ATHENS-CLARKE COUNTY PLANNING COMMISSION MEETING MINUTES AUGUST 4, 2022 MEMBERS PRESENT: Sara Beresford (chair), Sarah Gehring, Catherine Goodrum, Matthew Hall, Kristen Morales, Taylor Pass, Lucy Rowland and Monique Sanders MEMBERS ABSENT: Alice Kinman and Joey Tucker STAFF PRESENT: Brad Griffin and Stephen Jaques (Planning); and Austin Jackson (Attorney’s Office) GENERAL BUSINESS Ms. Beresford called the meeting to order at 6:00 p.m. 1. Introduction of Staff reports and all other documents submitted to the Planning Commission at this meeting into the official record. Ms. Rowland moved to introduce all reports and documents into the official record. Ms. Morales seconded the motion, which passed unanimously. 2. Approval of July 7, 2022 Planning Commission meeting minutes. Ms. Rowland made a motion for approval. Ms. Morales seconded the motion, which passed unanimously. 3. MACORTS Update and Public Comment. Mr. Griffin stated that the Mayor and Commission have approved the hire of RS&H Inc. to assist with an update of the Metropolitan Transportation Plan. OLD BUSINESS 1. 286, 290, & 296 CLASSIC ROAD – PD-2022-07-1683 Type I – Master Planned Development Petitioner: Scott Haines / W&A Engineering Owners: Jimmy D. Baugus; Nancy L. McElhannon; Myrtie & Jerry B. Hall Requests: From General Business and Employment Center to Mixed-Density Residential; From E-I (Employment-Industrial) to RM-2 (PD) (Mixed Density Residential, Planned Development) Tax ID: 044 001, 044 001B & 044 001C Mr. Jaques presented the staff report with a recommendation for tabling both requests. For: Scott Haines, Cameron Grogan Against: None Discussion: The applicant stated that they can meet the technical concerns raised by staff. Commissioners had an extensive discussion of the tree canopy waiver. The applicant estimated they would lose 20% of their units to meet the canopy requirement. The Commission tabled the item to request that the applicant revise their plans to meet the conserved canopy minimum. Future Land Use Motion: Ms. Rowland made a motion to recommend tabling. Ms. Morales seconded the motion, which passed 4-3. (Gehring, Hall, and Sanders in opposition) Zoning Motion: Ms. Gehring made a motion to recommend tabling. Ms. Rowland seconded the motion, which passed unanimously. NEW BUSINESS 1. 189, 191, & 193 HIGHLAND PARK DR. – SUP-2022-04-1161; SUP-2022-04-1162; SUP-2022-04-1163 Type I – Special Use Petitioner: Chris Church Owner: Freedom from Bondage, Inc. Requests: Special Use in RM-1 (Mixed Density Residential) Tax ID: 241A1 A012D Mr. Jaques presented the staff report with a recommendation for denial. For: Chris Church Against: None Discussion: The applicant noted that there would be up to 12-14 residents rather than 21, as stated in the staff report. One unit would be reserved for staff. Prospective residents are recovering from substance abuse rather than transitioning from incarceration. Motion: Ms. Rowland made a motion to recommend approval for all three special use permits. Ms. Gehring seconded the motion, which passed 6-1. (Pass in opposition) 2. 100 PRINCE AVENUE - PD-2022-07-1692 Type II – Planned Development Amendment Petitioner: Kayla Bare / Koons Environmental Design Owner: 100 Prince Avenue LLC Request: Amendment to C-D (WE) (PD) (Commercial-Downtown, West End Downtown Design Area, Planned Development) Tax ID: 171A2 B002 Mr. Jaques presented the staff report with a recommendation for approval. For: Josh Koons, Lindsey Kayal Against: None Discussion: The Commission reacted with excitement to the proposal and thinks the proposal will enhance the space. Motion: Ms. Rowland made a motion to recommend approval. Mr. Hall seconded the motion, which passed unanimously. 3. 4555 LEXINGTON ROAD – ZONE-2022-07-1722 Type II – Rezone Petitioner: Jeff Carter / Carter Engineering Owner: Marguerite Newton Estate Request: From RS-15 (Single-Family Residential) to RS-8 (Single-Family Residential) Tax ID: 234 019 Mr. Jaques presented the staff report with a recommendation for denial. For: Jeff Carter, Steve Oexmann Against: Robert Dean, Rebecca Moore, Robert Sheppard, Lynn Saunders, Matt McClain Rebuttal: Steve Oexmann, Jeff Carter Discussion: Applicant noted that a rezoning is needed to offset extra development costs associated with site conditions. Commission debated the need for more housing vs. concerns about potential unpredictable outcomes of a rezoning without a binding site plan. Extensive discussion of possible conditions followed. 1st Motion: Ms. Rowland made a motion to recommend tabling. The motion failed for lack of a second. 2nd Motion: Ms. Morales made a motion to recommend approval with the following conditions: 1. A 50 ft. wooded buffer between the proposal and the East Hampton subdivision shall be maintained, as shown, on the site plan. 2. The second connection to Woodgrove Dr., as shown on site plan, shall be constructed in alignment with Woodhurst Dr. 3. A minimum of 20% of the conserved canopy shall be maintained. Mr. Hall seconded the motion, which passed 5-1. (Rowland in opposition) 4. 2152 WEST BROAD STREET – ZONE-2022-07-1727 Type I – Rezone Petitioner: Athens-Clarke County Unified Government Owner: Athens-Clarke County Unified Government Request: From Government to General Business; From G (Government) to C-G (Commercial-General) Tax ID: 122C1 J017 Mr. Jaques presented the staff report with a recommendation for approval. For: None Against: None Discussion: None Future Land Use Motion: Mr. Hall made a motion to recommend approval. Ms. Rowland seconded the motion, which passed unanimously. Zoning Motion: Ms. Rowland made a motion to recommend approval. Ms. Morales seconded the motion, which pass unanimously. OTHER BUSINESS 1. Planning Commission Chair’s Report – No report 2. Planning Director's Report – Mr. Griffin stated that the Mayor & Commission took the following actions on the July Planning Commission’s Agenda:  Tabled the 505 & 515 Olympic Drive rezone for one month so that further discussions between applicant and the district commissioner could be had.  Approved the 100, 106, & 179 Timothy Park Lane rezone with the conditions recommended by the Planning Commission.  Approved the 1000 block of Hull Road rezone.  The applicant withdrew the 2325 Commerce Road rezone.  Approved the 229 Meigs Street special use.  Tabled the 347 West Hancock Avenue special use for one month to allow the applicant to have further discussions with the neighbors. 3.
