Mayor Casida announced that Staff would like to add an item to Closed Session. Melissa Whitten, City Manager stated that would like the City Council to consider adding Item D. Consider Position Regarding Application for Alcoholic Beverage License(s): Joint City Council/Successor Agency/Authority Meeting March 24, 2016 Page 2 of 10 Ms. Whitten, City Manager reported that Staff has received notification regarding a transfer of an Alcoholic Beverage License. The transferor is Ronald Bear; the applicants are Everardo Aguirre and Enrique Jimenez Jr.; an application is for transfer of an “on-Sale Beer” license located at 225 E. Kings St. which currently known as Bear’s Den. Staff mention that in prior years, the City Council has chosen: 1) support; 2) not support; 3) remain neutral on applications received. Staff will contact the Department of Alcoholic Beverage Control (ABC) and inform them of the City Council position. However, the final determination will be made by the department. Mayor Casida mentioned that when this license application was brought before them under the Bear’s Den/Ronald Bear, it allowed the sale of food with alcoholic beverages, but it must be food prepared on-site only. The food cannot be brought in from different restaurants. A motion made by Councilman Ovalle to remain neutral on the application for transfer of Alcoholic Beverage License for Everardo Aguirre and Enrique Jimenez Jr.; and seconded by Councilmember Woolley and carried. Consider Request for Letter of Support for Assembly Bill 2630 (San Joaquin Valley Clean Energy & Jobs Act) from Assemblyman Rudy Salas: Ms. Whitten mentioned that she received an email by Mr. William Munoz, on behalf of Assemblyman Rudy Salas, requesting a letter of support from the City of Avenal for Assembly Bill 2630 (San Joaquin Valley Clean Energy & Jobs Act). Existing Law, the Public Utilities Act, established the Independent System Operator to ensure the efficient use and reliable operation of the electric transmission grid. The Clean Energy and Pollution Reduction Act of 2015 would establish a target of 50% for the amount of electricity generated and sold to retail customers per year form eligible renewable energy resources, to be achieved by December 31, 2030. She continued that this bill would require the Public Utilities Commission and the Energy Resource Conservation and Development Commission to evaluate potential renewable energy projects on least-conflict lands in the San Joaquin Valley, as specified, on or before January 31, 2017. Using that evaluation to recommend to the Independent System Operator an amount of renewable energy, the use of least-conflict lands as identified by the San Joaquin Valley Solar Conservancy. Assemblyman Salas is asking for support of this bill. Councilmember Woolley had concerns regarding 50% or use of land. Ms. Whitten mentioned that the 50% is required already, she believes the intent is to establish where solar facilities could be located areas that are not prime Ag land or commercial land. It would be land that is not so affected as those types of zonings. A brief discussion, the City Council continued the Request for Letter of Support for Assembly Bill 2630 (San Joaquin Valley Clean Energy & Jobs Act) from Assemblyman Rudy Salas until the April 28, 2016 meeting. PUBLIC COMMENT/ANNOUNCEMENTS & UNSCHEDULED APPEARANCES: Chon Gong, the parent of owners of Panda Koala; who have been building in Avenal for 10-15 years, thanked the City of Avenal for their professional and respectful manner with which they have conducted business. They have built many homes in Avenal including those on infill lots. He thinks it has helped do away with ugly lots and made more revenue base for the city. The owners of the new homes can now say “it’s not my big ranch but it is my home.” He feel that it is a very good thing. They have just finished Phase I of the Celito Lindo and Phase II will be Joint City Council/Successor Agency/Authority Meeting March 24, 2016 Page 3 of 10 starting soon. He views the city government as a three way relationship: 1) business; 2) government; and, 3) the inhabitance of the citizens. Whenever occasions comes up; or, it benefits two or three parties in the relationship, he thinks the City Council should give it true consideration. Councilmember Woolley mentioned that Panda Koala has done such a great job in-filling houses on empty lots within Avenal. She used to have people tell her “Avenal does not have any new homes”, but mentioned that, you would not know where they are because Panda Koala builds them in all the lots. She asked how many homes has Panda Koala has built. Mr. Gong mentioned 100-200 homes. Mayor Casida stated that he has been here the longest and when Panda Koala started, the City of Avenal established Redevelopment. It was determined “that the City of Avenal is so blighted, the whole City was would qualify as a Redevelopment area instead of just the Business District” as in most cases. If they would come back today, the City of Avenal would not qualify for Redevelopment, because Panda Koala has in-filled the lots with new homes; where there used to be weeds, rundown houses etc... It has helped lift up the community and for that, “thank you”. Chon Gong, gives credit to his sons and Ken commented “primarily his brother Tom Gong”. Councilmember Woolley announced that the neatest part about the in-fill houses that Panda Koala has built, is not only that there is a new house on that lot, but we get to see the whole block transform because everyone wants to then fix their houses up. Avenal really changed because of that. ACTIVITY REPORTS/SPECIAL PRESENTATIONS AND COMMITTEE REPORTS: A. Activity Reports: 1) Public Works/Building/Code Enforcement/Animal Control Departments Activity Report: Rob Williams, Public Works Director; Rob Williams, Public Works Director, reported on the following: 1) Building Department; 2) Code Enforcement; 3) Park & Landscape; 4) Animal Control; 5) Streets; 6) Water Distribution; 7) Waste Water; and, 8) Vehicles, Equipment & Building Maintenance. B. Special Presentations/Requests: 1. Avenal Landfill Update – Ben Grey & George Anderson, Supervisor Ben Grey, District Manager reported the following: 1) He announced Dan has left Waste Connections and went back to Sonoma County in December; and 2) introduced George Anderson, as the new Site Supervisor for the Avenal Landfill. Mr. Anderson, Avenal Landfill, is proud to be a part of the Waste Connection team. Mr. Anderson made a business decision in deciding to move from Mid Valley to Waste Connection. Mr. Anderson, looks forward working with the City of Avenal residents and introduce his wife Laurie. Ben Grey continued with the Avenal Landfill donated $10,000 to various organizations: RAP, Avenal Gun Club, Avenal Theater, Sand Drags, Avenal High School and Pistachio Festival. It is a great joy to give back to the community. This year they hope to reach $2,000 in donations and will match last year’s donations or exceed that amount. He mentioned that the water line was pressure tested and thanked, Rob Williams and Staff, as they were excellent throughout the project. The Landfill gas system has been installed and has been up and running for about a month. It helps with the odors that were moving around and are now 100% sealed. Also, they are continuing day to day business and working on the berm. PUBLIC HEARING(s): 1) Consider Fiscal Year 2016/17 Local Transportation Fund (LTF): Joint City Council/Successor Agency/Authority Meeting March 24, 2016 Page 4 of 10 o Staff Report o Public Hearing o Adopt Resolution Dawn Perkins, CPA, Administrative Analyst reported that staff received notification from Kings County Association of Governments informing the City that their apportionment of Local Transportation Fund (LTF) for FY 16/17 is in the amount of $351,560.00. The use of the Funds are as follows: Article 8 Local Street and Roads $279,586 Local Transportation Services $ 4,000 Planning $ 9,334 KCAPTA $ 58,640 As per KCAPTA, a public hearing was held on our behalf on February 21st and 23rd. However, we were instructed by KCAG to hold a public hearing for unmet transportation needs. Staff returned the completed claim form to KCAG before 5:00 p.m. on April 1, 2016 and a copy of the resolution will be submitted following the City Council meeting. Staff recommended authorizing the submittal of the FY 2016/2017 claim by Resolution. Open Public Hearing for Fiscal Year 2016/17 Local Transportation Fund (LTF) at 6:30 p.m. Rob Williams, Public Works Director did receive an engineer’s estimate of $3.7 million for the proposed reconstruction of the Avenal Cut-Off Road. Closed Public Hearing for Fiscal Year 2016/17 Local Transportation Fund (LTF) at 6:32 p.m. RESOLUTION 2016-18: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AVENAL AUTHORIZING A CLAIM TO BE MADE FOR THE LOCAL TRANSPORTATION FUNDS FOR THE 2016/17 FISCAL YEAR, FINDING NO UNMET PUBLIC TRANSIT NEEDS AND AUTHORIZING THE CITY MANAGER TO MAKE AND AMEND SUCH CLAIM was adopted on a motion by Mayor Pro Tem Preciado and seconded by Councilman Ovalle and carried. Consider Extending Local Emergency Declared on February 27, 2014: Ms. Whitten reported that the City of Avenal is doing well with conserving. However, the City of Avenal received first initial estimate for water allocation this year 1,968 acre feet. She mentioned that north of the Delta, they are at 100% allocation; exchange contractors 100%; wildlife 100%; historic contractors 100%; and south of the Delta were at 55% or enough water to meet the Public Health and Safety needs. The City does have carry over water; which the City Council is aware will bring water up to 2,337 acre feet. Staff is requesting by motion, to approve the ongoing Local Emergency Declaration and drought conditions as they continue to exist; therefore, Staff recommends that the Local Emergency Declaration be renewed/extended for 14 days and reviewed again at the April 28, 2016 City Council meeting. NEW BUSINESS: A. Consider Request for Approval of Out-of-State Travel to Attend Beneficial Water & Wastewater Conferences: Ronald Brumley, Utilities Supervisor reported that is requesting authorization for out-of-state travel to attend two (2) water/wastewater conferences: 1) the California Rural Water Association EXPO help at Lake Tahoe, Nevada, April 22-25, 2016; and 2) the 31st Annual Tri State Seminar which will be held in Las Vegas, Nevada, September 20-22, 2016. These presentations are tailored to water and wastewater profession and will allow him to gain knowledge and understanding about how to improve their process. Also, will earn valuable contact hours to keep my certification(s) current. With the current water quality issue, he feels this would be beneficial. He would be able to obtain more information on the current technologies available and fist-hand experience from other operators experiencing similar problems. The following are estimated costs associated with travel and attendance at both conferences: California Rural Water Association EXPO: Registration: $425 (for Members) Hotel: 250 (3 nights) Per Diem 168 (4 days) Fuel 100 (Fuel) Total $943 (est.) The anticipated budget for FY 2016-17, Department 15.15100-661: $2,000. Mayor Casida mentioned that these conference will be a good learning and networking experience. Mayor Pro Tem Preciado mentioned that this will be a good learning experience especially with compliance issues and networking with other agencies that can help with issues. A motion made by Mayor Pro Tem Preciado to authorize conferences: 1) the California Rural Water Association EXPO held at Lake Tahoe, Nevada, April 22-25, 2016; and 2) the 31st Annual Tri State Seminar to be held in Las Vegas, Nevada, September 20-22, 2016 and seconded by Councilman Ovalle and carried Roll Call Vote: AYES: Preciado, Ovalle, Woolley, Casida. Ms. Whitten clarified, normally funds that are budgeted for conferences and it doesn’t exceed a certain amount of money, it is basically a given, they will be able to attend. This is out-of-state travel and according to the administrative policy, it requires the approval of the City Council. She stated that, “it has been decades since someone from the Wastewater Plant Department has been able to attend conferences”. B. Consider Approval of Updated Harassment Policy: Joint City Council/Successor Agency/Authority Meeting March 24, 2016 Page 6 of 10 Mrs. Perkins reported that new regulations regarding the Fair Employment and Housing Act (FEHA) went into effect April 1, 2016 for all employers with five (5) or more employees. The new legislation requires an update to the written policy in regards to definitions regarding sex and gender, human trafficking, sex discrimination, pregnancy, religious discrimination, support animals, reasonable accommodations and anti-bullying training. It also extends coverage to interns, whether paid or not, and volunteers. Staff recommends adoption of the updated resolution to conform with new legislation effective April 1, 2016. RESOLUTION 2016-19: RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AVENAL AMENDING THE PEERSONNEL POLICY- ADMINISTRATIVE POLICIES AND PROCEDURES RELATING TO HARRASMENT was adopted on a motion by Councilmember Woolley and seconded by Mayor Pro Tem Preciado and carried. Consider Approval of San Joaquin Valley Air Pollution Control District Public Benefit Grants Program Application: Fernando Santillan, Community Development Director reported that as the Council may recall, the City was able to purchase a Toyota Prius hybrid car and a John Deere electric cart using funds from the San Joaquin Valley Air Pollution Control District’s Public Benefits Grants Program several years ago. Chief Stivers would now like to use the same grant to purchase two Ford Fusion Energi hybrid vehicles for the Police Department to replace two 2010 Ford Crown Victoria Police Interceptor vehicles being used for detective and administrative purposes. One additional Fusion Energi would also be purchased to replace the 2004 Ford Taurus which is currently being used for city administrative travel and training purposes. He continues that the Air District grant provides $20,000 per vehicle, with the City providing a match for the difference in price. The application period for this grant is ongoing and it may be one to two years before the City is awarded the funds. An authorizing resolution is required for this grant which is attached for your consideration. Staff recommends to adopt resolution which approves the submittal of an application to the San Joaquin Valley Air Pollution Control District’s Public Benefits Grants Program and for the purchase of three Ford Fusion Energi vehicles to be used by the Police Department and City staff for administrative and training-related travel. The attached quote from Monarch Ford, the current cost of each vehicle, including taxes and fees, is estimated at $32,522.50, which would require a roughly $13,000 match from the City per vehicle. However, since the price may change between the time of the application and award, staff is requesting authorization for up to $15,000 per vehicle. Funds would be drawn from CIP Fund 75 ($40,000) and Equipment/Maintenance – Motor Vehicles Account 1018000-727 ($5,000) and carried over into the next budget year. He noted that Assistant Chief LaBlue forwarded him a new funding source that can provide an additional $5,500 per vehicle to bridge that gap between the San Joaquin Air Pollution Control Grant and the City of Avenal funds needed from $45,000 would now be reduced by $15,000. RESOLUTION 2016-20: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AVENAL AUTHORIZING THE SUBMITTAL OF AN APPLICATION TO THE SAN JOAQUIN VALLEY AIR POLLUTION CONTROL DISTRICT PUBLIC BENEFIT GRANT PROGRAM was adopted on a motion by Mayor Pro Tem Preciado and seconded by Councilman Ovalle and carried. Consider Approval to Purchase Shade Structures at Rice Park and Approve Agreement for Installation of Shade Structures: Joint City Council/Successor Agency/Authority Meeting March 24, 2016 Page 7 of 10 Mr. Santillan reported that the City was awarded funding by the Wonderful Community Grants Program for two shade structures at Rice Park which will cover each playground. The large playground will require a 30’x40’ structure with fabric shade material and the small playground will require a 25’x25’ fabric shade. Qualified quotes from various equipment vendors and equipment installers were received as follows:  USA Shade (Equipment + Install) $37,984.29  Bothof Construction (Equipment + Install) $28,588.40  MRC (Equipment) / Bothof Construction (Install) $30,427.15  MRC (Equipment) / Coastal Park & Recreation (Install) $24,094.75 Staff recommends by motion, approve the purchase of shade structures from MRC in the amount of $16,344.75 and; by motion, adopt the attached resolution which authorizes the City Manager to enter into an agreement with Coastal Park & Recreation for installation of two shade structures in the amount of $7,750.00. Total cost of equipment and installation will be $24,094.75. Consider Approval for Purchase of Tables & Chairs for Technology Center: Mr. Santillan reported that the City was awarded $53,000 by the Wonderful Community Grants Program for two projects at Rice Park and the Recreation Center. The Recreation Center project consists of converting the back room, currently being used for storage, into a Technology Training Center for the community. Consider Approval of Tract Map 903 (Celito Lindo No. 2 Residential Development); and Approval of Subdivision Improvement Agreement for Tract Map 903: Mr. Santillan reported that the Avenal Planning Commission originally approved Tentative Tract Map 903 on August 2, 2010. Since that time, the Applicant, Oasis Valley No. 1, LLC (Panda Koala) has received a three-year time extension under the Subdivision Map Act which will expire on January 6, 2017. The Tract Map will divide one parcel totaling 32.11 acres into 33 parcels ranging in size from 6,000 sq. ft. to 13,300 sq. ft. in size. Since the Planning Commission’s approval and subsequent extension, Panda Koala has worked with the City to bring the map to final status and obtain necessary approvals from Public Works, City Engineer Summers Engineering, and the City Manager’s Office. A conditional water and sewer will-serve letter was provided to the developer on November 4, 2015. He continued that the final map for this tract has been checked and approved by Staff and the City Engineer. Improvements for this project will be installed under plans developed by the Applicant and approved by Staff and the City Engineer. An agreement for the development of the tract has been completed, reviewed by Counsel and is attached for your approval. A copy of the map is also attached for your review. At the August 2, 2010 meeting, the Planning Commission approved an initial study/mitigated negative declaration per the California Environmental Quality Act which indicated that there will be no significant impacts associated with the project. All mitigation measures adopted at that time remain in effect. No CEQA action is required with this approval. Staff recommends that Council: 1. By motion approve Tract 903 and authorize the City Clerk to sign the map. 2. By motion accept the Right-Of-Way Dedication for all roads identified on Tract Map 903 on behalf of the public and into the City maintained mileage, and authorize the City Clerk to sign the acceptance on the map. 3.By Resolution authorize the City Manager to sign the Subdivision Improvement Agreement between the City and Oasis Valley No. 1, LLC, for development of improvements related to Tract 903. Mayor Pro Tem mentioned that he was a member of the Planning Commission at that time and it is a very nice map. ABSTAIN: None. Joint City Council/Successor Agency/Authority Meeting March 24, 2016 Page 9 of 10 Chon Gong, mentioned that it is beneficial having a nice house built in a neighborhood as it makes everyone else follow through with improvements. He feels Phase I of their subdivision is very nice and they are very proud of it. Ken Gong would like to share with the City Council and the citizens of Avenal, the upcoming project will be of similar quality and there will be no noticeable change in construction on Phase II. He will comply with the water conservation mandates by the State of California they will redo the landscaping to include less grass and more dry landscaping. He thanked the City Council for approval of the project. Once the map is officially recorded at the Recorders Office, they plan to break ground within a month. RESOLUTION 2016-22: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AVENAL AUTHORIZING THE CITY MANAGER TO ENTER INTO AN AGREEMENT WITH OASIS VALLEY NO. 1, LLC, FOR THE DEVELOPMENT OF TRACT 903 was adopted on a motion by Councilman Ovalle and seconded by Mayor Pro Tem Preciado and carried. Councilman Ovalle commented on the following: 1) Chat with the City Council and a few community members stopped by; 2) CRT meeting; and, 3) Landscape Ad Hoc meeting. Mayor Pro Tem Preciado commented on the following: 1) Sacramento – JPA meeting and assured everyone that the Central Valley JPA would not compete or be a rival of any kind for any project and it was a good meeting; 2) met with the authors of Proposition 1A regarding the Water Bond and their support of the Central Valley JPA and they would send a letter of support for the Temperance Flat project to go forward; 3) Fresno meeting – a USBR representative was present and would support the JPA and were willing to give them the technical support for all the years since 2007 that they have been doing studies and once the project; 4) Chat with the Council meeting - there was a concern with API of Reef Sunset School District and they will be attending the School Board Meeting to address their concerns and see that something is done; 5) CRT meeting and the improvements at the Avenal Police Department, thanked the Chief Of Police for money obtained for the project; 6) Trail committee meeting; and, 7) Finance meeting for the construction of the Catholic Church moving to Phase II. Mayor Casida commented on the following: 1) CRT meeting; 2) Landscape Ad Hoc meeting; 3) Trails Committee meetings; 4) the Center at APD, he hopes it will never be used because it is an emergency center, but if we do we have an emergency center to take care of it; and, 5) Old Timers Day is coming up, be ready, chicken plate Friday, activities Saturday- parade ends at the park, horse shoe contests, bounce land for the kids, Dr. Thurston’s Bluegrass, etc.… go to it. 6) And week before that is the Avenal Sand Drags and he invited the public to go the Sand Drags if they have never attended. Also, Fish Fry coming up next Monday, ticket are on sale, proceeds go to help the Avenal Theater; and, 7) Avenal City Appreciation Dinner, by invitation only, to appreciate employees, volunteers and businesses. Ms. Whitten commented on the following: 1) Annual Spring Clean-Up days are Saturday, April 16th and Saturday – April 23rd, the Landfill will be open 7:00 a.m. – 2:00 p.m.; 2) Saturday – Child Abuse Awareness event planned and sponsored by the City Recreation Department through Sheila and Anna, they have done a terrific job, that will be at Rice Park from 10:00 a.m. – 2:00 p.m.; 3) Thanked Panda Koala for investing in Avenal it is appreciated very much; and, 4) Old Timers Day; and, 5) Thanked, Staff for surprise birthday luncheon & cake.
