SPECIAL SESSION NOVEMBER 17, 2022 The City Council of the City of Athens met in Special Session on Thursday, November 17, 2022, at 5:30 p.m. in the Civic Hall, Room 216 of the Cain Center, 915 S. Palestine Street, Athens, Texas, with the following members present to-wit: Aaron Smith, Mayor Pro Tem SyTanna Freeman Bonnie Hambrick, City Secretary Staff Present: John Densmore, Chief of Police; Michael Hannigan, Tourism/Social Media Manager. Others present: Mistie Sharp, Tarah Day, Cynthis Robles, Summer Matthews, Armileigh Peavler, and other interested citizens. with the following member absent: Toni Clay, Robert Gross, and Mark Carroll. constituting a quorum at which time the following proceedings were enacted, to-wit: INVOCATION The Invocation was given by Aaron Smith. PLEDGE OF ALLEGIANCE The Pledge of Allegiance was recited. DECLARATION OF CONFLICT OF INTEREST No conflict of interest was declared. PUBLIC COMMUNICATIONS Armileigh Peavler, thanked the City Council and stated that this would make it a safer place for her kids to grow up. DISCUSS, CONSIDER, AND TAKE ACTION, AS NECESSARY, CONCERNING THE APPROVAL OF A RESOLUTION CANVASSING ELECTION RETURNS AND DECLARING THE RESULTS OF THE NOVEMBER 8, 2022, CITY OF ATHENS SPECIAL ELECTION Bonnie Hambrick, City Secretary, stated the item is to canvass the result from the November 8, 2022, City of Athens Special Election. She stated the Provisional Ballot Board met on Wednesday, November 16, 2022 and official results were provided. She stated there are 7224 registered voters. There were 1582 ballots cast for the proposition, and 1160 ballots were cast against the proposition. Mayor Pro Tem Smith stated the following: “I, Aaron Smith, Mayor Pro Tem of the City of Athens, Texas, met with the Athens City Council sitting as the canvassing board to canvass the results of the Special Election of November 8, 2022, on this the 17th day of November 2022 in the Civic Hall, Room 216 of the Cain Center 915 S. Palestine Street, Athens, Texas. I certify that the figures on the official Canvass Report (attached as “Exhibit A”) corresponds with the figures on the returns.” City Council Special Session November 17, 2022 Page 2 A motion was made by Councilwoman Freeman, seconded by Councilmember Smith, to approve a Resolution canvassing election returns and declaring the results of November 8, 2022, City of Athens Special Election. The motion carried unanimously. NOTICE TO PUBLIC Notice is hereby given that the City Council of the City of Athens, Texas will meet in Special Session on Thursday, November 17, 2022, at 5:30 p.m. in the Civic Hall, Room 216 of the Cain Center 915 S. Palestine Street, Athens, Texas to consider the following: 1) Invocation 2) Pledge of Allegiance 3) Declaration of Conflict of Interest 4) Public Communications “Pursuant to Texas Government Code section 551.007, members of the public may speak on an agenda item during the public communication section of the meeting, or at the time the agenda item is called for discussion by the Mayor. Speakers shall be given three (3) minutes to speak. A speaker needing a translator and/or interpreter may be given six (6) minutes to speak. Members of the public wishing to address the Council on non-agenda items may do so pursuant to the same time constraints as agenda items. The Council will not comment on items not on the agenda; however, the Council may refer the item to City Staff for research, resolution or referral of the matter to the Council as a future agenda item.” 5) Discuss, consider, and take action, as necessary, concerning the approval of a Resolution canvassing election returns and declaring the results of the November 8, 2022, City of Athens Special Election – [B.
