Unified Government of Athens-Clarke County, Georgia Mayor and Commission Tuesday, November 4, 2025 6:01 p.m. City Hall The Unified Government of Athens-Clarke County, Georgia met this date in regular monthly session. Present: Mayor Girtz; Commissioners Davenport, Link, Taylor, Wright, Fisher, Johnson, Culpepper, Myers, Thornton and Hamby. Commissioner Johnson arrived at 6:04 p.m. Commissioner Taylor joined by phone until 6:54 p.m. and arrived at 7:07 p.m. A motion was made by Commissioner Thornton, seconded by Commissioner Fisher, to approve the Minutes of meetings of Tuesday, October 7, 2025 and Tuesday, October 21, 2025 and non-voting meetings of Tuesday, October 14, 2025 and Tuesday, October 21, 2025. The motion passed by 9 YES votes. Commissioner Johnson was absent. Written Communications 1. Entered into the record was notice of acceptance of a street known as Brittany Way in Brittany Pointe Subdivision. 2. Entered into the record was notice of acceptance of the right of way for streets in the North Downtown Athens Development for Athens Housing Authority. Commissioner Johnson arrived at 6:04 p.m. Items under this section were discussed at prior public meetings and were presented for consideration as a single item. Only one vote was taken. Public Input There was none. A motion was made by Commissioner Wright, seconded by Commissioner Thornton, to consent to action on the following 12 items. The motion passed by unanimous vote. 1. a. Approve the list of roadways and associated maintenance activities recommended for the Calendar Year 2026 Pavement Maintenance Program (CY26 PMP) project, as shown in Attachment #1 as per agenda report dated September 22, 2025; b. Adopt the Project Resolution, as shown in Attachment #2; c. Authorize the Transportation & Public Works Department (T&PW) to submit an application, as shown in Attachment #3, to the Georgia Department of Transportation for Local Maintenance Improvement Grant (GDOT LMIG) in the amount of $1,756,898.36 (and requiring 30% matching funds in the amount of $527,069.51) to partially fund the proposed maintenance activities as shown on the proposed CY26 PMP Project, as shown in Attachment #1; d. Accept the grant funds in the amount of $1,756,898.36, if awarded; e. Adopt the following ordinance (#25-11-102) which was presented by title only; f. Authorize staff to advertise and solicit sealed bids on the CY26 PMP Project List; g. Authorize staff to include Extra Work Contingency Allowance in the amount of $400,000 for the CY26 PMP Project Contract; and, h. Authorize Mayor and appropriate staff to execute all related documents. AN ORDINANCE TO AMEND THE FY2026 OPERATING AND CAPITAL BUDGET FOR ATHENS-CLARKE COUNTY, GEORGIA SO AS TO PROVIDE GRANT FUNDING, IF AWARDED, FROM THE GEORGIA DEPARTMENT OF TRANSPORTATION LOCAL MAINTENANCE IMPROVEMENT GRANT (LMIG) FOR RESURFACING ROADWAYS; AND FOR OTHER PURPOSES. The Commission of Athens-Clarke County, Georgia hereby ordains as follows:  SECTION 1. The Commission of Athens-Clarke County, Georgia desires to amend the Grants Special Revenue Fund to provide grant funding, if awarded, from the Georgia Department of Transportation local maintenance improvement grant (LMIG) for resurfacing roadways; and for other purposes. Said Operating and Capital budget is hereby amended as follows: Grants Special Revenue Fund: REVENUES: Increase: Local Maintenance Improvement Grant $1,756,898 EXPENDITURES: Increase: Transportation & Public Works Department: Capital Expenses $1,756,898 SECTION 2. All ordinances or parts of ordinances in conflict herewith are hereby repealed. AUTHORIZING RESOLUTION CY2026 PAVEMENT MAINTENANCE PROGRAM PROJECT WHEREAS, The Mayor and Commission of the Unified Government of Athens-Clarke County, Georgia, have specifically determined and found that it is in the public interest to perform rehabilitation/resurfacing on approximately 47.17 (forty-seven and seventeen one-hundredths) lane-miles and preventive maintenance on approximately 53.90 (fifty-three and ninety one-hun- dredths) lane miles of locally maintained roads (hereinafter referred to as “the PMP Project”); and WHEREAS, The Mayor and Commission of the Unified Government of Athens-Clarke County have further found that the PMP Project is necessary and appropriate for the protection of public safety and serves the general welfare of Athens-Clarke County. NOW, THEREFORE, the Commission of Athens-Clarke County, Georgia, hereby resolves as follows: SECTION 1. This PMP Project is authorized and approved as an official project of the Unified Government of Athens-Clarke County, Georgia. SECTION 2. The Mayor, Clerk of Commission, and Manager, or their respective lawful designees, are hereby expressly authorized to initiate, certify, and sign all documents and to per- form all lawful acts necessary to secure funds from the State of Georgia, or the United States of America, or from any department, agency, or subdivision thereof or from any private individual or entity, to defray, in whole or in part, the cost of the said PMP Project; and SECTION 3. The Manager or his lawful designees are hereby expressly authorized to ac- quire appropriate interest or title to all real estate necessary for the reasonable execution of said PMP Project, by any means allowed by law including, without limitation, the exercise on behalf of the Unified Government of Athens-Clarke County, of the power of eminent domain; SECTION 4. The Manager or his lawful designees are hereby authorized to employ or contract for the professional services of attorneys, accountants, engineers, architects, appraisers, sureties, indemnitors, actuaries, and other professional consultants necessary for the plan, design, construction, execution, and general management of the said PMP Project; and, SECTION 5. The Manager or his lawful designees are hereby authorized to seek bids or competitive proposals in the newspaper, on radio stations and television stations, or by other means as they deem appropriate or as may be required by law; and SECTION 6. The Mayor, Clerk of Commission, and Manager, or their respective lawful designees, are hereby authorized to execute and file all documents and certifications necessary for the proper completion of the said PMP Project. SECTION 7. This Resolution shall be construed to confer upon the Mayor, Clerk of Com- mission, and Manager, or their respective lawful designees, all incidental authority necessary to  carry out the purposes of this Resolution as expressed in the preamble and the foregoing sections. 2. Adopt the following ordinance (#25-11-103) which was presented by title only to approve the prohibition of on-street parking on the south side of Herring Street, from its intersection with Peter Street to its intersection with Derby Street for 1100 feet, as shown in Attachment #1 as per revised agenda report dated October 28, 2025. AN ORDINANCE FOR THE ESTABLISHMENT OF YELLOW CURBING ON HERRING STREET BETWEEN THE INTERSECTIONS OF PETER STREET AND DERBY STREET; AND FOR OTHER PURPOSES. The Commission of Athens-Clarke County, Georgia hereby ordains as follows: SECTION 1. There is hereby established 1100 feet of yellow curbing on the southern side of Herring Street between the intersection of Herring Street and Peter Street and the intersection of Herring Street and Derby Street as shown on that certain map entitled “Herring St. Proposed Restricted Parking,” prepared June 25, 2025, and attached hereto as Attachment #1. SECTION 2. Pursuant to Section 3-3-5 of the Code of Athens-Clarke County, Georgia, said yellow curbing “shall indicate places where vehicles shall not park.” SECTION 3. The Athens-Clarke County Transportation & Public Works Department is hereby authorized to paint the yellow curbing indicated herein and perform all other actions necessary and incidental to the establishment of the yellow curbing described herein. SECTION 4. All ordinances or parts of ordinances in conflict herewith are hereby repealed. 3. Adopt the following ordinance (#25-11-104) which was presented by title only to approve the prohibition of on-street parking on the north side of Reese Street, from its intersection with North Pope Street to its intersection with North Church Street for 436 feet, as shown in Attachment #1 as per revised agenda report dated October 28, 2025. AN ORDINANCE FOR THE ESTABLISHMENT OF YELLOW CURBING ON REESE STREET BETWEEN THE INTERSECTIONS OF NORTH POPE STREET AND NORTH CHURCH STREET; AND FOR OTHER PURPOSES. The Commission of Athens-Clarke County, Georgia hereby ordains as follows: SECTION 1. There is hereby established 436 feet of yellow curbing on the northern side of Reese Street between the intersection of Reese Street and North Pope Street and the intersection of Reese Street and North Church Street as shown on that certain map entitled “Reese St. N. Church St. to N. Pope St,” prepared August 29, 2025, and attached hereto as Attachment #1. SECTION 2. Pursuant to Section 3-3-5 of the Code of Athens-Clarke County, Georgia, said yellow curbing “shall indicate places where vehicles shall not park.” SECTION 3. The Athens-Clarke County Transportation & Public Works Department is hereby authorized to paint the yellow curbing indicated herein and perform all other actions necessary and incidental to the establishment of the yellow curbing described herein. Approve use of General Fund contingency in the amount of $235,000 to cover processing, shipping and recycling of CHaRM materials in FY26 as per agenda report dated September 24, 2025; b. Adopt the following ordinance (#25-11-105) which was presented by title only; and c. Authorize the Mayor and staff to execute all related contracts and documents. AN ORDINANCE TO AMEND THE FY2026 OPERATING AND CAPITAL BUDGET FOR ATHENS-CLARKE COUNTY, GEORGIA SO AS TO PROVIDE FUNDING FOR SOLID WASTE CHARM PROCESSING; AND FOR OTHER PURPOSES. The Commission of Athens-Clarke County, Georgia hereby ordains as follows: SECTION 1. The Commission of Athens-Clarke County, Georgia desires to amend the General Fund to provide funding for Solid Waste CHaRM Processing. Said Operating budget is hereby amended as follows: General Fund: REVENUES: Decrease: Operating Contingency $235,000 EXPENDITURES: Increase: Solid Waste Professional Services $235,000 SECTION 2. All ordinances or parts of ordinances in conflict herewith are hereby repealed. 5. a. Adopt the attached resolution (Attachment #1) electing not to require mobile home decals pursuant to O.C.G.A. §48-5-492(a) as per agenda report dated September 25, 2025; and b. Authorize the Clarke County Tax Commissioner and the Tax Assessor’s Office to discontinue all duties related to the issuance, inspection, and enforcement of mobile home decals. A RESOLUTION OF THE COMMISSION OF ATHENS-CLARKE COUNTY, GEORGIA, ELECTING TO NOT REQUIRE MOBILE HOME DECALS WHEREAS, Senate Bill 193 was passed in the 2021-2022 Regular Session of the Georgia General Assembly, and was signed by the Governor and became effective on the 6th day of May, 2021; WHEREAS, Senate Bill 193 amended O.C.G.A. §48-5-492(a) to allow the governing authority of the county in which the mobile home is located to opt out of the requirement to issue mobile home decals as evidence of a mobile home location permit; and WHEREAS, pursuant to O.C.G.A. §48-5-263(b)(11), the appraiser of the County shall, in counties that elect to require decals pursuant to Code Section 48-5-492 inspect mobile homes located in the county to determine if the proper decal is attached to and displayed on the mobile home by the owner as provided by law; notify the residents of those mobile homes to which a decal is not attached of the provisions of Code Sections 48-5-492 and 48-5-493; and furnish to the tax commissioner a periodic list of those mobile homes to which a decal is not attached; and WHEREAS, the governing authority of Athens-Clarke County elects to not require mobile home location decals pursuant to O.C.G.A. §48-5-492(a) beginning with the 2026 tax year, NOW THEREFORE, BE IT RESOLVED, pursuant to and as authorized by O.C.G.A. §48-5- 492(a), the Commission of Athens-Clarke County, Georgia resolves and elects to not require mobile home location decals in Athens-Clarke County, Georgia, and hereby relieves the Tax Commissioner and the appraiser of Athens-Clarke County of any requirements under the law, whether pursuant to O.C.G.A. 48-5-263 and O.C.G.A. §48-5-492 et seq. or otherwise related to the issuance, inspection, and enforcement of mobile home location decals, and any and all other responsibilities that may have been otherwise required due to the issuance of mobile home location decals. REPEALER All previous Resolutions in conflict herewith are hereby superseded and repealed. EFFECTIVE DATE This Resolution shall be effective upon adoption. It shall remain in full force and effect until superseded or repealed. 6. a. Approve the designation of Archer Western Construction, LLC as the low responsive and responsible bidder for Lavender Road TPW # 6400 and Roberts Road TPW # 6399 Culverts Replacement Project as per agenda report dated September 22, 2025; b. Award a Total Unit Price Construction Services Contract in the amount of $1,853,086.77 to Archer Western Construction, LLC as the lowest responsive and responsible bidder for the Lavender Road TPW # 6400 and Roberts Road TPW # 6399 Culverts Replacement Project, as shown on Attachment #1 (including an Extra Work Contingency Allowance in the amount of $170,000); and, c. Authorize the Mayor and appropriate staff to execute all other project related documents. 7. a. Authorize the addition of the Juneteenth and Indigenous Peoples’ Day holidays as free parking days where fees are not charged for public downtown parking as per agenda report dated September 11, 2025; and, b. Authorize the Mayor and related staff to sign any related documents. 8. a. Approve the Proposed Project Concept for SPLOST 2020 Project 11 Renewable Energy Project SP #15 as described in Facts and Issues #2 as per agenda report dated September 18, 2025; b. Award the on-call Solar Installation Services Contract to Solar Sun World for a Not-to Exceed amount of $300,000 to provide and install the SPLOST 2020 Project 11, Renewable Energy Project, SP #15 at Fire Station #9; c. Direct the Manager to have any related rebates and credits channeled back to their original funding source; d. Approve the designation of SPLOST 2020 Project 11 SP #15 as not appropriate for Public Art; and e. Authorize the Mayor and appropriate staff to execute all related documents. 9. a. Approve Exemption of 30% Waiver of Water & Wastewater Connection Fees for an Affordable Housing Development at 195 Bray Street, a project by Piedmont Housing Group in partnership with Athens Land Trust, based on the organization providing additional housing resources of substantial benefit to the Athens- Clarke County community as per agenda report dated September 22, 2025; and, b. Authorize Mayor and ACCGov staff to execute all related documents. 10. a. Approve the Intergovernmental Agreement between the Tax Commissioner, the Unified Government of Athens-Clarke County (ACCGov), and the City of Winterville for Collection of Municipal Ad Valorem Taxes (Attachment #1) as per agenda report dated September 25, 2025, and b. Authorize the Mayor and other relevant officials to execute the necessary and related documentation. 11. a. Approve the revised Memorandum of Understanding with the Board of Regents of the University of Georgia Cooperative Extension and the Unified Government of Athens-Clarke County (Attachment #1) as per agenda report dated October 14, 2025; and b. Authorize the Mayor and appropriate staff to execute all related contracts and documents. 12. a. Approve an appropriation of $3,108,428 for Phase II of the North Oconee River Sanitary Sewer Interceptor Improvements project as per agenda report dated September 22, 2025; b. Award a unit price construction work order to RDJE, Inc., the apparent low bidder, in the amount of $2,427,755; c. Award a project management/resident inspection contract to Jacobs Engineering Group, Inc. for the provision of professional services during construction in the amount of $437,898; d. Authorize the Manager (or the Manager’s designee) to approve additive project change orders that do not collectively exceed the overall appropriation of $3,108,430, or any deductive change orders; and, e. Authorize the Mayor and appropriate staff to sign all documents related to the contracts. AN ORDINANCE TO AMEND THE CODE OF ATHENS-CLARKE COUNTY, GEORGIA WITH RESPECT TO SPECIAL USE APPROVAL IN THE C-O (M) [COMMERCIAL- OFFICE (MILLEDGE AVENUE CORRIDOR SPECIAL DISTRICT OVERLAY)] FOR ONE PARCEL OF LAND LOCATED AT 480 S. MILLEDGE AVENUE; AND FOR OTHER PURPOSES. The Commission of Athens-Clarke County, Georgia hereby ordains as follows: SECTION 1. The current C-O (M) [Commercial-Office (Milledge Avenue Corridor Special District Overlay)] District is hereby amended to provide for special use approval of a sorority house. The subject parcel of land is approximately 0.96 acres, is located at 480 S. Milledge Avenue, and is known as Tax Parcel Number 122D2 A002 on the Athens-Clarke County tax maps, being on file and available for public inspection in the office of the Athens-Clarke County Planning Department, 120 West Dougherty Street, Athens, Georgia. The date of this amendment to the Official Zoning Map as shown by Attachment A hereto shall be noted on the Official Zoning Map in the office of the Clerk of Commission and duly noted in the minutes of the Commission meeting. The proposed parking agreement with Clarke County School District, or appropriate substitute as determined by the Director of the Athens-Clarke County Planning Department, for use of the parking lot at Clarke Central High School shall become official, shall be recorded in the Office of the Clerk of Superior and State Court, and shall be submitted to the Athens-Clarke County Planning Department for inclusion in the department’s file regarding SUP-2025-07-1361 before the project receives a Certificate of Occupancy. SECTION 4. The following variances shall be associated with the special use approved herein. 1. Waiver from the requirement found in Section 9-10-3 of the Code of Athens-Clarke County, Georgia so as to increase the maximum lot coverage of the structure from 65% to 85.1%. 2. Waiver from the requirement found in Section 9-10-3 of the Code of Athens-Clarke County, Georgia so as to reduce the minimum landscaped area from 35% to 14.9%. 3. Waiver from the requirement found in Section 9-12-7 of the Code of Athens-Clarke County, Georgia so as to increase the maximum Floor-Area Ratio (“FAR”) of structures located within the Milledge Avenue Special District Overlay from 0.5 to 0.65. 4. Waiver from the requirement found in Section 9-30-2(A)(3) of the Code of Athens- Clarke County, Georgia so as to reduce the required number of parking spaces from 154 parking spaces to 35 spaces on-site and 45 spaces off-site. 5. Waiver from the requirement found in Section 9-30-9(E)(6)(b) of the Code of Athens- Clarke County, Georgia so as to remove the requirement to provide a sight-obscuring fence, wall, or evergreen hedge not less than six feet high between the parking facility or driveway and the property line. 6. Waiver from the requirement found in Section 8-7-15(c) of the Code of Athens-Clarke County, Georgia so as to reduce the minimum amount of conserved tree canopy from 25% to 7.3%. 7. Waiver from the requirement found in Section 8-7-15(c) of the Code of Athens-Clarke County, Georgia so as to reduce the minimum amount of total tree canopy from 50% to 32.5%. SECTION 5. All ordinances or parts of ordinances in conflict therewith are hereby repealed. A public hearing was held on request of Athens-Clarke County Unified Government to amend section 9-15-16 of the Code of Ordinances regarding home occupations in accessory structures and cottage food industry allowance. A motion was made by Commissioner Link, seconded by Commissioner Myers, to adopt the following ordinance (#25-11-107) which was presented by title only. The motion passed by unanimous vote. AN ORDINANCE TO AMEND THE CODE OF ATHENS-CLARKE COUNTY, GEORGIA, WITH RESPECT TO HOME OCCUPATIONS; AND FOR OTHER PURPOSES. The Commission of Athens-Clarke County, Georgia, hereby ordains as follows: SECTION 1. Section 9-15-16 of the Code of Athens-Clarke County, Georgia, entitled “Home occupations,” is hereby amended by deleting sub-section (A) in its entirety and replacing it so that said sub-section (A) now reads as follows: A. Dwelling. The occupation shall be carried on entirely within the primary and/or accessory structure. When the occupation is carried on within the primary structure, it shall be restricted to habitable floor space and shall not occupy an excess of 25 percent of the habitable floor space within the structure unless otherwise noted elsewhere in this code section. Section 9-15-16 of the Code of Athens-Clarke County, Georgia, entitled “Home occupations,” is hereby further amended by deleting the word “heated” in sub-section (O), paragraph (1) thereof and replacing said word with “habitable,” so that said sub-section (O), paragraph (1) now reads as follows: 1. In-home daycare for no more than six individuals under care at a time, excluding the family members of the resident caregiver, with the allowance to occupy a maximum of 50 percent of the habitable floor space within the structure and for outdoor recreational activity. Section 9-15-16 of the Code of Athens-Clarke County, Georgia, entitled “Home occupations,” is hereby further amended by deleting the phrase “Cottage food industry with proof of license from the Georgia Department of Agriculture” in sub-section (O), paragraph (5) thereof and replacing said phrase with “Reserved,” so that said sub-section (O), paragraph (5) now reads as follows: 5. Reserved. SECTION 2. All ordinances or parts of ordinances in conflict herewith are hereby repealed. A public hearing was held on request of Athens-Clarke County Unified Government to amend Chapter IX of the Code of Ordinances regarding the definition and permitted locations of Veterinary Clinics and Kennels. AN ORDINANCE TO AMEND THE CODE OF ATHENS-CLARKE COUNTY, GEORGIA WITH RESPECT TO VETERINARY CLINICS USES IN THE ZONING ORDINANCE OF ATHENS- CLARKE COUNTY, GEORGIA; AND FOR OTHER PURPOSES. The Commission of Athens-Clarke County, Georgia, hereby ordains as follows: SECTION 1. Section 9-2-1 of the Code of Athens-Clarke County, Georgia entitled “General,” is hereby amended by revising the definition of “veterinary clinic,” so that this defined term now reads as follows: Veterinary clinic: A facility for the temporary treatment and boarding of domestic animals that is operated under the supervision of a licensed veterinarian; temporary boarding may be provided for animals undergoing treatment; non- veterinary boarding services shall be regulated as kennels. SECTION 2. (8 YES; 2 NO) A RESOLUTION OF THE COMMISSION OF ATHENS-CLARKE COUNTY, GEORGIA, RECOMMENDING REZONING OF ALL OR PORTIONS OF PARCELS LOCATED AT 550 NORTH JACKSON STREET, 293 HOYT STREET, AND 295 EAST DOUGHERTY STREET; AND FOR OTHER LAWFUL PURPOSES. WHEREAS, on or about June 17, 2025, the Unified Government of Athens-Clarke County, Georgia (“Unified Government”), and the Downtown Athens Development Authority (“ADDA”) entered into that certain Intergovernmental Agreement (“IGA”) detailing a proposed development that the IGA refers to as the “Core Concept”; and WHEREAS, the IGA, in Section 3(c), contemplates the conveyance of certain property referred to therein as the “ACC Property” from the Unified Government to the ADDA; and WHEREAS, said “ACC Property” is comprised of two parcels of land, one located at 550 North Jackson Street, Athens, Georgia, and the other located at 293 Hoyt Street, Athens, Georgia; and WHEREAS, the Unified Government is the current owner of the ACC Property; and  WHEREAS, the IGA, in Section 3(l), further contemplates that either the Unified Government or the ADDA will initiate an action to rezone the ACC Property; and WHEREAS, rezoning of certain parcels—or applicable portions thereof—is contemplated as part of the Core Concept; and WHEREAS, the Commission desires to recommend the rezoning of the ACC Property and other parcels (or the applicable portions thereof), and further desires to authorize the ADDA to apply for and pursue said rezoning in accordance with Title 9 of the Code of Athens-Clarke County, Georgia, and other applicable laws; NOW THEREFORE, the Commission of Athens-Clarke County, Georgia, hereby resolves as follows: SECTION 1. The Commission hereby recommends and requests that the Athens-Clarke County Planning Commission review and consider applications for the rezoning of the following parcels (or the applicable portions thereof): 550 North Jackson Street, Athens, Georgia (Tax Parcel No. 163D3 N001) 293 Hoyt Street, Athens, Georgia (Tax Parcel No. 163D3 D001) 295 East Dougherty Street (Tax Parcel No. 163D3 L002) By way of further description, the areas to be considered for rezoning are those areas labeled as “Tract B” and “Tract C” on that certain document entitled “Administrative Recombination Survey for: The Graduate,” dated July 21, 2025, attached hereto as Exhibit A, and incorporated herein by reference. SECTION 2. By and through this resolution, the Unified Government hereby authorizes the ADDA to apply for and seek the rezoning of the parcels—or any applicable portions thereof—described in Section 1. The ADDA may undertake any actions necessary and incidental to pursue the rezoning of said parcels in conformance with the intent and purpose of the IGA. SECTION 3. The foregoing recitals beginning with “WHEREAS” provide necessary context and are an integral part of this resolution; therefore, said recitals are hereby adopted into this resolution as if fully set forth herein. SECTION 4. The Clerk of Commission (or Deputy Clerk) is authorized, in consultation with the Athens-Clarke County Attorney, to correct any scrivener’s errors in this resolution after the adoption and approval hereof. A motion was made by Commissioner Link, seconded by Commissioner Wright, to Approve the following for TSPLOST 2023 Project 26, W. Broad & Hancock Neighborhood Pedestrian Improvements Program – Proposed Project Concepts: 1. Modify V2 (traffic calming on Glenhaven & Indale) to also include all-way stops at Indale Ave and Rocksprings and Glenhaven & Rocksprings – upon approval, this sub-project would have warrant analyses completed for the additional all-way stops, and if warranted, advance to implementation with in-house forces. If not warranted, staff to determine alternate traffic calming measures. 2. Reassess G3 (intersection improvements at W. Hancock at Dearing Ext) for an all-way stop at Hancock Ave and Dearing St Ext – upon approval, this sub-project would have an updated warrant analysis completed and if warranted, advance to implementation with in-house forces. If not warranted, return sub-project back to a mid-block crossing that would be advanced to land acquisition and implementation with in-house forces, a change order to current contractors, and/or state contractors. 3. Modify V1 (traffic calming on Chase & Reese/Billups & Hancock) to also include all-way stops at Billups & Hancock and Billups & Hill– upon approval, this sub-project would have warrant analyses completed for the additional all-way stops, and if warranted, advance to implementation with in-house forces. If not warranted, staff to determine alternate traffic calming measures. 4. Modify P4 (Paris St sidewalk/traffic calming) to delete sidewalk project and replace with speed humps along Paris St from W Broad St to Baxter St – upon approval, this sub-project would advance to implementation with in-house forces, a change order to current contractors, and/or state contractors. 5. Modify P5 (Henderson Ext sidewalk gap from Paris to Columbus) to Highly Wanted project prioritization. 6. Modify V3 (Plaza traffic calming) to Must Have project prioritization and add an all-way stop at Hill St and The Plaza – upon approval, this sub-project would have a warrant analysis completed and if warranted, advance to implementation with in-house forces, a change order to current contractors, and/or state contractors. If not warranted, staff to determine alternate traffic calming measures. 7. Modify V4 (Evans Street traffic calming) to Must Have project prioritization – upon approval, this sub- project would advance to implementation with in-house forces, a change order to current contractors, and/or state contractors. 8. Modify P1 (neighborhood-wide sidewalk maintenance) to Must Have project prioritization – upon approval, this sub-project would advance to implementation with a contractor. Adopt a resolution (Attachment #1) to authorize the acquisition of rights-of-ways, permanent and temporary construction, maintenance of slopes, and driveway easements for Hawthorne Avenue and Oglethorpe Avenue Intersection Improvement Project – ROW Acquisition and Eminent Domain Resolution, as generally shown on Attachment #2, by eminent domain, as necessary; and, b. Authorize the Mayor and appropriate staff to execute all related documents. The motion passed by unanimous vote. RESOLUTION BE IT RESOLVED BY THE MAYOR AND COMMISSION OF ATHENS-CLARKE COUNTY: WHEREAS, on July 2, 2019, at a regularly scheduled meeting, Mayor and Commission of the Unified Government of Athens-Clarke County (“Mayor and Commission”) voted and approved the project concept for Hawthorne Avenue at Oglethorpe Avenue intersection improvement project, and authorized staff to move into the Preliminary Design Phase and execute any and all other project- related documents with a commission defined option that directed staff to coordinate installation of sidewalk within Bishop Park, all pursuant to an agenda report with attachment presented to the Mayor and Commission at such meeting, such agenda report and the minutes of such meeting being incorporated herein by reference; and WHEREAS, on August 1, 2023, at a regularly scheduled meeting, the Mayor and Commission voted and approved the Hawthorne Avenue at Oglethorpe Avenue Intersection Improvements Preliminary Plans and Right-of-Way (ROW) Plans, and authorized staff to advance the project into Final Design, ROW Acquisition, and Construction Advertisement Phases, all pursuant to an agenda report with attachments presented to the Mayor and Commission at such meeting, such agenda report and the minutes of such meeting being incorporated herein by reference; and WHEREAS, the improvements to be constructed on the Hawthorne Avenue at Oglethorpe Avenue intersection improvement project are in accordance with current local and state design standards. Intersection Improvements as described hereinabove are for transportation purposes and are intended to be used for enjoyment by the public and for the passage of vehicles; and WHEREAS, the Mayor and Commission of Athens-Clarke County, Georgia have specifically determined and found that it is in the public interest and for a public purpose to construct the Hawthorne Avenue at Oglethorpe Avenue Intersection Improvements as described hereinabove; and WHEREAS, the Unified Government shall engage in negotiations with all of the property owners whose property or interests therein is needed for construction of the Hawthorne Avenue at Oglethorpe Avenue Intersection Improvements and desires to acquire such rights-of-way and easements through voluntary conveyance from such owners where reasonably possible; and WHEREAS, construction of the Hawthorne Avenue at Oglethorpe Avenue Intersection Improvements cannot proceed without the necessary rights-of-way and easements from all property owners, and WHEREAS, the Mayor and Commission further find that the acquisition of the necessary rights of-way and easements is an integral component of the Hawthorne Avenue at Oglethorpe Avenue Intersection Improvements and such acquisition is necessary and appropriate to meet the needs of the citizens of Athens-Clarke County and that the use of eminent domain to acquire the necessary rights-of- way and easements is required for the completion of the Hawthorne Avenue at Oglethorpe Avenue Intersection Improvements; and WHEREAS, Article 9, Section 2, Paragraph 5 of the Georgia Constitution authorizes local governments to exercise the power of eminent domain for any public purpose; and WHEREAS, pursuant to Section 23-2-140 of the Official Code of Georgia, the Unified Government is authorized to acquire land, in fee simple, or in any lesser interest, under the procedures set forth in Article 1 of Chapter 3 of Title 32 of the Official Code of Georgia; and WHEREAS, the Mayor and Commission have determined that in order to accomplish the public purpose of the Hawthorne Avenue at Oglethorpe Avenue Intersection Improvements, it is necessary to exercise the right of eminent domain to acquire such rights-of-way and easements; and WHEREAS, all questions of necessity, public purpose and public convenience with respect to the acquisition and construction of the Hawthorne Avenue at Oglethorpe Avenue Intersection Improvements and the necessity of acquiring through eminent domain the rights-of-ways, permanent and temporary construction easements hereinabove described are hereby determined and established by the Mayor and Commission of Athens-Clarke County; WHEREAS, the necessary rights-of-ways, permanent and temporary construction easements are more specifically shown on the proposed construction plans ROW Plan section and entitled “Right-Of-Way of Proposed Hawthorne Avenue at Oglethorpe Avenue Intersection Improvements Athens-Clarke County” sheet 60-0001 to 60-0013, dated June 12, 2024, made by Alfred Benesch, and approved by T&PW Department Director, as may be amended from time to time for corrections and technical adjustments, attached hereto as Exhibit A; and being collectively referred to hereafter as the “Right-of-Way Plans”; and NOW, THEREFORE, BE IT HEREBY RESOLVED that condemnation of the above- described rights-of- ways and easements for the public purpose stated hereinabove as shown on the Right-of-Way Plans is hereby approved and authorized and that the acquisition procedure shall proceed under Title 32 of the Official Code of Georgia, as the Hawthorne Avenue at Oglethorpe Avenue Intersection Improvements’ schedule of completion requires acquisition of such rights- of-ways and easements quickly and without delay. Time is of the essence. IT IS FURTHER RESOLVED that the Right-of-Way Plans be kept on file at the Unified Government of Athens-Clarke County, SPLOST Program Management Office, and that any interested party may obtain a copy of same by writing to the Unified Government of Athens-Clarke County, SPLOST Program Management Office at 301 College Avenue, Athens, Georgia, 30601, and paying a nominal cost therefor. IT IS FURTHER RESOLVED that the Unified Government of Athens-Clarke County and its employees and agents may negotiate for and acquire the property needed for this project by gift, sale, or condemnation, and that the County Attorney and other proper agents or attorneys of the County, including but not limited to Special Counsel Gregory C. Sowell, Attorney at Law, is hereby directed to prepare the necessary deeds, easements, closing documents, petitions, and/or declarations of taking, and/or orders and any other documents required to effectuate the foregoing. IT IS FURTHER RESOLVED that the Mayor of the Unified Government of Athens-Clarke County, the Manager, the County Attorney, Special Counsel, and other agents as aforesaid, are authorized to sign any of the documents referenced in the preceding paragraph on behalf of the governing authority of the Unified Government of Athens-Clarke County, Georgia to complete the acquisition of the property required for the Hawthorne Avenue at Oglethorpe Avenue Intersection Improvements. District 6 Townhall meetings planned for November 20, 2025 and December 8, 2025 at Fire Station 8 at 5:30 p.m. in reference to a proposed development at the corner of Whitehead Road and Jefferson Road. 3. Explained that occasional tardiness to meetings is due to coming directly from class and asked for understanding. She does her best to arrive as quickly as possible. 4. Expressed empathy to those affected by the government closure. 5. Athens-Clarke County staff, in partnership with the mall, hosted a tremendous trunk-or-treat event. It was a great success. 6.
