KINGS STREET, AVENAL, CA 93204 MINUTES Mayor Pro Tem Woolley called the meeting to order at 5:15 p.m. Council Members Absent: Mayor Ovalle. Staff Present: Whitten, Ortiz, Perkins, Davis, Stivers, Starne, Santillan. Legal Counsel: Ken Jorgensen. PLEDGE OF ALLEGIANCE: Led by Mayor Por Tem Woolley. ROLL CALL: Councilman Harvick, Councilmember Hernandez, Mayor Pro Tem Woolley, Councilman Preciado. CITY CLERK: Government Code Section 54952.3: The members of the City Council and Successor Agency are entitled to receive a total of $300.00 per month as a result of being elected to the City Council. They receive no other compensation for sitting as a member of the Successor Agency. The Council went into Closed Session at 5:16 p.m. CLOSED SESSION: (City/Successor Agency): It is the intent of this governing body to meet in closed session to review its position and to instruct its designated representatives: A. CONFERENCE WITH REAL PROPERTY NEGOTIATOR(S) (Government Code §54956.8). It is the intent of this governing body to meet in Closed Session to confer with its real property negotiator(s) concerning the purchase, sale, exchange or lease of real property by or for this local agency as follows: Property Description: 201 Hydril / APN: 038-260-23 & 45 Negotiator(s): City Manager/City Attorney. Party with whom negotiating: Avenal Landfill. Instructions to negotiator concerning: Terms Closed Session concluded at 5:45 p.m. with action out of Closed Session as follows: The City Council directed Melissa Whitten, City Manager to provide a letter to Waste Connection approving the construction of a v-ditch across city property. PUBLIC COMMENT/ANNOUNCEMENTS & UNSCHEDULED APPEARANCES: No comments were offered. ACTIVITY REPORTS/SPECIAL PRESENTATIONS & COMMITTEE REPORTS: A. Activity Reports: 1) Community Development/Planning Activity Report: Fernando Santillan, Community/Economic Development Director; Fernando Santillan, Community/Economic Development Director, reported the following: 1) the 18" Water Transmission Line Replacement Project, Community Center bids, ReLeaf grant, Avenal Fitness Court, Rice Park restrooms; 2) transition of City computers to the Kings County Network; 3) revision of the Zoning Ordinance and Municipal Code, as they pertain to on-street parking of trailers, trucks, and RV's; 4) Arroyo Del Camino Phase II is progressing; 5) Trails Committee meeting; 6) on January 30th, the California Transportation Commission revised their Active Transportation Program Grant Award recommendations to include an award for Avenal's Safe Routes to School SR 269 Improvement Project in the amount of $537,000. 2) Avenal Police Department Activity Report: Rusty Stivers, Chief of Police; Rusty Stivers, Chief of Police, reported the following: 1) traffic collision & drunk driver; 2) burglary at Avenal High School; 3) robbery warrant suspect arrested; 4) active shooter training continues; 5) Police Activities League; 6) Explorer Post 1050; 7) personnel changes; 8) monthly statistical report; 9) CAD calls; 10) Avenal’s Lip Sync was selected as a top five finalist to be included in a television show to air on CBS; and, 11) Senior Officer Storm will be honored at 2019 Soroptimist International of Hanford Live Your Dream Award Banquet; Tuesday, March 26, 2019, Glad Tidings Church Hall, Corner of 10th Avenue & Grangeville Blvd. Hanford, and tickets can be purchased no later than March 15, 2019 for $25.00. B. Special Presentations/Requests: 1. Avenal Landfill Quarterly Report: George Anderson, Site Manager George Anderson, Site Manager, reported the following: 1) 83,853.2 tons of material; 2) 120 tons - concrete; 3) 64 tons - green waste and of that, recycled 47 tons; 4) 750 tons – e-waste; 5) 80 tons – mattresses with some recycled for $2.25 each; 6) 131 tons – metal; 7) Annual 2018 Report: 299,355.8 tons – material; 8) new Excavation Plan - Phase II; and, 9) Mr. Anderson, thanked Enrique Jimenez for the RAP Program. Because of his passion, Mr. Anderson asked Waste Connections to donate more to help the RAP Program. Councilman Preciado expressed concerned as to why the landfill wasn’t receiving $10.00 per mattress. Mr. Anderson stated that since they are a landfill, they only get $2.50 per mattress. If they were a private party, they would receive the $10.00 per mattress. 2. Responsible Athletes Program Quarterly Report: Enrique Jiménez. Enrique Jimenez reported the following: 1) Community Gym; 2) Youth Soccer; 3) Career Days; 4) new sponsor: Rent-A- Toilet; 5) new office in the Reef Sunset Unified School District auditorium basement; 6) High School Aquatics Program will Joint Meeting City Council/Successor Agency February 28, 2019 Page 3 of 3 be taken over by RAP; 7) Screen Printing for future uniform needs and to sustain the RAP Program; 8) Youth Basketball; 9) Spirit Squad; 10) Adult Volleyball; and, 11) he thanked George Anderson for his donations. PUBLIC HEARING(s): A. None OLD BUSINESS: A. None. NEW BUSINESS: A. None. CORRESPONDENCE/ANNOUNCEMENTS/CLOSING COMMENTS: Alicia Ramirez asked the City Council to re-open Public Comments/Announcements & Unscheduled Appearances for Erika Rodriguez, Field Representative for Assemblyman Rudy Salas, as she was late to the meeting. It was the City Council consensus to let Ericka Rodriguez speak at 6:39 p.m. Alica Ramirez, Assemblyman Rudy Salas’ Field Representative, is requesting the City Council’s support of Assembly Bill 17, known as the “Voter Protection Act.” This bill will address voter suppression and protect ballot integrity by prohibiting an employer from requiring or requesting that an employee bring and cast their vote by mail ballot to work. This bill shall apply to all public agencies and private industries; and will ensure that voters have a workplace free from voter intimidation and suppression. Violators will be subject to a civil fine of up to $10,000 per election and charges may be brought by the Secretary of State or any public prosecutor with jurisdiction. She is requesting a letter of support from the City Council. Councilman Preciado stated that the City Council could not make any decision at this time. Ms. Whitten stated that this item was not received prior to the meeting but it could be put on the next agenda for the City Council meeting on March 14, 2019. Councilman Preciado reported the following: 1) the soccer program it was a big success; 2) Music Fest meeting, March 30th it was decided to limit performers to 25 minutes each; 3) attended Reef Sunset School District Board meeting; 4) Saint Joseph Catholic Church Finance Committee is considering a fundraiser for March 17, 2019; and, 5) he will be attending the Latino Water Leaders Conference. Melissa Whitten, City Manager, reported the following: 1) Movie Night 5:00 p.m. & 7:00 p.m.; 2) Drama Club; 3) the Bureau of Reclamation new water year estimate of 75% of our historic use. However, we are hopeful to get 100% of water this year. Final numbers will come in April. Mayor Pro Tem Woolley reported the following: 1) KCAG/KCAPTA/LAFCO; and, 2) she read at Avenal Elementary School for Read Across America Week. ADJOURNMENT.
