Information and Update: Richard Valle, Supervisor District 2; Richard Valle, Supervisor District 2 reported the following: 1) COVID-19 update; 2) $5 million for small business recovery alocated as follows: Avenal-$450,000; Lemoore-$850,000; Corcoran-$700,000; Hanford-1.9 Million; Kettleman City/Stratford &Unincoporated-$1.1 Million. He thanked Fernando, Amy and Alicia for helping distibute applications; and, 3) Jose Ramirez has a task with wear a mask campaign and advertised with TV commercials, social media. Ms. Whitten would like to personally thank Spervisor Valle. He has been wonderful about reaching out and making sure that the City of Avenal have the information needed, not just for this item but for numerous items and Richard you've been a great representative. Richard Valle commented thanked Melissa for years of service. Melissa Whitten has served the City of Avenal with honor, integrity, high ethics and morals. She has done her job now whatever happens after that is the five elected officials that the Community represents. So, same thing at the Board of Supervisors our county CEO can make recommendations. It's up me to vote yes or no and then he is held accountable by the community. His very sad to hear about the news, but you very much do deserve a nice healthy retirement. God bless you. Also, hope you get to have many years of enjoyment after all the hard work and everything that you did for the community of Avenal and for Kings County that you've been an asset and thank you for your service. B. Consider to Letter of Support for Kings County Human Services: Ms. Whitten reported that concerns have been received from the Community/Public as well as concerns noted by a Councilmember regarding a Letter of Support; therefore, a Letter of Support for Kings County Human Services Application for funding for Project Homekey is before the City Council for reconsideration. Avenal is not included nor is it a part of the County's grant fund application for a Project Homekey Program. Richard Valle, Supervisor District 2 reported that the Board of Supervisors did not have Avenal in mind for the Project HomeKey. After a long discussion, A motion by Councilman Ramirez to resined the letter of support, seconded by Councilman Hernandez and carried. Roll Call Vote: AYES: Preciado, Hernandez, Ramirez, Woolley. Consider Direction Regrading Study Session Topic RE: Re-organization Policy: Joint Meeting City Council/Successor Agency August 13, 2020 Page 3 of 8 Ms. Whitten mentioned that this agenda item has been added by request of Mayor Pro Tern Preciado regarding the Study Session held prior to the regular meeting: City Council Re-organization Policy. Michael Farley,City Attorney went on for 30-minutes regaring City Council Re-organization Policy the issue which has come up dealing with issue to remove the mayor and/or Mayor Pro Tem and not remove them as council members that remove them from their elected position. He wants to make it clear that there's no power under the California Law or constitution or otherwise that allows a City Council to remove one of its members as a member of the Council resolution as it pertains to the election of Mayor & Mayor Pro Tem would not take effect until the next November Election. So, then after that this resolution would be your guideline to follow. Basically, what it says is that the the City Council by majority votes selects the mayor and Mayor Pro Tem and the City Council selected under this resolution. Mayor Woolley asked for the cost of a recall election? Michael Farley, City Attorney stated taht Special Election cost $18,000 just for the county election office and doesn't include the process. Mayor Pro Tem Preciado mentioed that he been waiting to get the structure bylaws for three months and today his getting some information. He believes that the City Council must have the bylaws ordinance or whatever it takes and have answer for the community, whether the City Council receivse a letter from the community regarding recalls they don't know the process. That's why they requested a Study Session. So, the City Council can be aware and can setup our own structural bylaws or resolutions that the City Council needs to be done to inform our community. Michael Farley, City Attorney commented that he cannot prevent the City Council from doing whatever they want and take his advice. The City Council should not be involved in any recall effort that is not the City Council’s role that is the role of the electorate. The electorate has questions regarding the recall effort they can go to the Election Office and Kings County, which the City of Avenal contract with if Avenal was a larger city like Los Angeles they have their own election office they would go there, or you can go online, as he did, simply and tab in, you know, recall State of California and you will get from the Secretary of State steps to do so, but the city of Avenal should be involved in a recall ever that's not our role that's not the function of our government. D. Consider Appointing a City Council Member to Serve on City of Avenal Operating Authority Board of Directors: Ms. Whitten reported that as the City Council is aware, the City of Avenal Operating Authority, 317 Alpine Street, Avenal, CA has been established by Agreement with the Avenal Hospital District. In order to conduct business as the CAOA, the City representative seat and alternate are vacant and should be filled. As per the Joint Powers Agreement, Section 6.02: Directors and Alternates -- provides the process in which to select a new Board Member and Alternate. Its further states that "Directors and Alternate Directors shall be elected or appointed officials of their governing bodies Members". The section also includes information regarding the term of office. Councilman Hernandez motion to nonimate Mayor Pro Tem Preciado as representative for CAOA. Councilman Hernandez closed nominations seconded by Councilman Ramirez and carried. Councilman Ramirez motioned to nominated Councilman Hernandez as alternate representative. Consider Designating of Voting Delegate and Alternates for the League of California Cities Vitiual Annual Conference & Expo -October 7-9, 2020, Long Beach Convection Center: Maria Ortiz reported that the League's 2020 Virtual Annual Conference & Expo is scheduled for October 7-9, 2020. An important part of the conference is the Annual Business Meeting, which is scheduled on Friday, October 9th, where the League Membership consider and act on Resolutions that establish League Policy. The League of Cities intends to ensure the voting process at the Annual Business Meeting. Staff recommends By motion: 1) designate voting delegate and alternate voting delegates for the Virtual Annual Conference & Expo scheduled for October 7-9, 2020; and, 2) authorize the City Clerk to complete the Voting Delegate form and return it to the League's Office no later than Wednesday , September 30, 2020. PUBLIC COMMENT/ANNOUNCEMENTS & UNSCHEDULED APPEARANCES: Maria Ortiz, City Clerk stated that as per City Attorney, the letters for public comment do not need to be read but will are, hereby, entered into the official record and are as follows: Christopher Mendoza (Exhibit A); Gustavo Morillion (Exhibit B.); Howard C. Knadler (Exhibit C.); No name (Exhibit D.); Veronica Aguirre (Exhibit E.); 729 Shasta ((Exhibit F.); A proud and productive member of our community and society (Exhibit G.); Estela Jimenez, Principal/Community Engagement Coordinator (Exhibit H.); and, Miguel Fausto (Exhibit I.). Howard Knadlers stated that he is the head teacher at Sunrise Continuation High School and has been there for eight or nine years. He was informed that there are some issues about funding for Avenal PD. He wanted to comment along with his letter and let everyone know just what an outstanding job Avenal PD does. It's a combination of economic uncertainty, isolation and nothing to do for the kids. So, it's a delicate balance trying to balance community safety and community policing - it is difficult. He couldn't be prouder of the partnership that he feels they’ve had with Avenal PD ever since he has been at Sunrise. Avenal PD are always available by phone call; he has cell phone numbers because everyday something happens. Some of you may not know me by name, but you probably see me standing in front of the District Office reading to students, talking to parents, making sure the day gets started safely. He does this same thing at three o'clock every day when we're let out and, trust me, he’s been in that park more than once to stop an Joint Meeting City Council/Successor Agency August 13, 2020 Page 5 of 8 altercation that was going on that lead to violence. Avenal PD has always been there for him. They started having food events and one of the major things they wanted was to bring closer relationship between students’ families and Avenal PD. We have those food events; some of them are just barbecues; some of them are holiday meals. Miss Jimenez came on board and she was completely supportive, and all kinds of Avenal PD show up on a regular basis and that has helped to break down barriers within the community. This is not a time to try to save money. These are difficult situations and he really values Avenal PD and support them. Estela Jimenez stated that she has a comment and would like to read her letter if that’s okay. Being a lifelong resident of Avenal (30+ years), she can say that there is a drastic difference between having a substation and our own police department. Kings County Sheriff did the best they could but at the time with limited resources and Avenal being a revolving door for officers, it was difficult to have any preventative measures in place. They responded in emergency situations but having a police department with dedicated officers that know the community, our families, and our challenges has been so much better for Avenal. As a school administrator she can attest to the efficiency of Avenal PD not only are they available, but they take a community outreach approach to prevent crimes and build trust with the people of Avenal. Avenal PD has always gone above and beyond to serve our community and get involved in all aspects associated with the City and Reef Sunset Unified from teen pageants to graduation ceremonies and BBQ’s with Alternative Ed. She can't speak for all departments, but she can say without a doubt that having Avenal Police Department has made a huge difference with our youth. As Mr. Knadlers said, she can't speak for all departments in other cities, but she can say without a doubt that having Avenal PD has made a huge difference with our youth and it is a blessing. So, she just wanted to share that with you guys. Thank you. Juan Ruiz, Principal at Avenal High School, stated that he would like to thank the City, Rotary and Avenal PD for supporting us during graduation and doing the parade. It was an amazing parade and I love the way the community came together. He believes it was about eight years ago when they still were Sheriff. The city decided to hire their own Police Department and as the principal of Avenal High School, he has seen the huge difference just in discipline and crime that has happened. When he first came about 10 or 11 years ago, there was no discipline at the high school, and it was out of control. He thinks is one of the best decisions that they've ever made having your own Police Department. He’s seen discipline and the crime at the Avenal High School decline and he thinks that's a huge reason because of the Avenal PD. Avenal PD has built relationships with our students and staff. He knows who they are on a personal basis because they have gone above and beyond to build those relationships. And, once again, he just wants to thank the City for all the support that they've always provided us at the high school. Thank you. Blanca Rodriguez, Principal at the Avenal Elementary School, stated that she wanted to piggyback off the same sentiments. As my fellow administrators here, she just wants to speak out for Avenal PD and just say, having worked with them at two different sites, Avenal Middle School and Avenal Elementary. She has felt so much support from them over the years on all matters and been at our community events. They're ready on-call. Whenever we need them regardless if it's the officer that's assigned to schools or not, she thinks she’s probably met and have communication with all the officers, because they're all so readily available in any situation that arises at our sites. So, she just wanted to share the same sentiments her fellow administrators. Also, thanked the Recreation Department for allowing her to be a part of the Summer Reading Program. Veronica Aguirre stated that it's great that all the school administrators have come out and shared their sentiments. It's always great to hear other people come and be a part of these types of meetings and especially to express their concerns for, you know, children and public safety, but there's still one more impending problem that continues and that's public health that continues to be ignored. We continue to get reports regarding the horrific smells that come from the Landfill. She received several reports and it smelled so bad that people were nauseous. She would be happy to share these reports that people get online and submit these reports constantly. They were addressed by the Air District and they are saying that from what they understood, the Landfill is getting trucks from Baker Commodities that are coming in with dead rotting chickens. Their parking on the side that was the reason for the terrible smells that were coming through town on yesterday morning. So, she doesn’t know if this is acceptable to allow this kind of stuff or big trucks with disgusting nasty rotten truckloads of chickens, you know, can park on the side of Skyline Boulevard four hours. Why they go and apparently are walking down and getting tacos. She really doesn’t know how true that is but that's what is being said. So, she really hopes that as Council Members investigate and find out what exactly is going on because it's not getting any better. And I think that not only should we address issues like public safety, but you also should consider public health; and, it is a nuisance to the community that can't even enjoy walking outside, going for a walk and exercise or anything like that. Thank you. Artie, community member stated that she’s been here most of my life, and, yes, we've had different agencies in our community. She has seen a change and now that everything is running smoothly, everything is great. Everybody knows everybody -- she would want it to stay the same. Also, it is not a time to save any money, we need Avenal PD as much as we can. So, as a community member she supports to keep Avenal PD and not having any type of budget cuts in that area. Thank you. Diana Enriquez stated that as community member and coached cheer last year (which was my last year), but she coached for 12 years and it was important for her to communicate when she had girls and cheerleaders out practicing early mornings. They practiced early Joint Meeting City Council/Successor Agency August 13, 2020 Page 6 of 8 mornings and practiced late in the evenings and it was important for her to have communication with Avenal PD. Avenal PD would drive by make sure that the girls were safe. There were numerous times when we had cars driving around and harassing girls and she would give Avenal PD a quick call to help them. So, it's very important that Avenal PD stay with Avenal because we do have good communication with them with the schools - with coaches - and, with sports programs. Eliminating them, it’s going to be more difficult for people in the community to continue giving back without their support and knowing that we have safety within the people around us. She thinks it's important to keep Avenal PD within the community. Chief Stivers stated that he is speaking as a Director of Emergency Services right now just to give an update. He will be attending the virtual meeting tomorrow for PG&E Public Safety Program as it applies to power outages in the communities during fire season. So, hopefully have some questions answered as to why, when and where our power goes out as a result of fire. So, he will bring that back to you as well. Thank you. Councilman Ramirez had a concern regarding letters received from the public and asked, can they be read at public comment? Ms. Ortiz stated that as per City Attorney, she could read their name and letters will be entered into the record and reflected in the minutes. Michael Schulte, Deputy City Attorney, stated to clarify - if the individual wants to read their own letter or someone else's letter they can, but if they want to submit a letter, the only requirements are that it gets to the council members via the agenda process and entered into the record noting that the individual has submitted a letter, but that's all that's required. So, as you can imagine, if you know on some subjects, you get a lot of letters and so reading them all into the record isn't necessary. It's certainly not required, and it's not necessarily appropriate. PUBLIC HEARING(s): Continued Joint Hearing of the City of Avenal Successor Agency RDA/Trust Obligations Fund/Public Finance Authority: A. None. OLD BUSINESS: A. Consider Second Reading and Adoption of Ordinance No. 2020-04: Proposed Changes to Avenal Zoning Ordinance. (9.79.01, 979.02, 9.79.10): Fernando Santillan, Community Development Director, stated that as you may recall on June 25th at the last Council meeting, the City Council voted to introduce this Ordinance and waive the first reading, which would amend our current Zoning Ordinance to add language to make it easier to enforce RV and trailer parking rules in residential areas. It would also add language regarding the hours and the distances that cars must be moved in order to follow the Zoning Ordinance. Staff recommends that the Council make the following findings as included in the staff report to waive the second reading and adopt Ordinance No. 2020-05. A motion was made by Councilman Preciado to waive the second reading and adopt Ordinance 2020-05, seconded by Councilman Hernandez and carried. Consider SB1 Project List for Road Maintenance and Rehabilitation Account Funding "The Road Repair and Accountability Act of 2017”: . Mr. Davis reported as discussed previous meeting The SB 1 Project list was developed by Rob Williams, Public Works Director, Scott Davis, Public Works Supervisor, with assistance from Brian Skaggs, City Engineer. The proposed list is as follows: Seventh Avenue Road Project ($365,000); Monterey Street Road Project ($525,000); Mariposa Street Road Project ($525,000); and, Avenal Cutoff Road Project ($4,060,000). Since the California Transportation Commission is requiring annual reporting before the FY 2020/21 City Budget review, if the project list is approved by the City Council, the FY 2020/21 budget will include revenues and expenditures for use of SB 1 funds received. Joint Meeting City Council/Successor Agency August 13, 2020 Page 7 of 8 After a brief discussion, a motion was made by Councilman Ramirez to table this item for the next meeting, seconded by Councilman Preciado and carried. Consider Extending Local Emergency Declared on March 24, 2020: Ms. Whitten stated that on March 24, 2020, the Avenal City Council adopted Resolution No. 2020-14 declaring a Local Emergency due to the existence or threatened existence of a local emergency: COVID-19 pandemic. The declaration is required to be reviewed to consider the following action: 1) reaffirm that a local emergency continues to exist; or, 2) make a finding that a local emergency no longer exists. Staff is recommending that the City Council consider the following action by motion: "Approve and support the ongoing local emergency Resolution, and specifically, move that prior to the expiration of the 21st day, the emergency Resolution be renewed for an additional 21days after the conclusion of the 21days, unless a Councilmember or member of the public requests that the Council convene to consider the ongoing emergency Resolution, at which time a special meeting would be scheduled". RESOLUTION NO. 2020-33: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AVENAL APPROVING POLICIES RELATIVE TO UTILITY BILLING AND RELATED POLICIES IN REGARD TO THE WATER SHUTOFF PROTECTION ACT. ABSENT: Woolley. Joint Meeting City Council/Successor Agency August 13, 2020 Page 8 of 8 ABSTAIN: None CLOSING COMMENTS: Councilman Hernandez reported the following: 1) He wanted to advise the community to continue using their facemasks and practicing social distancing. Councilman Ramirez reported the following: 1) He wanted to touch base on the importance of using a face masks. Also, report any kind of violations regarding facemasks because it is a serious issue; 2) Ask Mayor to consider putting on an item on the agenda to amend the resolution that was passed regarding the facemask to increase penalty amount for noncompliance; and, 3) Also, ask Mayor to consider reports of every department and analyze all departments where funds are being spent to evaluate and consider any changes that are needed. Ms. Whitten stated that she will ask City Attorney the process to increase penalties for noncompliance with facemasks (as per Ordinance No. 2020-05); also, acknowledging the request for a departmental activity reports including the number of employees, total payroll per month, productivity impact, among other things, to evaluate departmental activity. Mayor Ovalle stated that it was a very broad request. Councilman Ramirez stated yes, it would be helpful to see, you know, on a monthly basis how much departments are using. Chief Stivers commented that it's a broad and lengthy thing, you know, to revise, basically, each department in the City. So, it can be a separate report or included in the monthly reports for Council to review the departments and to see whether funds are being spent properly. Council can direct the City Manager to discuss process for reporting to be brought back at a future meeting. Councilman Alvaro Preciado reported the following: 1) Thanked everybody who has gotten involved with distributing masks to businesses; 2) he would like to motion to add an item as Study Session for City By laws; 3) also, would like to request to add item on the agenda for reorganization of Council. Michael Schulte, City Attorney, stated that he was happy to produce a letter regarding the bylaws, but he has done a little bit of research and there isn't much to the City’s By-Laws. Also, regarding Study Session item first; he could explain how elections work and the Brown Act works. Secondarily, if this is about reorganizing the Council, it could be addressed in a Study Session, but it's complicated; it takes more than just a motion and a Council vote. The Council itself can't really reorganize itself - that's not the way it works adding that he can certainly participate in that meeting. Mayor Ovalle reported the following: 1) This COVID-19 is very real, he has had loved ones pass away. So, his choice is to wear a mask and protect myself and protect others as well as loved ones; so, just stay safe. ADJOURNMENT.
