AGENDA ITEM NO. 4. – A. CITY OF AVENAL JOINT MEETING OF THE AVENAL CITY COUNCIL/SUCCESSOR AGENCY THURSDAY, JANUARY 11, 2018; 6:00 P.M. AVENAL THEATER, 233 E. KINGS ST.; AVENAL, CA 93204 MINUTES Mayor Preciado called the meeting to order at 6:00 p.m. Council Members Absent: Councilmember Moreno. Staff Present: Whitten, Ortiz, Davis, Perkins. Legal Counsel: Joseph Beery PLEDGE OF ALLEGIANCE: Lead by Mayor Preciado. ROLL CALL: Councilman Gravelle, Councilmember Woolley, Mayor Pro Tem Ovalle, Mayor Preciado. CITY CLERK: Government Code Section 54952.3: The members of the City Council, Successor Agency and Housing Authority are entitled to receive a total of $300.00 per month as a result of being elected to the City Council. They receive no other compensation for sitting as a member of Successor Agency and Housing Authority. CONSENT CALENDAR: All items listed under the consent calendar are considered to be routine and enacted by one motion: (Action) A. City of Avenal/Successor Agency – Approval of Minutes for December 14, 2017: B. City Warrants and Financial Statements for December: A motion to approve the Consent Calendar was made by Councilman/Successor Agency Member Gravelle, seconded by Mayor Pro Tem/Successor Agency Ovalle and carried. Roll Call Vote: AYES: Gravelle, Ovalle, Woolley, Preciado. NOES: None. ABSENT: Moreno. ABSTAIN: None. MAYOR & COUNCIL MEMBER/ SUCCESSOR AGENCY/HOUSING AUTHORITY MEMBER REPORTS/ITEMS FOR CONSIDERATION: A. Public Works Department Introduces - New Employee Vicente Navarro, Landscaper: Scott Davis, (A) Public Works Director. Melissa Whitten, City Manager announced that Public Works item be moved up to introduce New Employee Vicente Navarro. Scott Davis, (A) Public Works Director introduced Vicente Navarro, Landscaper. The City Council, welcomed Mr. Navarro to the City of Avenal. B. Acknowledge Sgt. Jeff Stamper (Retired) for his “Years of Service”; Avenal Police Department: Chief Stivers Ms. Whitten stated that, she spoke with Chief Stivers to due presentation for Stg. Jeff Stamper (Retired) for his “Years of Service” and are as follows: 1) Chief Stivers; 2) Legislators 3) City and break for a few minutes for cake, network and pictures. Joint Meeting City Council/Successor Agency December 14, 2017 Page 2 of 4 Mayor Preciado stated it’s a small agenda and there could be a break. Chief Stivers stated that it is a special night for Sgt. Stamper had to tell him it is a low key event; because Sgt. Stamper does not like big crowds like this events. Sgt. Stamper retired December 27, 2017 after seven (7) years of service to the City of Avenal and 19-years before that a total of 26-years of service for the citizens of Kings County, Sheriff’s Office and District Attorney before Chief Amoroso lured to Avenal. Sgt. Stamper is one of the original 16- Officers hired by the City of Avenal when the decision was made to create their own Police Department and was chosen for his leadership and ability to be a solid field training Officer. He continues that Sgt. Stamper tasks were patrol sergeant, range master, Taser instructor, lethal weapon instructor, field agent instructor, coordinator and scheduling. Also, Sgt. Stamper was a Watch Commander, Chief Stivers spoke in behalf of Retired Chief Amoroso and Assistant Chief LaBlue; they never had any doubt that the residents of Avenal and Officers were in safe hands. Also, could not overlook family support and “thanked Julia and Lilly for sharing” Sgt. Stamper. Chief Stivers, thanked Sgt. Stamper presented plaque, retired Sgt. Id card along with CCW pin. Also, honoring Stg. Jeff Stamper were Weston Anderson from Senator Vidak Office and Justin Mendes from Congressman David Valadao with certificates for “Years of Service” in law enforcement. Mayor Preciado and City Council, thanked Sgt. Stamper for his years of service dedication and years of service to the City of Avenal Ms. Whitten state that there is a lot to be said for those involved in the mobilization and establishing the Avenal Police Department and “it one of her proudest moments”. When introduced Police Officers at the Avenal High School auditorium and Jeff Stamper you are part of the elite sixteen (16) and thank him for choosing the City of Avenal and for your service and wished you the best in whatever he does. Jeff Stamper stated that people are thanking him but he would like to thank Melissa Whitten, City Manager, City Council, Chiefs of Police and all the residents of Avenal for allowing him the opportunity to work here and it’s has been a great 7-years. Mayor Preciado announced that there will be short brake at 6:14 p.m. meeting commenced at 6:34 p.m. PUBLIC COMMENT/ANNOUNCEMENTS & UNSCHEDULED APPEARANCES: Weston Anderson from Senator Vidak Office stated that State Senator Andy Vidak with Congressman David Valadao invite the community to attend a Career & Resource Expo in collaboration with Tachi Palace: Thursday, January 25, 2018; 9am-1pm; Tachi Palace - 17225 Avenue Lemoore, CA 93245. ACTIVITY REPORTS/SPECIAL PRESENTATIONS AND COMMITTEE REPORTS: A. Activity Reports: 1) Public Works/Building/Code Enforcement/Animal Control Departments Activity Report: Scott Davis, (A) Public Works Director; Scott Davis, (A) Public Works Director, reported the following: 1) Building Department; 2) Code Enforcement; 3) Park & Landscaping; 4) Animal Control; 5) Streets; 6) Water Distribution; 7) Waste Water Collection; and, 8) Vehicle, Equipment, & Building Maintenance. B. Special Presentations/Requests: 1) None. PUBLIC HEARING(s): Joint Meeting City Council/Successor Agency December 14, 2017 Page 3 of 4 A. None. OLD BUSINESS: A. None. NEW BUSINESS: A. Consider Request for two (2) New Well Permits by California Resources Production Corporation: Ms. Whitten reported that on November 12, 2017, the City received two (2) new Oil/Gas Well Permit Applications from California Resources Production Corporation (CRC). Information as submitted indicates both wells will be drilled on the same well pad; thus, only one location is noted. She mentioned that as per the Municipal Code, new oil/gas wells require a permit consideration and approval by the City Council. (Copy of AMC section is attached for review.) Review of the application is for local permitting purposes only. CRCC is still required to meet any and all other requirements as dictated by rules, regulations and laws governing oil and gas wells for drilling, production, etc. The information submitted has been accepted and deemed complete as per Code. Staff has attached an APN map to assist in identifying the location of the proposed wells. Well permit requested at this time: Well Number Locations: 318-11P Section 11, T22S, R17E, MDB&M 45-11P Section 11, T22S, R17E, MDB&M She concludes that if requests are approved by the City Council, the permit will be signed by the Public Works Director and issued by the City Clerk. There is no cost for well permit applications; however; an annual license fee/operating charge is required at $500 per each well. ** (The first annual license fee/operating charge shall be prorated; no license fee or operating charge shall be refunded; such license fee or operating charge shall continue to be paid for each well.) A bond in the amount of $5,000 is also required for each permitted well and must be approved by the City Attorney and the Mayor. Staff recommends to approve wells by resolution. RESOLUTION 2018-01: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AVENAL APPROVING TWO (2) OIL/GAS WELL PERMIT APPLICATIONS SUBMITTED BY CALIFORNIA RESOURCES PRODUCTION CORPORATION FOR THE KETTLEMAN NORTH DOME FIELDS LOCATED WITIDN THE CITY OF AVENAL. A motion was made by Councilman Gravelle to approve, seconded by Councilmember Woolley and carried. Roll Call Vote: AYES: Gravelle, Woolley, Ovalle, Preciado. NOES: None. ABSENT: Moreno. CORRESPONDENCE/ANNOUNCEMENTS/CLOSING COMMENTS: Mayor Pro Tem Ovalle commented on the following: 1) Happy New Years Melissa Whitten, City Manager, commented on the following: 1) City Hall will be closed - Monday, January 25, 2018 in observance of Martin Luther King Jr.; 2) Movies: Louisa mentioned that they went really good next round of movies will be Friday, January 19, 2018 and four movies that will be shown; 3) City was awarded State Water Resources Control Joint Meeting City Council/Successor Agency December 14, 2017 Page 4 of 4 Board Planning Grant Wastewater Treatment Plant & Sewer Collection System Improvements in the amount of $500,000 and next step - will be to bring an agreement to the City Council to consider hiring a consultant to do the writing the grant; 4) she received a call from the State regarding the solar project and it been submitted and asked question at the Water Treatment Plant; 5) she thanked, Public Works Department for their outstanding job getting decorations up and Recreation Department did a lovely job on the Christmas tree. Councilmember Woolley mentioned that worried about the Christmas tree during the wind storm. Mr. Davis mentioned that when Ana was taking decoration off she fill-up four totes and it was surprising on how many people hung up decoration on the tree and hoping next year it will continue to improve to become a tradition. Mayor Preciado commented on the following: 1) he attended Town Hall Meeting with Cemetery Board members, City of Huron & City of Coalinga regarding cemetery. A group that just formed called Friends of Pleasant Valley Cemetery that includes the cities of Huron, Coaling and Avenal. The City of Avenal is not part of the district and community members are charged $370.00 more because there considered out of the district at the same time Avenal does not have a cemetery within 10-miles and it being discussed. Also, many other concerns regarding the cemetery were discussed. He would like everyone to know that he will represent community of Avenal and if we can discuss helping as a study session item; 2) he attended JPA meeting; 3) he received a call form Congressman David Valadao office regarding immigration concerns since Avenal is a rural community and if any community member has concerns regarding immigration or needs help direct them to Congressman David Valadao Officer they will help.
