Consider New Appointment to Avenal Planning Commission: Fernando Santillan, Community/Economic Development Director, reported that a vacancy on the Avenal Planning Commission has opened up under very unfortunate circumstances due to the passing of our long-time Chair, Mr. Michael Beil. Mr. Beil's term would have expired on Dec. 31, 2018. Councilman Gravelle has the option of choosing who would be appointed. Yesterday, Mr. Santillan received an application from Jenny Torres, a resident of Avenal, who has shown interest in the Planning Commission. Staff is seeking direction from Councilman Gravelle. Councilman Gravelle appointed Jenny Torres to the Avenal Planning Commission. ACTIVITY REPORTS/SPECIAL PRESENTATIONS AND COMMITTEE REPORTS: Activity Reports: 1) Recreation Department Update: Shelia Verdugo, Supervisor; Shelia Verdugo, Supervisor, reported the following: 1) Fit to Succeed begins; 2) Karate; 3) Zumba; 4) Dance Classes; 5) Paint Night; 6) KCHD Food Handlers training, Anna, Louisa and Sheila will be receiving their food handlers permits; 7) Outreach Services & Training: the City entered into Memorandum of Understanding with KCAO for Free Tax Preparation and they are looking for volunteers from Avenal to prepare taxes and Staff has assisted with publicizing the Avenal State Prison Blood Drive; 8) Upcoming events – March 24th Easter in Park 10AM-1:00 PM, April 21st Week of the Young Child at Rice Park, April 27th at 6:30 p.m. a Dance Recital at the Avenal High School Auditorium and May 5th Old Timers Day. 2) Theater & Event Coordinator Activity Report: Louisa Starne, Avenal Theater & Event Coordinator; Louisa Starne, Avenal Theater & Event Coordinator, reported the following: 1) February 3rd attended Ohana Comic Con in Hanford; 2) movie nights will continue to be held on the 1st and 3rd Friday of each month and presented count per show. Next movie dates: March 2nd and 16th; 3) the brass has been cleaned around the theater (kick plates, handrails); 4) February 17th - Salsa Night Presented by P.A.T.Y.’s Studio - Fundraiser for the Avenal Recreation Dance Program but only three attended; 5) As an effort to bring in more families on our movie nights, we created concession gift certificates - a special offer to the RSUSD school sites. The value of the gift certificate is $3.50, RSUSD schools can purchase them at $2 each. Tamarack Elementary had purchased 18 for their Student of the Month awards. After passing them out to the students who won, they decided to purchase gift certificates for all of the students who won the Student of the Month awards from the beginning of the school year (additional 79); 6) 7) Theater Cleaning Day on March 3rd 9am - 1pm, focusing on the auditoriums, please RSVP to have lunch; and, 8) She presented the Avenal Theater Facebook page to the Council for their approval. Chief Stivers thanked and complimented Louisa for helping the Police Department with their Facebook Page. 3) Community Development/Planning Activity Report: Fernando Santillan, Community/Economic Development Director; Fernando Santillan, Community/Economic Development Director reported the following: 1) Thanked Tony for keeping up with everything in his absence; 2) The 2018 General Plan Update/Enhancement is nearing completion and it will come to Council for adoption in March; 3) The environmental review process is moving forward for the 18" Water Transmission; 4) Line Replacement project is currently in the cultural resources phase; 5) Environmental technical studies have been completed for the new public recreation facility and Staff will be compiling those into a draft Initial Study/ Mitigated Negative Declaration to move the project forward; 6) Met with developers of the Arroyo Del Camino Phase II to discuss construction timelines and other items; 7) The RFP for an administrative sub-consultant for our latest HOME grant is currently posted and will close on February 21; 8) Site Plan Review has been completed for a new donut shop downtown on Kings St./Second Ave.; 9) a workshop in Lost Hills was hosted by the Wonderful Company for all awarded grantees for this year's Wonderful Community Grants Program; 10) outreach and other assistance to other organizations with their grant-funded programs; 11) Web Development Classes at the Avenal Technology Training Center is scheduled to begin in March 2018. This will be a twice weekly course for nine weeks; 12) marketing and outreach sessions have begun and we would like to get as much participation as possible; 13) Continue working on the City's Housing Programs, including potential foreclosures, payoffs, reconveyances, and loan subordinations; 14) The I-5 Highway Commercial Marketing project is ongoing with the marketing brochure posted online (LoopNet). It has been viewed 7,780 times and sent directly to various developers across the state. No inquiries have been received as of today: 14) Various grant workshops related to infrastructure that Community Development will be attending; and, 15) Keeping up with website and calendar updates. 4) Avenal Police Department Activity Report: Russell Stivers, Chief of Police Joint Meeting City Council/Successor Agency February 22, 2018 Page 3 of 9 Russell Stivers, Chief of Police, reported the following: 1) Four firearms were seized in three separate investigations; 2) DUI arrests continue; 3) Officers Zack and Smith have completed training. Officers Campbell and Rodrigues were sworn in as full-time; 4) JSO report- on January 17, 2018, in light of recent shootings, an Active Shooter training was provided to staff at Tamarack Elementary School. February 24th was National Compliment Day so Officer Storm hand-wrote 310 compliment cards for female students at AHS and held an assembly to speak on the importance of being kind, as well as, loving and respecting one’s self. Two days later, she met with male students at AHS to speak on the importance of respect, both for self and to others. The Alcohol Awareness Program “Every 15 Minutes” is to be held May 2nd; 6) Monthly Statistical Report; and, 7) Total CAD calls received. Mayor Preciado asked to add an Emergency Item, a letter from Nisei Farms for the City Council’s consideration as an item that needs action to be taken. ABSTAIN: None. Mayor Preciado announced that this item would be under Special Presentation Item B.4 B. Special Presentations/Requests: 1) Champion’s Wellness Program Update Report: Crystal Hernandez, Psy. D., MBA, Executive Director-Champions. Crystal Hernandez, Psy.D., MBA, Champions Executive Director, reported the following: 1) Ms. Hernandez introduced Long Frank, Outpatient Manager, and thanked the Council for adding her to the agenda; 2) Champions is now open to the community; 3) Mr. Henderson remodeled this facility and did a great job; 4) Since their grand opening in September 2017, they have served over 200 people in various programs: 80 clients in Outpatient Therapy for substance abuse disorder, Noble Youths, 12; Parenting Programs – (English) Nurturing Parenting, 1; (Spanish) Nurturing Parenting, 8; Celebrating Families (whole families), 40; Interpersonal Violence Program - Child Abuse Treatment (CAT 52 week program) CAT English, 5; CAT Spanish, 2; Batterer’s Intervention Program (BIP 52 week program), 2; it is mandated by the Courts, Probation, Parole, or CPS to help change behavior; Anger Management Adolescence (16-week program), 6; and, Therapy for Individuals and Families, 9. They have a play room for child therapy. Their community involvement includes the Pistachio Festival, Frontier Days, Farmers Markets, Christmas Parades & “Every 15 Minutes” at Avenal High School. In closing, she is extremely grateful for the support of the community and they are here to help in any way possible. Mayor Preciado stated this is good for the community. Councilmember Moreno mentioned that she had assisted Champions a long time ago and they have grown. Thank you for bringing the program to Avenal. Ms. Hernandez mentioned that they hire Avenal residents because this job from the heart, not for a paycheck. 2) Margarita Ramirez, Resident of Avenal Request to Consider Road Improvements on Kern Street: Mr. Santillan reported that this item was brought forth by Mrs. Margarita Ramirez, who owns a parcel on Kern Street which is currently undeveloped. Mrs. Ramirez has been looking for ways to put a mobile home on the parcel. She approached City Staff who told Mrs. Ramirez the requirements necessary to pave the street. Kern Street is currently unpaved in that area. Her idea was to have a mobile home park but has decided to only have a single mobile home. Staff shared the Zoning Ordinance which requires any developer to pave the road as she is not allowed to access her property from an unpaved road. Ms. Ramirez had delivered a letter to City Hall and wanted to know if there was a response to her letter. Mayor Preciado stated that the letter was to be added to the Agenda. Mrs. Ramirez also needs help with resolving the issue. Joint Meeting City Council/Successor Agency February 22, 2018 Page 4 of 9 Mayor Preciado mentioned that this item was brought to the last City Council meeting and presented during Public Time and because of State Law, the City Council cannot discuss or take action on any item not on the agenda. He has reached out to Rudy Salas, Assemblyman, Richard Valle, County Supervisor for District 2, the County and City Manager as to options to remedy undeveloped areas. It would be beneficial to all when land is developed and the City receives more in property taxes. He mentioned that this item would take time to research. After a lengthy discussion, the City Council was in the consensus to bring back item at a later date to research road issue and bring item back before the City Council. 3) Petition for A Local Community Garden: Pablo Hernandez, Resident of Avenal: Pablo Hernandez, resident of Avenal, reported on behalf of the Bee Happy Community Garden group, we are petitioning the Avenal City Council to support our efforts in the founding of a community garden in the City of Avenal. Our group consist of young students and retired farm-labor professionals who are looking to bring a positive impact in the community. We see a need for an open garden space in Avenal that will be an example to our families and teaches key life lessons such as responsibility, sustainability, healthy eating, and community. We ask the Avenal City Council to support us by providing a City owned space for this community garden. The space would remain City owned, and we would adhere to any zoning policies and ordinances, as well as maintain any specifications such as fencing and landscaping, as required by the City. We are currently in the process of applying for our non-profit status. Our organization's bylaws will include provisions that require responsible interactions by our members and have rules against drugs and alcohol. We will be a productive and positive group in our community. Once established, we plan to participate in all local community events such as Old Timers Day, Pistachio Festival, and the Farmers Market. We would like to begin the tradition of street and alley clean-up days so our families can be proud of the entire city and help to maintain its beauty. As our group grows, we will always remain open to any resident that is interested, and communally help each other grow our gardens. Please give this request serious consideration, and we look forward to working with the Avenal City Council in providing this community garden to Avenal. A petition was introduced with 1,000 signatures of support and they have Rotary Club’s support. As soon as they are established as a non-profit, Adventist Health has set aside $5,000. City Attorney Beery ask Mayor Preciado to step out for this discussion as this item is a conflict of interest for him. Mayor Pro Tem Ovalle took over the meeting for the remainder of this item. After lengthy discussion, the City Council asked the Local Community Garden to bring this item back for consideration once their non-profit status is obtained. 4) Emergency Item - A letter from Nisei Farms: Mayor Preciado received the letter from Nisei Farms and asked Mrs. Perkins to read it. Mrs. Perkins read this letter requesting City Council’s support on a letter to President Trump and Congress to advocate to protect the Dreamers, undocumented individuals who were brought in as children. Mayor Preciado stated that Manuel Cunha, Nisei Farm League, is a big advocate for immigration and it was his idea to get the signatures of all of the Mayors in the Central Valley San Joaquin Valley and other Elected Officials to sign and send the letter to President Trump. There will be a Press Conference where the Mayors will sign the letters for Congress and President Trump. He is requesting approval from the City Council to allow him to sign the letter. After a brief, discussion, a motion was made by Mayor Pro Tem Ovalle to approve the Mayor to sign the letter of support for the Dreamers, seconded by Councilmember Moreno and carried. None. OLD BUSINESS: A. Consider Recommendation from Planning Commission Regarding Backyard Chicken Coops in Residential Area: Mr. Santillan reported that comments were received by the City Council from members of the public, and the Planning Commission was asked to reconsider the issue of backyard chicken coops. Specifically, the goal was to review the current ordinance which bans hens and roosters in all residential areas, except Residential Estate zones, and consider whether it may be appropriate or beneficial to change the ordinance. Community Development staff reviewed ordinances from surrounding cities to analyze how the issue is currently addressed there and found that regulations vary widely, ranging from not allowing them in residential areas (Visalia) to allowing a specified number of hens per lot in residential areas (Lemoore (4), Huron (10)), or based on lot size (Corcoran). They also met with the City Manager, Code Enforcement, Public Works, and the Police Department to discuss what is currently happening as far as backyard chicken coops are concerned, as well as the issues faced when chickens were allowed in the early days of Avenal's incorporation. Staff presented the findings of this research to the Planning Commission over the course of several meetings. After two public hearings and extensive discussion, the Commission voted at their November 6th meeting (resolution attached) to recommend to the City Council the zoning ordinance remain unchanged as it pertains to backyard chickens coops, allowing backyard chickens (not roosters) only in Residential Estate (R-E) zones and prohibiting them in the R-1, R-2, and R-3 residential zones. Mayor Preciado asked for copies of the information provided to the Planning Commission for their decision and he would like to bring it back to the City Council. After, a lengthy discussion, the following action was taken: A motion was made by Councilman Gravelle to table item, seconded by Councilmember Moreno and carried. Consider Entering Into An Agreement with AM Consulting Engineers, Inc. to Undertake and Complete a Clean Water Revolving Fund Planning Grant Engineering Report for Wastewater Treatment Plant & Sewer Collection System Improvements Project Application for Funding: Alfonso Manrique, Engineer, reported that he has submitted two applications to the State for the Clean Water Revolving Fund Planning Grant for the Engineering Report of the Wastewater Treatment Plant & Sewer Collection System Improvements Project. A grant was submitted for a solar facility to power the Waste Water Treatment Plant which has not been approved yet, but the last thing he heard from the State was the funding agreement should be Joint Meeting City Council/Successor Agency February 22, 2018 Page 6 of 9 available sometime in June and construction to start sometime in the fall. The item today is an agreement with AM Consulting Services, Inc. for the preparation of the engineering report, environmental documents and other associated services needed to prepare a CWSRF Application. The Budget Breakdown is as follows: AM Consulting Engineers, Inc. $270,000 CCTV Contractor $200,000 City - Grant Administration $ 30,000 Total budget: $500,000 After a brief discussion, the following action was taken: RESOLUTION 2018-08: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AVENAL ENTERING INTO AN AGREEMENT WITH AM CONSULTING ENGINEERS, INC. TO UNDERTAKE AND COMPLETE A PROP 1, CLEAN WATER STATE REVOLVING FUND (CWSRF) PLANNING GRANT ENGINEERING REPORT FOR WASTEWATER TREATMENT PLANT AND SEWER COLLECTION SYSTEM IMPROVEMENTS PROJECT APPLICATION FOR FUNDING; AND FURTHER AUTHORIZE THE CITY MANAGER TO SIGN AND EXECUTE SAID AGREEMENT. A motion was made by Councilmember Woolley, seconded by Mayor Pro Tem Ovalle and carried. Roll Call Vote: AYES: Woolley, Ovalle, Gravelle, Moreno, Preciado. NOES: None. ABSENT: None. ABSTAIN: None. B. Consider Expenditure of Funds to Repair Main Pump No. 2 at Water Treatment Plant No.1: Ronald Brumley, Utilities Supervisor, reported that due to normal wear and tear, Water Treatment Plant No. 1- main pump No. 2 has been sent in for inspection. It was leaking from the main seal, vibrating and not pumping efficiently. Through inspection, the following is needed to repair the pump: machine a new head shaft, stuffing box bushing, 6" couplers, top bowl and mechanical seal at a cost of $14,352.31. He continued that in the past, we have sent pumps to multiple companies for repairs. SCI has always given us the lowest price. In a situation where we are unsure of the exact problem, the companies must tear down the pump prior to giving us a quote. If we chose not to go with SCI, there would be a $1,500 charge for the disassembly of the pump to diagnose and then we would have to pick up the pump and take it to another company with the hope that their quote would be less; however, there is no guarantee. For this reason, we only have one quote. Staff recommends by motion: 1) approve expenditure of $14,352.31to SCI for parts and labor needed to repair main pump No. 2; 2) drawdown funds in the amount of $14,352.31 from Fund 75 (CIP) Enterprise Fund - Water Treatment and transfer to Fund 14.14000.667.5; 3) and, let the FY 2017/18 reflect the change. A motion was made by Councilmember Woolley to: 1) approve expenditure of $14,352.31to SCI for parts and labor needed to repair main pump No. 2; 2) drawdown funds in the amount of $14,352.31 from Fund 75 (CIP) Enterprise Fund - Water Treatment and transfer to Fund 14.14000.667.5; 3) and, let the FY 2017/18 reflect the change, seconded by Mayor Pro Tem Ovalle and carried. Consider Request for Out of State Travel to Attend California Rural Water Association Joint Meeting City Council/Successor Agency February 22, 2018 Page 7 of 9 Expo and Tri-State Seminar: Ronald Brumley stated that he would like to have one employee from Public Works and two from Utilities attend one of two out-of-state water/wastewater conferences: 1) the California Rural Water Association Expo, held in Lake Tahoe, Nevada April 23-26, 2018; and, 2) the 33rd Annual Tri-State Seminar which will be held in Las Vegas, Nevada September 25-27, 2017. The employees that attend the conference would rotate among the positions which need continuing education units. These conferences will enable Staff to attend a variety of sessions that are directly applicable to our work and will allow us to network with a variety of experts and colleagues from the tri-state area. Many of the presentations are tailored to the water and wastewater professions which will allow us to gain knowledge and understanding of how we can improve our processes. We will also earn valuable contact hours to keep our certifications current. The presentations are facilitated by both industry experts and water/wastewater colleagues who have faced similar challenges. He concluded that in getting the information in a conference format will greatly reduce time and costs that would normally be incurred in researching the topics. Here is an estimated cost breakdown of each conference: California Rural Water Association EXPO, April 23-26, 2018: Registration- $425 for members per person Hotel- $ 65 per night for 4 nights, per person Per Diem- $114 for 4 day, breakfast and lunch provided in r egistration fee Total- $800per person Plus fuel- $100 for all to travel in 1 car Tri-State Seminar, September 23-27, 2018: Registration- $ 95 Hotel- $400 for 4 nights (Estimate) Per Diem- $170 Total- $665 (Estimate) per person Plus fuel- $100 for all to travel in 1 car Staff recommends by motion, approve three (3) City Staff to travel out-of-state to attend the CRWA Expo and also the Tri- State Seminar as noted above. Funds are budgeted in the FY 2017/18 City Budget for Water and Sewer Funds to cover travel and expenses. *Also noted that He or Scott Davis would not be gone at the same time. After a brief discussion, a motion was made by Councilman Gravelle to approve three (3) City Staff to travel out-of-state to attend the CRWA Expo and also the Tri- State Seminar as noted above. Funds are budgeted in the FY 2017/18 City Budget for Water and Sewer Funds to cover travel and expenses, seconded by Councilmember Woolley and carried. Consider Collaboration with Avenal Historical Society & Museum for 2018 ReLeaf Grant: Antony Lopez, Associate Planner, stated that on January 24th, Staff attended a Grant Workshop in Huron for the California ReLeaf 2018 Social Equity Tree Planting Grant Program. This grant provides up to $75,000 in funds for the planting of trees in public spaces in an effort to reduce greenhouse gasses in California. 25% of requested funds must be matched, which may be provided as in-kind; such as labor, equipment, and staff time. Eligible Joint Meeting City Council/Successor Agency February 22, 2018 Page 8 of 9 applicants must be a 501(c)(3) non-profit organization, which excludes the City. However, government agencies may collaborate with eligible groups as a fiscal sponsor. This grant requires and encourages collaborations between local groups and government entities by involving the local communities through volunteerism and education surrounding the important of green spaces. Staff shared this opportunity to both the Avenal Rotary Club and the Avenal Historical Society and Museum. Both groups hold an interest in planting new trees in Avenal for the community at-large. Rotary was looking forward to applying to this grant, but because they are a 501(c)(4), they are ineligible. Being an eligible non-profit, the Historical Society Board voted on Sunday, February 11, 2018, to apply for the 2018 ReLeaf Grant, however, the scope of their original project would not meet the goal of reducing "at least 100 metric tons of greenhouse gasses per $10,000 in funding requested." Therefore, the Historical Society Board has approached the City to collaborate on the 2018 ReLeaf Grant thus allowing the City to be a fiscal sponsor, access to spaces to plant trees, and also provide the 25% matching requirement through labor and equipment from Public Works by planting trees. The Historical Society will be the lead applicant to the 2018 ReLeaf Grant, and follow through on any requirements and reporting for the grant, with help from City Staff, as needed. The Museum campus and other spaces - as determined by City Staff - will easily benefit from much needed new trees. Public Works has expressed an eagerness to get started on a tree replacement project for the City, and is willing to commit the labor and equipment to see this project through. Due to our extensive drought seasons in recent years and the age of our trees, Public Works has had to cut down over 20 trees at Rice Park in the past year alone. This situation is only worsening, and the need for replacement and additional trees is becoming more paramount. Should the grant be awarded, funds would go towards purchasing 15-gallon classification trees that will stand a better chance at reaching maturity and replenishing our public spaces with shade. While the grant reporting ends on January 4, 2020, this will be a long-term investment to the benefit of the entire Avenal community. Mrs. Tuttle read the Historical Society and Museum’s letter and reaffirmed their role as the grant requires and encourages collaborations between local groups and government entities by involving the local communities through volunteerism and education surrounding the important of green spaces. After a brief discussion, the following action was taken. RESOLUTION 2018-09: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AVENAL ENTERING INTO A MEMORANDUM OF UNDERSTANDING (MOU} BETWEEN THE CITY OF AVENAL ("CITY") AND THE AVENAL HISTORICAL SOCIETY AND MUSEUM ("MUSEUM"), ALSO REFERRED TO AS THE "PARTIES", FOR THE PURPOSE OF ACHIEVING THEVARIOUS AIMS AND OBJECTIVES RELATING TOTHECALIFORNIA RELEAF2018SOCIAL EQUITY TREE PLANTING GRANT PROGRAM ("PROJECT").
