of hearings and appeals shall be governed by the procedures described in Chapter 1-5 of the Code of Athens-Clarke County, Georgia, or otherwise set forth in state law. SECTION 5. All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 6. The provisions of this ordinance are severable, and should any part of this ordinance be deemed by the final decision of a court of competent jurisdiction to be invalid, such invalidity shall not affect the validity of the ordinance as a whole, or any part thereof other than the part declared to be invalid. SECTION 7. The Clerk of Commission is authorized, in consultation with the Athens- Clarke County Attorney, to correct any scrivener’s errors that may be found herein after the adoption and approval hereof. SECTION 8. This ordinance shall become effective once approved by the Mayor or as otherwise set forth in Section 2-204 of the Charter of the Unified Government of Athens-Clarke County, Georgia. The motion passed by unanimous vote. AN ORDINANCE TO AMEND THE CODE OF ATHENS-CLARKE COUNTY, GEORGIA WITH RESPECT TO APPEALS OF SIGN VARIANCES; AND FOR OTHER PURPOSES. The Commission of Athens-Clarke County, Georgia, hereby ordains as follows: SECTION 1. Section 7-4-21 of the Code of Athens-Clarke County, Georgia, entitled “Variances to sign requirements,” is hereby amended by deleting subsection (a) thereof in its entirety and the following subsection (a) is inserted in lieu thereof: a. After denial of a sign permit by the building official, a property owner or sign contractor may either appeal the decision pursuant to section 7-4-22(f) or apply to the Hearings Board established under the zoning code for a variance by filing an application on a form to be obtained from the Planning Department. The variance request must be filed within ten calendar days after the denial of the sign permit. The variance request must be set for a hearing within 75 calendar days of the filing of the complete written variance application. SECTION 2. Section 7-4-22 of the Code of Athens-Clarke County, Georgia, entitled “Permits,” paragraph (2) of subsection (d) thereof entitled “Permit issue if application is in order; time for consideration” is hereby by deleted in its entirety and the following new paragraph (2) is inserted in lieu thereof: 2. All sign permit applications shall be granted, denied or rejected for incompleteness within 60 calendar days of the building official's actual receipt of a completed application and the payment of the permit fee. The building official or designee shall give notice to the applicant of the decision by hand delivery or by mailing a notice to the address on the permit application on or before the 60th calendar day after receipt of the completed application and payment. If mailed, the notice shall be deemed to have been given upon the date of mailing in conformity with this section. If the building official fails to act by granting, denying or rejecting the application within the 60- calendar day period, the permit shall be deemed to have been denied. SECTION 3. The Commission of Athens-Clarke County, Georgia, hereby ordains as follows: SECTION 1. Chapter 1-8 of the Code of Athens-Clarke County, Georgia, entitled “Finance Generally,” is hereby amended by adding a new section to be numbered Section 1-8-8, which section reads as follows: Sec. 1-8-8. – Conveyance of small or narrow strips of land. (a) In accordance with O.C.G.A. § 36-9-2, O.C.G.A. § 36-9-3(h), and Section 7- 502 of the Charter of the Unified Government of Athens-Clarke County, Georgia, the Unified Government shall be authorized to sell and convey parcels of small or narrow strips of land, so shaped or so small as to be incapable of being used independently as zoned or under applicable subdivision or other development ordinances or land use plans, or as streets, whether owned in fee or used by easement, to abutting property owners where such sales and conveyances facilitate the enjoyment of the highest and best use of the abutting owner’s property without first submitting the sale or conveyance to the process of an auction or the solicitation of sealed bids. (b) The following shall apply to all sales and conveyances authorized under this code section: (1) Prior to any sales or conveyances as described in this code section, the matter shall be presented to the Commission of Athens- Clarke County, Georgia, for authorization to proceed under those terms and conditions as may be imposed by the Commission. (2) If the Commission authorizes the matter to proceed, each abutting property owner must be notified in writing of the availability of the property and shall have the opportunity to purchase the property under those terms and conditions imposed by the Commission. (3) The Unified Government shall not convey any property under this code section in exchange for consideration of less than the fair market value of the property as established by the Athens-Clarke County Board of Tax Assessors or an appraisal authorized by the Unified Government. As part of the transaction, the Unified Government may require the purchaser(s) to reimburse the Unified Government for all due diligence costs reasonably incurred by the Unified Government for the sale, including, but not necessarily limited to, closing costs, survey costs, and appraisal costs. (4) The Manager, or the Manager’s designee, shall have all incidental authority necessary and proper to effectuate the purposes of this code section, such as obtaining surveys and appraisals from qualified professionals. (c) The Mayor may execute all deeds, sales agreements, or other similar written instruments necessary and incidental to a sale or conveyance authorized under this code section. SECTION 2. The Commission of Athens-Clarke County, Georgia hereby ordains as follows:  SECTION 1. The Commission of Athens-Clarke County, Georgia desires to amend the General Fund to provide funding for expenses related to costs in providing animals with medical care, including services and supplies, and animal care maintenance in the Animal Services Department. WHEREAS, pursuant to Section 9-4-3A.2. of the Code of Athens-Clarke County, Georgia, the adoption of an amendment to the zoning ordinance which changes the text of the zoning is a Type I procedure; and WHEREAS, pursuant to Section 9-4-3C.b. of the Code of Athens-Clarke County, Georgia, the initiation of a Type 1 procedure may be made by recommendation of the Athens- Clarke County Commission and Mayor; and WHEREAS, Title 9 of the Code of Athens-Clarke County, Georgia, contains subsection (C) of Section 9-4-15 which prescribes the procedures for reviewing demolition or relocation applications; and WHEREAS, the Mayor and Commission of Athens-Clarke County, Georgia, finds that it is appropriate to recommend an amendment to the Planning Commission of the text of subsection (C) of Section 9-4-15 of the Code of Athens-Clarke County, Georgia; NOW, THEREFORE, the Commission of Athens-Clarke County, Georgia, hereby resolves as follows: SECTION 1. Pursuant to Section 9-4-3C.b. of the Code of Athens-Clarke County, Georgia, the Mayor and Commission recommend an amendment to the Planning Commission of the text of subsection (C) of Section 9-4-15 of the Code of Athens-Clarke County, Georgia in the form attached hereto as Exhibit “A” and incorporated herein by reference. SECTION 2. The Manager’s Office and the Attorney’s Office are hereby authorized to take all actions necessary and incidental to effectuate the purposes of this Resolution, as expressed in the recitals hereto.
