Government Code Section 54952.3: The members of the City Council/Successor Agency are entitled to receive a total of $300.00

Mayor Preciado opened public comments for Closed Session items at 3:10 p.m. with no public comments it was
closed at 3:10 p.m. The City Council went into Closed Session at 3:11 p.m.

PUBLIC COMMENT/ANNOUNCEMENTS & UNSCHEDULES APPERANCES:
Veronica Aguirre commented that today is Earth Day would like to ask as elected officials and decision makers of
this community. When they go home tonight to reflect on if the decisions they made are good for the environment,
community and the theme restore the earth for Earth Day. Also, Landfill berm and concerns haven’t been addressed
or brought back as an agenda item and let’s make Earth Day every day.

A motion was made by Mayor Pro Tem/Successor Agency Member Ramirez approve Consent
Calendar, seconded by Councilman Hernandez, and carried.

MAYOR & COUNCIL MEMBER/ SUCCESSOR AGENCY/ ITEMS FOR CONSIDERATION:
A. Consider One (1) Appointment to Avenal State Prison Citizens’ Advisory Committee (CAC):
Antony Lopez, City Manager reported that at the April 8th meeting, the Council appointed City Manager to one of
the open vacancies. There still one appointment need filling any suggestions from the City Council.
Mayor Pro Tem Ramirez asked Veronica Aguirre if she would like to be appointed to the Avenal State Prison
Citizens’ Advisory Committee (CAC). Mrs. Aguirre accepted appointment and thanked the Council for their
consideration
After a brief, discussion the following action was taken.
A motion made by Mayor Pro Tem Ramirez to appoint Veronica Aguirre to the Avenal State Prison Citizens’
Advisory Committee (CAC), seconded by Councilman Gravelle and carried.
Roll Call Vote:
AYES: Ramirez, Gravelle, Hernández, Preciado.
NOES: None.
ABSENT: Verdugo.

B. Continued Discussion Regarding Vehicle Overcrowding and Commercial Vehicles on Residential Streets.
Mr. Lopez reported that since March 11, 2021, four (4) new commercial vehicles parking permits have been issued
for parking in the designated streets. The Code Enforcement Officer, Lupe Chavez will present an update regarding
progress to remove commercial vehicles.
Lupe Chavez, Code Enforcement Officer, reported the following: 1) yes, increase of permits for commercial
vehicles on First Street, Second Street and Tulare area; 2) resident has an extra trailer has not been running it due to
work slowdown and doesn’t have the use for it, but does plan to get it on the road and bought a permit just for the
trailer plans on moving it; 3) Utility trailers – three (3) were towed thanks to the help of Avenal Police Department.
He did his 72-hours and APD towed; 4) there is one-commercial vehicle that will be towed will check; 5) there are
new commercial vehicles and will leave pamphlet and proceed from there and compliance has been great.
Mayor Preciado is concerned with loss of parking for commercial vehicles and is there need for more commercial
designated streets. Mr. Chavez stated that they lost half a block to Aria Health Clinic, but what his seen there is still
plenty of parking for commercial vehicles. He has not noticed anymore commercial vehicles on residential areas and

his sure there might be some during the weekends and it’s on his schedule to flex time to work weekends. He has
seen compliance from commercial vehicle owners and they don’t want to pay fines.
Mayor Preciado asked if there will be enough parking during the summer during seasonal work. Mr. Chavez states
that as far as he could tell from previous years, because not most of them will take their trailer only the tractor tail
and do not think there is need for more parking. This something we can revisit once the season hit and tomato
season is around the corner. He can flex time and give an update on this issue.
Mayor Pro Tem Ramirez stated that when are the fees going to increase for Commercial Vehicles. Mr. Lopez is
looking into increasing various fees but need to consult with City Attorney.
Councilman Gravelle would like clarification who is in charge of removing vehicles sitting on the street. Mr.
Chavez stated that since his worked for the City of Avenal. His understanding is that the Avenal Police Department
takes care of vehicles on the streets and Code Enforcements takes care of vehicles on private property. Also, the City
Council has authorized Code Enforcement to take care of trailers and commercial vehicles.
Chief Stivers stated that they tagged vehicles that will be towed Sunday. Officers get to them when they can. The
Officers do first is go to the front door of the house asks homeowner if they can move their vehicles. It is good will
for the Police Officers. If it’s the City Council’s wish they can tag and tow.
ACTIVITY REPORTS/SPECIAL PRESENTATIONS & COMMITTEEREPORTS:
A. Activity Reports:
1) Public Works/Building/Code Enforcement/ Animal Control Activity Report: Scott Davis, Public Works
Supervisor.
Arturo Mora, Leadsman, Public Works Supervisor, reported on the following: 1) Building Department;
2) Code Enforcement; 3) Park & Landscaping; 4) Streets; 5) Water Distribution; 6) Wastewater Collection;
and, 7) Vehicle, Equipment, & Building Maintenance.
2) Avenal Police Department Activity Report: Rusty Stivers, Chief of Police.
Rusty Stivers, Chief of Police, reported on the following: 1) community concerns of speeding and reckless
vehicles officers patrolled the Sports Complex and found a few vehicles associated with reckless activity;
2) Traffic stop reckless vehicle; 3) Officer Smith worked joint traffic enforcement efforts with Coalinga CHP
office. Detective Smith issues 13-citations, all on the Avenal Cut-off for excessive speed (all over 70mph);
3) domestic violence; 4) carjacking used force to take the victim’s, vehicle from a residence in the 600 block of
Alpine; 5) assist Avenal School District due Welfare checkups; 6) Officers defuse a situation where a teenager
was asked turn off PlayStation. The juvenile armed with knife, stabbed a wall and began breaking items in the
residence as an act of defiance. There was considerable damage to the apartment and appropriate charges will
be filed with DA’s office on behalf of Management Company; 7) Outstanding Warrant Officer Prieto made
arrest and found half ounce of methamphetamine, scale, and packing material. The suspect was booked into
jail on his warrant and methamphetamine sales; and, 8) Update on Covid and we are in the orange tier,

OLD BUSINESS:
A. Consider Extending Local Emergency Declared on March 24, 2020: (Discussion/Action).
Mr. Lopez reported that the Local Emergency continues to exist or threat existence of a local emergency: COVID-
19 pandemic. The declaration must be reviewed to consider the following action: 1) reaffirm that a local emergency
continues to exist; or, 2) make a finding that a local emergency no longer exists. Staff is recommending that the
City Council consider the following action by motion:

Approve and support the ongoing local emergency Resolution, and specifically, move to renew the emergency
Resolution by thirty (30) days, unless a Councilmember or member of the public request that the Council convene to
consider the ongoing emergency Resolution, at which time a special meeting would be scheduled.
A motion was made by Councilman Gravelle to approve as recommended, seconded Councilman Hernandez
and carried.

NEW BUSINESS:

CORRESPONDENCE/ANNOUNCEMENTS/CLOSING COMMENTS:
Mr. Lopez reported that in speaking with Mayor regarding Old Timers Day the tradition was to ride in a float
through Kings St. but Staff has done a new route to Sports Complex. He would like to know who would like to have
a Council float ride in the parade and the theme this year is “Welcome Back Bucs”. Ms. Ortiz suggested a truck for
the parade. If anyone is interested in being in the parade be at Avenal High School at 9:30 a.m. and start parade at
10:00 a.m. On that same note last week he was finalizing the details on the parade and all event activities.
The Old Timers Committee met to select special resident recognition in Avenal they are as follows: 1) Grand
Marshall-Larry Todd; 2) Favorite Son-Lou Gravelle; 3) Favorite Daughter-Glenda Woolley; and 4) new category for
people that have passed away its going to be Adopted Son-Sherman Jones; 5) Staff is working diligently with the
Old Timers event with vendors obtaining there Business License and food permits since were in the orange tier. May
1st 9:30 a.m. - Parade lineup at Avenal High School ends at Sports Complex, horseshoe/cornhole tournament,
softball tournaments, and food booths. There will be live entertainment DJ, live band and movie. He invited all to
the Veterans Hall at 1:00 p.m. to travel to Tar Canyon Tour and if you do not have a vehicle that can take the rough
road you could carpool with him. Also, Saturday Alumni reunion at Veteran’s Hall opens at 5:00 p.m. dinner at 6:00
p.m.; 6) Also, mark your calendars for Special City Council meeting April 28, 2020 at 5:00 p.m.; and, 7) April 23rd
Mayor Preciado and Mr. Lopez will be having lunch with Assemblyman Rudy Salas.
Councilman Gravelle would like to thank all City of Avenal employees and Avenal Police Department for all they
do for the community.
Antony Lopez, City Manager, reported the following thank you for this fast meeting.
Mayor Preciado reported the following: 1) He thanked the whole community for being patient and abide by Covid -
19 regulations and everyone keep safe. If there any concerns bring them and thanked everyone for attending. He
invited the community to Old Timers event.
Mr. Lopez announced that everyone’s invited to Old Timers were following all the social distancing rules and plenty
of hand sanitizer. Staff will be sanitizing there will be many fun activities.

Antony Lopez, City Manager announced that there is an emergency item that he would like to add to the Agenda
came in after agenda was posted it is the purchase of VFD. There having trouble with main pump #2 at Plant 1. So,
there down to I-pump and this provides water to the City. Also, move Activities Reports and New Business before
Consent Calendar.
Moses Diaz, City Attorney stated that any emergency item was brought to Staff after the agenda was posted and
information is provided.

Chief Stivers reported that Officer Voyles identified a problem with catalytic converter being stolen. Officer Voyles
with Avenal Towing introduced a plan to stop catalytic converter theft by engraving catalytic converter with a
numbers this allows officers to trace your catalytic converter. This event will take place Saturday, April 17, 2021;
8:00AM-2:00PM; Avenal City Yard (1290 Hydril Road Avenal).
ACTIVITY REPORTS/SPECIAL PRESENTATIONS & COMMITTEE REPORTS:
A. Activity Reports:
1) Avenal Theater & Event Center Activity Report: Humberto Bermudez, Avenal Theater & Event
Center Coordinator.
Humberto Bermudez, Avenal Theater & Event Center Coordinator, reported the following: 1) Tech Updates;
2) March 1o t11 Rotary Food Distributions; 3) Outreach: City Staff and the Avenal Theater continue to assist the
community with the submission of the Self-Help Enterprises COVID-19 Utility Assistance Application; 4) Facility
Maintenance: The Avenal Theater is reaching out to various signage companies to prepare for an LED conversion;
and, 5) Events: Interactive Easter Egg Hunt Drive-Thru and working with the Community Activities Department,
The Avenal Theater supplied interactive prop-up cutouts for community members to customize for the March 27th
event and upcoming: Old Timers Day in collaboration with the Community Activities Department.
2) Community Development Repo1t: Kao Nou Yang, Community & Economic Development
Kao Nou Yang, Community & Economic Development, reported the following: 1) revising Zoning Ordinance,
subdivision and adding accessory dwellings to make projects more streamline and more up to date for regulations.
2) meeting with Caltrans to revise the development plan for route 269 & Hwy 33 to make it more compatible makes
and it easier to develop; 3) fees schedule study; 4) she is working to connect with local organization and working
with CrisCom with more grant opportunities; 5) updating Mapping system with GIS; and, 6) update Community
Center.
B. Special Presentations/Reports:
1) Route 12 Avenal Proposed New Service or Potential Pilot Program: Angie Dow,
Executive Director, Kings Area Rural Transit (KART).
Mr. Lopez reported that he reached out to Angie Dow Executive Director, Kings Area Rural Transit (KART) for
potential money on a piolet program for local transit or out of town transit in Avenal. There was a survey posted on
the website, social media and given to the City Council for distribution,
Councilman Hernandez mentioned that his surveys he received would like rides to Coalinga.

and suggestions regarding Route 12 Avenal Proposed New Service or Potential Pilot Program. The City Council
would like to explore the pilot program for volunteers and Mrs. Dow will be taking this decision to the Board.

Councilman Hernandez and carried.

A. Emergency Item Replacement Purchase of VFD.
Ronald Brumley, Utilities Supervisor, reported that their having issues with the main pump #2 at plant #1 and there
down to 1 pump. This only source of water to the City. Staff at this time is requesting to purchase a VFD funds are
available in the 14.14000/667.5
A motion was made by Mayor Pro Tern Ramirez to approve purchase of VFD, seconded by Councilman
Hernandez and carried.

B. Consider Approval to Purchase BOLA Wrap:
Sargent Carr reported that the Avenal Police Department constantly strives to improve and enhance the ability of the
police officers within our agency. Senate Bill 230 was signed by Governor Newsome on September 12, 2019.
Senate Bill 230 mandated certain requirements for use of force training and Department Policy as well as redefined
what deadly force is. Senate Bill 230 states each law enforcement agency shall, by no later than January 1, 2021,
maintain a policy that provides a minimum standard on the use of force. Each agency's policy shall include, in
part, all of the following:
• A requirement that officers utilize de-escalation techniques, crisis intervention tactics, and other
alternatives to avoid force when feasible.
• A requirement that an officer may only use a level of force that they reasonably believe is proportional
to the seriousness of the suspected offense or the reasonably perceived level of actual or threatened
resistance.
• A requirement that officers consider their surroundings and potential risks to bystanders, to the extent
reasonable under the circumstances, before discharging a firearm.
• Training standards and requirements relating to demonstrated knowledge and understanding of the law
enforcement agency's use of force policy by officers, investigators, and supervisors. The Avenal Police
Department has researched a new tool,
The ability to use the Bola Wrap can significantly reduce the amount of force necessary for officers by
reducing the ability for the subject to physically resist by partially restraining the subject. If the subject were
to be in possession of a blunt force or sharp edge weapon, restraint of the arms from a distance can possibly
give officers an advantage without using deadly or more intrusive means of force. Pro Force is the single
source vendor for Bola Wrap. Pro Force, in association with Bola Wrap, is currently offering a completely
free training for law enforcement departments to train the Bola Wrap Instructors. The amount of$1l,761.95
will be expended from 10.12500.655.19 which is the Supplemental Law Enforcement Fund for fiscal years
18/19. Staff show a small clip how Bola Wrap is used.
Staff recommends by motion, to approve the purchase of the Bola Wrap devices.

Mr. Lopez rep01ied that at this time, Melissa is still assisting in a few special projects, such as updating the fire
agreement with Kings County, updating the City's Water Management plan, and providing institutional memory to
Staff as they explore refinancing the City's bonds and other crucial activities.
Attached is the previous agreement and amendment prepared by the City Attorney.
Staff is requesting that Council extend the Professional Consulting Services Agreement with Melissa G. Whitten by
amendment - six (6) months.
A motion was made by Councilman Verdugo to extend the Professional Consulting Services Agreement with
Melissa G. Whitten by amendment - six (6) months, seconded by Councilman Hernandez and carried.

D. Discuss Bonds Refinancing and Consider Proposals for Financial Advisor:
Mr. Lopez reported that in 2005, Avenal refinanced 9,660,000.00 in bond obligations for the Redevelopment
Agency (RDA) and Water Enterprise Account. Currently, the bonds are showing interest rates from 4.50% - 5.00%
and will mature on September I, 2036. Given historically low interest rates in today's economy, it may be beneficial
for the City to consider another refunding of the City's bonds to take advantage of this opportunity. Staff along with
Consultant Melissa Whitten, have reached out to the underwriter and bond counsel who helped arrange the 2005
refinancing, Tom Lockard, and Chip Eady, respectively. They both represent new firm but familiar with Avenal and
have assisted Staff in exploring whether or not a refinance would benefit the City and rough estimates show that the
life of the bonds the City could save around $500,000.00. Given new financial regulations after the 2008 financial
crash, if the City decides to pursue a refinancing of the bonds, we will require a municipal/financial advisor,
someone who provides advice to or on behalf of a municipal entity with respect to municipal financial products and
work with the City's interest.
Moses Diaz, City Attorney mentioned that due to new regulations the City Council need to select
municipal/financialadvisor.
Staff recommends reviewing and approve entering into an agreement with a municipal/financial advisor who will
assist in refinancing the 2005 bonds.
There proposals are as follows:

• Del Rio Advisors, LLC

Mr. Lopez reported that earlier in March, Avenal State Prison (ASP) reached out to City Staff regarding new
appointments to the Citizens' Advisory Committee (CAC) given recent elections and turnover. The Avenal City
Council is afforded two appointments that can serve for two-year terms. Currently the CAC meets on the second
Wednesday of odd numbered months.
Mayor Preciado appointed Antony Lopez, City Manager to the Avenal State Prison Citizens' Advisory
Committee, seconded by Mayor Pro Tern Ramirez and carried.

B. Consider One (1) Appointment for Vacant Planning Commission Seat- Mayor Preciado.
Mr. Lopez reported that as of September 2020, the Planning Commission has a vacancy left when Lulu Carrizales
was appointed to the Avenal City Council. Since then, Staff has advertised the vacancy and to date has not received
any new application. Staff also reached out to previous applicants but did not receive a response. Lulu Carrizales
expressed an interest in returning to the Planning Commission if the Council would consider re-appointing her.
This appointment can be filled by Mayor Preciado if he so chooses.
Mayor Preciado appointed Lulu Carrizales to the Planning Commission,
C. Consider Collaboration with Avenal Rotary Club for Old Timers' Day, May 1, 2021 Event.
Mr. Lopez reported that because of the COVID-19 outbreak in 2020, Old Timers' Day last year was canceled. This
year with the positive outlook on the fight against COVID-19, the Avenal Rotary Club is preparing to host the 37th
Annual Old Timers' Day on May 1st, 2021.Current plans for the event include a city-wide car parade, followed by
activities at the Avenal Sports Complex. These activities include food booths, softball tournament, cornhole
tournament, horseshoe tournament, and other fun events.
He continues that the Old Timers Day Committee (comprised of Rotarians, City Staff, and Avenal Residents) are
working to secure evening entertainment in collaboration with local music promoters - which will be contingent on
the lifting of restrictions for such events by the County and State. Although Old Timers' Day is a staple of Avenal's
culture and a long-lasting tradition, Staff is seeking formal consent by Council to collaborate and commit resources
to this event in collaboration with Avenal Rotary. Examples of potential resources being used are: LTF
transportation funds to provide a bus loop to the Sports Complex, and funding from the Community Activities
Department to improve the baseball diamonds and provide referees for the softball tournament, alongside other
family activities.
After a brief, discussion the following action was taken.

19 pandemic. The declaration must be reviewed to consider the following action: 1) reaffirm that a local emergency
continues to exist; or, 2) make a finding that a local emergency no longer exists.
Staff is recommending that the City Council consider the following action by motion:
Approve and support the ongoing local emergency Resolution, and specifically, move to renew the emergency
Resolution by thirty (30) days, unless a Councilmember or member of the public request that the Council convene to
consider the ongoing emergency Resolution, at which time a special meeting would be scheduled.

INFORMATION:
7200 BUILDING DEPARTMENT:
Staff continues to issue building permits for re-roofs, solar, patios, additions, and new construction. Panda
Koala is continuing work on the new home on Whitney St. and has started a new home on south Third Ave.
Dry utilities are being installed for the Development on south Corcoran Ave. There are 11 homes under
various stages of construction and staff received 11 more permit applications for this development. Staff
continues to work with Wildan for plan checks and inspections of the new buildings under construction.
7300 CODE ENFORCEMENT:
Code Enforcement has been busy with property abatements. Staff has been working on educating the public
regarding the new trailer parking ordinance. Staff continues working with local businesses for COVID-19
compliance.

8100 PARKS & LANDSCAPE:
Staff continues to maintain Rice Park, landscaped areas on Skyline, Neighborhood Park, Skate Park, Sport
Complex, the Ken Brown Public Safety Center and Elliott Park. The playgrounds at rice park and the
neighborhood park as well as the skate park are open. The fitness court has been closed due to vandalism
and will be reopened sometime in April. We are keeping two (2) restroom open at Rice Park.
9000 ANIMAL CONTROL DEPARTMENT:
Staff continues to maintain the Animal Shelter with animals rescued weekly. Staff continues to work with
Corcoran and Animal Rescue using safe distancing practices.

13000 STREETS:
Staff maintains city streets, signs, flags, and banners. Staff is working with the contractor for the San
Joaquin Street Project. There are a few items that need to be addressed before the project is closed out.
Staff gave the contractor a list and the items are being taken care of. Staff is preparing documents for the
contractor that will be striping the road.
14100 WATER DISTRIBUTION:
Staff continues to work with the City Engineer for the 18” water transmission replacement project. The
preliminary schedule is to have pre-bid meetings starting the first of June and have bid opening late
October and construction starting January 2022. Staff continues to maintain and repair the cities
distribution system.

15000 WASTEWATER COLLECTIONS:
Staff continues to report monthly to Regional Water Quality Control Board regarding overflows. There was
one (1) call for a sewer plug, it was on the customer side. Staff is continuing the enzyme treatment for
grease.

Staff continues to maintain city-owned property, vehicles, and equipment. Staff continues
monthly/quarterly reporting to SJVAPCD.

Investigations
• Due to community concerns of speeding and reckless vehicles, officers patrolled the Sports
Complex and found a few vehicles associated with reckless activity. An occupant of the vehicle
was arrested for DUI as well as being a minor in possession of alcohol. A passenger was arrested
for methamphetamine and alcohol possession as well.
Officer Rodrigues was on patrol when he heard vehicles traveling at a high rate of speed near the
middle school. Officer Rodrigues made his way to the area and saw a vehicle being driven very
erratically. Officer Rodrigues made a traffic stop and arrested the driver for reckless driving. On
a side note, the suspect's friends were at the middle school in their vehicles. They left the area
when Officer Rodrigues stopped their friend. We appreciate the community's support and patience
as well all try to address this issue.
• Problem Policing Officer Smith worked a joint traffic enforcement.effort with the Coalinga CHP
office. Detective Smith issued 13 citations, all on the Avenal Cutoff for excessive speed (all over
70 MPH). These enforcement efforts will continue.
• Officers were dispatched to an apartment complex to investigate a domestic violence restraining
order violation. During the investigation, officers learned the female was at the complex to speak
with her children in the parking lot. There were conflicting statements about whether or not the
female's new boyfriend almost ran over her ex-husband. Alcohol was involved. A report is being
submitted to the Kings County District Attorney's Office for review.
• Officers investigated a caijacking in which the same female from above used force to take the
victim's vehicle from a residence in the 600 block of Alpine. At the time of the call for service,

RE: Consider Extending Local Emergency Declaration
INFORMATION:
On March 24, 2020, the Avenal City Council adopted Resolution No. 2020-14 declaring a Local
Emergency due to the existence or threatened existence of a local emergency: COVID 19
pandemic.
The declaration is required to be reviewed to consider the following action: 1) reaffirm
that a local emergency continues to exist; or, 2) make a finding that a local emergency no longer
exists.
Although COVID-19 vaccines are becoming readably available and Kings County has moved to
the Red Tier, COVID-19 still poses a threat to the public’s health. Staff is recommending the
City Council consider the following action by motion:
Approve and support the ongoing local emergency Resolution, and specifically,
move to renew the emergency Resolution by thirty (30) days, unless a
Councilmember or member of the public request that the Council convene to
consider the ongoing emergency Resolution, at which time a special meeting would
be scheduled.
