Whitten, City Manager PREPARED BY: Arend La Blue, Assistant Chief of Police DATE: April 23, 2020 REGARDING: Consideration for Approval to Declare Patrol Cars Surplus Property <><><><> INFORMATION: On April 22, 2020, the Avenal Police Department was contacted by Kings County Sheriff's Department Historical Librarian Rod Huckabay, on behalf of Sheriff Dave Robinson. Librarian Huckabay advised that the Kings County Sheriffs Department (KCSO) is cun;ently working on a historical museum showcasing photographs and equipment from KCSO's past. He explained that the City of A venal was still in possession of two KCSO Chevy Caprice patrol units that were in service when the City of Avenal still contracted with KCSO for law enforcement services. Librarian Huckabay advised that KCSO would like to obtain these two vehicles and restore one of them for parades and community events. One of the units in question is has not been in service since 2016 (Vehicle ID #1G1BL52P9SR181615). At that time it was having overheating issues and due to cost vs. value the vehicle was not repaired. It has been sitting at the City Yard since that time and is inoperable. The second vehicle (Vehicle ID #1GlBL52P3SR181593) is the old Avenal Police Depaitment CRT vehicle. This vehicle has not been in use in over five yeai·s and has not run in that time. Several parts have been removed from this vehicle to keep the aforementioned patrol unit running and it is not operable. To recap, neither vehicle is operable and it would talce considerable expense to make either of them run reliably. Public Works Supervisor Scott Davis was contacted regmding these vehicles and he concurs that they should be surplused. It should be noted that both of these vehicles were purchased from KCSO by the City of A venal for the sum of $1. Whitten, City Manager PREPARED BY: Fernando Santillan, Community Development Director DATE: April 27, 2020 RE: Consider Small Business Loan Program BACKGROUND The COVID-19 pandemic and resulting shelter-in-place orders nationwide have resulted in extremely difficult conditions for our local small businesses. Though the State and Federal governments have implemented aid programs to help business owners weather the crisis, the process of distributing the funds has experienced many difficulties and the first round of funding was exhausted very quickly. The Federal government has now authorized a second round of funding through the Paycheck Protection Program, though it is difficult to say whether any of our local businesses will be successful in accessing these funds. Many businesses do not have existing relationships with banks who are participating in the program. In light of these circumstances, staff would like to ask the City Council to consider a City-sponsored fund to help struggling local businesses make it through the current crisis. Staff proposes a first-come, first-served fund loan fund in the amount of $25,000, or another amount of the Council's choosing. The City would make loans up to $3,000 to businesses who demonstrate need. - -· . - - .... - The loans would have to be repaid, though Council may choose to make the loans convertible into grants if certain requirements are met. Council may also choose to make more funds available in the future if the original funds are exhausted. Staff would work with the City Attorney to draft language for loan agreements, lending . guidelines, and other necessary items. Loan terms are yet to be decided. Whitten, City Manager Phone: (559) 386-5766 Fax: (559) 386-0629 DATE: April 28, 2020 RE: Information Regarding the Kings County Board of Supervisors Meeting Held on April 28, 2020 RE: Kings County's Shelter-in-Place Order INFORMATION: Summary: Chief Stivers and I called-in and participated (listen-only mode) in the Kings County Board of Supervisors meeting on Tuesday, April 28, 2020. We were on the call from 9:00 a.m. to approximately 11:45 a.m. The item of interest was Agenda Item V. E, 1 (b) relating to the County's Shelter-in-Place Order. In summary, after a lengthy discussion, the Board terminated their Shelter-in-Place Order by Resolution. As discussed, the intent was to begin taking the necessary steps to "reopen" Kings County and the businesses thereof. However, Lee Burdick, County Counsel, explained that by terminating the County's Shelter-in-Place Order, it would not affect nor remove the Governor's Shelter-in-Place Order. She added that non-essential businesses would not be able to reopen at this time; it would be, basically, in opposition of Governor's Order. From a long list of businesses that were reviewed for evaluation, only Dog Groomers (now defined as an essential s~rvice); and, golf courses (requiring certain restrictions as well as measures in place) could be considered for reopening to the public. Dr. Teske, Kings County Health Officer, and Dr. Yukta, Director of ERat Adventist, provided interesting information relating to COVID 19. The information included: the number of cases in the County, hospital statistics, Kings County selected by the State to locate a COVID 19 Testing Center which should be open soon, ability to serve if there was a surge in cases, hospital facilities available outside of area, if needed, etc. After further discussion, Ed Hill, Director of Public Health, was directed by the Board of Supervisors to develop a plan to begin "reopening the County" by business types and timelines, within state guidelines. They further requested that the information be provided to them for review at the meeting next week. Mr. Hill indicated it would be by measured approach, understanding businesses "would not all open at the same time". It was further noted the approach would also need to keep in the mi~d the Governor's 6 (Critical) Indicators. Supervisor Valle clearly stated that removal of the County's Shelter-in-Place Resolution was "not to send a message to open up; this is not approval that the State has opened up". The Governor's Order is still in place and we cannot override it - adding that this needed to be a balanced approached. Whitten, City Manager DATE: April 28, 2020 RE: Information RE: 2020 USBR Water Allocation and Conservation Measures: INFORMATION: The purpose of this report is to keep the City Council apprised of the 2020 USBRWater Allocation. Please be advised this is a work in process until the final allocation numbers are provided by Reclamation. I thought it might be beneficial to provide information regarding the City's water allocations since 2017. As you will see, each year is different depending on water year conditions, availability, Historic Use calculations, the need to acquire additional supply, drought conditions and how conservation affects use: City's Water Year as per CVP contract: March 1st - February 28 th of following year: Example: 2020 Water Year: March 1, 2020 - February 28, 2021 2020: 65% of Historic Use (1,652-acre feet); the final snowpack measurement will take place tomorrow, April 30 th ; we hope to see an increase in the percentage. Depending on information received, Staff will proceed as directed and necessary. 2019: 100% allocation year (3,500-acre feet); City utilized 3,098-acre feet. 2018: 75% of Historic Use (2,050-acre feet); City had to acquire additional supply to meet the community water needs; 500-acre feet of additional water was (ultimately) obtained and used to fill'the gap; total of 2,542-acre feet was utilized. 2017: 100% allocation year (3,500-acre feet; however, only 2,120-acre feet utilized). The valley was slowly recovering from drought conditions. For a port ion of the water year, the City was under Stage 3 water restrictions. Stage 3 was lifted, and Stage 2 water restrictions have been in effect since that time. Staff will keep the City Council advised on this matter. The purpose of this letter is to request continued assistance utilizing Phase II water conservation measures by all users until further notice . The following measures, including amendments, are in force and effect: GOAL: Continued water conservation measures by all water users: Alternate Watering Schedules for all users of water supplied by the City: Odd Number Addresses : Watering only on Mondays & Fridays from 12:00 a .m. - 11 :59 p.m . Even Number Addresses : Watering only on Tuesdays & Saturdays from 12:00 a.m. -11 :59 p.m . ** Sunday Watering: Both even and odd-numbered addresses may water on Sundays during the hours of 12:00 a.m . -11 :59 p.m. Other Requirements for use of water supplied by the City: ► No person, entity or other water user shall wash motor vehicles, trailers, boats and other types of equipment without utilizing a hand-held bucket or hose equipped with a positive shut-off nozzle for quick rinses on appropriate watering days; ► All homes/apartment complexes with swimming pools require City approval prior to draining orfilling pools; ► No open hoseorfaucets; all unattended hoses shall haveaspraynozzleorsprinkling device; no excessive water flow down gutters/streets or accumulation of water on properties; repair all dripping or leaking hydrants, faucets, pipes, outlets or plumbing fixtures . **Allowable Uses (Phase II): ► Reasonable use of potable water for car wash "fundraising" for local non-profit groups, agencies and organizations. Requires approval by the City prior to event; ► Reasonable use of potable water for small water slides, small pools and other small recreational water toys/activities; ► Reasonable use of potable water to wash down sidewalks, driveways, drive approaches, curbs and gutters, clean and/or spray down houses, buildings, etc. The City appreciates the Community's assistance over the past few years in order to meet mandatory water · restrictions. Although water conditions have improved somewhat, we request cooperation from all water users to continue practicing water conservation measures. Water use will continue to be monitored by the City's Code Enforcement Department; and, violators of water conservation measures could be subject to penalties of $50, $100 or $150 per violation as per AMC 6-4.22 .
