KINGS ST.; AVENAL, CA 93204 MINUTES Mayor Preciado called the meeting to order at 6:00 p.m. Council Members Present: Woolley, Moreno, Ovalle, Preciado. Council Members Absent: Gravelle. Legal Counsel: City Attorney Jennie Barkinskaya. PLEDGE OF ALLEGIANCE: Lead by Mayor Preciado. CITY CLERK ANNOUNCED: Government Code Section 54952.3: The members of the City Council, Successor Agency and Housing Authority are entitled to receive a total of $150.00 each as a result of convening a meeting as the City Council, Successor Agency and Housing Authority and, unless declined, each member will receive $150.00 (maximum aggregate of $300.00 per month per member) as a result of convening a meeting as the City Council, Successor Agency and Housing Authority. CONSENT CALENDAR: All items listed under the consent calendar are considered to be routine and enacted by one motion: (Action) A. MAYOR & COUNCIL MEMBER/ SUCCESSOR AGENCY/HOUSING AUTHORITY MEMBER REPORTS/ITEMS FOR CONSIDERATION: A. Public Works Department: Introduction of New Employee, Rigoberto Sandoval, Janitor/Maintenance: Scott Davis, Public Works Director (A): Scott Davis, Public Works Director (A) introduced Rigoberto Sandoval Janitor/Maintenance and said he is doing a great job. Rigoberto stated that “he is glad to be part of the team”. The City Council welcomed Rigoberto Sandoval. B. Consider Nominating Community Member to Serve on the Avenal State Prison, Citizen’s Advisory Committee: Dawn Perkins, CPA, Administrative Analyst, reported that Staff received an e-mail from Larry Chavarria, Community Resource Manager – Avenal State Prison, informing the city that 2-year term served by Jim Jepsen on the Citizen’s Advisory Committee (CAC) expired on December 31, 2016. He noted that Mr. Jepsen has indicated his interest to serve another two (2) years. As Council is aware, final appointments are made and confirmed by the Warden. Joint Meeting City Council/Successor Agency/Housing Authority February 9, 2017 Page 2 of 5 Staff recommends by motion, nominate Jim Jepsen to serve another two (2) year term on the CAC Avenal State Prison; or, consider other direction. A motion was made by Councilmember Woolley to nominate Jim Jepsen to serve another two (2) year term on the CAC Avenal State Prison, seconded by Mayor Pro Tem Ovalle and carried. Consider Scheduling Special Study Session to Discuss the Theater Facility, its Personnel Needs and Farmers Market. Mrs. Perkins reported that Staff had met with the City Council previously to discuss the Theater Facility, its Personnel Needs and the Farmer’s Market. A Special Study Session is necessary to continue the discussion of the needs of this facility and its future uses. The proposed date for this meeting is Wednesday, February 22, 2017 at 4:00 p.m. at Avenal City Hall. Staff recommends by motion, scheduling a Special Study session to be held on Wednesday, February 22, 2017 at 4:00 p.m. at City Hall to discuss the Theater Facility, its personnel needs and Farmer’s Market. After a brief discussion, a motion was made by Councilmember Woolley to schedule a Special Study Session meeting on Wednesday, February 22, 2017 at 4:00 p.m. to discuss the Theater Facility, its personnel needs and Farmer’s Market with the approval of the other Council Members, seconded by Mayor Pro Tem Ovalle and carried. Councilmember Moreno joined the meeting at 6:07 p.m. PUBLIC COMMENT/ANNOUNCEMENTS & UNSCHEDULED APPEARANCES: No comments were offered by the public. ACTIVITY REPORTS/SPECIAL PRESENTATIONS AND COMMITTEE REPORTS: A. Activity Reports: 1) Public Works/Building/Code Enforcement/Animal Control Departments Activity Report: Scott Davis, Public Works Director (A); Scott Davis, Public Works Director (A) reported the following: 1) Building Department; 2) Code Enforcement; 3) Park & Landscape; 4) Animal Control; 5) Streets; 6) Water Distribution; 7) Waste Water; and, 8) Vehicle Equipment & Building Maintenance. Mayor Preciado asked if Staff has discussed the Zeropex unit with Fresno State because they also had the unit and could maybe help with issues. Mr. Davis mentioned that Fresno State ran the Zeropex unit only and did not have the bypass system. Staff has talked with the Zeropex Company and other companies that have dealt with vibration problems in piping without the Zeropex Unit and received some suggestions of ways to prevent vibration. The companies stated that none of the pipes are supported or braced enough. This would require a whole confirmation. Staff will ask who ran the test and see who performed the demonstration for Fresno State for the power generation type system. Joint Meeting City Council/Successor Agency/Housing Authority February 9, 2017 Page 3 of 5 2) Community Development Department Activity Report: Fernando Santillan, Community/Economic Development Director Fernando Santillan, Community/Economic Development Director reported the following: 1) we have moved closer to selecting a new Associate Planner – a final decision is expected to be made by early next week; 2) the Site Plan Review has been completed for the Arroyo Del Camino II project. We have also been responding to requests from the developer for information required for the HOME grant application; 3) Began working with Self-Help Enterprises on the application process for the Housing-Related Parks Program, which is expected to be submitted before the February 23, 2017 deadline. If successful, we estimate the total award to be at least $332,650 in grant funds. They will be used at Rice Park (new bathrooms) and the planned new Public Recreation Facility; 4) continue to assist with the Avenal Transit Hub project; 5) as in December, January was heavy on the reporting side. Much time was spent gathering data for reports to the State, as well as, internal reports; 6) moving forward on all of our newly awarded grants as well as those which are close to completion, including the surveying and utility location work done by Public Works on the 18” Transmission Line; 7) met with RAP and City Staff to continue planning discussions on the Public Recreation Facility Project and potential amenities at that facility; 8) continuing to assist brokers, developers, and site selectors on questions relating to commercial real estate development in Avenal; 9) our tire-derived rubber project has been set back due to the weather, but we hope to take advantage of an upcoming break from rain the week of February 13, 2017 to complete the project downtown and at Rice Park; 10) The next Parent Technology Education class is on February 9, 2017, at 6:00 pm at the Technology Training Center. Diana Enriquez is teaching the class and will be covering a variety of topics of interest to the students; 11) permit and zoning applications are continuing to be received at a steady pace, keeping staff and Planning Commission busy; 12) we are planning for the next Tire & E-Waste Collection Event to be held from March 29, 2017 through April 1, 2017. This will be the last event as part of our 2015 grant. We hope to apply for additional funds in future funding rounds; and, 13) the next Trails Committee Meeting will be February 14, 2017 at 3:30 pm at City Hall. B. Special Presentations/Requests: 1) Mid Valley Disposal Quarter 4 Activity Report: Isaac Kulikoff Isaac Kulikoff, Mid Valley Supervisor reported the following: 1) they sponsored and donated time to help distribute turkeys to needy families during Operation Gobble; 2) Recycling Contest Awards – three winning classrooms were awarded a “Recycling Award” certificate and a pizza party on stage during lunch; 3) commercial site visits to Arroyo Del Camino where educational materials for tenants and moving packets were provided; and, 4) gave the tonnage report and stated that there are many openings for employment at Mid Valley Disposal. PUBLIC HEARING(s): 1) None. OLD BUSINESS: A. Consider Extending Local Emergency Declared on February 27, 2014: Staff is requesting by motion, approval of the ongoing Local Emergency Declaration and drought conditions as they continue to exist; therefore, Staff recommends that the Local Emergency Declaration be renewed/extended for 14 days and reviewed again at the February 9, 2017 City Council meeting. A motion was made by Councilmember Woolley to approve ongoing Local Emergency Declaration to be renewed/extended for 14 days and reviewed again at the February 23, 2017 City Council meeting, seconded by Mayor Pro Tem Ovalle and carried. Consider Submittal of Application for the 2016 Housing Related Parks Grant: Joint Meeting City Council/Successor Agency/Housing Authority February 9, 2017 Page 4 of 5 Mr. Santillan reported the Department of Housing and Community Development (Department) released a Notice of Funding Availability (NOFA) on November 16, 2016, for Housing-Related Parks (HRP) Program funds. The HRP Program is designed to encourage cities and counties to develop new residential housing by rewarding those jurisdictions that approve housing for lower-income households and are in compliance with State housing element law with grant funds for parks and recreation projects that benefit the community and add to the quality of life. It is anticipated that this will be the final HRP Program NOFA. He continued that the 2016 NOFA will award program funds to eligible jurisdictions on a per-bedroom basis for each residential unit affordable to very low- and low-income households permitted during the designated time period of January 1, 2010 to June 30, 2016. In addition, units substantially rehabilitated, converted from market rate to affordable, and preserved with certificates of occupancy issued within the designated time period are also eligible to receive funding. There is no maximum award; however, if total eligibility for funds exceeds the amount of funding available, the Department may reduce all grants proportionally. The City is eligible to apply for an estimated $332,650, with a potential 50% increase to $498,975 if HCD applies RHNA bonus funds. The funds would be used for new bathrooms at Rice Park and to supplement the construction budget for the planned new Public Recreation Facility. Staff recommends that the City Council of the City of Avenal adopt the following: 1. Authorize and direct the City to apply for and submit to the State Housing and Community Development Department the Housing-Related Parks (HRP) Program Application Package released November 16, 2016 for the 2016 Designated Program Year. If the application is approved, authorize and direct the City Manager or her designee to enter into, execute, and deliver a State of California Standard Agreement (Standard Agreement), and any and all other documents required or deemed necessary or appropriate to secure the HRP Program Grant from the Department, and all amendments thereto (collectively, the “HRP Program Grant Documents”). 2. The City shall be subject to the terms and conditions as specified in the Standard Agreement if the application is approved. Funds are to be used for allowable capital asset project expenditures to be identified in Exhibit A of the Standard Agreement. The application, in full, is incorporated as part of the Standard Agreement. Any and all activities funded, information provided, and timelines represented in the application are enforceable through the Standard Agreement. If the application is approved, the City hereby agrees to use the funds for eligible capital asset(s) in the manner presented in the application as approved by the Department and in accordance with the NOFA, Program Guidelines, and Application Package. 3. Authorize the City Manager or Community Development Director to execute in the name of the City the HRP Program Application Package and the HRP Program Grant Documents as required by the Department for participation in the HRP Program. CORRESPONDENCE/ANNOUNCEMENTS/CLOSING COMMENTS: Councilmember Woolley commented the following: 1) she was invited by Mrs. Truman’s 4th grade class at Avenal Elementary School to discuss being an elected official, how to get elected and the importance of voting. It was fun and she told the kids not to flush baby wipes down the toilet. Councilmember Moreno commented on the following: 1) she attended a transportation meeting. Mayor Preciado announced that everyone is invited to the Puma meeting, February 21, 2017; Avenal Scout House; 708 E San Joaquin at 5:00 p.m. Mayor Preciado commented on the following: 1) January 30,2017 Oversight Board meeting; 2) January 20, 2017 City/County Coordinating meeting; 3) Immigration meeting with Gabriela Mora at the Recreation Center; and, 4) Rotary annual luncheon.
